En data 30 d'octubre de 2021 es publicà en el <em>Butlletí Oficial de les Illes Balears</em> la Resolució de la consellera d'Afers Socials i Esports de 28 d'octubre de 2021 per la qual s'aprova la convocatòria d'ajuts per a entitats sense ànim de lucre que desenvolupen projectes de garantia alimentària amb càrrec a l'assignació tributària del 0,7 % de l'impost sobre la renda de les persones físiques i l'impost sobre societats, corresponent a l'any 2021, per a accions a realitzar durant el 2022.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Dins el termini previst en el punt 7.1 de la convocatòria , les entitats que s'indiquen en l'annex d'aquesta proposta de resolució han presentat una sol·licitud de subvenció per finançar projectes i actuacions d'entitats sense ànim de lucre destinats a cobrir les necessitats bàsiques de persones i famílies en situació de precarietat econòmica a fi de reduir les situacions de vulnerabilitat i/o exclusió social.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. El personal del Servei de Serveis Socials de la Direcció General de Serveis Socials ha revisat la documentació de les sol·licituds presentades i ha comprovat que s'adapten a l'objecte que disposa el punt 1 de la convocatòria i que les entitats compleixen els requisits que estableix el punt 3.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. En data 26 de novembre de 2021 s'ha aprovat l'informe tècnic que fonamenta la proposta provisional de concessió de subvencions. Aquest informe inclou les sol·licituds aprovades.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">5. D'acord amb el punt 2.1 de la convocatòria, l'import màxim que es destina a aquesta convocatòria és de sis-cents vuitanta-vuit mil cent vuitanta-un euros amb quaranta-vuit cèntims (688.181,48 €), amb càrrec a la partida pressupostària 17401.313E01.48000.00 FF 21073 dels pressuposts generals de la Comunitat Autònoma de les Illes Balears corresponents a l'exercici 2021.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">La distribució del crèdit es farà atenent les modalitats i els criteris següents:</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">a. Modalitat 1. Projectes de distribució d'aliments entre les entitats dedicades al repartiment d'aliments: 300.000,00 €.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">b. Modalitat 2. Projectes de repartiment d'aliments i/o productes de primera necessitat que atenen usuaris d'un o més municipis: 308.181,48 €.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">c. Modalitat 3. Projectes de menjadors socials: 80.000,00 €.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">6. El punt 6 de la convocatòria estableix la determinació de l'import de la subvenció, fixant les següents fórmules: </span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">a. D'acord amb el punt 9.3 de la convocatòria, <span style="color:black">si </span>la suma dels imports sol·licitats per totes les sol·licituds presentades a la convocatòria que compleixin els requisits establerts en el punt 3 no supera l'import màxim previst en el punt&nbsp;2, s'ha d'atorgar a les entitats el 100&nbsp;% de l'import sol·licitat<span style="color:black">, sempre que sigui inferior al 100&nbsp;% del cost total del projecte. </span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">8. En data 30 de novembre de 2021 es publicà en el <em>Butlletí Oficial de les Illes Balears</em>, d'acord amb l'apartat 10.3 de la convocatòria, la proposta de resolució provisional de la directora general de Serveis Socials de concessió de les sol·licituds presentades a la convocatòria d'ajuts per a entitats sense ànim de lucre que desenvolupen projectes de garantia alimentària amb càrrec a l'assignació tributària del 0,7 % de l'impost sobre la renda de les persones físiques i l'impost sobre societats, corresponent a l'any 2021, per a accions a realitzar durant el 2022 de data 26 de novembre de 2021. Atès que, d'acord amb el punt 9.3 de la convocatòria, no s'ha superat l'import màxim previst en el punt 2, l'import a concedir a les entitats ha de ser del 100 % de l'import sol·licitat; a excepció dels casos que l'import sol·licitat és igual al cost total del projecte en què l'import a concedir ha de ser menor al 100 % de l'import sol·licitat.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">9. Ha transcorregut el termini de cinc dies hàbils per presentar-hi al·legacions a la proposta provisional sense que cap entitat les hagi presentat.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">10. Segons l'apartat 10.4 de la convocatòria, una vegada finalitzat el tràmit d'audiència i revisades les al·legacions presentades, l'òrgan instructor del procediment ha de formular una proposta de resolució definitiva perquè en un termini de dos dies hàbils des de l'endemà de la publicació de la proposta de resolució definitiva en el<em> Butlletí Oficial de les Illes Balears</em>, els interessats comuniquin l'acceptació o la renúncia a la proposta de resolució. En tot cas, es considera que l'entitat beneficiària accepta la proposta de resolució si no manifesta el contrari en el termini de dos dies hàbils comptadors des de l'endemà que s'hagi publicat. En cas que l'import de la subvenció proposada sigui igual a l'import sol·licitat es pot prescindir d'aquest tràmit.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">11. S'ha comprovat, de conformitat amb el que disposa el punt 4.1 de la convocatòria de subvencions, en relació amb l'article 11.f del Decret legislatiu 2/2005, de 28 de desembre, pel qual s'aprova el Text refós de la Llei de subvencions, i l'article 38 del Decret 75/2004, de 27 d'agost, de desplegament de determinats aspectes de la Llei de finances i de les lleis de pressuposts generals de la comunitat autònoma de les Illes Balears, que les entitats proposades per la concessió de la subvenció es troben al corrent del compliment de les obligacions tributàries i amb la Seguretat Social.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">12. L'Acord del Consell de Govern de data 25 d'octubre de 2021 estableix que, d'acord amb el punt 11 de la convocatòria, els pagaments que es deriven d'aquest expedient es faran de manera anticipada i seran del 100% de l'import de la subvenció, d'acord amb l'article 37.2 del TRLS. També eximeix les entitats de presentar aval bancari per la quantitat que se li anticipa, de conformitat amb el que preveu l'article 25 del Decret 75/2004, de 27 d'agost, de desplegament de determinats aspectes de la Llei de finances i de les lleis de pressuposts generals de la Comunitat Autònoma de les Illes Balears.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Fonaments de dret</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. La Llei 39/2015, d'1 d'octubre, del procediment administratiu comú.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. La Llei 40/2015, d'1 d'octubre, de règim jurídic del sector públic.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. El Text refós de la Llei de subvencions, aprovat pel Decret legislatiu 2/2005, de 28 de desembre.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. El Decret 75/2004, de 27 d'agost, de desplegament de determinats aspectes de la Llei de finances i de les lleis de pressuposts generals de la Comunitat Autònoma de les Illes Balears.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">5. La Llei 4/2009, d'11 de juny, de serveis socials de les Illes Balears, que en l'article 3 estableix que els objectius de les polítiques socials són, entre d'altres, prevenir i atendre les situacions de vulnerabilitat de les persones i dels grups en situació d'exclusió social. Així mateix, l'article 4 disposa, entre els principis rectors, el d'universalitat i igualtat, pel qual els serveis públics han de garantir a tothom el dret d'accés als serveis socials i l'ús efectiu en condicions d'igualtat, equitat i justícia distributiva.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">6. El Decret 11/2021, de 15 de febrer, de la presidenta de les Illes Balears, pel qual s'estableixen les competències i l'estructura orgànica bàsica de les conselleries de l'Administració de la Comunitat Autònoma de les Illes Balears (BOIB núm. 21, de 15 de febrer). Dins aquesta estructura, i sota la direcció del Govern, s'inclou la Conselleria d'Afers Socials i Esports, de la qual depèn la Direcció General de Serveis Socials i li atribueix les competències, entre d'altres, de gestió dels programes de serveis socials i de foment de programes d'inclusió social.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">7. L'Ordre de la consellera d'Afers Socials i Esports de 5 de març de 2021 per la qual s'estableixen les bases reguladores de les subvencions en matèria de serveis socials i de joventut (BOIB núm. 34, d'11 de març).</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">8. <span style="color:black">La Resolució de la consellera d'Afers Socials i Esports de 28 d'octubre de 2021 per la qual s'aprova la convocatòria d'ajuts per a entitats sense ànim de lucre que desenvolupen projectes de garantia alimentària amb càrrec a l'assignació tributària del 0,7 % de l'impost sobre la renda de les persones físiques i l'impost sobre societats, corresponent a l'any 2021, per a accions a realitzar durant el 2022.</span></span></p> <div style="page-break-after:always"><span style="display:none">&nbsp;</span></div> <p style="text-align:center"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Proposta de resolució definitiva</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Propòs a la consellera d'Afers Socials i Esports que dicti una resolució en els termes següents:</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. <span style="color:black">Aprovar</span> la concessió de les subvencions sol·licitades a favor de les entitats i pels imports que consten en l'annex d'aquesta proposta de resolució definitiva. El període d'execució de les activitats està comprés entre dia 1 de gener i el dia 31 de desembre de 2022.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. <span style="color:black">Autoritzar</span> i disposar una despesa a favor de les entitats i pels imports que consten en l'annex, per executar projectes i actuacions destinats a cobrir les necessitats bàsiques de persones i famílies en situació de precarietat econòmica a fi de reduir les situacions de vulnerabilitat i/o exclusió social amb càrrec a la partida 17401.313E01.48000.00 FF 21073 dels pressuposts generals de la comunitat autònoma de les Illes Balears per a l'exercici 2021.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. <span style="color:black">L'Acord de Consell de Govern de data 25 de d'octubre de 2021 i l'apartat 11 de la convocatòria estableixen que els pagaments que es deriven d'aquest expedient es faran de manera anticipada, eximint les entitats de presentar aval bancari per la quantitat que se li anticipa.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. <span style="color:black">Informar les entitats beneficiàries que:</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- <span style="color:black">El </span>pagament de la subvenció concedida s'efectuarà de conformitat amb el que disposa el punt 11 de la convocatòria.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- La justificació de la subvenció concedida s'efectuarà de conformitat amb el que disposen els punts 12 i 13 de la convocatòria.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">5.
