&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;RESOLC FORMULAR:&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;L'informe d'impacte ambiental sobre &lt;span style="color:#000000"&gt;el&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;projecte &lt;/span&gt;&lt;span style="color:#000000"&gt;d'instal·lació d'un MACROLAN de fibra òptica per al CEIP Tramuntana a la ctra. Favàritx, polígon 22, parcel·les 11 i 15 (TM de Maó)&lt;span style="color:#000000"&gt; &lt;/span&gt;, en els termes següents: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;1. Determinació de subjecció a avaluació ambiental i tramitació&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;D'acord amb l'article 13.2 del Decret legislatiu 1/2020, de 28 d'agost, pel qual s'aprova el Text Refós de la Llei d'Avaluació Ambiental de les Illes Balears, han de ser objecte d'avaluació d'impacte ambiental simplificada els projectes inclosos en l'annex II d'aquesta Llei. En&lt;/span&gt;&lt;span style="color:#000000"&gt;tre els projectes inclosos a l'annex 2 del Decret &lt;/span&gt;&lt;span style="color:#000000"&gt;l&lt;/span&gt;&lt;span style="color:#000000"&gt;egislatiu, el &lt;/span&gt;&lt;span style="color:#000000"&gt;«&lt;/span&gt;&lt;span style="color:#000000"&gt;P&lt;/span&gt;&lt;span style="color:#000000"&gt;rojecte d'instal·lació d'un MACROLAN de fibra òptica per al CEIP Tramuntana a la ctra. Favàritx, polígon 22, parcel·les 11 i 15&lt;/span&gt;&lt;span style="color:#000000"&gt;»,&lt;/span&gt;&lt;span style="color:#000000"&gt; s'inclou al punt &lt;/span&gt;&lt;span style="color:#000000"&gt;8&lt;/span&gt;&lt;span style="color:#000000"&gt; del grup 7:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Infraestructures de telecomunicació ubicades en sòl rústic amb la qualificació d'ANEI i ARIP, espais naturals protegits a l'empara de la Llei 42/2007 i espais de rellevància ambiental de la Llei 5/2005.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Per altra banda, segons l'art. 71, lletra b, del PORN de s'Albufera des Grau, han de ser objecte d'avaluació d'impacte ambiental simplificada les actuacions relatives a esteses elèctriques, telefòniques o similars.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Per tant, el projecte s'ha de tramitar com a una Avaluació d'Impacte Ambiental Simplificada i seguir el procediment establert a la secció 2a del Capítol II d'avaluació d'impacte ambiental de projectes del Títol II d'avaluació ambiental de la Llei 21/2013. S'han de complir també les prescripcions de l'article 21 del Decret legislatiu 1/2020, que li siguin d'aplicació. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;2. Descripció i ubicació del projecte&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;El projecte pretén&lt;/span&gt;&lt;span style="color:#000000"&gt; donar servei de fibra òptica al CEIP Tramuntana, &lt;/span&gt;&lt;span style="color:#000000"&gt;el qual&lt;/span&gt;&lt;span style="color:#000000"&gt; ha sol·licitat un circuit MACROLAN en les &lt;/span&gt;&lt;span style="color:#000000"&gt;seves&lt;/span&gt;&lt;span style="color:#000000"&gt; instal·lacions, ubicades a la ctra. de Favàritx, 24 – polígon 22, parcel·les 11 i 15 – (TM de Maó), amb l'objecte de millorar la seva connectivitat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;A manca d'infraestructura de fibra òptica a la zona, caldrà instal·lar:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;-Un p&lt;/span&gt;&lt;span style="color:#000000"&gt;al&lt;/span&gt;&lt;span style="color:#000000"&gt; de formigó de 12 m de longitud, a 150 m de distància de l'escola. No requereix l'eliminació de vegetació natural.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;-Una nova infraestructura canalitzada de fibra òptica, &lt;/span&gt;&lt;span style="color:#000000"&gt;que anirà des del pal de formigó fins a l'escola, de 150 m de longitud en rasa amb tritub PVC de 40 mm de diàmetre, 80-100 cm de profunditat i 25 cm d'amplada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;-Quatre arquetes in situ.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;No és objecte d'aquest projecte la instal·lació de cap antena ni altres infraestructures diferents de&lt;/span&gt;&lt;span style="color:#000000"&gt; les descrites. Segons el document ambiental, tampoc es necessitarà l'increment de serveis. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;D'acord amb el document ambiental, una vegada finalitzades les obres de la nova infraestructura, amb &lt;/span&gt;&lt;span style="color:#000000"&gt;una durada prevista de 30 dies hàbils&lt;/span&gt;&lt;span style="color:#000000"&gt; i un període de funcionament estimat de 100 anys, la topografia de l'àmbit no es veurà modificada. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;3. Avaluació dels efectes previsibles&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Durant la fase d'obres, es preveuen els següents impactes ambientals negatius: generació de residus, ocupació de terreny per aplec de materials, moviments de terra que poden alterar la qualitat i estructura del sòl, i molèsties a la fauna, emissions acústiques, i de gasos i partícules a l'atmosfera, associades al trànsit de vehicles i a l'ús de maquinària. Es preveu que l'afecció sobre el patrimoni cultural de l'entorn de l'àmbit d'actuació sigui mínima.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;Durant la fase de funcionament, es preveu un impacte paisatgístic negatiu, a causa de la instal·lació del pal de formigó. Els impactes ambientals negatius de la nova infraestructura canalitzada es consideren nuls, mentre que es preveu un impacte positiu sobre el benestar i la qualitat de vida del territori afectat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;4. Consultes a les administracions públiques afectades i persones interessades&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;L'òrgan ambiental ha realitzat les consultes següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;- Servei de Planificació al Medi Natural, de la DG d'Espais Naturals i Biodiversitat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;- Servei de Canvi Climàtic i Atmosfera (DG d'Energia i Canvi Climàtic), de la Conselleria de Transició Energètica i Sectors Productius.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;- Servei de Residus i Sòls Contaminats, de la DG de Residus i Educació Ambiental.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;- Servei d'Estudis i Planificació, de la DG de Recursos Hídrics.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;- Servei de Gestió del DPH, de la DG de Recursos Hídrics.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;- Servei de Gestió Forestal i Protecció del Sòl, de la DG d'Espais Naturals i Biodiversitat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;- Servei d'Espais Naturals, de la DG d'Espais Naturals i Biodiversitat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;- Direcció Insular d'Ordenació Territorial, del Consell Insular de Menorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;- Direcció Insular de Cultura i Patrimoni, del Consell Insular de Menorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;En el moment de redactar el present informe, es disposa dels següents informes de les administracions previsiblement afectades:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;- Informe&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;del &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;Servei de Planificació al Medi Natural, de la DG d'Espais Naturals i Biodiversitat:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;S'informa que:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;El projecte està situat a fora de la xarxa natura 2000, però dins l'àmbit del Parc Natural de s'Albufera des Grau, amb la qual cosa, s'hauria de trametre al Servei d'Espais Naturals per al seu informe.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;- Informe del &lt;span style="color:#000000"&gt;Servei de Canvi Climàtic i Atmosfera (DG d'Energia i Canvi Climàtic), de la Conselleria de Transició Energètica i Sectors Productius:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Es conclou que:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Es considera que no és necessari que el projecte estigui sotmès a avaluació d'impacte ambiental per afecció al canvi climàtic o a la contaminació atmosfèrica.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;- Informe del &lt;span style="color:#000000"&gt;Servei d'Espais Naturals, de la DG d'Espais Naturals i Biodiversitat, signat pel director del parc natural de s'Albufera des Grau:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Es conclou que:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;En relació al PORN de s'Albufera des Grau, s'informa favorablement el projecte corresponent a llicència d'obres per a la instal·lació d'un circuit MACROLAN, per portar fibra òptica a les oficines del CEIP Tramuntana, atès, que el projecte no provocarà un deteriorament del patrimoni etnològic i sí una millora en infraestructura de comunicacions de l'escola, sempre que es compleixin les condicions indicades en aquest informe i es compleixin les condicions que pugui imposar la Comissió Balear de Medi Ambient al seu temps. És en aquest sentit que s'informa l'òrgan substantiu que segons l'article 71 del PORN del parc natural de s'Albufera des Grau, aquest projecte d'instal·lació d'un MACROLAN de fibra òptica, ha de ser objecte d'un estudi d'impacte ambiental simplificat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Els condicionants PORN són els següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;1. Els promotors de l'obra de rehabilitació, es comprometen a deixar la zona utilitzada sense cap mena de residu i els residus que es generin hauran de ser retirats i lliurats a un gestor autoritzat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;2. S'haurà de respectar en tot moment els valors naturals i patrimonials del lloc on es realitzarà l'activitat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;3. Durant la realització de l'activitat s'haurà d'evitar al màxim la producció de renou, a fi de no pertorbar la fauna. Per evitar possibles afeccions a les aus de la zona, les obres es realitzin, si escau, respectant els períodes de nidificació, que de manera general, es troben entre l'1 d'abril i el 30 de juny.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;- Informe del &lt;span style="color:#000000"&gt;Servei d'Estudis i Planificació, de la DG de Recursos Hídrics:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Es conclou que:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Informem favorablement, condicionat al compliment del següent condicionant:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Atès que la zona presenta un nivell de la vulnerabilitat a la contaminació d'aqüífers baix, s'atendrà al que disposa l'art. 2 punt 1 c) del Decret llei 1/2016, de 12 de gener, de mesures urgents en matèria urbanística:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;«Durant l'execució de les obres, s'han d'adoptar les màximes precaucions per evitar l'abocament de substàncies contaminants, incloses les derivades del manteniment de les maquinàries». &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;- Resolució del&lt;span style="color:#000000"&gt; conseller executiu del Departament d'Economia i Territori, del Consell Insular de Menorca &lt;/span&gt;&lt;span style="color:#000000"&gt;(transcripció de l'informe emès per l'arquitecta del Departament d'Economia i Territori):&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Es conclou que:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Inform favorablement sobre el projecte d'instal·lació de fibra òptica per al CEIP Tramuntana, a la Ctra. Favàritx 24, polígon 22, parcel·la 11 i 15, del TM de Maó, expedient núm. AIA 3-2021, ja que no existeix cap impediment des del punt de vista territorial amb les observacions realitzades en el cos de l'informe.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;5. Anàlisi dels criteris de l'annex III de la Llei 21/2013&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;S'han analitzat els criteris de l'annex III de la Llei 21/2013, de 9 de desembre, d'avaluació ambiental, i no es preveu que el projecte pugui tenir efectes significatius sobre el medi ambient, en concret:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;1. Característiques del projecte&lt;/span&gt;&lt;span style="color:#000000"&gt;: El projecte &lt;/span&gt;&lt;span style="color:#000000"&gt;pretén&lt;/span&gt;&lt;span style="color:#000000"&gt; donar servei de fibra òptica, &lt;/span&gt;&lt;span style="color:#000000"&gt;canalitzada i soterrada,&lt;/span&gt;&lt;span style="color:#000000"&gt; al CEIP Tramuntana,&lt;/span&gt;&lt;span style="color:#000000"&gt; amb l'objecte de millorar la seva connectivitat. &lt;/span&gt;&lt;span style="color:#000000"&gt;Es tracta d'&lt;/span&gt;&lt;span style="color:#000000"&gt;una zona &lt;/span&gt;&lt;span style="color:#000000"&gt;que no disposa actualment&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;d'aquesta infraestructura.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;D'acord amb el document ambiental, una vegada finalitzades les obres de la nova infraestructura, amb &lt;/span&gt;&lt;span style="color:#000000"&gt;una durada prevista de 30 dies hàbils&lt;/span&gt;&lt;span style="color:#000000"&gt; i un període de funcionament estimat de 100 anys, la topografia de l'àmbit no es veurà modificada. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;2. Ubicació del projecte:&lt;/span&gt; &lt;span style="color:#000000"&gt;les actuacions previstes al projecte es localitzen a la ctra. de Favàritx, 24 – polígon 22, parcel·les 11 i 15 – (TM de Maó).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;D'acord amb el PTI Menorca, la zona d'estudi es &lt;/span&gt;&lt;span style="color:#000000"&gt;troba&lt;/span&gt;&lt;span style="color:#000000"&gt; dins &lt;/span&gt;&lt;span style="color:#000000"&gt;sòl rústic protegit (SRP), amb la categoria d'&lt;/span&gt;&lt;span style="color:#000000"&gt;àrea natural d'interès territorial (ANIT). &lt;/span&gt;&lt;span style="color:#000000"&gt;Segons el PGOU de Maó, les actuacions &lt;/span&gt;&lt;span style="color:#000000"&gt;se&lt;/span&gt; &lt;span style="color:#000000"&gt;situen&lt;/span&gt;&lt;span style="color:#000000"&gt; en sòl rústic, sistema general d'equipaments comunitaris, àmbit educatiu. &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;L'&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;àmbit d'actuació &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;es troba al costat de la carretera que condueix fins &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;a&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;l far de Favàritx,&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt; afectat parcialment per àrea de protecció territorial (APT) de carreteres, &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;i &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;molt pròxim a una zona forestal, zona de pastures amb arbrat i de pastures arbustives.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;S'ubica&lt;/span&gt;&lt;span style="color:#000000"&gt; íntegrament dins el &lt;/span&gt;&lt;span style="color:#000000"&gt;p&lt;/span&gt;&lt;span style="color:#000000"&gt;arc &lt;/span&gt;&lt;span style="color:#000000"&gt;n&lt;/span&gt;&lt;span style="color:#000000"&gt;atural de s'Albufera des Grau, &lt;/span&gt;&lt;span style="color:#000000"&gt;a pocs metres&lt;/span&gt; &lt;span style="color:#000000"&gt;d'&lt;/span&gt;&lt;span style="color:#000000"&gt;un&lt;/span&gt;&lt;span style="color:#000000"&gt;a&lt;/span&gt; &lt;span style="color:#000000"&gt;àrea natural d'especial interès (ANEI), &lt;/span&gt;&lt;span style="color:#000000"&gt;definida pel PTI de Menorca (BOIB del 16/05/2003) &lt;/span&gt;&lt;span style="color:#000000"&gt;i envoltada pel LIC &lt;/span&gt;&lt;span style="color:#000000"&gt;i ZEPA&lt;/span&gt; &lt;span style="color:#000000"&gt;S'Albufera des Grau&lt;/span&gt;&lt;span style="color:#000000"&gt; «&lt;/span&gt;&lt;span style="color:#000000"&gt;ES0000234» i per la ZEPA Capell de Ferro &lt;/span&gt;&lt;span style="color:#000000"&gt;«&lt;/span&gt;&lt;span style="color:#000000"&gt;ES0000386». &lt;/span&gt;&lt;span style="color:#000000"&gt;Pr`òxim&lt;/span&gt;&lt;span style="color:#000000"&gt;s&lt;/span&gt;&lt;span style="color:#000000"&gt; a la zona d'estudi destaquen tres hàbitats d'interès comunitari (HIC): ullastrar menorquí - Prasio-Oleetum Sylvestris (H152) -, alzinar balear - Cyclamini balearici-Quercetum ilicis (H077) -, i Rubo ulmifolii – Crataegetum brevispinae (H159). Pel que fa als hàbitats protegits característics de l'illa de Menorca, a pocs metres de l'àmbit d'actuació, tot i que fora d'aquesta hi ha pinedes mediterrànies (9540), alzinars i carrascars (9340) i màquies d'ullastre arborescent (9320).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Els terrenys afectats pel projecte es localitzen dins la Unitat Paisatgística 3 (UP-3) «Plans de Tudornell i Sant Bartomeu», corresponent majoritàriament a un àmbit agroforestal on &lt;/span&gt;&lt;span style="color:#000000"&gt;coexisteixen&lt;/span&gt;&lt;span style="color:#000000"&gt; cultius extensius de secà, ullastrars, boscos mixt&lt;/span&gt;&lt;span style="color:#000000"&gt;os d'alzines i pins, boscos mixtes d'alzines i ullastres, i pastures i camps abandonats. D'acord amb el document ambiental, es tracta d'un relleu pla, a la vora d'un dels turons que encaixa la llacuna salobre de s'Albufera des Grau.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Es tracta d'una zona sense &lt;/span&gt;&lt;span style="color:#000000"&gt;risc d'erosió, despreniments, &lt;/span&gt;&lt;span style="color:#000000"&gt;o &lt;/span&gt;&lt;span style="color:#000000"&gt;inundació. &lt;/span&gt;&lt;span style="color:#000000"&gt;Segons el IV Pla Forestal de les Illes Balears 2015-2024, es &lt;/span&gt;&lt;span style="color:#000000"&gt;localitza&lt;/span&gt;&lt;span style="color:#000000"&gt; a una zona amb risc moderat d'incendi forestal (ZAR). &lt;/span&gt;&lt;span style="color:#000000"&gt;Per altra banda, l&lt;/span&gt;&lt;span style="color:#000000"&gt;es parcel·les objecte d'estudi es troben sobre la massa d'aigua subterrània 19NM02 «La Mola - Es Grau», sense aqüífer important i baixa vulnerabilitat a la contaminació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Segons el Bioatles (quadrícula 1x1, codi 7.064), a l'àmbit d'actuació figura com a espècie catalogada el granot arbori (Hyla meridionalis) i, &lt;span style="background-color:#ffffff"&gt;d&lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;'acord amb el document ambiental, no existeix cap element &lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;d'interès cultural, ni exemplars arboris,&lt;/span&gt;&lt;span style="background-color:#ffffff"&gt; catalogat&lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;s.&lt;/span&gt; &lt;span style="background-color:#ffffff"&gt;No obstant això, a 300 m cap a l'est s'ubica el jaciment «BAY03: Assentament i necròpolis des Banyuls/puig de sa Sella», a 300 m cap al nord el jaciment «BAY06: Balma des Banyuls/Coster de Baix» i a 320 m cap a l'oest, «BAY01, Cova des Banyul/coster de davant ses Cases», respecte del terrenys objecte d'estudi.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;3. &lt;/span&gt;&lt;span style="color:#000000"&gt;Característiques del potencial impacte&lt;/span&gt;&lt;span style="color:#000000"&gt;: &lt;/span&gt;&lt;span style="color:#000000"&gt;els impactes ambientals negatius del projecte es produiran majoritàriament a la fase d'obres. No obstant això, seran temporals i d'intensitat mitja&lt;/span&gt;&lt;span style="color:#000000"&gt;na&lt;/span&gt;&lt;span style="color:#000000"&gt;-baixa. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Atesa la naturalesa de l'activitat a desenvolupar es preveu que els efectes sobre el medi ambient siguin mínims si s'apliquen les mesures preventives i correctores contingudes al document ambiental.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Conclusions de l'informe d'impacte ambiental&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="background-color:null"&gt;&lt;strong&gt;Primer.&lt;/strong&gt; No subjectar a avaluació d'impacte ambiental ordinària el «Projecte d'instal·lació d'un MACROLAN de fibra òptica per al CEIP Tramuntana a la ctra. Favàritx, polígon 22, parcel·les 11 i 15 (TM de Maó)», sempre que es compleixin les mesures proposades al document ambiental, signat amb data abril de 2021 per la Sra. Marta Gómez Pons, enginyera superior de monts i enginyera tècnica agrícola, per la Sra. Paula Orduña Giró, llicenciada en geografia i doctora en urbanisme, i per la Sra. Blanca Botey Sánchez, llicenciada en Biologia, de l'empresa AdEdMA Consultoria i Serveis, SL – promotor TELEFÓNICA DE ESPAÑA, SAU –, i els condicionants següents: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;1. Abans de l'execució de les obres, s'haurà de disposar d'informe favorable de les administracions competents en matèria de patrimoni i de carreteres, atesa la presència de jaciments arqueològics a l'entorn i a l'afecció de l'àmbit d'actuació per una APT de carreteres, respectivament.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;2. Durant l'execució de les obres s'han d'adoptar les màximes precaucions per evitar l'abocament de substàncies contaminants, incloses les derivades del manteniment de les maquinàries. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;3. En compliment del Decret 125/2007, de 5 d'octubre, pel qual es dicten normes sobre l'ús del foc i es regula l'exercici de determinades activitats susceptibles d'incrementar el risc d'incendis forestals, s'haurà de tenir especial esment amb aquelles activitats susceptibles de produir incendis forestals, com l'ús de maquinària que pot generar espurnes, especialment de l'1 de maig al 15 d'octubre, època d'alt risc d'incendi.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;4. En cas que el traçat &lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;de la línia de fibra òptica &lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;coincideixi amb algun peu arbori, aquest s'evitarà sempre que sigui possible. &lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;Si no fos&lt;/span&gt; &lt;span style="background-color:#ffffff"&gt;viable per raons tècniques o econòmiques, es procedirà al seu trasplantament a un espai pròxim amb característiques ambientals similars.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;5.&lt;/span&gt; D'acord amb el Servei d'Espais Naturals:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;- Els promotors de l'obra hauran de deixar la zona afectada sense cap mena de residu i els residus que es generin hauran de ser lliurats a un gestor autoritzat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;- S'haurà de respectar en tot moment els valors naturals i patrimonials del lloc on es realitzarà l'activitat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;- Durant la realització de l'activitat s'haurà d'evitar al màxim la producció de renou, a fi de no pertorbar la fauna. Per evitar possibles afeccions a les aus de la zona, les obres s'hauran de realitzar, si escau, respectant els períodes de nidificació, que de manera general, es troben entre l'1 d'abril i el 30 de juny.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;6. El Pla de Vigilància Ambiental (PVA) de les mesures preventives i correctores proposades al document ambiental, haurà de preveure quines actuacions es duran a terme en cas d'incompliment dels indicadors de seguiment.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Per altra banda, es recomana aprofitar el pal de formigó projectat per a fomentar la diversitat d'avifauna de l'entorn, col·locant a la part superior pals de fusta en horitzontal a diferents nivells. &lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Segon.&lt;/strong&gt; Es publicarà el present informe ambiental al Butlletí Oficial de les Illes Balears, d'acord amb el que disposa l'article 47.3 de la Llei 21/2013, de 9 de desembre, d'avaluació ambiental.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#1a1718"&gt;&lt;strong&gt;Tercer.&lt;/strong&gt; L'informe d'impacte ambiental perdrà la seva vigència i cessarà en la producció dels efectes que li són propis si, una vegada publicat en el BOIB, no s&lt;/span&gt;&lt;span style="color:#000000"&gt;'hagués procedit a l'aprovació del projecte en el termini màxim de quatre anys des de la publicació, d'acord amb el que disposa l'article 47.4 de la Llei 21/2013.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Quart.&lt;/strong&gt; L'informe d'impacte ambiental no ha de ser objecte de cap recurs, sense perjudici dels que, si s'escau, siguin procedents en la via administrativa o judicial davant de l'acte, si s'escau, d'autorització del projecte, d'acord amb el que disposa l'article 47.6 de la Llei 21/2013.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Cinquè.&lt;/strong&gt; Aquesta proposta de resolució s'emet sense perjudici de les competències urbanístiques, de gestió o territorials de les administracions competents i de les autoritzacions o informes necessaris per a l'aprovació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
