    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El punt 3 de l'apartat Vuitè de la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 28&amp;nbsp;de gener&amp;nbsp;de 2021, per la qual es convoquen ajudes destinades al pagament compensatori en zones de muntanya per a l'any 2021, especifica que la resolució expressa es notificarà a les persones interessades mitjançant la seva publicació al Butlletí Oficial de les Illes Balears, i es farà d'acord amb els termes que preveu l'article 45.2 de la llei 39/2015, de l'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Els expedients han estat tramitats pel Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) en compliment del que disposa l'article 43 de la llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#212121"&gt;El vicepresident&amp;nbsp;&amp;nbsp;en Matèria Agrària&amp;nbsp;del FOGAIBA&amp;nbsp;en data 17 de gener&amp;nbsp;de 2022, va signar la següent resolució:&lt;/span&gt;&lt;strong&gt;&amp;nbsp;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;strong&gt;&lt;em&gt;&lt;strong&gt;&lt;em&gt;“PROPOSTA&amp;nbsp;DE RESOLUCIÓ I RESOLUCIÓ &amp;nbsp;DE DENEGACIÓ&lt;/em&gt;&lt;/strong&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Antecedents&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;1. En data de 30 de gener de 2021&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;&amp;nbsp;es va publicar, en el BOIB núm. 13, la Resolució de la Presidenta del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 28 de &lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;gener&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;&amp;nbsp;de 20&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;21&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;, per la qual s'aprova la convocatòria per a l'any 20&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;21&amp;nbsp;de les ajudes destinades al pagament compensatori per a zones de muntanya a les Illes Balears.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;2. De conformitat amb l'apartat sisè de l'esmentada Resolució, i l'Ordre APA 407/2021, de 25 d'abril, per la que es modifiquen , per a l'any 2021, diversos terminis establerts en el Reial Decret 1075/2014, de 19 de desembre, dictat per l'aplicació a Espanya de la Política Agrícola Comú, &lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;el termini de presentació de sol·licituds de la convocatòria va acabar el dia 15/6&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;/&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;20&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;21, i varen tenir entrada en el Registre del Fons de Garantia Agrària i Pesquera de les Illes Balears un total de 244 sol·licituds d'ajuda.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;3. Els òrgans gestors del Servei d'Ajudes al Desenvolupament Rural han dut a terme el control administratiu de les sol·licituds i de la documentació aportada d'acord amb les normes reguladores d'aquesta ajuda. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;4. Una vegada avaluades les sol·licituds d'ajuda pels òrgans gestors, i d'acord amb els criteris d'elegibilitat establerts, &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;els interessats &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;que figuren a l'annex I &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;em&gt;&lt;em&gt;no compleix&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;en &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;el requisit previst &amp;nbsp;el punt 1.b) de l'apartat Tercer&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;em&gt;de la convocatòria.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;5. En data 10 de desembre de 2021 es notifica, mitjançant publicació a la pàgina web &lt;/em&gt;&lt;u&gt;&lt;u&gt;&lt;em&gt;http:// &lt;/em&gt;&lt;/u&gt;&lt;/u&gt;&lt;/em&gt;&lt;em&gt;&lt;u&gt;&lt;u&gt;&lt;em&gt;www.caib.es&lt;/em&gt;&lt;/u&gt;&lt;/u&gt;&lt;/em&gt;&lt;em&gt;&lt;u&gt;&lt;u&gt;&lt;em&gt;,&lt;/em&gt;&lt;/u&gt;&lt;/u&gt;&lt;em&gt;&amp;nbsp;l'informe desfavorable i la proposta provisional de denegació de l'ajuda , emesa per Servei d'Ajudes al Desenvolupament Rural als interessats, concedint-los un termini de 10 dies per presentar les al·legacions escaients.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;6. Dins el termini establert, els interessats indicats a l'Annex I adjunt &amp;nbsp;no han presentat al·legacions.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Fonaments de dret&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;2. Reglament (UE) núm. 1305/2013 del Parlament Europeu i del Consell, de 17 de desembre de 2013, relatiu a l'ajuda al desenvolupament rural a través del Fons Europeu Agrícola de Desenvolupament Rural (FEADER) i pel qual es deroga el Reglament (CE) núm. 1698/2005 del Consell.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Reial decret 1075/2014, de 19 de desembre, sobre l'aplicació a partir del 2015 dels pagaments directes a l'agricultura i a la ramaderia i altres règims d'ajuda, així com sobre la gestió i control dels pagaments directes i dels pagaments al desenvolupament rural.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;8. Reial decret 1078/2014, de 19 de desembre, pel qual s'estableixen les normes de condicionalitat que han de complir els beneficiaris que rebin pagaments directes o determinades primes anuals de desenvolupament rural, o pagaments en virtut dels programes de suport a la reestructuració i reconversió o de suport a la collita en verd, al sector vitivinícola.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;9. Llei 38/2003, de 17 de novembre, general de subvencions.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Decret 65/2007, de 25 de maig, de constitució, organització i funcionament de l'Organisme Pagador de les despeses del Fons Europeu Agrícola de Garantia (FEAGA) i del Fons Europeu Agrícola de Desenvolupament Rural (FEADER), a la comunitat autònoma de les Illes Balears &lt;/em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;BOIB núm. 082 de 2007&lt;/em&gt;&lt;/span&gt;&lt;em&gt;; en virtut de l'Ordre de la consellera d'Agricultura i pesca de 23 de desembre de 2005, per la qual es disposa l'assumpció de l'execució de la política de millora i foment dels sectors agrari i pesquer per part del Fons de Garantia Agrària i Pesquera de les Illes Balears, estableix a l'article 1 que el FOGAIBA assumeix l'execució de la política de la Conselleria d'Agricultura i Pesca referent a l'aplicació de les mesures de foment i millora dels sectors agrari i pesquer, a partir de l'1 de gener de 2006.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;16. Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Proposta &amp;nbsp;de&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;resolució de&amp;nbsp;&amp;nbsp;denegació&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Per tot això, s'informa desfavorablement i propòs al vicepresident en Matèria Agrària del FOGAIBA que dicti una resolució en els termes següents:&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;1.Denegar l&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;es &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;sol·licitud&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;s&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;presentad&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;es&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;pe&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;ls interessats relacionats a l'Annex I, &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;per incompliment del requisit indicat.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;2.Declarar conclòs el procediment i arxivar els expedients detallats a l'Annex I.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;3. Notificar la resolució als interessats de l'Annex I.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
