    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;El Ple de l'Ajuntament de Santa Margalida en sessió ordinària duta a terme dia 30 de setembre de 2021, va adoptar el següent acord:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;strong&gt;«Antecedents de fet&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;strong&gt;1. &lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;En data 23 de novembre de 2020, es va adoptar l'acord del Consell de Govern pel qual es declararen com a inversions d'interès autonòmic, les intervencions previstes per als nous centres de salut, unitats bàsiques de salut i servei d'urgència d'atenció primària (SUAP) a Mallorca; entre les quals hi consta al construcció d'una nova unitat bàsica en el municipi de Santa Margalida, situat en el solar amb referència cadastral 9250708ED0995S0001US:&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;strong&gt;«Primer&lt;/strong&gt;. De conformitat amb l'article 7 del Decret llei 1/2018, en relació amb l'article 5 de la Llei 4/2010, de 16 de juny, declarar Inversió d'interès autonòmic les intervencions previstes següents:&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;2. La construcció d'una nova unitat bàsica de salut en el municipi de Santa Margarida, situat en el solar amb referència cadastral 9250708ED0995S0001US»&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;strong&gt;2. &lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;En el BOIB núm. 199 de data 24 de novembre de 2020, es va publicar l'esmentat acord.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;strong&gt;3. &lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Atès que dins l'expedient consta:&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;strong&gt;PRIMER-. &lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Cedir gratuïtament i de forma definitiva al Servei de Salut de les Illes Balears, Conselleria de Salut i Consum, el terreny bé patrimonial de titularitat municipal amb referència cadastral 9250708ED0995S0001US; perquè es destini a l'ús de construcció de la nova unitat bàsica de salut a Santa Margalida.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;strong&gt;SEGON.- &lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Determinar la reversió automàtica al patrimoni d'aquest Ajuntament del bé cedit gratuïtament, si no és destinat a l'ús previst en el terme màxim de cinc anys, i deixa de ser-ho en tot cas posteriorment en el transcurs dels trenta anys propers.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;strong&gt;TERCER.- &lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Anotar la cessió gratuïta a l'Inventari Municipal de Béns a aquest efecte d'actualitzar-ho.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;strong&gt;QUART.- &lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Facultar al batle perquè subscrigui totes les actuacions que es derivin de l'expedient, entre elles la signatura de l'Escriptura pública de cessió del bé.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;strong&gt;CINQUÈ.-&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt; &lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Notificar el present Acord a l'Entitat beneficiària, que haurà de comparèixer al moment que sigui emplaçat per procedir a elevar a Escriptura pública la cessió referida.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;strong&gt;SISÈ.- &lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Remetre la documentació necessària al Registre de la Propietat perquè efectuïn els oportuns assentaments registrals segons la Legislació hipotecària.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;strong&gt;SETÈ.- &lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Remetre certificat de l'acord de cessió gratuïta a l'autoritat competent de la Comunitat Autònoma (Direcció General de Funció Pública) a l'efecte de la presa de coneixement de la cessió del bé patrimonial d'acord amb l'article 109.2 RBEL.»&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
