    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Al no haver-se presentat reclamacions durant el termini d'exposici&lt;/span&gt;ó al públic, queda automàticament elevat a definitiu l'Acord plenari de dia &lt;span style="color:#000000"&gt;25/11/2021&lt;/span&gt;, en virtut del que s'aprovava inicialment l'Ordenança per a la protecció de camins i vies municipals de Santa Margalida, (BOIB Núm. 167 de dia 04/12/2021), el text íntegre de la qual es fa públic, per al seu general coneixement i en compliment del previst en l'article 70.2 de la Llei 7/1985, de 2 d'abril, Reguladora de les Bases del Règim Local: &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;strong&gt;ORDENANÇA PER A LA PROTECCIÓ DE CAMINS I VIES MUNICIPALS DEL TERME MUNICIPAL DE SANTA MARGALIDA&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;strong&gt;Exposició de motius&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;La utilització, cada vegada més habitual, dels camins rurals per part de vehicles de gran tonatge, exigeix ​​d'una regulació que permeti a l'Ajuntament de Santa Margalida conèixer la realització d'aquesta activitat amb antelació, a l'objecte d'establir les mesures que permetin garantir el bon estat i conservació d'aquests camins després de la seva utilització.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;La regulació continguda en aquesta Ordenança ha estat redactada tenint en compte els articles 4, 84 i següents de la Llei 7/1985, de 02 d'abril, reguladora de les Bases de Règim Local, la Llei 17/2009, de 23 de novembre, sobre el lliure accés a les activitats de serveis i el seu exercici i altres normes de transposició de la Directiva 2006/123 / CE de Parlament Europeu i de Consell, de 12 de desembre de 2006, relativa als serveis en el mercat interior.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;L'Ajuntament de Santa Margalida té competències en matèria d'ordenació, gestió, execució i disciplina sobre la conservació dels camins i vies rurals de la seva competència, el que implica la possibilitat d'exercir la potestat sancionadora respecte dels danys que es puguin causar als mateixos, així com exercir totes les mesures legalment previstes, fins i tot coercitives, per a la restitució al seu estat originari dels camins danyats, a càrrec dels responsables dels mateixos. Aquestes competències s'han d'exercir respecte dels camins que figurin en l'Inventari Municipal de Béns o en el Planejament i respecte d'aquells que el caràcter de bé de domini públic del camí estigui prou acreditat.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Per part de l'Ajuntament de Santa Margalida s'instaurarà un servei especial que exerceixi les funcions d'inspecció i vigilància necessàries per al correcte compliment de les normes establertes en la present Ordenança per part de Policia Local de Santa Margalida, sense perjudici de les competències dels altres cossos i forces de seguretat Seprona, Agents de Medi Ambient, etc.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Així doncs, es pretén prohibir totalment la circulació per camins rurals municipals per part de vehicles que deteriorin el ferm dels camins, com són &lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;els vehicles&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt; de gran tonatge, si no és amb la preceptiva autorització municipal. S'entén per &lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;vehicle&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt; de gran tonatge a l'efecte d'haver d'obtenir la preceptiva autorització per circular pels camins rurals aquells vehciles el pes màxim autoritzat sigui superior a 10 tones &lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;i &lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;una longitud superior a vuit metres, així com també els remolcs (de tractors) amb una MMA superior a 10 tones.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;Article 1. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;Objecte&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;La present ordenança té per objecte regular l'ús i la protecció de l'aprofitament de camins i altres trames viàries de possessió municipal que cobreixin les necessitats generades en àrees rurals o donin servei a nuclis de població o predis agrícoles o forestals, així com els que, com tals, apareguin concebuts en la legislació estatal o autonòmica.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;Es consideren de possessió municipal els camins i vies existents a la realitat que reculli l'Inventari municipal o en el Planejament Urbanístic, així com aquells que el caràcter de bé de domini públic del camí estigui suficientment acreditat a criteri dels serveis tècnics municipals.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;Article 2. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;Obligacions&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;El manteniment, la conservació, reparació i millora dels béns que constitueixen objecte d'aquesta ordenança correspondrà a l'Ajuntament de Santa Margalida que informarà per escrit i amb la periodicitat que sigui necessària de l'estat en què es trobin els camins i vies municipals, podent paralitzar qualsevol variació o abús que tractés d'exercir-se en ells i requerint la presentació o exhibició, de la llicència necessària per a l'execució de l'actuació pretesa, de la qual han d'informar immediatament a l'alcalde.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;Article 3. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;Ús comú dels camins i vies municipals per camions i maquinària&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;La utilització de camins, carreteres i vies municipals per part de camions o maquinària per a diverses indústries de gran tonatge constitueix un ús comú especial als efectes dels articles 75 i 77 de el Reglament de béns de les entitats locals R.D. 1372/1986.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;L'ús comú especial normal dels béns de domini públic es subjectarà a llicència, ajustada a la naturalesa del domini, als actes de la seva afectació i obertura a l'ús públic i als preceptes de caràcter general.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;Article 4. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;Procediment i sol·licituds de l'ús dels camins, carreteres i vies municipals&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;L'obtenció d'autorització per a la utilització de camins, carreteres i vies municipals per part de vehicles pesats (longitud de més de vuit metres i una MMA superior a 10 tones i en el cas de tractors amb remolc, amb una MMA del remolc superior a 10 tones), se sotmet a el següent procediment:&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;A) Sol·licitud a l'Ajuntament de Santa Margalida amb una antelació mínima de 20 dies naturals a l'inici de l'activitat. La sol·licitud ha d'anar acompanyada de la següent documentació:&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;•&lt;/span&gt; &lt;span style="color:#000000"&gt;&lt;em&gt;Identificació de la parcel·la on es realitzarà l'activitat i itinerari a realitzar amb la càrrega.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;•&lt;/span&gt; &lt;span style="color:#000000"&gt;&lt;em&gt;Identificació dels camins i vies municipals que resultaran afectats.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;•&lt;/span&gt; &lt;span style="color:#000000"&gt;&lt;em&gt;Identificació dels vehicles i maquinària que s'utilitzarà en l'activitat.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;•&lt;/span&gt; &lt;span style="color:#000000"&gt;&lt;em&gt;Tones previstes a transportar.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;•&lt;/span&gt; &lt;span style="color:#000000"&gt;&lt;em&gt;Autorització de el Govern Balear o Consell Insular competent en l'activitat sol·licitada en cas de ser preceptiva.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;•&lt;/span&gt; &lt;span style="color:#000000"&gt;&lt;em&gt;Justificant d'abonament d'una fiança per import de 200,00.- €.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;•&lt;/span&gt; &lt;span style="color:#000000"&gt;&lt;em&gt;Durada prevista de l'activitat.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;•&lt;/span&gt; &lt;span style="color:#000000"&gt;&lt;em&gt;En el termini de vint dies naturals des de la presentació de la comunicació prèvia, es pot exigir que l'import de la fiança sigui superior a 200,00.- € (mitjançant informe degudament motivat per l'Oficina Tècnica corresponent). Fins que no es completi la fiança requerida la comunicació prèvia no produirà efectes.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;•&lt;/span&gt; &lt;span style="color:#000000"&gt;&lt;em&gt;En el mateix termini de vint dies naturals podrà l'Ajuntament de Santa Margalida condicionar, limitar o prohibir l'activitat mitjançant resolució motivada.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;En tot cas, abans de la data d'inici de l'activitat comunicada, els serveis municipals han de comprovar l'estat real dels camins i vies municipals afectades, realitzant un reportatge fotogràfic.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;Finalitzada la utilització dels camins i arreglats per l'interessat els desperfectes que hagin pogut ocasionar podrà aquest sol·licitar la cancel·lació de la garantia. La cancel·lació de la fiança s'acordarà per resolució previ informe favorable dels serveis municipals.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;La inexactitud, falsedat o omissió, de caràcter essencial, en qualsevol dada, manifestació o document que s'acompanyi o incorpori a la comunicació prèvia, o la no presentació davant l'Ajuntament de Santa Margalida de la mateixa, determinaran la impossibilitat de continuar amb l'exercici de l'activitat des del moment en què es tingui constància de tals fets, sense perjudici de les responsabilitats penals, civils o administratives a què hi haguera lloc, es presumeix que el camí es trobava en perfecte&amp;nbsp;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;estat abans de l'inici de l'activitat.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;La Resolució d'Ajuntament que declari circumstàncies de l'apartat anterior, podrà determinar l'obligació de la interessada de restituir la situació jurídica a el moment previ a el reconeixement o a l'exercici de el dret o a l'inici de l'activitat.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;L'Ajuntament, en l'atorgament de les llicències i autoritzacions sobre actuacions que afecten els camins, haurà de considerar i assegurar que aquestes autoritzacions &lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;siguin&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt; compatibles i respectar la seguretat, tranquil·litat i ús pacífic, lliure i general dels camins, podent denegar aquelles sol·licituds que suposin obstacles o impediments importants o graduant les restants segons el criteri que menys onerós i menor restricció d'ús suposi per a la generalitat dels usuaris.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;Expressament s'estableix que les peticions d'autorització o de llicències per a actuacions que afecten els camins, que no hagin estat resoltes expressament en el termini de tres mesos, s'entendran desestimades per silenci administratiu negatiu&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;Article 5. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;Obligacions dels sol·licitants&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;Del compliment de les obligacions recollides en aquesta ordenança seran responsables solidaris el sol·licitant del permís, el transportista i el beneficiari del servei.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;En el cas que diversos sol·licitants realitzin l'activitat simultàniament en el mateix camí respondran solidàriament de la seva reparació.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;Durant la realització de l'activitat el sol·licitant haurà de mantenir els camins i vies utilitzats en un estat correcte perquè els altres ciutadans puguin transitar sense dificultats, donant compliment a les normes de circulació i seguretat vigents en cada moment&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;Article 6. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;Restriccions&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;Es prohibeix la circulació en camins i vies veïnals rurals del terme de Santa Margalida a vehicles amb un Pes Màxim Autoritzat superior a 10 tonelades i una longitud superior a vuit metres, així com també els remolcs (de tractors) amb una MMA superior a 10 tonelades.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;Aquesta incidència es senyalitzarà mitjançant cartell informatiu de l'Ajuntament de Santa Margalida.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;Queda prohibit, igualment:&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;- Realitzar tasques de rompuda o de cultiu en camins de domini públic, procedir a fer qualsevol classe d'abocaments o afectar les cunetes o camins amb operacions de reg o volteig de la terra, així com realitzar aplicacions plaguicides que provoquin la pèrdua d'estabilitat i vegetació en els perfils de les cunetes o camins.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;- Accedir a les finques a través d'accessos no regulats, així com, especialment, utilitzar els vorals per accedir a parcel·les amb ocasió d'efectuar tasques agrícoles.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;- Encendre foc en llocs públics o privats susceptibles de provocar incendis en els camins, cunetes o espais inclosos en la delimitació d'aquests.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;Amb caràcter general, es limita la velocitat de circulació per la xarxa de camins rurals de Santa Margalida a 30 km / h i tots els vehicles hauran de respectar el pes màxim autoritzat que tenen permès per circular.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;Article 7. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;Constitució de fiances&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;Quan la utilització del domini públic pugui ocasionar danys en el mateix, es pot exigir fiança en quantia superior als que preveu aquesta ordenança, previ informe de valoració emès per l'Oficina Tècnica Municipal corresponent.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;En el cas que la infracció hagi ocasionat un deteriorament greu en el camí que impedeixi el seu ús normal, l'Ajuntament adoptarà les mesures que consideri apropiades per mantenir els camins oberts al trànsit veïnal, ordenant les reposicions i obres necessàries per a la reparació de l'ús pertorbat, sense perjudici de les accions de repercussió de el cost a l'infractor.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;Article 8. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;Autotutela&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;L'Ajuntament de Santa Margalida un cop comprovada la inexistència de llicència, autorització, comunicació prèvia o declaració responsable, segons els casos, per a l'ocupació o utilització del domini públic municipal, ha d'ordenar la retirada immediata dels vehicles, mobles, instal·lacions, maquinària o altres elements que estiguin situats en el domini públic.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;Quan es comprovi que s'estan realitzant actes d'ús o ocupació del domini públic o d'utilització dels serveis públics que no s'ajusten a les condicions de l'autorització atorgada, l'òrgan competent de l'Ajuntament, ha d'ordenar a l'interessat el compliment de la normativa en un termini màxim de 5 dies hàbils.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;El compliment de les ordres que regula aquest article no eximeix de la responsabilitat per comissió d'infraccions regulades en la present ordenança.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;Article 9. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;Execució Forçosa&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;En el cas d'incompliment de les ordres que regula l'article anterior, l'Administració municipal, procedirà a execució subsidiària, d'acord amb el que disposa la legislació vigent.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;Article 10. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;Infraccions&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;Els infractors d'aquesta ordenança seran sancionats amb multes que imposarà l'alcaldia o regidors delegats, dins dels límits assenyalats en la legislació.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;Les infraccions administratives per incompliment de les prescripcions d'aquesta ordenança es classifiquen en lleus, greus i molt greus.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;Es consideren infraccions lleus la comissió de les següents accions:&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;•&lt;/span&gt; &lt;span style="color:#000000"&gt;&lt;em&gt;L'incompliment de l'contingut de li llicència, autorització, per a la utilització de camins, carreteres i vies municipals per camions o maquinària per a l'explotació de pedreres, mines, teuleres, muntanyes de fusta i altres indústries.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;•&lt;/span&gt; &lt;span style="color:#000000"&gt;&lt;em&gt;No exhibir a l'autoritat competent la llicència, autorització, comunicació prèvia o declaració responsable.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;Es consideren infraccions greus les següents:&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;•&lt;/span&gt; &lt;span style="color:#000000"&gt;&lt;em&gt;Impedir amb un vehicle o moble no autoritzat el pas de vehicles en els edificis, finques i solars senyalitzats amb el senyal de gual municipal.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;•&lt;/span&gt; &lt;span style="color:#000000"&gt;&lt;em&gt;Circular amb vehicles amb un Pes Màxim Autoritzat superior a 10 tonelades i amb una longitud superior a vuit metres, així com també amb els remolcs (de tractors) amb una MMA superior a 10 tonelades, sense causar danys.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;•&lt;/span&gt; &lt;span style="color:#000000"&gt;&lt;em&gt;La circulació de vehicles que es desplacin mitjançant eruga o cadena per camins, vies i carreteres asfaltades o formigonades, sense causar danys.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;•&lt;/span&gt; &lt;span style="color:#000000"&gt;&lt;em&gt;Abocament de qualsevol classe de líquids residuals al domini públic.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;•&lt;/span&gt; &lt;span style="color:#000000"&gt;&lt;em&gt;La instal·lació d'elements o estacionament de vehicles que dificultin la circulació de vehicles o límit d'amplada de les vies, sense la preceptiva autorització.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;Es consideren infraccions molt greus les següents:&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;•&lt;/span&gt; &lt;span style="color:#000000"&gt;&lt;em&gt;Circular amb vehicles amb un Pes Màxim Autoritzat superior a 10 tonelades i amb una longitud superior a vuit metres, així com també amb els remolcs (de tractors) amb una MMA superior a 10 tonelades, causant danys.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;•&lt;/span&gt; &lt;span style="color:#000000"&gt;&lt;em&gt;La circulació de vehicles que es desplacin mitjançant eruga o cadena per camins, vies i carreteres asfaltades o formigonades, sense causar danys.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;•&lt;/span&gt; &lt;span style="color:#000000"&gt;&lt;em&gt;La no reparació del paviment o voreres de terrenys d'ús públic local, un cop finalitzats els treballs autoritzats, o en el termini assenyalat en el requeriment municipal.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;•&lt;/span&gt; &lt;span style="color:#000000"&gt;&lt;em&gt;La utilització de camins, carreteres i vies municipals per camions o maquinària per a l'explotació de pedreres, mines, t&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;euleres&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;, muntanyes de fusta i altres indústries, sense la preceptiva llicència, autorització, comunicació prèvia o declaració responsable.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;Article 11. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;Sancions&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;Les sancions per infracció de la present ordenança seran les següents:&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;•&lt;/span&gt; &lt;span style="color:#000000"&gt;&lt;em&gt;Infraccions lleus: multa, fins a 750 euros&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;•&lt;/span&gt; &lt;span style="color:#000000"&gt;&lt;em&gt;Infraccions greus: multa des de 751 euros fins a 1.500 euros.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;•&lt;/span&gt; &lt;span style="color:#000000"&gt;&lt;em&gt;Infraccions molt greus: multa des de 1.501 euros fins a 3.000 euros.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;En qualsevol cas, a més de la multa podrà sancionar amb la pèrdua de l'autorització que permeti l'exercici d'una activitat.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;Per a la graduació de les sancions i sempre que les disposicions legals no estableixin una altra qualificació, s'atendrà a&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;•&lt;/span&gt; &lt;span style="color:#000000"&gt;&lt;em&gt;El grau de culpabilitat o l'existència d'intencionalitat.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;•&lt;/span&gt; &lt;span style="color:#000000"&gt;&lt;em&gt;La continuïtat o persistència en la conducta infractora.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;•&lt;/span&gt; &lt;span style="color:#000000"&gt;&lt;em&gt;La naturalesa dels perjudicis causats.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;•&lt;/span&gt; &lt;span style="color:#000000"&gt;&lt;em&gt;La reincidència, per comissió en el terme d'un any de més d'una infracció de la mateixa naturalesa quan així hagi estat declarat per resolució ferma en via administrativa.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;En la fixació de les multes es tindrà en compte, a més en tot cas, que la comissió de la infracció no resulti més beneficiosa per a l'infractor que el compliment de les normes infringides.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;Article 12. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;Responsables&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;La responsabilitat administrativa per les infraccions comeses contra aquesta Ordenança correspondrà a sol·licitant del permís, transportista i &lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;beneficiari del servei&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt; de forma solidària.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;La responsabilitat s'exigirà, en cada cas, a les citades persones, sense perjudici de el dret d'aquestes a al·legar, en descàrrec seu, qui és la persona materialment imputable i traslladar-li, si escau, aquesta responsabilitat.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;Les responsabilitats administratives que es derivin del procediment sancionador seran compatibles, amb l'exigència a l'infractor de la reposició de la situació alterada pel mateix al seu estat originari, així com amb la indemnització pels danys i perjudicis causats que podran ser determinats per l'òrgan competent, havent de, en aquest cas, comunicar a l'infractor per a la seva satisfacció en el termini que a l'efecte es determini, i quedant, de no fer així, expedita la via judicial corresponent.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;Article 13. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;Procediment&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;Les denúncies seran formulades per l'autoritat competent o pels particulars, i tramitades en el marc de les disposicions legals que siguin aplicables.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;És competència la resolució dels expedients sancionats que s'incoïn a l'empara de la present ordenança a l'Alcaldia o la Regidoria delegada, si és el cas.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;Article 14. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;Prescripció d'infraccions i sancions.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;Les infraccions molt greus prescriuran als tres anys, les greus als dos anys i les lleus als sis mesos.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;Les sancions per infraccions molt greus prescriuran als tres anys, les greus als dos anys i les lleus a l'any.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;El termini de prescripció de les infraccions comença a comptar des del dia en què la infracció s'hagués comès. En el cas d'infraccions continuades o permanents, el termini començarà a córrer des que va finalitzar la conducta infractora.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;El termini de prescripció de les sancions començarà a comptar des de l'endemà del dia en que es pugui executar la resolució per la qual s'imposa la sanció o hagi transcorregut el termini per recórrer-la.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;Article 15. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;Concurrència Reglamentària.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;Els supòsits que poguessin estar contemplats en altres normes prèvies de caràcter reglamentari de l'Ajuntament de Santa Margalida i que estiguessin prevists igualment en la present ordenança, &lt;/em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;quedaran sotmesos, preferentment, a allò&lt;/em&gt;&lt;/span&gt;&lt;em&gt; que estableix aquesta última, sense perjudici de l'aplicació supletòria i complementària d'aquelles en qualsevol aspecte no considerat.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;Article 16. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;Entrada en vigor.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;La present ordenança entrarà en vigor una vegada publicat el text íntegre en el BOIB i una vegada transcorregut el termini de quinze dies hàbils a comptar de la comunicació de l'acord a el Govern de les Illes Balears, al Consell i a la Delegació del Govern a les Illes Balears.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Contra el present acord, es podrà interposarà recurs contenciós-administratiu, davant la Sala contenciosa administrativa del Tribunal Superior de Justícia de les Illes Balears, en el termini de dos mesos a comptar des de l'endemà a la publicació del present anuncio, de conformitat amb l'article 46 de la Llei 29/1998, de 13 de juliol, de la Jurisdicció Contenciós-Administrativa.
