    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;Vist l'informe tècnic amb proposta de resolució de dia &lt;span style="color:#000000"&gt;3 de novembre&lt;/span&gt;&lt;span style="color:#000000"&gt; de 20&lt;/span&gt;&lt;span style="color:#000000"&gt;21&lt;/span&gt;, i d'acord amb l'article 10.1.a) del Decret 4/2018, de 23 de febrer, pel qual s'aproven l'organització, les funcions i el règim jurídic de la Comissió de Medi Ambient de les Illes Balears (CMAIB) (BOIB núm. 26 de 27 de febrer de 2018),&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;RESOLC FORMULAR:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;L'informe d'impacte ambiental sobre &lt;span style="color:#000000"&gt;el&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;projecte &lt;/span&gt;&lt;span style="color:#000000"&gt;d'actuacions de manteniment i condicionament del Port de Banyalbufar, en els termes següents: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;1. Determinació de subjecció a avaluació ambiental i tramitació&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;D'acord amb l'article 13.2 del Decret legislatiu 1/2020, de 28 d'agost, pel qual s'aprova el Text Refós de la Llei d'Avaluació Ambiental de les Illes Balears, han de ser objecte d'avaluació d'impacte ambiental simplificada els projectes inclosos en l'annex II d'aquesta Llei. En&lt;/span&gt;&lt;span style="color:#000000"&gt;tre els projectes inclosos a l'annex 2 del Decret &lt;/span&gt;&lt;span style="color:#000000"&gt;l&lt;/span&gt;&lt;span style="color:#000000"&gt;egislatiu, el &lt;/span&gt;&lt;span style="color:#000000"&gt;«&lt;/span&gt;&lt;span style="color:#000000"&gt;P&lt;/span&gt;&lt;span style="color:#000000"&gt;royecto &lt;/span&gt;&lt;span style="color:#000000"&gt;de actuaciones de mantenimiento y acondicionamiento del Puerto de Banyalbufar&lt;/span&gt;&lt;span style="color:#000000"&gt;»,&lt;/span&gt;&lt;span style="color:#000000"&gt; s'inclou al punt &lt;/span&gt;&lt;span style="color:#000000"&gt;14&lt;/span&gt;&lt;span style="color:#000000"&gt; del grup 7:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;Totes les actuacions que, d'acord amb el pla d'ordenació dels recursos naturals, el pla rector d'ús i gestió, el pla de gestió de la zona on s'ubiquin o en el decret que reguli àrees biològiques crítiques, han de ser objecte d'un estudi d'avaluació d'impacte ambiental.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;En aquest sentit, segons l'art. 101.2 del PORN de la Serra de Tramuntana «s'han de sotmetre obligatòriament als procediments d'avaluació d'impacte ambiental i/o avaluació ambiental estratègica, les actuacions de reforma i condicionament de carreteres, rondes, vials i camins existents i les infraestructures i obres en el litoral», com és el cas. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;Per tant, el projecte s'ha de tramitar com a una Avaluació d'Impacte Ambiental Simplificada i seguir el procediment establert a la secció 2a del Capítol II d'avaluació d'impacte ambiental de projectes del Títol II d'avaluació ambiental de la Llei 21/2013, de 9 de desembre, d'avaluació ambiental. S'han de complir també les prescripcions de l'article 21 del Decret legislatiu 1/2020, que li siguin d'aplicació. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;2. Descripció i ubicació del projecte&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;El projecte consisteix en el manteniment i condicionament de les infraestructures existents &lt;/span&gt;&lt;span style="color:#000000"&gt;a la zona marítima terrestre del Port de Banyalbufar, &lt;/span&gt;&lt;span style="color:#000000"&gt;propietat de Ports de les Illes Balears,&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;les quals&lt;/span&gt;&lt;span style="color:#000000"&gt; han sofert un deteriorament al llarg dels anys, &lt;/span&gt;&lt;span style="color:#000000"&gt;amb l'objecte&lt;/span&gt;&lt;span style="color:#000000"&gt; de garantir la seguretat &lt;/span&gt;&lt;span style="color:#000000"&gt;dels&lt;/span&gt;&lt;span style="color:#000000"&gt; usuaris i visitants, sense realitzar cap &lt;/span&gt;&lt;span style="color:#000000"&gt;mena &lt;/span&gt;&lt;span style="color:#000000"&gt; d'ampliació &lt;/span&gt;&lt;span style="color:#000000"&gt;i&lt;/span&gt;&lt;span style="color:#000000"&gt; seguint amb la mateixa tipologia actual. E&lt;/span&gt;&lt;span style="color:#000000"&gt;s &lt;/span&gt;&lt;span style="color:#000000"&gt;durà a terme &lt;/span&gt;&lt;span style="color:#000000"&gt;la r&lt;/span&gt;&lt;span style="color:#000000"&gt;epara&lt;/span&gt;&lt;span style="color:#000000"&gt;ció&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;d&lt;/span&gt;&lt;span style="color:#000000"&gt;els elements deteriorats, &lt;/span&gt;&lt;span style="color:#000000"&gt;l'embelliment del conjunt i la millora&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;d&lt;/span&gt;&lt;span style="color:#000000"&gt;els serveis portuaris &lt;/span&gt;&lt;span style="color:#000000"&gt;(&lt;/span&gt;&lt;span style="color:#000000"&gt;aigua, electricitat &lt;/span&gt;&lt;span style="color:#000000"&gt;i&lt;/span&gt;&lt;span style="color:#000000"&gt; il·luminació&lt;/span&gt;&lt;span style="color:#000000"&gt;), mantenint el caràcter rústic actual de la instal·lació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;El port està format per un antic dic o&lt;/span&gt;&lt;span style="color:#000000"&gt; espigó &lt;/span&gt;&lt;span style="color:#000000"&gt;per a la protecció&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;d'&lt;/span&gt;&lt;span style="color:#000000"&gt;un petit varador per barques, &lt;/span&gt;&lt;span style="color:#000000"&gt;amb&lt;/span&gt;&lt;span style="color:#000000"&gt; una longitud total de 40 metres. La seva altura en el costat del mar &lt;/span&gt;&lt;span style="color:#000000"&gt;é&lt;/span&gt;&lt;span style="color:#000000"&gt;s variable, &lt;/span&gt;&lt;span style="color:#000000"&gt;mentre que&lt;/span&gt;&lt;span style="color:#000000"&gt; en el seu costat terrestre &lt;/span&gt;&lt;span style="color:#000000"&gt;és de 3,20 m. La seva cara exterior està formada per pedres rodones d'uns 30 cm amb morter de formigó de forma uniforme i cuidada en la part exterior, més descuidada en la part interior.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Segons el document ambiental, aquesta instal·lació ha patit &lt;/span&gt;&lt;span style="color:#000000"&gt;un deteriorament progressiu d'&lt;/span&gt;&lt;span style="color:#000000"&gt;ençà&lt;/span&gt;&lt;span style="color:#000000"&gt; que es va redactar l'any 2009 el «Proyecto de Rehabilitación de la Instalación Portuaria del Port de Banyalbufar, Fase 1», &lt;/span&gt;&lt;span style="color:#000000"&gt;projecte que no es va arribar a executar,&lt;/span&gt;&lt;span style="color:#000000"&gt; moment en què ja presentava un deteriorament &lt;/span&gt;&lt;span style="color:#000000"&gt;per&lt;/span&gt;&lt;span style="color:#000000"&gt; l'ambient salí, la falta de manteniment i els temporals de la zona. &lt;/span&gt;&lt;span style="color:#000000"&gt;L'any 2011 es varen realitzar una sèrie d'actuacions de manteniment i reparació del dic &lt;/span&gt;&lt;span style="color:#000000"&gt;pel mal estat que presentava.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;Les actuacions previstes al projecte són les següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;- Demolició d'edificacions en mal estat, instal·lacions i serveis a restaurar, estructures de suport d'embarcacions i altres estructures a reposar, amb retirada per part d'un gestor autoritzat d'aquells residus de demolició que no es reutilitzin. En concret, afectarà:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;+L&lt;/span&gt;&lt;span style="color:#000000"&gt;a desconnexió&lt;/span&gt;&lt;span style="color:#000000"&gt; i retirada de &lt;/span&gt;&lt;span style="color:#000000"&gt;canalització d'aigua potable existent des del punt de connexió a la xarxa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;+La &lt;/span&gt;&lt;span style="color:#000000"&gt;desconnexió i&lt;/span&gt;&lt;span style="color:#000000"&gt; retirada de l&lt;/span&gt;&lt;span style="color:#000000"&gt;a canalització elèctrica aèria, des del punt de connexió, incloent-&lt;/span&gt;&lt;span style="color:#000000"&gt;hi la canalització de la xarxa d'enllumenat i 4 punts d'il·luminació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;+La &lt;/span&gt;&lt;span style="color:#000000"&gt;retirada&lt;/span&gt;&lt;span style="color:#000000"&gt; del sistema/quadre elèctric antic.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;+La demolició de l&lt;/span&gt;&lt;span style="color:#000000"&gt;a petita edificació al costat d&lt;/span&gt;&lt;span style="color:#000000"&gt;e l'accés a la platja.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;+La demolició del mur d'obra ceràmic, per a la reconstrucció amb pedra de la zona.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;+El desmuntatge i retirada de 7 portes per a la seva substitució a diverses edificacions.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;+El desmuntatge i la retirada d'estructures metàl·liques de suport d'embarcacions, per a la seva renovació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;+El desmuntatge i la retirada de travesses de fusta per a la seva substitució.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;- Reconstrucció de la plataforma d'embarcacions, rompuda amb els temporals. Es preveu la demolició del que queda actualment de la plataforma actual, utilitzant les restes com a base de cimentació per a la nova plataforma, a regularitzar amb material d'aportació. Les dimensions d'aquesta seran similars a les de la plataforma existent en l'actualitat (19,35 m&lt;sup&gt;2&lt;/sup&gt;).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;- Millora de l'accés al dic i les seves escales. Es projecta una passarel·la de fusta per ampliar i assegurar l'accés el dic, de 30 m de longitud, i 1,15 m d'ample total, inclosa la barana. A més, s'inclou una escala de baixada i pujada des de la passarel·la fins a la superfície de varada d'embarcacions, també de fusta i de 0,55 m d'ample amb barana inclosa. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;- Millores de l'accés des de la platja. Es realitzarà la reparació de les escales de pujada fins al primer nivell, millorant la zona de pas fins a la torre, i les escales fins al nivell d'accés al dic, molt deteriorat. A més, es reparen paraments de pedra, amb neteja o demolició prèvia, des del nivell inferior fins al primer nivell i des del primer nivell fins al superior. Per tant, aquestes millores consistiran en:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;+Reparació de murs de pedra en sec.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;+Execució de mur de pedra en sec en els trams on aquest ha caigut.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;+Reparació d'escales de pedra.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;+Pavimentació amb formigó imprès.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;+Ressolat amb llistons de fusta.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;+Reposició de canalitzacions d'enllumenat amb prisma de formigó davall el paviment &lt;/span&gt;&lt;span style="color:#000000"&gt;i instal·lació de lluminàries.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;- Actuacions de manteniment d'habitacles, torre i mur d'espigó, previstes en el projecte del 2009. Inclou:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;+El reompliment de l'habitacle de sustentació deteriorat sota la zona de pas de l'accés des de la platja, amb material procedent de les demolicions. Posteriorment es cobrirà amb pedra seca, actuació inclosa a l'apartat anterior.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;+Reparació de murs de pedra en els habitacles.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;+Reparació de murs de pedra en la torre, i reparació de cobertes de la torre.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;+Substitució de portes existents en habitacles i petites edificacions, incloses a la torre, per portes de fusta tractada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;+Reparació del mur de l'espigó i del morro del dic, incloent-hi la reparació i restitució del volum amb pedra de la zona i morter per reconstrucció.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;+Recuperació i adequació de les escales de pedra en el morro del dic, amb pedra de la zona.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;+Execució de paviment de formigó en zona de pas a la plataforma d'embarcacions.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;- Actuacions de manteniment en rampa i estructures de suport per embarcacions. Les actuacions es basen en:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;+Col·locació de travesses de fusta sobre la rampa de formigó.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;+Instal·lació d'estructures de marina seca sobre les terrasses de formigó. Cada superfície tindrà dues altures, per dues embarcacions de petites dimensions, amb estructura d'aliatge amb patins de fusta natural. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;- Instal·lació de la nova línia elèctrica de baixa tensió des del comptador del port, ocultant la línia aèria, la qual passa a ser en superfície protegida; substitució dels elements i línies, i instal·lació de nou enllumenat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;- Instal·lació nova d'aigua potable, en superfície, fins a la nova toma.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;Per a la realització de les tasques descrites, i a causa del calat i orografia, s'utilitzarà una embarcació tipus multicat, amb molta maniobrabilitat, poc calat i grua a bord, i possibilitat de fixar l'embarcació al fons, si escau. Es tendrà en compte que existeixen dos punts d'abocament d'aigua a la mar sense conducció en l'àmbit del projecte, amb l'objecte de no interferir amb aquests.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;El pressupost d'execució material de les obres ascendeix a 235.378,10 €, &lt;/span&gt;&lt;span style="color:#000000"&gt;amb un termini aproximat d'execució de tres mesos&lt;/span&gt;&lt;span style="color:#000000"&gt;. S'inclou al pressupost un Pla de gestió de residus de construcció i demolició, el qual preveu la gestió dels residus genera&lt;/span&gt;&lt;span style="color:#000000"&gt;ts&lt;/span&gt;&lt;span style="color:#000000"&gt; a través d'un gestor de residus autoritzat, segons la normativa vigent.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;3. Avaluació dels efectes previsibles&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Durant la fase d'obres es preveuen els següents efectes adversos sobre el medi ambient: augment de la terbolesa a la zona litoral més propera (fons rocós), la disminució de la qualitat atmosfèrica i acústica, l'alteració de la qualitat química de l'aigua per incorporació de fins, i l'afecció a les comunitats naturals terrestres o marines i als espais naturals protegits. &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;Durant la fase de funcionament, es preveuen impactes positius sobre el paisatge per soterrament de la línia elèctrica aèria, i en la seguretat i operativitat de la instal·lació portuària.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;Atesa la naturalesa de l'activitat a desenvolupar es preveu que els efectes sobre el medi ambient siguin mínims si s'apliquen les mesures preventives i correctores contingudes al document ambiental.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;4. Consultes a les administracions públiques afectades i persones interessades&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;L'òrgan ambiental ha realitzat les consultes següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;- Servei d'Abocaments, de la DG de Territori i Paisatge.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;- Servei de Costes i Litoral, de la DG de Territori i Paisatge.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;- Servei de Protecció d'Espècies, de la DG d'Espais Naturals i Biodiversitat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;- DG de Pesca i Medi Marí, de la Conselleria d'Agricultura, Pesca i Alimentació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;- DG d'Emergències i Interior, de la Conselleria de Presidència, Funció Pública i Igualtat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;- Servei de Canvi Climàtic i Atmosfera (DG d'Energia i Canvi Climàtic), de la Conselleria de Transició Energètica i Sectors Productius.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;- Servei d'Ordenació del Territori i Urbanisme, de la DG de Territori i Paisatge.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;- Servei de Residus i Sòls Contaminats, de la DG de Residus i Educació Ambiental.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;En el moment de redactar el present informe, es disposa dels següents informes de les administracions previsiblement afectades:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- La directora del Paratge Natural de la Serra de Tramuntana (Servei d'Espais Naturals, de la DG d'Espais Naturals i Biodiversitat) - informe aportat pel promotor amb la sol·licitud d‘inici d'avaluació d'impacte ambiental del projecte -, amb data 27 d'abril de 2021, va informar el següent:&lt;/span&gt;&lt;/p&gt;

&lt;div style="page-break-after:always"&gt;&lt;span style="display:none"&gt;&amp;nbsp;&lt;/span&gt;&lt;/div&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;Es conclou que:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;1. Quant al PORN de la Serra de Tramuntana, i complint amb l'article 21.2 de la llei 5/2005, s'informa favorablement el «Proyecto de actuaciones de mantenimiento y acondicionamiento del Puerto de Banyalbufar», sempre i quan es compleixin les següents condicions:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;a) Per evitar l'alteració de la vegetació natural, no es poden ubicar sobre àrees de vegetació silvestre les zones d'aplec i altres materials i estris necessaris per a l'execució de les obres.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;b) Amb l'objectiu d'evitar pertorbacions sobre la fauna present a la zona, no es podran generar renous forts o estridents durant l'execució de les obres.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;c) Es prendran totes les mesures que siguin adients per a prevenir qualsevol afectació a elements del patrimoni històric presents en la zona d'actuació (marjades i parets) i s'utilitzaran tècniques tradicionals de pedra en sec, respectant les seves característiques originals, tant en estructura com en materials. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;d) Tot el transport de persones i materials s'haurà de dur a terme per camins o vials existents, sense fer-ne de nous ni obrir dreceres o, tal com s'indica al projecte, per via marítima. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;e) Tot i que la &lt;/span&gt;&lt;span style="color:#000000"&gt;instal·lació&lt;/span&gt;&lt;span style="color:#000000"&gt; elèctric&lt;/span&gt;&lt;span style="color:#000000"&gt;a&lt;/span&gt;&lt;span style="color:#000000"&gt; que es vol modificar no ´&lt;/span&gt;&lt;span style="color:#000000"&gt;és&lt;/span&gt;&lt;span style="color:#000000"&gt; una nova estesa o una ampliació d'una existent, s&lt;/span&gt;&lt;span style="color:#000000"&gt;í &lt;/span&gt;&lt;span style="color:#000000"&gt;que s'hauria &lt;/span&gt;&lt;span style="color:#000000"&gt;de presentar un informe justificatiu del motiu pel qual no es considera la implantació d'energies renovables (art. 95.1 PORN), que palesi que aquests sistemes no són vi&lt;/span&gt;&lt;span style="color:#000000"&gt;a&lt;/span&gt;&lt;span style="color:#000000"&gt;bles en el cas concret. Tant les noves esteses com l'ampliació de les existents, han de disc&lt;/span&gt;&lt;span style="color:#000000"&gt;ó&lt;/span&gt;&lt;span style="color:#000000"&gt;rre&lt;/span&gt;&lt;span style="color:#000000"&gt;r&lt;/span&gt;&lt;span style="color:#000000"&gt; soterrades pels vials existents o les seves voreres. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;f) Tots els residus que es generin hauran de ser retirats i lliurats a un gestor autoritzat, o reutilitzats en la mateixa obra del projecte, tal com s'indica a la memòria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;g) S'haurà de tenir especial esment amb aquelles activitats susceptibles de produir incendis forestals, especialment de l'1 de maig al 15 d'octubre, època d'alt risc d'incendi. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;h) El projecte s'haurà de sotmetre al procediment d'avaluació d'impacte ambiental, ja que es tracta d'infraestructures i obres en el litoral (art. 101.2 del PORN de la Serra de Tramuntana). &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;2. Quant a les possibles repercussions del projecte sobre els espais de Xarxa Natura 2000, s'avaluaran adequadament dins el procediment d'avaluació d'impacte ambiental, al que s'ha de sotmetre el projecte.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:80px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- El Servei d'Abocaments, de la DG de Territori i Paisatge, amb data 16 de juny de 2021, va informar el següent:&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:80px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;Examinat el projecte, s'ha comprovat que cap de les actuacions implica l'abocament d'aigua a la mar i, per tant, no afecta les nostres competències en virtut de la Llei 22/1988, de 28 de juliol, de costes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:80px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- La DG de Pesca i Medi Marí, de la Conselleria d'Agricultura, Pesca i Alimentació, amb data 23 de juny de 2021, va informar el següent:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;Es conclou que:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;S'informa POSITIVAMENT el «Projecte d'actuacions de manteniment i condicionament del port de Banyalbufar» sempre que: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;+es desenvolupi el PVA.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;+Les feines amb el vaixell multicat es desenvolupin els dies de calma, i&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;+es respectin les condicions imposades per part de les autoritats ambientals o dels altres organismes complementaris.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;- La DG d'Emergències i Interior, de la Conselleria de Presidència, Funció Pública i Igualtat, &lt;/span&gt;&lt;span style="color:#000000"&gt;amb data &lt;/span&gt;&lt;span style="color:#000000"&gt;29 de juny de 2021, va informar el següent:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;Es conclou que: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Una vegada examinada la documentació, es considera que el «Projecte d'actuacions de manteniment i condicionament del port de Banyalbufar», es pot informar favorablement, atès que les modificacions introduïdes a la infraestructura portuària no introdueixen més riscos dels que ja existien prèviament ni semblen incrementar-los.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- El Servei de Protecció d'Espècies, de la DG d'Espais Naturals i Biodiversitat, amb data 7 de juliol de 2021, va informar el següent:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;S'informa que:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;Segons el criteri del Servei de Protecció d'Espècies, no és de preveure que les actuacions projectades puguin suposar un efecte negatiu sobre les espècies presents a la zona, sempre que es portin a terme les mesures preventives, correctores i compensatòries, així com el pla de vigilància ambiental.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;Es conclou que:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;Per tot això, inform FAVORABLEMENT sobre el projecte d'actuacions de manteniment i condicionament del Port de Banyalbufar.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;- El &lt;span style="color:#000000"&gt;Servei de &lt;/span&gt;&lt;span style="color:#000000"&gt;Canvi Climàtic i Atmosfera (DG d'Energia i Canvi Climàtic), de la Conselleria de Transició Energètica i Sectors Productius&lt;/span&gt;&lt;span style="color:#000000"&gt;, &lt;/span&gt;&lt;span style="color:#000000"&gt;amb data &lt;/span&gt;&lt;span style="color:#000000"&gt;8 de juliol de 2021, va informar el següent:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;Es conclou que: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;1. Es podria aprofitar el projecte de condicionament per tal de dur endavant accions establertes en el Pla d'Adaptació al Canvi Climàtic dels Ports de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;2. La licitació de les obres hauria de tenir en compte els preceptes del títol VI de la Llei 10/2019, de 22 de febrer, de canvi climàtic i transició energètica.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;5. Anàlisi dels criteris de l'annex III de la Llei 21/2013&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;S'han analitzat els criteris de l'annex III de la Llei 21/2013, de 9 de desembre, d'avaluació ambiental, i no es preveu que el projecte pugui tenir efectes significatius sobre el medi ambient, en concret:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;1. Característiques del projecte&lt;/span&gt;&lt;span style="color:#000000"&gt;: &lt;/span&gt;&lt;span style="color:#000000"&gt;El projecte consisteix en&lt;/span&gt;&lt;span style="color:#000000"&gt; el manteniment i condicionament de les infraestructures existents &lt;/span&gt;&lt;span style="color:#000000"&gt;a la zona marítima terrestre del Port de Banyalbufar, &lt;/span&gt;&lt;span style="color:#000000"&gt;propietat de Ports de les Illes Balears,&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;les quals&lt;/span&gt;&lt;span style="color:#000000"&gt; han sofert un deteriorament al llarg dels anys, &lt;/span&gt;&lt;span style="color:#000000"&gt;amb l'objecte&lt;/span&gt;&lt;span style="color:#000000"&gt; de garantir la seguretat &lt;/span&gt;&lt;span style="color:#000000"&gt;d&lt;/span&gt;&lt;span style="color:#000000"&gt;els usuaris i visitants, sense realitzar cap &lt;/span&gt;&lt;span style="color:#000000"&gt;mena&lt;/span&gt;&lt;span style="color:#000000"&gt; d'ampliació &lt;/span&gt;&lt;span style="color:#000000"&gt;i&lt;/span&gt;&lt;span style="color:#000000"&gt; seguint amb la mateixa tipologia actual. E&lt;/span&gt;&lt;span style="color:#000000"&gt;s &lt;/span&gt;&lt;span style="color:#000000"&gt;durà a terme &lt;/span&gt;&lt;span style="color:#000000"&gt;la r&lt;/span&gt;&lt;span style="color:#000000"&gt;epara&lt;/span&gt;&lt;span style="color:#000000"&gt;ció&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;d&lt;/span&gt;&lt;span style="color:#000000"&gt;els elements deteriorats, &lt;/span&gt;&lt;span style="color:#000000"&gt;l'embelliment del conjunt i la millora&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;d&lt;/span&gt;&lt;span style="color:#000000"&gt;els serveis portuaris &lt;/span&gt;&lt;span style="color:#000000"&gt;(&lt;/span&gt;&lt;span style="color:#000000"&gt;aigua, electricitat &lt;/span&gt;&lt;span style="color:#000000"&gt;i&lt;/span&gt;&lt;span style="color:#000000"&gt; il·luminació&lt;/span&gt;&lt;span style="color:#000000"&gt;), mantenint el caràcter rústic actual de la instal·lació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;El port està format per un antic dic o&lt;/span&gt;&lt;span style="color:#000000"&gt; espigó &lt;/span&gt;&lt;span style="color:#000000"&gt;per a la protecció&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;d'&lt;/span&gt;&lt;span style="color:#000000"&gt;un petit varador per barques, &lt;/span&gt;&lt;span style="color:#000000"&gt;amb&lt;/span&gt;&lt;span style="color:#000000"&gt; una longitud total de 40 metres. La seva altura en el costat del mar &lt;/span&gt;&lt;span style="color:#000000"&gt;és&lt;/span&gt;&lt;span style="color:#000000"&gt; variable, &lt;/span&gt;&lt;span style="color:#000000"&gt;mentre que&lt;/span&gt;&lt;span style="color:#000000"&gt; en el seu costat terrestre &lt;/span&gt;&lt;span style="color:#000000"&gt;és de 3,20 m. La seva cara exterior està formada per pedres rodones d'uns 30 cm amb morter de formigó de forma uniforme i cuidada en la part exterior, més descuidada en la part interior.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Segons el document ambiental, aquesta instal·lació ha patit &lt;/span&gt;&lt;span style="color:#000000"&gt;un deteriorament progressiu d'&lt;/span&gt;&lt;span style="color:#000000"&gt;ençà&lt;/span&gt;&lt;span style="color:#000000"&gt; que es va redactar l'any 2009 el «Proyecto de Rehabilitación de la Instalación Portuaria del Port de Banyalbufar, Fase 1», &lt;/span&gt;&lt;span style="color:#000000"&gt;projecte que no es va arribar a executar,&lt;/span&gt;&lt;span style="color:#000000"&gt; moment en què ja presentava un deteriorament &lt;/span&gt;&lt;span style="color:#000000"&gt;per&lt;/span&gt;&lt;span style="color:#000000"&gt; l'ambient salí, la falta de manteniment i els temporals de la zona. &lt;/span&gt;&lt;span style="color:#000000"&gt;L'any 2011 es varen realitzar una sèrie d'actuacions de manteniment i reparació del dic &lt;/span&gt;&lt;span style="color:#000000"&gt;pel mal estat que presentava.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;Per a l'execució de les obres previstes al projecte, i a causa del calat i orografia, s'utilitzarà una embarcació tipus multicat, amb molta maniobrabilitat, poc calat i grua a bord, i possibilitat de fixar l'embarcació al fons, si escau. Es tendrà en compte que existeixen dos punts d'abocament d'aigua a la mar sense conducció en l'àmbit del projecte, amb l'objecte de no interferir amb aquests.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;El pressupost d'execució material de les obres ascendeix a 235.378,10 €, &lt;/span&gt;&lt;span style="color:#000000"&gt;amb un termini aproximat d'execució de tres mesos&lt;/span&gt;&lt;span style="color:#000000"&gt;. S'inclou al pressupost un Pla de gestió de residus de construcció i demolició, el qual preveu la gestió dels residus genera&lt;/span&gt;&lt;span style="color:#000000"&gt;ts&lt;/span&gt;&lt;span style="color:#000000"&gt; a través d'un gestor de residus autoritzat, segons la normativa vigent.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;2. Ubicació del projecte:&lt;/span&gt; &lt;span style="color:#000000"&gt;D'acord amb el P&lt;/span&gt;&lt;span style="color:#000000"&gt;la &lt;/span&gt;&lt;span style="color:#000000"&gt;Territorial Insular de Mallorca (PTM), la zona d'estudi es troba qualificada com a sòl rústic protegit &lt;/span&gt;&lt;span style="color:#000000"&gt;(SRP)&lt;/span&gt;&lt;span style="color:#000000"&gt;, amb la categoria d'àrea natural d'especial interès d'alt nivell de protecció (AANP). &lt;/span&gt;&lt;span style="color:#000000"&gt;Es troba&lt;/span&gt;&lt;span style="color:#000000"&gt; dins ANEI, el LIC ES5310081 «Port des Canonge» i el Paratge Natural de la Serra de Tramuntana. &lt;/span&gt;&lt;span style="color:#000000"&gt;No hi figura cap hàbitat d'interès comunitari (HIC), &lt;/span&gt;&lt;span style="color:#000000"&gt;sent els més pròxims, &lt;/span&gt;&lt;span style="color:#000000"&gt;a una distància superior a 60 m, &lt;/span&gt;&lt;span style="color:#000000"&gt;Cneoro triccoi-Ceratonieum siliquae i Arundini-Convolvuletum sepium.&lt;/span&gt; &lt;span style="color:#000000"&gt;Respecte dels hàbitats marins trobam a uns 50 m de distància una taca d'aproximadament 846 m&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;sup&gt;2 &lt;/sup&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;d'algues fotòfiles sobre pedra amb Posidonia oceanica, i a uns 130 m una superfície d'uns 34327 m&lt;sup&gt;2&lt;/sup&gt; de praderia de Posidonia oceanica.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;La zona d'estudi es troba afecta&lt;/span&gt;&lt;span style="color:#000000"&gt;da&lt;/span&gt;&lt;span style="color:#000000"&gt; per àrees de prevenció de riscos (APR) d'erosió, d'esllavissament i d'incendi. Segons el IV Pla Forestal de les Illes Balears 2015-2024, correspon a una zona amb alt risc d'incendi.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Segons l'IDEIB, els terrenys afectats pel projecte estan travessats pel torrent d'en Roig, sense que es trobin a una zona potencialment inundable, i es localitzen damunt la massa d'aigua subterrània 1802M2 «Banyalbufar», aqüífer profund en bon estat qualitatiu i quantitatiu&lt;/span&gt;&lt;span style="color:#000000"&gt;, &lt;/span&gt;&lt;span style="color:#000000"&gt;amb&lt;/span&gt;&lt;span style="color:#000000"&gt; moderada &lt;/span&gt;&lt;span style="color:#000000"&gt;vulnerabilitat&lt;/span&gt;&lt;span style="color:#000000"&gt; a la contaminació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;D'altra banda, trobam a uns 600 m cap al sud de la zona d'estudi &lt;/span&gt;&lt;span style="color:#000000"&gt;un&lt;/span&gt;&lt;span style="color:#000000"&gt;a font d'abastiment urbà (DI-_30281_Vigent-DI-_30281).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;D'acord amb&lt;/span&gt;&lt;span style="color:#000000"&gt; el Bioatles (&lt;/span&gt;&lt;span style="color:#000000"&gt;q&lt;/span&gt;&lt;span style="color:#000000"&gt;uadrícula 1x1, codi &lt;/span&gt;&lt;span style="color:#000000"&gt;1.56&lt;/span&gt;&lt;span style="color:#000000"&gt;8), a l'àmbit d'actuació &lt;/span&gt;&lt;span style="color:#000000"&gt;figuren les següents&lt;/span&gt;&lt;span style="color:#000000"&gt; espècie&lt;/span&gt;&lt;span style="color:#000000"&gt;s&lt;/span&gt;&lt;span style="color:#000000"&gt; catalogad&lt;/span&gt;&lt;span style="color:#000000"&gt;e&lt;/span&gt;&lt;span style="color:#000000"&gt;s: Dendropoma lebeche &lt;/span&gt;&lt;span style="color:#000000"&gt;(també figura com a espècie amenaçada)&lt;/span&gt;&lt;span style="color:#000000"&gt;, fonoll marí (Crithmum maritimum), garballó (Chamaerops humilis), marfull (Viburnum tinus), cirerer de betlem (Ruscus aculeatus), aladern (Rhamnus alaternus) i linària (Linaria aeruginea subsp. pruinosa). &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. Característiques del potencial impacte: Es preveuen impactes ambientals negatius, compatibles i d'intensitat baixa-moderada, sobre la qualitat atmosfèrica i acústica, i en la qualitat de l'aigua, durant la fase d'obres. El PVA incorpora una sèrie de mesures preventives i correctores, com són la incorporació de barreres antiterbolesa per abocaments accidentals, en cas que sigui necessari, la realització de les obres fora de l'època estival, o la utilització de maquinària eficient per reduir la contaminació a l'atmosfera i les emissions acústiques.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;Per altra banda, durant la fase de funcionament es preveuen impactes positius sobre el paisatge, pel soterrament de la línia elèctrica aèria, així com la creació de llocs de feina.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;Conclusions de l'informe d'impacte ambiental&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Primer. No subjectar a avaluació d'impacte ambiental ordinària el «Proyecto de actuaciones de mantenimiento y acondicionamiento del Puerto de Banyalbufar», sempre que es compleixin les mesures proposades tant al document ambiental, signat amb data 28 de maig de 2021 pel Sr. Bartomeu Llompart Capó, ambientòleg, i els condicionants següents: &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Per evitar l'alteració de la vegetació natural, no es poden ubicar sobre àrees de veg&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;etació silvestre les zones d'aplec i altres materials i estris necessaris per a l'execució de les obres.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;2. Atès que la zona d'estudi presenta un nivell moderat de vulnerabilitat a la contaminació d'aqüífers, durant l'execució de les obres, s'han d'adoptar les màximes precaucions per evitar l'abocament de substàncies contaminants, incloses les derivades del manteniment de les maquinàries (art. 2, punt 1, lletra c, del Decret llei 1/2016, de 12 de gener, de mesures urgents en matèria urbanística).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;3. &lt;span style="color:#000000"&gt;Les feines amb el vaixell multicat &lt;/span&gt;&lt;span style="color:#000000"&gt;s'hauran de&lt;/span&gt;&lt;span style="color:#000000"&gt; desenvolup&lt;/span&gt;&lt;span style="color:#000000"&gt;ar&lt;/span&gt;&lt;span style="color:#000000"&gt; els dies de calma.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;4. No es podran generar renous forts o estridents durant l'execució de les obres, amb l'objectiu d'evitar pertorbacions sobre la fauna present a la zona.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;5. Atès que dins l'àmbit d'actuació hi ha constància de la presència de fonoll marí &lt;span style="background-color:#ffffff"&gt;(&lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;Crithmum maritimum&lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;), catalogada com a espècie d'especial protecció al Decret 75/2005, de 8 de juliol, pel qual es crea el Catàleg Balear d'Espècies Amenaçades i d'Especial Protecció, les Àrees Biològiques Crítiques i el Consell Assessor de Fauna i Flora de les Illes Balears, &lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;en la mesura del possible, &lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;els peus que s'hi trobin es deixaran intactes. &lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;Alternativament, es traslladaran a un altre espai pròxim amb característiques ambientals semblants.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;6. Es prendran totes les mesures que siguin adients per a prevenir qualsevol afectació a elements del patrimoni històric presents a la zona d'actuació (marjades i parets) i s'utilitzaran tècniques tradicionals de pedra en sec, respectant les seves característiques originals, tant en estructura com en materials.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;7. Tot el transport de persones i material s'haurà de dur a terme per camins o vials existents, sense fer-ne de nous ni obrir dreceres o, tal com s'indica al projecte, per via marítima. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;8. Tots els residus que es generin durant la fase de construcció hauran de ser retirats i lliurats a un gestor autoritzat, o reutilitzats en la mateixa obra del projecte, sempre que els elements que s'emprin no tenguin elements contaminants (com per exemple, metalls pesants) que puguin afectar el sòl o els hàbitats de l'entorn.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;9. &lt;/span&gt;&lt;span style="color:#000000"&gt;En compliment del Decret 125/2007, &lt;/span&gt;de 5 d'octubre, pel qual es dicten normes sobre l'ús del foc i es regula l'exercici de determinades activitats susceptibles d'incrementar el risc d'incendis forestals, s&lt;span style="color:#000000"&gt;'haurà de tenir especial esment amb aquelles activitats susceptibles de produir incendis forestals, &lt;/span&gt;&lt;span style="color:#000000"&gt;com l'ús de maquinària que pot generar espurnes, especialment de l'1 de maig al 15 d'octubre, època d'alt risc d'incendi.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;Per altra banda, es recorda que:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;- D'acord amb el Servei d'Espais Naturals, i segons l'art. 95.1 del PORN de la Serra de Tramuntana, el promotor haurà de presentar un informe justificatiu del motiu pel qual no es considera al projecte la implantació d'energies renovables. En cas que aquest informe finalment prevegi la implantació d'energies renovables al projecte, s'haurà de tramitar un nou procediment d'avaluació ambiental, com a modificació substancial del projecte.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;- D'acord amb el Servei de Canvi Climàtic i Atmosfera, l&lt;span style="color:#000000"&gt;a licitació de les obres haurà de tenir en compte els preceptes del títol VI de la Llei 10/2019, de 22 de febrer, de canvi climàtic i transició energètica.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;Segon. Es publicarà el present informe ambiental al Butlletí Oficial de les Illes Balears, d'acord amb el que disposa l'article 47.3 de la Llei 21/2013, de 9 de desembre, d'avaluació ambiental.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#1a1718"&gt;Tercer. L'informe d'impacte ambiental perdrà la seva vigència i cessarà en la producció dels efectes que li són propis si, una vegada publicat en el BOIB, no s&lt;/span&gt;&lt;span style="color:#000000"&gt;'hagués procedit a l'aprovació del projecte en el termini màxim de quatre anys des de la publicació, d'acord amb el que disposa l'article 47.4 de la Llei 21/2013.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;Quart. L'informe d'impacte ambiental no ha de ser objecte de cap recurs, sense perjudici dels que, si s'escau, siguin procedents en la via administrativa o judicial davant de l'acte, si s'escau, d'autorització del projecte, d'acord amb el que disposa l'article 47.6 de la Llei 21/2013.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="color:#000000"&gt;&lt;span style="display:inline-block"&gt;Cinquè. Aquesta proposta de resolució s'emet sense perjudici de les competències urbanístiques, de gestió o territorials de les administracions competents i de les autoritzacions o informes necessaris per a l'aprovació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
