font-size:12px"><span style="color:#000000"><strong>I</strong></span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">L'Acord del Consell de Govern de 25 d'octubre de 2021 va<span style="color:#000000"> </span>aprov</span><span style="color:#000000">ar</span><span style="color:#000000"> el Pla de Mesures de Prevenció, Contenció i Coordinació Front a la COVID-19 i el </span><span style="color:#000000">Pla Específic de Mesures de Prevenció i Contenció de la COVID-19 en els Serveis Socials,</span><span style="color:#000000"> i</span><span style="color:#000000"> </span><span style="color:#000000">va </span><span style="color:#000000">establ</span><span style="color:#000000">ir</span><span style="color:#000000"> els nivells d'alerta sanitària que s'h</span><span style="color:#000000">avien </span><span style="color:#000000">d'aplicar </span><span style="color:#000000">temporalment </span><span style="color:#000000">en cada una de les illes, </span><span style="color:#000000">nivells </span><span style="color:#000000">que</span><span style="color:#000000"> </span><span style="color:#000000">es varen revisar</span><span style="color:#000000"> el</span><span style="color:#000000">s dies<span style="color:#000000"> </span>8 i 23 de novembre.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">El nou Pla de Mesures de Prevenció, Contenció i Coordinació Front a la COVID-19 es va articular<span style="color:#000000"> </span>establi</span><span style="color:#000000">n</span><span style="color:#000000">t, </span><span style="color:#000000">d'una banda, </span><span style="color:#000000">un seguit de mesures de caràcter i aplicació general, qualsevol </span><span style="color:#000000">que </span><span style="color:#000000">fos</span><span style="color:#000000"> </span><span style="color:#000000">el nivell d'alerta sanitària </span><span style="color:#000000">declarat, mesures centrades </span><span style="color:#000000">en </span><span style="color:#000000">el manteniment de </span><span style="color:#000000">les normes bàsiques de seguretat i prevenció dels contagis </span><span style="color:#000000">—</span><span style="color:#000000">ú</span><span style="color:#000000">s de </span><span style="color:#000000">la </span><span style="color:#000000">mascareta, </span><span style="color:#000000">higiene de mans, </span><span style="color:#000000">manteniment de distàncies interpersonals, ventilació d'espais tancats</span><span style="color:#000000">—</span><span style="color:#000000">,</span><span style="color:#000000"> </span><span style="color:#000000">i, </span><span style="color:#000000">de l'altra</span><span style="color:#000000">, unes </span><span style="color:#000000">mesures aplicables exclusivament a sectors d'activitat de major risc i que es modulaven en funció del nivell d'alerta sanitària declarat per a cada illa. </span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Així doncs, les determinacions del nivell d'alerta sanitària que periòdicament es duen a terme són les que determinen quin és el conjunt efectiu de mesures de prevenció i protecció front a la transmissió de la COVID-19 establertes en el Pla esmentat que són aplicables en cada moment a cada illa.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Així mateix, el Consell de Govern, en la sessió del 29 de novembre, va aprovar l'Acord pel qual s'estableixen mesures temporals i excepcionals en l'àmbit de l'activitat de determinats establiments en funció del nivell d'alerta sanitària de l'illa on estiguin radicats<span style="color:#000000"> </span>com a mesures temporals i excepcionals per raó de salut pública per a la contenció de la COVID-19. </span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="background-color:#ffffff">Aquest Acord va rebre l'autorització de la Sala Contenciosa Administrativa del Tribunal Superior de Justícia de les Illes Balears, mitjançant la Interlocutòria 382/2021, d'1 de desembre de 2021, i l'Acord així autoritzat es va publicar en el Butlletí Oficial de les Illes Balears núm. 167, de 4 de desembre, amb una eficàcia temporal que s'estenia fins al dia 24 de gener de 2022. </span></span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">L'eix central d'aquest Acord consisteix a determinar l'obligatorietat de l'ús del denominat<span style="color:#000000"> </span><em>Certificat COVID Digital UE</em> (CCD-UE), o la documentació autèntica que acredita un contingut idèntic a aquest </span><span style="color:#000000">certificat</span><span style="color:#000000"> </span><span style="color:#000000">—</span><span style="color:#000000">que acredita que el seu titular es troba vacunat amb pauta completa, o que ha superat la COVID-</span><span style="color:#000000">19</span><span style="color:#000000"> dins dels sis mesos anteriors o que ha obtingut un resultat negatiu </span><span style="color:#000000">en</span><span style="color:#000000"> una prova de detecció d'infecció activa en dates immediatament anteriors</span><span style="color:#000000">—</span><span style="color:#000000">, per poder accedir a determinats locals o establiments en els quals, per raó de les seves característiques físiques o per raó de les activitats que s'hi duen a terme, </span><span style="color:#000000">hi ha un risc major de transmissió de la malaltia. A més, aquest Acord condiciona al nivell d'alerta sanitària declarat en cada illa la determinació de l'àmbit objectiu d'exigència de l'ús d'aquesta documentació, de manera que com més alt sigui el nivell d'alerta sanitària en el qual es trobi una illa més categories d'establiments han de demanar aquesta documentació per permetre-hi l'accés. </span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">El passat dia 3 de desembre el Consell de Govern va adoptar l'Acord pel qual s'establi</span><span style="color:#000000">r</span><span style="color:#000000">en els nivells d'alerta sanitària que s'ha</span><span style="color:#000000">vien</span><span style="color:#000000"> d'aplicar en cada una de les illes </span><span style="color:#000000">i es modifica</span><span style="color:#000000">va</span><span style="color:#000000"> puntualment el Pla de Mesures de Prevenció, Contenció i Coordinació Front a la COVID-19, aprovat per l'Acord del Consell de Govern de 25 d'octubre de 2021.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Amb aquest Acord i una vegada paleses les dades relatives als factors de risc epidemiològics i assistencials que hi havia en aquell moment, el Consell de Govern va declarar que les illes de Mallorca, Eivissa i Formentera es trobaven en nivell d'alerta sanitària 1, mentre que Menorca es trobava en nivell d'alerta sanitària 3.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Ara bé, de manera sobtada, entre els dies 1 i 10 de desembre s'ha produït un augment important de les xifres de contagis a les illes de Mallorca i Menorca, i de forma semblant també a Eivissa, amb la qual cosa s'han incrementat agudament les dades d'incidències acumulades i les taxes de positivitat a 7 dies, i allò que tal volta és més preocupant és que s'han incrementat els nivells d'ocupació de llits de planta i de cures crítiques en les dues primeres illes, quan a finals del mes de novembre totes aquestes dades es trobaven en paràmetres de risc baix o de circulació controlada. </span></span></span></p> <div style="page-break-after:always"><span style="display:none">&nbsp;</span></div> <p style="text-align:center"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>II</strong></span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Així doncs, la situació epidemiològica i assistencial a les illes globalment, d'acord amb l'informe del Comitè Autonòmic de Gestió de Malalties Infeccioses de 10</span><span style="color:#000000"> de </span><span style="color:#000000">desembre</span><span style="color:#000000"> de 2021, basat en dades </span><span style="color:#000000">consolidades a dia </span><span style="color:#000000">9</span><span style="color:#000000"> del mateix mes de la Direcció General de Salut Pública i Participació i </span><span style="color:#000000">les </span><span style="color:#000000">dades</span><span style="color:#000000"> oferides pel Servei de Salut de les Illes Balears de dia </span><span style="color:#000000">10 de desembre, </span><span style="color:#000000">la comunitat autònoma presenta una incidència acumulada a 14 dies (IA14) per 100.000 habitants en la població general de </span><span style="color:#000000">392,3</span><span style="color:#000000"> casos, la qual cosa suposa un nivell de risc </span><span style="color:#000000">alt</span><span style="color:#000000">. Per altra banda, en la població &gt; 65 anys l'IA14 es troba en </span><span style="color:#000000">195,4</span><span style="color:#000000"> </span><span style="color:#000000">casos (risc </span><span style="color:#000000">alt</span><span style="color:#000000">).</span><span style="color:#000000"> </span><span style="color:#000000">La taxa de positivitat a 7 dies és del<span style="color:#000000"> </span>10,4 %.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Per illes, Mallorca presenta una IA14 de 398,8 casos; Menorca, de 559,4;</span><span style="color:#000000"> </span><span style="color:#000000">Eivissa presenta una IA14 de </span><span style="color:#000000">2</span><span style="color:#000000">7</span><span style="color:#000000">2,7 casos,<span style="color:#000000"> </span>i Formentera presenta una IA14 de 50,4 casos.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">D'altra banda, la situació assistencial empitjora i es comença a fer sentir l'augment de contagis en forma d'augment de la pressió assistencial, </span><span style="color:#000000">de </span><span style="color:#000000">manera</span><span style="color:#000000"> que </span><span style="color:#000000">l'ocupació de llits de planta per COVID-19 </span><span style="color:#000000">passa a nivell de risc baix des d'un </span><span style="color:#000000">nivell de nova normalitat, </span><span style="color:#000000">amb un 4,</span><span style="color:#000000">4 </span><span style="color:#000000">%, </span><span style="color:#000000">i </span><span style="color:#000000">l'ocupació de llits de cures crítiques, amb un </span><span style="color:#000000">10</span><span style="color:#000000"> % </span><span style="color:#000000">en conjunt </span><span style="color:#000000">, </span><span style="color:#000000">es manté, just al límit, en</span><span style="color:#000000">tre el </span><span style="color:#000000">nivell de risc baix i mitjà. </span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Per illes, Mallorca presenta una ocupació de llits de planta en un nivell de risc baix <span style="color:#000000"> </span>amb una ocupació del 4,</span><span style="color:#000000">8 </span><span style="color:#000000">%;</span><span style="color:#000000"> </span><span style="color:#000000">Menorca </span><span style="color:#000000">es troba pel que a fa a l'ocupació de llits de planta e</span><span style="color:#000000">n la mateixa </span><span style="color:#000000">situació </span><span style="color:#000000">amb </span><span style="color:#000000">un </span><span style="color:#000000">3 </span><span style="color:#000000">%, </span><span style="color:#000000">mentre que Eivissa (que inclou els ingressos procedents de Formentera) es troba en </span><span style="color:#000000">un risc baix<span style="color:#000000"> </span>(2,4 %). </span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Pel que fa a les ocupacions de llits de cures crítiques, Mallorca i Menorca (11,5 % </span><span style="color:#000000">i </span><span style="color:#000000">14,8 </span><span style="color:#000000">%, respectivament</span><span style="color:#000000">) es trob</span><span style="color:#000000">en</span><span style="color:#000000"> en </span><span style="color:#000000">un </span><span style="color:#000000">nivell de risc </span><span style="color:#000000">mitjà</span><span style="color:#000000">, mentre que Eivissa </span><span style="color:#000000">i Formentera </span><span style="color:#000000">es troben en nivells de nova normalitat o risc controlat (1,6 %).</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Com ja s'ha fet palès,<span style="color:#000000"> </span>aquestes dades dibuixen un quadre epidemiològic d</span><span style="color:#000000">e creixement sostingut </span><span style="color:#000000">dels contagis </span><span style="color:#000000">a Mallorca i Menorca, </span><span style="color:#000000">mentre que a Eivissa aquests contagis creixen a un ritme més lent i Formentera sembla trobar-se fora d'aquesta dinàmica de nova onada pandèmica. Per la seva banda, la situació assistencial empitjora a Mallorca i Menorca, mentre que a les Pitiüses, sense ser òptima, es troba a hores d'ara sota control.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Ara bé, tot i que és un fet que la dinàmica d'aquesta onada havia resultat manifestament distinta de les precedents, amb uns creixements de les incidències molt menys abruptes i amb unes ocupacions de llits hospitalaris notòriament inferiors als que es produïen amb les mateixes dades d'incidències<span style="color:#000000"> </span>en onades anteriors, no és menys cert que entre els dies 1 i 10 de desembre, tot coincidint amb el període que marquen les festivitats de la Constitució i de la Immaculada, s'ha produït un fort i sobtat creixement tant d'aquestes incidències com d'ocupacions de llits hospitalaris, molt especialment a les illes de Mallorca i Menorca, i que no deixa de ser també preocupant a l'illa d'Eivissa. </span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">En aquest sentit, l'informe del Comitè Autonòmic de Malalties Infeccioses de </span><span style="color:#000000">1</span><span style="color:#000000">0</span><span style="color:#000000"> </span><span style="color:#000000">d</span><span style="color:#000000">e </span><span style="color:#000000">desembre</span><span style="color:#000000"> d</span><span style="color:#000000">e 2021 </span><span style="color:#000000">s'ha emès</span><span style="color:#000000"> d'acord amb el document </span><span style="color:#000000">«</span><span style="color:#000000">Actuaciones de respuesta coordinada para el control de la transmisión de COVID-19</span><span style="color:#000000">»</span><span style="color:#000000">, aprovat per la Comissió Interterritorial del Servei Nacional de Salut (CISNS), que estableix que s'ha de posicionar un territori en un nivell d'alerta que es correspon amb el seu nivell de risc d'acord amb l'anàlisi d'indicadors </span><span style="color:#000000">de risc, </span><span style="color:#000000">de </span><span style="color:#000000">manera</span><span style="color:#000000"> que </span><span style="color:#000000">e</span>s classifica un territori en el màxim nivell d'alerta en què es compleixin les condicions següents:</span></span></p> <ul> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Almenys dos indicadors del bloc I es troben en aquell nivell de risc o superior. </span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Almenys un dels indicadors del bloc II es troba en aquell nivell de risc o un de superior.</span></span></li> </ul> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">El bloc II està integrat per dos indicadors d'hospitalització general i per dos indicadors d'UCI, i s'ha de tenir en compte per a la determinació del nivell l'indicador que presenti el màxim d'entre els dos indicadors d'hospitalització general i d'entre els dos d'UCI. </span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">A més, el nivell resultant no pot ser inferior en més d'un nivell del risc marcat per l'indicador d'ocupació d'UCI, ni en dos nivells per sota del marcat pel bloc I en el seu conjunt. </span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Examinats tots aquest factors, l'informe esmentat conclou que en data 10 de desembre de 2021 Menorca es troba en nivell d'alerta sanitària 3, Mallorca en nivell d'alerta sanitària 2 i Eivissa i Formentera es troben en nivell d'alerta sanitària 1.</span></span></span></p> <p style="text-align:center"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>III</strong></span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Per altra banda i pel que fa al Pla de Mesures de Prevenció, Contenció i Coordinació Front a la COVID-19, aprovat per l'Acord del Consell de Govern de 25 d'octubre de 2021, resulta necessari fer una modificació de les regles relatives als establiments d'oci nocturn que es preveien al punt 13 de l'apartat III relatiu a les «Mesures especifiques per als territoris en nivell 1, 2 o 3» .</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Aquesta modificació es du a terme per tal d'adaptar el Pla, als termes en els quals es regula aquesta matèria a l'Acord del Consell de Govern de 29 de novembre de 2021, pel qual s'establiren mesures temporals i excepcionals en l'àmbit de l'activitat de determinats establiments en funció del nivell d'alerta sanitària de l'illa on estiguin radicats<span style="color:#000000"> </span>com a mesures temporals i excepcionals per raó de salut pública per a la contenció de la COVID-19; Acord el qual, per una banda, va implantar l'exigència del la exhibició del <em>Certificat COVID Digital UE</em> (CCD-UE), o la documentació autèntica que acredita un contingut idèntic a aquest certificat, per poder accedir a uns o altres determinats locals o establiments, en funció del nivell d'alerta sanitària de cada Illa i, per altra banda, va regular les condicions en les què es podien desenvolupar les activitats dels establiments d'oci nocturn.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Aquest Acord de 29 de novembre de 2021, va rebre l'autorització de la Sala Contenciosa Administrativa del Tribunal Superior de Justícia de les Illes Balears, mitjançant la Interlocutòria 382/2021, d'1 de desembre de 2021, i l'Acord així autoritzat va ser publicat en el <em>Butlletí Oficial de les Illes Balears</em> núm. 167, de 4 de desembre, amb una eficàcia temporal que s'estenia fins al dia 24 de gener de 2022 i d'acord amb els seus termes, durant el seu termini d'eficàcia és d'aplicació prevalent en les matèries que regula, respecte de les disposicions que, en les mateixes matèries pugui contenir el Pla de Mesures de Prevenció, Contenció i Coordinació Front a la COVID-19.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Aquest Acord de 29 de novembre de 2021, contenia petites diferències envers les disposicions del Pla, pel que fa a les condicions de desenvolupament de l'activitat dels locals consistents bars de copes i cafès concert, pel que feia al seu horari de tancament i la forma en la qual es pot dur a terme la consumició d'aliments i begudes, i atès que aquestes divergències poden conduir a confusions pel que<span style="color:#000000"> </span>fa a quina de les disposicions resulta aplicable, allò més adient és unificar el seu contingut en ambdós casos, substituint dins del Pla de Mesures de Prevenció, Contenció i Coordinació Front a la COVID-19, les normes relatives a l'activitat de bars de copes i cafès concerts, per les incloses a l'Acord de 29 de novembre de 2021. </span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Per tot això, el Consell de Govern, com a responsable màxim de la política sanitària a les Illes Balears, a proposta de la consellera de Salut i Consum, en la sessió de 13 de desembre de 2021, adoptà entre d'altres, l'Acord següent:</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>Primer. </strong>Disposar que des de la publicació d'aquest Acord fins a les 24.00 hores del dia 23 de desembre de 2021, llevat que es revisin abans, són aplicables a les Illes Balears els nivells d'alerta sanitària següents:</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">- A l'illa de Mallorca, el nivell d'alerta sanitària<span style="color:#000000"> </span>2.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">- A l'illa de Menorca, el nivell d'alerta sanitària<span style="color:#000000"> </span>3.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">- A l'illa d'Eivissa, el nivell d'alerta sanitària 1.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">- A l'illa de Formentera, el nivell d'alerta sanitària 1.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>Segon. </strong>Modificar el punt 13 de l'apartat III de l'a</span><span style="color:#000000">nnex 1 de l'</span><span style="color:#000000">A</span><span style="color:#000000">cord del Consell de Govern de 25 d'octubre de 2021, </span><span style="color:#000000">pel </span><span style="color:#000000">qual s'estableixen els nivells d'alerta sanitària que s'han d'aplicar en cada una de les illes i es modifica puntualment el Pla de Mesures de Prevenció, Contenció i Coordinació Front a la COVID-19, el qual passa a tenir la redacció següent:<strong> </strong></span></span></span></p> <div style="page-break-after:always"><span style="display:none">&nbsp;</span></div> <p style="margin-left:40px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em><strong>«13. Condicions en què es pot dur a terme l'activitat d'oci nocturn</strong></em></span></span></p> <p style="margin-left:40px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em><strong>A) </strong>Condicions aplicables a l'activitat de les sales de festa, discoteques i sales de ball a les Illes Balears</em></span></span></p> <p style="margin-left:40px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em>Els establiments d'oci nocturn situats a les Illes Balears poden dur a terme l'activitat si compleixen les mesures següents:</em></span></span></p> <ol class="lower-alpha" start="1"> <li style="margin-left: 40px;"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em>Poden prestar serveis de terrassa amb el cent per cent de la capacitat màxima permesa. Per al servei a l'interior, l'ocupació màxima és del setanta-cinc per cent de la cabuda permesa en cas de establiments radicats a illes en nivell 0 d'alerta sanitària i del seixanta per cent en cas d'establiments radicats a illes en nivell 1 o superior.</em></span></span></li> <li style="margin-left: 40px;"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em>No es permet el consum a la barra. Únicament es pot utilitzar la barra perquè les persones usuàries sol·licitin i recullin les consumicions.</em></span></span></li> <li style="margin-left: 40px;"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em>A la barra s'han de respectar les distàncies de seguretat i s'ha d'impedir la formació d'aglomeracions.</em></span></span></li> <li style="margin-left: 40px;"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em>S'ha de mantenir en tot moment la distància de seguretat interpersonal i evitar, en particular, la formació d'aglomeracions. Així mateix, s'ha de mantenir la distància de seguretat d'1,5 metres a les taules o agrupacions de taules.</em></span></span></li> <li style="margin-left: 40px;"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em>En cas que hi hagi pista de ball, se'n permet l'ús amb una ocupació que en cap cas no pot ser superior a la que resulti de l'assignació de dos metres quadrats de la pista per a cada persona usuària.</em></span></span></li> <li style="margin-left: 40px;"> </li> <li style="margin-left: 40px;"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em>A l'entrada i a la sortida dels assistents s'han d'establir els mecanismes necessaris per impedir aglomeracions de persones i respectar les distàncies de seguretat.</em></span></span></li> <li style="margin-left: 40px;"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em>L'horari màxim de tancament dels establiments d'oci nocturn és a les 05.00 hores, tret que les ordenances municipals estableixin una hora de tancament anterior.</em></span></span></li> <li style="margin-left: 40px;"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em>L'ús de mascareta és obligatori en tot moment. Únicament es pot exceptuar l'ús de la mascareta en els moments estrictament necessaris per menjar o beure.</em></span></span></li> <li style="margin-left: 40px;"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em>Els establiments han de fer ús de dispositius mesuradors de CO</em>_<em>2</em><em>, que han de disposar d'una pantalla que mostri els nivells de CO</em>_<em>2</em><em> en temps real en una zona visible per als usuaris.</em></span></span></li> </ol> <p style="margin-left:40px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em>Aquests dispositius han de dur el marcatge CE. La ubicació s'ha d'ajustar a les indicacions tècniques aplicables i tenir en compte la grandària i la forma de l'espai, les entrades d'aire i el flux de la ventilació. No s'han de situar prop de les finestres, portes o altres punts de ventilació.</em></span></span></p> <p style="margin-left:40px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em>Tant en els casos de ventilació natural com en els de mecànica o mixta, no s'han de superar a l'interior les 800 ppm de concentració de CO</em>_<em>2</em><em>, i és responsabilitat del local adoptar les mesures necessàries de renovació de l'aire perquè no se superi la xifra indicada abans.</em></span></span></p> <p style="margin-left:40px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em><strong>B) Condicions aplicables a l'activitat de bars de copes (pubs) i cafès concert</strong></em></span></span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em>- Es permet l'activitat dels establiments que exerceixen les activitats pròpies de cafè concert i bar de copes, amb una ocupació del 75 % de la capacitat màxima autoritzada d'aquests espais en cas de establiments radicats a illes en nivell 0 d'alerta sanitària i del seixanta per cent en cas d'establiments radicats a illes en nivell 1 o superior.</em></span></span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em>- S'ha d'assegurar el manteniment de la distància deguda de seguretat d'un mínim d'1,5 metres entre les cadires de diferents taules i s'ha d'usar la mascareta quan no s'estigui consumint.</em></span></span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em>- L'horari de tancament és el que autoritza la llicència d'activitat de l'establiment o les que disposin les ordenances municipals</em><span style="color:#000000"><em>.</em></span></span></span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em>- No es permet el ball en espais interiors ni exteriors.</em></span></span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><em>- En tot allò no previst en els paràgrafs anteriors els cafès concert i bars de copes s'han de regir per la normativa COVID-19 general i l'aplicable a l'àmbit de la restauració, incloent-hi la normativa referent a les condicions de ventilació i l'obligatorietat de disposar de mesuradors de CO</em>_<em>2</em><em>.»</em></span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>Tercer.</strong><span style="color:#000000"> </span>Aprovar el Text consolidat, annexat a aquest Acord, del Pla de Mesures de Prevenció, Contenció i Coordinació per Fer Front a la COVID-19, que es va aprovar mitjançant l'annex I de l'Acord del Consell de Govern de 25 d'octubre de 2021, pel qual s'aprovà el Pla de Mesures de Prevenció, Contenció i Coordinació Front a la COVID-19 i el Pla Específic de Mesures de Prevenció i Contenció de la COVID-19 en els Serveis Socials, i s'estableixen els nivells d'alerta sanitària que s'han d'aplicar en cada una de les illes.<strong> </strong></span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>Quart.</strong></span> <span style="color:#000000">Notificar aquest Acord a la Delegació del Govern a les Illes Balears, així com a la direcció operativa del Pla Territorial de Protecció Civil de la Comunitat Autònoma de les Illes Balears (PLATERBAL) per a la transició cap a una nova normalitat derivada de la situació d'emergència de salut pública ocasionada per la COVID-19.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>Cinquè. </strong>Fer constar que corresponen a l'Administració de la Comunitat Autònoma de les Illes Balears i als ajuntaments, en l'àmbit de les seves competències, les funcions de vigilància, inspecció i control del compliment correcte de les obligacions que preveu aquest Acord, per tal de garantir-ne l'efectivitat. A aquest efecte, les administracions esmentades poden sol·licitar la col·laboració dels cossos i forces de seguretat de l'Estat.
