    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;L'apartat 9.3. de la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 10 de juliol de 2015 per la qual es convoquen, subvencions per a inversions a les explotacions agràries, corresponents als anys 2015-2019, especifica que la resolució expressa es notificarà a les persones interessades mitjançant la seva publicació al &lt;em&gt;&lt;em&gt;Butlletí Oficial de les Illes Balears &lt;/em&gt;&lt;/em&gt;d'acord amb els termes que preveu l'article 45.2 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;Els expedients han estat tramitats pel Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) en compliment del que disposa l'article 43 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;El vicepresident en matèria agrària del FOGAIBA, en data 28&amp;nbsp;de setembre&amp;nbsp;de 2021, va signar la següent resolució,&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;strong&gt;&lt;em&gt;&lt;strong&gt;&lt;em&gt;“INFORME/&lt;/em&gt;&lt;/strong&gt;&lt;/em&gt;&lt;/strong&gt;&lt;strong&gt;&lt;em&gt;&lt;strong&gt;&lt;em&gt;&amp;nbsp;PROPOSTA/RESOLUCIÓ DE DESISTIMENT&lt;/em&gt;&lt;/strong&gt;&amp;nbsp;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;1.En data de 16 de juliol de 2015 es va publicar, en el Butlletí Oficial de les Illes Balears núm. 106, la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) per la qual es convoquen, per als anys 2015 a 2019, subvencions per a inversions a les explotacions agràries, modificada mitjançant les resolucions de data 17 de desembre de 2015 (BOIB núm. 185), en data 22 de juny de 2016, (BOIB núm. 81) i en data 26 de juny de 2018 (BOIB núm. 80). &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;2.De conformitat amb l'apartat sisè de l'esmentada Resolució, el termini de presentació de sol·licituds va acabar el dia 11 de maig de 2020. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;3.Els òrgans gestors del Servei d'Ajudes al Desenvolupament Rural han dut a terme el control administratiu de les sol·licituds i de la documentació aportada d'acord amb les normes reguladores d'aquesta ajuda.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;4.&lt;/em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Una vegada avaluades les sol·licituds presentades pels òrgans gestors, i d'acord amb els criteris d'elegibilitat de la convocatòria, les persones interessades assenyalades a l'annex adjunt, no compleixen amb algun requisits prevists a la convocatòria per poder ser beneficiaris de l'ajuda, pels motius indicats a l'esmentat annex.&amp;nbsp;&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Fonaments de dret&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;2.Ordre del conseller d'Agricultura, Medi Ambient i Territori de 19 de febrer de 2015, per la qual s'estableixen les bases reguladores per a la concessió de subvencions en el marc del Programa de Desenvolupament Rural de les Illes Balears 2014-2020.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;3.Llei 39/2015, d'1 d'octubre, del Procediment Administratiu Comú de les Administracions Públiques.&amp;nbsp;&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;Per tot això, s'informa favorablement i &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;prop&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;ò&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;s al vicepresident &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;en matèria &amp;nbsp;agrària del FOGAIBA que dicti una resolució en els termes següents:&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;1.Donar per desistid&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;a&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;l&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;a ajuda &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;sol·licit&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;a&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;d&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;a pels interessats que figuren &amp;nbsp;a &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;l'&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;A&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;nnex &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;d'aquesta resolució&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;, que són un total de dos expedients i comença amb PERE ANTONI MULET MONSERRAT i acaba amb SON TORTOVA, SL, relativa a de la línia d'ajudes “Inversions a les explotacions agràries” pels motius especificats en l'annex esmentat.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;2.Declarar conclòs el procediment i arxi&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;var els&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;expedients&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;detallats en l'annex &amp;nbsp;d'aquesta resolució.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;3.Notificar aquesta resolució a l&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;a&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;person&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;a&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;interessad&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;a&amp;nbsp;mitjançant la publicació en el Butlletí Oficial de les Illes Balears.&amp;nbsp;&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;Contra aquesta resolució –que no exhaureix la via administrativa- es pot interposar recurs d'alçada davant el&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;conseller d&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;e Medi Ambient, &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;Agricultura&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;i&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;Pesca, en el termini d'un mes, comptador des de l'endemà de la notificació de la resolució, d'acord amb l'article 58.4 de la Llei 3/2003, de 26 de març, de règim jurídic de l'Administració de la comunitat autònoma de les Illes Balears, i &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;els &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;article&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;s &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;1&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;21 i 122 &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;de la Llei 39/2015, d'1 d'octubre, del Procediment Administratiu Comú de&amp;nbsp;les Administracions Públiques.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
