font-size:12px"><span style="line-height:114%">L'apartat 9.3 de la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 10 de juliol de 2015 per la qual es convoquen subvencions per a<strong>&nbsp;</strong>les explotacions a les explotacions agràries, per als anys 2015-2019, especifica que la resolució expressa es notificarà a les persones interessades mitjançant la seva publicació en el Butlletí Oficial de les Illes Balears d'acord amb els termes que preveu l'article 45.2 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:114%">Els expedients han estat tramitats pel Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA), en compliment del que disposa l'article 43 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:114%">El vicepresident en matèria agrària del FOGAIBA, en data de 4&nbsp;d'octubre&nbsp;de 2021, signa la següent resolució:</span></span></p> <p style="margin-bottom:0px; La Resolució esmentada es va modificar en data 17 de desembre de 2015 (BOIB núm. 185) i en data 22 de juny de 2016, (BOIB núm. 81) i en data 26 de juny de 2018 (BOIB núm. 80). </em></span></span></em></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:120%"><em><span style="background-color:#ffffff"><span style="color:#000000"><em>2.Una vegada analitzada tota la documentació presentada, el vicepresident del FOGAIBA va resoldre favorablement la concessió de l'ajuda a favor de BERNAT VANRELL MARROIG</em></span></span></em><em><span style="background-color:#ffffff"><span style="color:#000000"><em>, entre d'altres,</em></span></span></em><em>&nbsp;</em><em><span style="background-color:#ffffff"><span style="color:#000000"><em>que figuren en l'annex de la Resolució de concessió, R1 de data 10 de setembre de 2020, (BOIB núm. 161, de 17 de setembre de 2020) amb les dades i els imports corresponents&nbsp;(amb un import concedit de </em></span></span></em><em><span style="background-color:#ffffff"><span style="color:#000000"><em>16</em></span></span></em><em><span style="background-color:#ffffff"><span style="color:#000000"><em>.53</em></span></span></em><em><span style="background-color:#ffffff"><span style="color:#000000"><em>4</em></span></span></em><em><span style="background-color:#ffffff"><span style="color:#000000"><em>,</em></span></span></em><em><span style="background-color:#ffffff"><span style="color:#000000"><em>80&nbsp;€).</em></span></span></em></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:120%"><em><span style="background-color:#ffffff"><span style="color:#000000"><em>3. Atesa la Resolució de concessió de l'ajuda esmentada, i d'acord amb el que estableix l'apartat desè de la convocatòria abans esmentada, el beneficiari s'obliga, entre altres, a realitzar les actuacions auxiliades dins el termini establert i a justificar les despeses relacionades amb la inversió per a la recepció dels fons comunitaris en la manera i els terminis determinats en la convocatòria. </em></span></span></em></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:120%"><em><span style="background-color:#ffffff"><span style="color:#000000"><em>4. Atesa la Resolució de concessió de l'ajuda esmentada, i d'acord amb el que estableix l'apartat Dotzè, punt 2 de la Resolució, l'actuació subvencionada haurà d'estar realitzada i pagada pel beneficiari en el període comprès entre la data de començament del període d'elegibilitat previst a l'apartat 4 de la present Resolució i el termini previst en el punt anterior, que serà també especificat en la resolució de concessió. També l'interessat haurà de presentar documentació justificativa del pagament de l'import de les factures presentades; el pagament de l'import d'aquestes factures quedarà acreditat presentant: fotocòpia compulsada del justificant de l'ordre de transferència bancària o document bancari acreditatiu de la transferència, en el qual hi figuri: la data de la transferència, l'import a transferir, la identificació del concepte de la transferència amb l'objecte que quedi identificat el pagament de la factura, així com les dades de l'ordenant i del destinatari que hauran de coincidir amb el beneficiari i amb l'emissor de la factura, respectivament.</em></span></span></em></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:120%"><em><span style="background-color:#ffffff"><span style="color:#000000"><em>5. Dins el termini legalment establert, en data 16 de març de 2021 l'interessat presenta sol·licitud del pagament total així com la documentació exigida. Un cop analitzada aquesta, es comprova que la factura núm. 0/013700 per una aclotadora hidràulica amb broca, la factura núm. A21-38 per un cultivador i la factura núm. IC066635 per un remolc no són auxiliables ja que l'actuació subvencionada no ha estat pagada pel beneficiari. Tal i com estableixen les ordres de transferències presentades per l'interessat per a la justificació del pagament, el titular del compte bancari és PEDRO VANRELL GARAU mentre que el beneficiari de l'ajuda, BERNAT VANRELL MARROIG, consta com a autoritzat i no com a titular del compte bancari mitjançant el qual es van realitzar els pagaments de les factures abans mencionades.</em></span></span></em></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:120%"><em><span style="background-color:#ffffff"><span style="color:#000000"><em>6. En relació amb la factura núm. F20201098 per una pinça per troncs, en les ordres de transferència bancàries presentades per l'interessat no hi figura la identificació del concepte de la transferència amb l'objecte de la factura i per tant no queda suficientment identificat el pagament de la factura. Tampoc la suma de l'import de les transferències aportades pel beneficiari coincideixen amb l'import total de la factura de la pinça acabada d'esmentar.</em></span></span></em></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:120%"><em><span style="background-color:#ffffff"><span style="color:#000000"><em>7. L'article 43 del Text refós de la Llei de subvencions, aprovat per Decret legislatiu 2/2005,</em></span></span>&nbsp;<span style="background-color:#ffffff"><span style="color:#000000"><em>de 28 de desembre, disposa que “Pertoca la revocació de la subvenció quan, posteriorment a la resolució de concessió vàlida i ajustada a dret, el beneficiari incompleix totalment o parcialment les obligacions o els compromisos contrets als quals està condicionada l'eficàcia de l'acte de concessió de la subvenció. Com a conseqüència de la revocació de la subvenció, queda sense efecte, totalment o parcialment, l'acte de concessió i pertoca el reintegrament de les quantitats percebudes indegudament”.</em></span></span></em></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:120%"><em><span style="background-color:#ffffff"><span style="color:#000000"><em>8. En data 5 de juliol es notifica a la persona interessada, mitjançant la publicació al web, l'Informe/Proposta provisional de resolució de revocació parcial de 30 de juny de 2021, a l'efecte de complir amb el tràmit d'audiència per dur a terme les al·legacions. </em></span></span></em></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:120%"><em><span style="background-color:#ffffff"><span style="color:#000000"><em>9. El 29 de juliol de 2021, dins del termini i en la forma escaient, la persona interessada va presentar l'escrit d'al·legacions sobre l'Informe/Proposta provisional de resolució de revocació parcial abans esmentat, i va adjuntar documentació (ja aportada dins l'expedient) i certificats del proveïdor Metba NHB, SL del pagament de la factura número 20201098 i certificat ITT CM93 del pagament de la factura número 13700.</em></span></span></em></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:120%"><em><span style="background-color:#ffffff"><span style="color:#000000"><em>No s'accepten les al·legacions ja que les actuacions subvencionades no han estat pagades pel beneficiari, d'acord amb el que estableix l'apartat Dotzè, punt 2 de la Resolució, l'actuació subvencionada haurà d'estar realitzada i pagada pel beneficiari en el període comprès entre la data de començament del període d'elegibilitat previst a l'apartat 4 de la present Resolució i el termini previst en el punt anterior, que serà també especificat en la resolució de concessió</em></span></span></em></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:120%"><em><span style="background-color:#ffffff"><span style="color:#000000"><em>10. En data 6 de setembre de 2021 es notifica a la persona interessada, mitjançant la publicació al web, notificació de deficiències de 3 de setembre de 2021, aportar compte corrent on sigui el titular la persona beneficiaria.</em></span></span></em></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:120%"><em><span style="background-color:#ffffff"><span style="color:#000000"><em>11. El 16 de setembre de 2021, dins del termini i en la forma escaient, la persona interessada va presentar l'escrit de notificació de deficiències i certificat de titularitat del compte corrent.</em></span></span></em></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:120%"><em><span style="background-color:#ffffff"><span style="color:#000000"><em>12. S'ha considerat l'Informe/Proposta provisional de resolució de 30 de juny de 2021, de revocació parcial de l'ajuda concedida a BERNAT VANRELL MARROIG, amb NIF ***1503**.&nbsp;</em></span></span></em></span></span></p> <p><strong><span style="font-family:Times New Roman,Times,serif;
