CAIB 511474 ca CAIB 600 43261 2021-10-30 CAIB ![CDATA[Informació pública de la citació als interessats per a l'aixecament de l’acta prèvia a l’ocupació en relació amb l’expropiació forçosa motivada pel "Projecte de remodelació de l'accés de Can Senyora a la carretera EI-500, de Sant Rafel a Santa Agnès" al terme municipal de Sant Antoni de Portmany, i de la relació definitiva de béns i drets]] text/html 43262 ![CDATA[<p><span style="font-family:Times New Roman,Times,serif; font-size:12px">El Consell Insular d'Eivissa, mitjançant Resolució del conseller executiu del Departament de Gestió del Territori, Infraestructures Viàries, Ordenació Turística i Lluita contra l'Intrusisme de data 2 de setembre de 2021, aprovà definitivament la relació individualitzada de béns i drets afectats pel projecte esmentat i la sol·licitud al Govern de les Illes Balears de la declaració d'urgència en l'ocupació dels terrenys necessaris per a l'execució. </span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Contra l'anterior acord, que no posa fi a la via administrativa, es podrà interposar recurs d'alçada davant el president del Consell Insular, en el termini d'un mes comptador des del dia següent al de la present publicació, d'acord amb els arts. 121 i 122 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques, en relació a l'art. 22.3 de la Llei 8/2000, de 27 d'octubre, de consells insulars i l'art. 147.2) del Reglament orgànic del Consell Insular d'Eivissa. No obstant l'anterior, es pot exercitar, en el seu cas, qualsevol altre recurs que s'estimi escaient.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Posteriorment, el Consell de Govern de les Illes Balears, en sessió celebrada el dia 11 d'octubre de 2021, va aprovar la declaració d'urgència sol·licitada. L'acord es publicà al BOIB núm. 140 de 12 d'octubre de 2021. </span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">D'acord amb l'anterior i conforme a l'establert a l'article 52.2ª i 3ª de la Llei d'expropiació forçosa, s'anuncia tot seguit la relació de propietaris i titulars de drets afectats i se'ls cita per tal de comparèixer a la finca o terrenys objecte de l'expropiació al dia i hora assenyalats a fi de procedir a aixecar l'acta prèvia a l'ocupació.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">La compareixença, s'haurà de fer per si o per persona que legalment us representi, i podreu fer-vos acompanyar, d'estimar-ho adient, per un perit o notari (a la vostra costa).
