2021-12-07 CAIB ![CDATA[<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">En data 1 de desembre de 2021, la directora general de Primera Infància, Innovació i Comunitat Educativa ha formulat la proposta de resolució següent:</span></span></p> <p style="margin-left:40px"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">Fets</span></span></strong></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">1.El conseller d'Educació, Universitat i Recerca va convocar ajuts per a la reconversió de centres privats que atenen regularment infants de 0-3 anys sense autorització educativa en centres educatius de primer cicle d'educació infantil, mitjançant Resolució de 27 de novembre de 2020 (BOIB núm. 204, de 5 de desembre).</span></span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">2.El 22 de juny de 2021, es va publicar, en el BOIB núm. 82, la Resolució del conseller d'Educació i Formació Professional de 16 de juny de 2021 per la qual s'amplia el crèdit i es modifica la Resolució del conseller d'Educació, Universitat i Recerca de 27 de novembre de 2020 per la qual es convoquen ajuts corresponents als exercicis 2020 a 2024 per a la creació i consolidació de places públiques de primer cicle d'educació infantil i per a la reconversió de centres privats que atenen regularment infants de 0-3 anys sense autorització educativa en centres educatius de primer cicle d'educació infantil.</span></span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">3.La Direcció General de Primera Infància, Innovació i Comunitat Educativa, a través de l'Institut per a l'Educació de la Primera Infància com a òrgan instructor del procediment, va examinar les sol·licituds i va fer els requeriments de documentació pertinents als sol·licitants per poder valorar les peticions d'acord amb el barem.</span></span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">4.La Comissió Avaluadora es va reunir el dia 22 de juny de 2021 per examinar, valorar i informar sobre les sol·licituds, així com per valorar la proposta de resolució de concessió, segons consta en l'acta de sessió estesa el mateix dia.</span></span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">5.El 23 de juny de 2021, la directora general de Primera Infància, Innovació i Comunitat Educativa va dictar la proposta provisional de resolució de concessió dels ajuts esmentats.</span></span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">6.L'òrgan instructor ha revisat els apèndixs 6 de l'annex 2 que les entitats sol·licitants han presentat dins el període de justificació del primer termini.</span></span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">7.En aquest període, es va requerir a l'entitat Pharos S. Microcooperativa, que no havia presentat la justificació del primer termini, que presentàs la documentació justificativa. Passat el termini de presentació de documentació sense resposta, es considera que l'entitat Pharos S. Microcooperativa desisteix de la seva petició.</span></span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">8.Les propostes d'autorització i disposició de despesa (AD) de més de 30.000&nbsp;€ s'han fiscalitzat de conformitat.</span></span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">9.El punt 3 de la base quinzena de la convocatòria estableix que la resolució s'ha de publicar en el Butlletí Oficial de les Illes Balears.</span></span></p> <p style="margin-left:40px"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">Fonaments de dret</span></span></strong></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">1.El Decret legislatiu 2/2005, de 28 de desembre, pel qual s'aprova el Text refós de la Llei de subvencions (BOIB núm. 196, de 31 de desembre de 2005).</span></span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; text-align:center"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">Proposta de resolució</span></span></strong></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">Propòs al conseller d'Educació i Formació Professional que dicti una resolució en els termes següents:</span></span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">1.Concedir els ajuts per a la reconversió de centres privats que atenen regularment infants de 0-3 anys sense autorització educativa en centres educatius de primer cicle d'educació infantil a les entitats sol·licitants que figuren en l'annex 1, en què també s'indiquen els imports concedits. </span></span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">2.Declarar la no admissió o la denegació de les sol·licituds d'ajut que figuren en l'annex 2, juntament amb la indicació dels motius de la no admissió o denegació.</span></span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">3.Condicionar la concessió dels ajuts a què fan referència els apartats anteriors al compliment efectiu de les obligacions assumides per les entitats beneficiàries, d'acord amb les bases de la convocatòria i la normativa reguladora dels ajuts i subvencions públiques.</span></span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">4.Notificar aquesta Resolució a les entitats sol·licitants mitjançant la publicació en el Butlletí Oficial de les Illes Balears.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">Per tot això, dict la següent</span></span></p> <p style="text-align:center"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">Resolució</span></span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">Manifestar la conformitat amb la proposta de resolució i dictar-ne resolució en els mateixos termes.</span></span></p> <p><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">Interposició de recursos</span></span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">Contra aquesta Resolució, que exhaureix la via administrativa, es pot interposar un recurs potestatiu de reposició davant el conseller d'Educació i Formació Professional en el termini d'un mes comptador des de l'endemà de la publicació, d'acord amb els articles 123 i 124 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques, i l'article 57 de la Llei 3/2003, de 26 de març, de règim jurídic de l'Administració de la Comunitat Autònoma de les Illes Balears.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif;
