&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;La Junta de Govern Local d'aquesta Corporació municipal en sessió ordinària celebrada dia&lt;span style="color:#000000"&gt; &lt;/span&gt;3 de desembre de 2021&lt;/span&gt;&lt;span style="color:#000000"&gt;, &lt;/span&gt;&lt;span style="color:#000000"&gt;ha&lt;/span&gt; aprovat les bases que regularan &lt;span style="color:#000000"&gt;la convocatòria per al Concurs de Betlems&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;per a centres escolars 2021-22&lt;/span&gt;&lt;span style="color:#000000"&gt;&amp;nbsp;que es transcriuen literalment a continuació:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;«&lt;strong&gt;BASES GENERALS CONCURS ESCOLAR DE BETLEMS&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;strong&gt;1. OBJECTE I FINALITAT&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;L'objecte d'aquesta convocatòria, per part de l'Ajuntament d'Andratx, té com a finalitat la recuperació de les tradicions i fomentar la participació dels centres escolars a les festes de Nadal.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;Per tot això, es convoca un Concurs de Betlems escolar; convidant a tots els centres educatius del municipi a participar-hi.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;strong&gt;2. DESTINATARIS&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;Podran participar al concurs tots el centres escolars ubicats dins el terme municipal d'Andratx &lt;span style="color:#000000"&gt;que compleixin &lt;/span&gt;&lt;span style="color:#000000"&gt;amb&lt;/span&gt; &lt;span style="color:#000000"&gt;els&lt;/span&gt;&lt;span style="color:#000000"&gt; requisits&lt;/span&gt;&lt;span style="color:#000000"&gt; estable&lt;/span&gt;&lt;span style="color:#000000"&gt;rt&lt;/span&gt;&lt;span style="color:#000000"&gt;s &lt;/span&gt;&lt;span style="color:#000000"&gt;a&lt;/span&gt;&lt;span style="color:#000000"&gt; l'art&lt;/span&gt;&lt;span style="color:#000000"&gt;icle&lt;/span&gt;&lt;span style="color:#000000"&gt; 13 de la L&lt;/span&gt;&lt;span style="color:#000000"&gt;l&lt;/span&gt;&lt;span style="color:#000000"&gt;e&lt;/span&gt;&lt;span style="color:#000000"&gt;i&lt;/span&gt;&lt;span style="color:#000000"&gt; 38/2003, de 17 de novembre, L&lt;/span&gt;&lt;span style="color:#000000"&gt;l&lt;/span&gt;&lt;span style="color:#000000"&gt;e&lt;/span&gt;&lt;span style="color:#000000"&gt;i&lt;/span&gt; &lt;span style="color:#000000"&gt;g&lt;/span&gt;&lt;span style="color:#000000"&gt;eneral de subvencions. &lt;/span&gt;&lt;span style="color:#000000"&gt;Destacan&lt;/span&gt;&lt;span style="color:#000000"&gt;t&lt;/span&gt; &lt;span style="color:#000000"&gt;trobar-&lt;/span&gt;&lt;span style="color:#000000"&gt;se a&lt;/span&gt;&lt;span style="color:#000000"&gt;l corrent en el c&lt;/span&gt;&lt;span style="color:#000000"&gt;o&lt;/span&gt;&lt;span style="color:#000000"&gt;mpliment de l&lt;/span&gt;&lt;span style="color:#000000"&gt;e&lt;/span&gt;&lt;span style="color:#000000"&gt;s obligacions tribut&lt;/span&gt;&lt;span style="color:#000000"&gt;à&lt;/span&gt;&lt;span style="color:#000000"&gt;ri&lt;/span&gt;&lt;span style="color:#000000"&gt;e&lt;/span&gt;&lt;span style="color:#000000"&gt;s, &lt;/span&gt;&lt;span style="color:#000000"&gt;davant&lt;/span&gt;&lt;span style="color:#000000"&gt; la S&lt;/span&gt;&lt;span style="color:#000000"&gt;eguretat &lt;/span&gt;&lt;span style="color:#000000"&gt;S&lt;/span&gt;&lt;span style="color:#000000"&gt;ocial, &lt;/span&gt;&lt;span style="color:#000000"&gt;l'Administració pública de la Comuni&lt;/span&gt;&lt;span style="color:#000000"&gt;t&lt;/span&gt;&lt;span style="color:#000000"&gt;a&lt;/span&gt;&lt;span style="color:#000000"&gt;t&lt;/span&gt;&lt;span style="color:#000000"&gt; Aut&lt;/span&gt;&lt;span style="color:#000000"&gt;ò&lt;/span&gt;&lt;span style="color:#000000"&gt;noma, l'&lt;/span&gt;&lt;span style="color:#000000"&gt;Agència Estatal d'Administració Tributària (&lt;/span&gt;&lt;span style="color:#000000"&gt;AEAT&lt;/span&gt;&lt;span style="color:#000000"&gt;)&lt;/span&gt; &lt;span style="color:#000000"&gt;i&lt;/span&gt; &lt;span style="color:#000000"&gt;l'&lt;/span&gt;&lt;span style="color:#000000"&gt;A&lt;/span&gt;&lt;span style="color:#000000"&gt;juntament d'Andratx.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;La Tresoreria Municipal de l'Ajuntament d'Andratx expedirà d'ofici certificació acreditativa de si els peticionaris estan al corrent de les seves obligacions fiscals amb aquest Ajuntament i de si són o no deutors del mateix per qualsevol altre concepte no tributari.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;strong&gt;3. BASES REGULADORES&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Per a tots els casos no prevists en aquesta convocatòria serà aplicable:&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Llei 38/2003, de 17 de novembre, general de subvencions (BOIB 276, de 18 de novembre de 2003).&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Reial Decret 887/2006, pel qual s'aprova el reglament que desenvolupa la Llei general de subvencions (BOIB 176, de 25 de juliol de 2006).&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Llei 39/2015, d'1 de octubre, del Procediment Administratiu Comú de les Administracions Públiques (BOE 236, de 2 d'octubre de 2015).&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;Ordenança general de subvencions d'Andratx 2017 (BOIB núm 47, de 20 d'abril de 2017).&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;Resta de normativa que resulti d'aplicació.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;strong&gt;4. CRÈDIT PRESSUPOSTARI&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;Durant l'exercici pressupostari 2021, es destina la quantitat de 1.750,00 € euros a les subvencions objecte d'aquesta convocatòria, amb càrrec a l'aplicació pressupostària &lt;span style="color:#000000"&gt;2021&lt;/span&gt;.4310.48100&lt;span style="color:#c9211e"&gt;.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;strong&gt;5. REQUISITS I CONDICIONS&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;Es prioritzarà que la &lt;/span&gt;&lt;span style="color:#000000"&gt;ubic&lt;/span&gt;&lt;span style="color:#000000"&gt;ació dels Betlems &lt;/span&gt;&lt;span style="color:#000000"&gt;sigui visible des del carrer (principalment &lt;/span&gt;&lt;span style="color:#000000"&gt;accessos, &lt;/span&gt;&lt;span style="color:#000000"&gt;finestres, portals, etc.). Així mateix, podrà localitzar-se a l'interior dels &lt;/span&gt;&lt;span style="color:#000000"&gt;centres escolars.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;Els betlems que es presentin guardaran el degut respecte al fet que representen.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;Els Betlems romandran muntats durant el &lt;/span&gt;&lt;span style="color:#000000"&gt;període &lt;/span&gt;&lt;span style="color:#000000"&gt;mínim&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;comprès entre el dia &lt;/span&gt;&lt;span style="color:#000000"&gt;13&lt;/span&gt;&lt;span style="color:#000000"&gt; de desembre de 202&lt;/span&gt;&lt;span style="color:#000000"&gt;1&lt;/span&gt;&lt;span style="color:#000000"&gt; i &lt;/span&gt;&lt;span style="color:#000000"&gt;el 6 de gener de 202&lt;/span&gt;&lt;span style="color:#000000"&gt;2&lt;/span&gt;&lt;span style="color:#000000"&gt;, ambdós inclosos.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;Els centres &lt;/span&gt;&lt;span style="color:#000000"&gt;participants&lt;/span&gt;&lt;span style="color:#000000"&gt; han de cedir, &lt;/span&gt;&lt;span style="color:#000000"&gt;sempre que estiguin d'acord i&lt;/span&gt;&lt;span style="color:#000000"&gt; amb caràcter no exclusiu, els drets d'&lt;/span&gt;&lt;span style="color:#000000"&gt;imatge&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;de les fotografies dels seus betlems&lt;/span&gt;&lt;span style="color:#000000"&gt;, amb caràcter indefinit, a favor d&lt;/span&gt;&lt;span style="color:#000000"&gt;e l'Ajuntament d'Andratx als efectes de la seva difusió per a qualsevol mitjà.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;strong&gt;6. CATEGORIES &lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;Els criteris de valoració per cada Betlem seran els següents:&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&amp;nbsp;Treball manual realitzat i la laboriositat en l'execució dels elements, així com els elements empleats( fang, suro paper, materials reciclats,...)&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&amp;nbsp;Originalitat en la composició i les figures.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&amp;nbsp;Creativitat i innovació en el conjunt del Betlem&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;strong&gt;8.1. Presentació de sol·licitud&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;Les sol·licituds de participació al concurs (annex 1)&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;i la resta de documentació obligatòria&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;es podran presentar a partir de l'endemà a la publicació &lt;span style="color:#000000"&gt;en el&lt;/span&gt;&lt;span style="color:#000000"&gt; B&lt;/span&gt;&lt;span style="color:#000000"&gt;ulletí Oficial de les Illes Balears (BOIB)&lt;/span&gt;&lt;span style="color:#000000"&gt; d'aquesta convocatòria fins al&lt;/span&gt; fins al 13 de desembre de 2021(inclòs).&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;La inscripció a aquest concurs és totalment gratuïta.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;Les sol·licituds es podran presentar, d'acord amb el que estableix &lt;span style="color:#000000"&gt;els &lt;/span&gt;&lt;span style="color:#000000"&gt;articles&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;14.2, &lt;/span&gt;&lt;span style="color:#000000"&gt;14.&lt;/span&gt;&lt;span style="color:#000000"&gt;3, &lt;/span&gt;&lt;span style="color:#000000"&gt;16.&lt;/span&gt;&lt;span style="color:#000000"&gt;4&lt;/span&gt;&lt;span style="color:#000000"&gt; i 66, de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques, de les següents formes:&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Telemàticament&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;: &lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;a&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt; través de la &lt;/em&gt;&lt;/span&gt;&lt;em&gt;seu electrònica&lt;/em&gt;&lt;em&gt; &lt;/em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;de l'Ajuntament d'Andratx &lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;mitjançant&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt; &lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;el tramit específic&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt; &lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;(&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;En tot cas, &lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;subjectes &lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;o&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;bligats a relacionar-se a través de mitjans electrònics amb les administracions públiques, &lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;i opcionalment persones físiques no obligades&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;)&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;. &lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;C&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;al disposar d'un dels mètodes d'identificació permesos &lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;(c&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;ertificat electrònic, DNI electrònic o Cl@ve pin&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;)&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Si la sol·licitud no compleix els requisits establerts en la convocatòria, l'òrgan gestor ha de requerir al centre escolar interessat perquè ho esmeni en el termini màxim de 10 dies hàbils, amb la indicació que, si no ho fa, es considerarà que ha desistit de la sol·licitud, amb la resolució prèvia que ha de ser dictada en els termes que preveu l'article 68 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;strong&gt;8.2. Contingut&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Les sol·licituds de participació al concurs s'han de presentar mitjançant les instàncies i les annexos que facilita l'Ajuntament d'Andratx i que es poden trobar en la&lt;/em&gt;&lt;/span&gt;&lt;em&gt; &lt;/em&gt;&lt;em&gt;seu electrònica&lt;/em&gt;&lt;em&gt; &lt;/em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;de l'Ajuntament d'Andratx.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:80px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;Els centres escolars autoritzaran expressament la captació, la reproducció i la publicació de les imatges generals i a detall del betlem facilitades (Annex I). Aquestes podran ser difoses als diversos mitjans i canals de l'Ajuntament (web municipal, xarxes socials, material promocional, publicacions externes, revistes, tríptics i altres mitjans propis).&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;Una fotografia del betlem &lt;/span&gt;&lt;span style="color:#000000"&gt;amb &lt;/span&gt;&lt;span style="color:#000000"&gt;els &lt;/span&gt;&lt;span style="color:#000000"&gt;alumnes i professors&lt;/span&gt;&lt;span style="color:#000000"&gt; del c&lt;/span&gt;&lt;span style="color:#000000"&gt;urs&lt;/span&gt;&lt;span style="color:#000000"&gt; escolar participant.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;

&lt;p style="margin-left:80px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;El dret a la pròpia imatge és reconegut en l'article 18.1 de la Constitució espanyola, regulat per la Llei orgànica 1/1982, de 5 de maig, sobre el dret a l'honor, a la intimitat personal i familiar i a la pròpia imatge i la Llei orgànica 3/2018, de 5 de desembre, de Protecció de Dades Personals i garantia dels drets digitals.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:80px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;Per la qual cosa, la&lt;/span&gt;&lt;span style="color:#000000"&gt; fotografia del betlem amb &lt;/span&gt;&lt;span style="color:#000000"&gt;els &lt;/span&gt;&lt;span style="color:#000000"&gt;alumnes i professors&lt;/span&gt;&lt;span style="color:#000000"&gt; del c&lt;/span&gt;&lt;span style="color:#000000"&gt;urs&lt;/span&gt;&lt;span style="color:#000000"&gt; escolar participant&lt;/span&gt;&lt;span style="color:#000000"&gt; no serà objecte de &lt;/span&gt;&lt;span style="color:#000000"&gt;ser difos&lt;/span&gt;&lt;span style="color:#000000"&gt;a&lt;/span&gt;&lt;span style="color:#000000"&gt; als diversos mitjans i canals de l'Ajuntament (web municipal, xarxes socials, material promocional, publicacions externes, revistes, tríptics i altres mitjans propis) &lt;/span&gt;&lt;span style="color:#000000"&gt;sense &lt;/span&gt;&lt;span style="color:#000000"&gt;l'autorització&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;expressa&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;per part del centre escolar (Annex I).&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:80px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;El centre escolar es farà r&lt;/span&gt;&lt;span style="color:#000000"&gt;esponsable de trac&lt;/span&gt;&lt;span style="color:#000000"&gt;tar&lt;/span&gt;&lt;span style="color:#000000"&gt;, &lt;/span&gt;&lt;span style="color:#000000"&gt;reunir&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;i custodiar &lt;/span&gt;&lt;span style="color:#000000"&gt;tots els&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;c&lt;/span&gt;&lt;span style="color:#000000"&gt;onsentiment&lt;/span&gt;&lt;span style="color:#000000"&gt;s&lt;/span&gt;&lt;span style="color:#000000"&gt; per escrit &lt;/span&gt;&lt;span style="color:#000000"&gt;de&lt;/span&gt;&lt;span style="color:#000000"&gt;l&lt;/span&gt;&lt;span style="color:#000000"&gt;s&lt;/span&gt;&lt;span style="color:#000000"&gt; interessat&lt;/span&gt;&lt;span style="color:#000000"&gt;s&lt;/span&gt;&lt;span style="color:#000000"&gt;/&lt;/span&gt;&lt;span style="color:#000000"&gt;afectat&lt;/span&gt;&lt;span style="color:#000000"&gt;s&lt;/span&gt;&lt;span style="color:#000000"&gt; o de l&lt;/span&gt;&lt;span style="color:#000000"&gt;es&lt;/span&gt;&lt;span style="color:#000000"&gt; person&lt;/span&gt;&lt;span style="color:#000000"&gt;es&lt;/span&gt;&lt;span style="color:#000000"&gt; que ostent&lt;/span&gt;&lt;span style="color:#000000"&gt;i&lt;/span&gt;&lt;span style="color:#000000"&gt;n&lt;/span&gt;&lt;span style="color:#000000"&gt; la tutoria legal/pàtria potestat en cas de menors d'edat per &lt;/span&gt;&lt;span style="color:#000000"&gt;l'ús, &lt;/span&gt;&lt;span style="color:#000000"&gt;tractament i difusió&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;de&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;les &lt;/span&gt;&lt;span style="color:#000000"&gt;dades personals, &lt;/span&gt;&lt;span style="color:#000000"&gt;imatge/veu i material elaborat &lt;/span&gt;&lt;span style="color:#000000"&gt;en l&lt;/span&gt;&lt;span style="color:#000000"&gt;a&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;confecció d&lt;/span&gt;&lt;span style="color:#000000"&gt;el&lt;/span&gt;&lt;span style="color:#000000"&gt; betlem, &lt;/span&gt;&lt;span style="color:#000000"&gt;on surtin alumnes i professors que hi siguin clarament identificables als espais de comunicació i difusió de l'&lt;/span&gt;&lt;span style="color:#000000"&gt;Ajuntament d'Andratx.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:80px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Un pic presentada la sol·lic&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;i&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;tud (Annex I) &lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;en el Registre d'entrada de l'Ajuntament&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt; o en qualsevol de les formes previstes en l'article 16.4 de la Llei 39/2015, de 1 d'octubre, de procediment administratiu comú de les administracions públiques,&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt; &lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;c&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;ada &lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;centre escolar&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;, &lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;enviarà la documentació gràfica (fotografies)&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt; &lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;del betlem &lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;al correu electrònic &lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;patrimoni@andratx.cat&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;. &lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;El pagament d'aquests premis, seran abonats a càrrec de la partida corresponent, una vegada duta a terme la tramitació legalment establerta.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;strong&gt;10. ÒRGANS COMPETENTS PER A INSTRUIR I RESOLDRE EL PROCEDIMENT.&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;La tramitació i gestió d'aquesta convocatòria se subjectarà als principis enumerats en l'article 8.3 de la Llei 38/2003, de 17 de novembre, General de Subvencions.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;La Junta de Govern Local serà l'òrgan encarregat d'aprovar les bases i la convocatòria i de resoldre-la, d'acord amb el Decret número 1945/2021, de 31 de maig de 2021, pel qual el Senyor Batle de l'Ajuntament d'Andratx, delega un conjunt de competències a la Junta de Govern Local, entre les quals es troba la de concessió d'ajudes, subvencions i beques econòmiques.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;Rebut l'informe per l'òrgan instructor que gestioni les sol·licituds per participar en el concurs de betlems i comprovat que els sol·licitants compleixen amb els requisits exigits, es dictarà la proposta de resolució corresponent. I posteriorment, la Junta de Govern Local resoldrà la convocatòria, amb indicació dels extrems continguts en la proposta de resolució definitiva.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;strong&gt;11. CRITERIS PER A LA VOTACIÓ&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;11.1. &lt;/strong&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;strong&gt;&lt;strong&gt;V&lt;/strong&gt;otació dels Betlems participants:&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;Des de l'àrea de Patrimoni es publicaran les fotografies dels betlems a les xarxes socials i s'obrirà el període de &lt;em&gt;votació&lt;/em&gt;&lt;em&gt; &lt;/em&gt;comprès des de la publicació de l'àlbum de fotografies en la pàgina de Facebook de l'Ajuntament d'Andratx fins al 10 de gener de 2022 inclòs, fins les 12:00h del migdia.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;Les fotografies es &lt;/span&gt;&lt;span style="color:#000000"&gt;publica&lt;/span&gt;&lt;span style="color:#000000"&gt;ran dins un&lt;/span&gt;&lt;span style="color:#000000"&gt; àlbum &lt;/span&gt;&lt;span style="color:#000000"&gt;fotogràfic &lt;/span&gt;&lt;span style="color:#000000"&gt;a la pàgina del Facebook de l'Ajuntament d'Andratx, que servirà com a sistema de votació a través de les interaccions.&lt;/span&gt;&lt;span style="color:#000000"&gt; Es realitzarà un àlbum per cada betlem &lt;/span&gt;&lt;span style="color:#000000"&gt;presentat. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;Cada perfil personal de Facebook podrà votar els àlbums que desitgi. El curs escolar guanyador serà el titular de l'àlbum que més interaccions hagi tengut a la pàgina del Facebook de l'Ajuntament d'Andratx. Es comptabilitzaran els ‘‘m'agrada'' de l'àlbum, no de les imatges adjuntes dins aquest.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;S'entendrà com a interacció els «&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;img alt=""  height="33" data-eboib-alt-url="https://intranet.caib.es/eboibback/preVisualizarImagen/1101845/656000/image1639045631765.png" src="https://intranet.caib.es/eboibback/preVisualizarImagen/1101845/656000/image1639045631765.png" width="77" /&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;» exclusivament . No es tindrà en compte com a interacció/votació qualsevol altra reacció, comentari o contingut compartit en altres pàgines o perfils.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;Quan hi hagi dubtes derivats de l'&lt;/span&gt;&lt;span style="color:#000000"&gt;origen de les fotografies&lt;/span&gt;&lt;span style="color:#000000"&gt;, &lt;/span&gt;&lt;span style="color:#000000"&gt;l'Ajuntament d'Andratx podrà&lt;/span&gt;&lt;span style="color:#000000"&gt; sol·licitar &lt;/span&gt;&lt;span style="color:#000000"&gt;a l'interessat, &lt;/span&gt;&lt;span style="color:#000000"&gt;de manera motivada &lt;/span&gt;&lt;span style="color:#000000"&gt;i aplicant totes les mesures de seguretat,&lt;/span&gt;&lt;span style="color:#000000"&gt; la &lt;/span&gt;&lt;span style="color:#000000"&gt;compareixença&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;per part de&lt;/span&gt;&lt;span style="color:#000000"&gt;l tècnic de patrimoni&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;per &lt;/span&gt;&lt;span style="color:#000000"&gt;tal de comprovar que el Betlem és el corresponent a la documentació presentada.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;strong&gt;12. PROCEDIMENT I NOTIFICACIÓ DEL PREMIS&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;La convocatòria, amb les bases que la regeixen, es publicaran al Bolletí Oficial de la Comunitat Autònoma corresponent, a la pàgina Web i al tauler d'anuncis de l'Ajuntament d'Andratx.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;Les resolucions de concessió dels premis del concurs de betlems es publicaran en la citada pàgina web i el tauler d'anuncis de l'Ajuntament d'Andratx, en els termes de la disposició addicional setena de la Llei orgànica 3/2018, de 5 de desembre, de protecció de dades personals i garantia dels drets digitals.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;El termini màxim per a resoldre el procediment i notificar-lo és de sis mesos des de la data de publicació de l'extracte de la convocatòria en el Butlletí Oficial de les Illes Balears.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;I si no es resolgués en termini el procediment de concessió dels premis, hem d'assenyalar que, segons allò que s'ha fixat en l'article 25.4 i 5 LGS, transcorregut el termini de sis mesos des de la iniciació sense resoldre i notificar resolució, els interessats podran entendre desestimada la seva sol·licitud. A partir d'aquest moment podran interposar el recurs potestatiu de reposició (en un mes des que es produeixen els efectes de silenci administratiu) o, directament, el contenciós-administratiu davant el Jutjat Contenciós. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;strong&gt;13. ABONAMENT DELS PREMIS&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;strong&gt;&lt;span style="color:#000000"&gt;13.1. Centres Escolars&lt;/span&gt;&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;Els centres &lt;/span&gt;&lt;span style="color:#000000"&gt;educatius &lt;/span&gt;&lt;span style="color:#000000"&gt;guanyadors hauran de comprar el material escolar que considerin adient pel&lt;/span&gt;&lt;span style="color:#000000"&gt;s&lt;/span&gt;&lt;span style="color:#000000"&gt; valors indicats &lt;/span&gt;&lt;span style="color:#000000"&gt;en el xec regal.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;La data màxima per emprar el xec regal als comerços del municipi d'Andratx serà el dia 31 de maig del 2022.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;El Xec regal es podrà gastar en qualsevol establiment comercial del Terme Municipal d'Andratx que desitgi col·laborar. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Els premis estan enfocats principalment a llibreries, papereries i informàtica, però estan oberts a qualsevol establiment que vengui productes relacionats amb l'activitat escolar.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Si el preu de la compra és inferior a l'import del xec, el comerç no haurà de retornar cap import. Donat el cas que la compra sigui superior, el centre escolar haurà d'abonar la diferència de preu a l'establiment corresponent.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Els centres escolars premiats no podran exigir ni el canvi del premi per un be o servei diferent de l'indicat ni el seu valor en diners, de manera que aquest premi no serà negociable o transferible. En cas de no esgotar els diners del premi íntegrament al llarg del termini establit, es perdrà la diferència.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;strong&gt;13.2. Comerços&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;Poden participar tots els comerços que la seva &lt;/span&gt;&lt;span style="color:#000000"&gt;act&lt;/span&gt;&lt;span style="color:#000000"&gt;i&lt;/span&gt;&lt;span style="color:#000000"&gt;vitat es desenvolup&lt;/span&gt;&lt;span style="color:#000000"&gt;i&lt;/span&gt;&lt;span style="color:#000000"&gt; en el terme municipal d'Andratx.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;Els comerços que han sigut receptors dels xecs o vals de compra presentaran &lt;/span&gt;&lt;span style="color:#000000"&gt;la f&lt;/span&gt;&lt;span style="color:#000000"&gt;actura &lt;/span&gt;&lt;span style="color:#000000"&gt;a nom de l'Ajuntament d'Andratx &lt;/span&gt;&lt;span style="color:#000000"&gt;i la resta de documentació obligatòria &lt;/span&gt;&lt;span style="color:#000000"&gt;següent&lt;/span&gt;&lt;span style="color:#000000"&gt; amb data màxima del dia 31 de juliol de 2022:&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;a) Sol·licitud de transferència bancària per a pagaments (&lt;/em&gt;&lt;/span&gt;&lt;em&gt;Model SEPA&lt;/em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;)&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;b) Xec de regal original facilitat pel centre escolar guanyador.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;El comerços podran presentar la documentació esmentada més amunt &lt;/span&gt;&lt;span style="color:#000000"&gt;de la següent manera d'acord amb &lt;/span&gt;&lt;span style="color:#000000"&gt;els &lt;/span&gt;&lt;span style="color:#000000"&gt;articles&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;14.2 i 3, &lt;/span&gt;&lt;span style="color:#000000"&gt;16.&lt;/span&gt;&lt;span style="color:#000000"&gt;4 i 66, de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques:&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;Els centre escolars beneficiaris han de complir les obligacions establertes en l'article 8 de l'Ordenança Municipal de Subvencions d'Andratx i l'article 14 de la Llei 38/2003 general de subvencions.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;strong&gt;15. REINTEGRAMENT I PÈRDUA DEL DRET AL COBRAMENT DE LA SUBVENCIÓ.&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;Per a l'aplicació del reintegrament s'ajustarà a les causes i el procediment establerts a la present convocatòria (destacant l'article 13 d'aquesta), en els articles 36 i següents de la Llei 38/2003 General de Subvencions, 96 i següents del Reglament General de Subvencions, i 49 i següents de l'Ordenança reguladora de Subvencions d'Andratx.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;strong&gt;16. ACCEPTACIÓ DE LES BASES, DRETS I OBLIGACIONS&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;La presentació al concurs suposa l'acceptació de les bases i dels drets i obligacions que se'n deriven&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;strong&gt;17. RENUNCIA&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;En qualsevol moment del procediment, els interessats podran desistir de la seva sol·licitud o renunciar al dret de percebre els premis concedits &lt;/span&gt;&lt;span style="color:#000000"&gt; de conformitat amb allò que disposa l'article 94 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú &lt;/span&gt;&lt;span style="color:#000000"&gt;de les administracions públiques.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;La renúncia s'haurà de presentar &lt;/span&gt;&lt;span style="color:#000000"&gt;mitjançant instància general&lt;/span&gt;&lt;span style="color:#000000"&gt; d'acord amb &lt;/span&gt;&lt;span style="color:#000000"&gt;els &lt;/span&gt;&lt;span style="color:#000000"&gt;articles&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;14.&lt;/span&gt;&lt;span style="color:#000000"&gt;2, 14.3 i &lt;/span&gt;&lt;span style="color:#000000"&gt;16.&lt;/span&gt;&lt;span style="color:#000000"&gt;4 &lt;/span&gt;&lt;span style="color:#000000"&gt;de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;strong&gt;18. INFRACCIONS I SANCIONS&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;L'incompliment dels requisits establerts en aquestes bases o en la normativa d'aplicació, podrà donar lloc a l'aplicació del règim de sancions establert en la LGS.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;strong&gt;19. PRESENTACIÓ DE RECURSOS&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;Contra la resolució per la qual s'aproven les presents bases &lt;/span&gt;i de conformitat amb el que es disposa en els articles 123 i 124 de la Llei 39/2015, d'1 d'octubre, i 8, 45 i 46 de la Llei 29/1998, de 13 de juliol, es podrà interposar un dels següents recursos:&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;a) Amb caràcter potestatiu, recurs de reposició davant el mateix òrgan que va dictar l'acte recorregut (tret que es tracti d'un acte dictat per delegació en aquest cas correspondrà la resolució a l'òrgan que ha fet la delegació), en el termini d'un mes, a comptar des de l'endemà de la publicació de la convocatòria de les presents bases.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;La interposició del recurs, excepte en els casos en què una disposició estableixi el contrari, no suspendrà l'execució de l'acte impugnat, de conformitat amb el que es disposa en l'article 117 de la Llei 39/2015, d'1 d'octubre.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;Si transcorregués un mes des de l'endemà al de la interposició del recurs de reposició sense que aquest hagi estat resolt, podrà entendre que ha estat desestimat i interposar recurs contenciós-administratiu davant el Jutjat del Contenciós Administratiu de Palma, en el termini de sis mesos, a comptar des de l'endemà al de la desestimació presumpta.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;b) Recurs contenciós-administratiu davant el Jutjat del Contenciós Administratiu de Palma, dins del termini de dos mesos comptats des de l'endemà de la publicació de la convocatòria de les presents bases.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;En cas d'optar pel recurs potestatiu de reposició no es podrà interposar el recurs contenciós-administratiu fins que aquell sigui resolt expressament o s'hagi produït la seva desestimació per silenci administratiu.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;Tot això sense perjudici de qualsevol altre recurs o acció que estimi procedent.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
