    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;La Comissió de Govern del Consell Insular de Menorca, en sessió de caràcter extraordinari de 1&lt;span style="color:#000000"&gt;3&lt;/span&gt; de gener de 2022, aprovà definitivament el projecte constructiu denominat «Millora de la carretera ME-1 entre els PK&lt;span style="color:#000000"&gt; 7+700 &lt;/span&gt;&lt;span style="color:#000000"&gt;A PK&lt;/span&gt;&lt;span style="color:#000000"&gt; 10+200, terme municipal d'Alaior i el document ambiental&lt;/span&gt;&lt;span style="color:#000000"&gt;»&lt;/span&gt;; reafirmà la seva utilitat pública, així com aprovà definitivament la relació de béns i drets que es transcriu a l'annex I que resultaran afectats per l'expropiació dels terrenys necessaris per a executar el projecte constructiu, i finalment acordà de sol·licitar al Govern de les Illes Balears la reafirmació de la declaració d'urgència de l'ocupació dels terrenys afectats pel projecte constructiu de referència. Es fa constar que els acords esmentats es publiquen de conformitat amb el previst en l'article 21, apartats 2 i 3 de la Llei d'expropiació forçosa i en l'article 20 del Reglament d'expropiació forçosa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Contra l'acord precedent, que posa fi a la via administrativa, es pot interposar:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;-&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;En el termini d'un mes a partir de l'endemà des de la publicació al Butlletí Oficial de les Illes Balears, recurs potestatiu de reposició davant el Ple. Aquest recurs s'entendrà desestimat si no se us n'ha notificat la resolució quan hagi transcorregut un mes des que l'haguéssiu interposat. Contra la desestimació per silenci del recurs de reposició podreu interposar recurs contenciós administratiu davant &lt;span style="color:#000000"&gt;el Jutjat Contenciós Administratiu de Palma&lt;/span&gt;&lt;span style="color:#ff0000"&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;- En el termini de dos mesos a partir de l'endemà des de la publicació al Butlletí Oficial de les Illes Balears, recurs contenciós administratiu davant el &lt;span style="color:#000000"&gt;Jutjat Contenciós Administratiu de Palma&lt;/span&gt; sempre que no haguéssiu interposat recurs potestatiu de reposició, atès que en aquest cas haureu d'esperar que se'n dicti resolució. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Tot això sens perjudici que pugueu utilitzar qualsevol altre recurs que considereu procedent en dret. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Tot l'anterior s'ajusta a la Llei 29/1998, de 13 de juliol, que regula de la jurisdicció contenciosa administrativa,i a la Llei 39/2015 d'1 d'octubre del Procediment Administratiu Comú de les Administracions Públiques.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Finalment, escau d'indicar que la interposició dels recursos pertinents no suspèn l'eficàcia de la resolució impugnada ni interromp els terminis que se'n puguin derivar, excepte que l'autoritat competent ho acordi expressament. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
