&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;L'apartat 9.3. de la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 10 de juliol de 2015 per la qual es convoquen, subvencions per a inversions a les explotacions agràries, corresponents als anys 2015-2019, especifica que la resolució expressa es notificarà a les persones interessades mitjançant la seva publicació al &lt;em&gt;&lt;em&gt;Butlletí Oficial de les Illes Balears &lt;/em&gt;&lt;/em&gt;d'acord amb els termes que preveu l'article 45.2 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;Els expedients han estat tramitats pel Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) en compliment del que disposa l'article 43 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;El vicepresident&amp;nbsp;en matèria agrària&amp;nbsp;del FOGAIBA, en data 16&amp;nbsp;de setembre&amp;nbsp;de 2021, va signar la següent resolució,&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;1.En data de 16 de juliol de 2015 es va publicar, en el Butlletí Oficial de les Illes Balears núm. 106, la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) per la qual es convoquen, per als anys 2015 a 2019, subvencions per a inversions a les explotacions agràries, modificada mitjançant les resolucions de 17 de desembre de 2015, 22 de juny de 2016&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;,&amp;nbsp;26 de juny de 2018.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;2.De conformitat amb l'apartat sisè de la Resolució esmentada, el termini per presentar les sol&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;·&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;licituds va acabar el dia 3&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;0&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;de &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;juny&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;de 201&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;8. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;3.El 10 de setembre de 2020, el secretari general de la Conselleria d'Agricultura, Pesca i Alimentació va dictar una Resolució de concessió d'ajudes per a inversions a les explotacions agràries, que es va publicar al Butlletí Oficial de les Illes Balears número 161, del 17 de setembre de 2020, en la qual hi figurava una concessió, entre d'altres, a favor de TANQUES DE LLUCAITX SRM, amb NIF J57645517, amb un import concedit de 104.493,25 euros per a una inversió en bens inmobles (reforma i ampliació nave agrícola), inversió elegible de 208.986,50 €, expedient número INEA2018_1/179.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;4.En data 24 de febrer de 2021, el Sr. ANTONIO LEON&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;, &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;amb&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;NIF ***2697**, &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;en representació de&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;em&gt;&lt;em&gt;TANQUES DE LLUCAITX SRM&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;, va presentar en el registre del FOGAIBA, Maó, amb número de registre L95E11490, una sol·licitud de modificació de la inversió prevista per una nova inversió de maquinària (Picadora Claas Jaguar automotriz), amb un pressupost de 272.564,00 €, per causes tecnico-econòmiques de l'explotació agrícola i degut a les demandes del mercat actual. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;5.Segons el punt setè de l'apartat novè de la convocatòria «Amb caràcter excepcional, i respectant la quantia de l'ajuda concedida, com també la forma i els terminis d'execució i justificació de les despeses corresponents, les persones beneficiàries poden sol·licitar la modificació del contingut de les actuacions subvencionades quan es donin circumstàncies que alterin o dificultin el desenvolupament de les activitats que no siguin imputables a les persones sol·licitants.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;​​​​​​​&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;Les sol·licituds de modificació han d'estar prou motivades i s'han de formular amb caràcter immediat a l'aparició de les circumstàncies que la justifiquen i, en qualsevol cas, en un màxim de sis mesos per a les inversions immobles i de tres mesos per a les inversions mobles i sempre amb anterioritat al moment en què acabi el termini d'execució de les activitats subvencionades [...]»&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;6.La sol·licitud de modificació del contingut de les actuacions no especifica el moment de l'aparició de les circumstàncies que justifiquen el canvi d'inversió, el qual ha de ser de tres mesos des del dia de l'aparició d'aquestes causes modificatives i amb anterioritat al moment en què acabi el termini d'execució de les activitats subvencionades.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;La modificació del contingut de les actuacions subvencionades no ha estat prou justificat ja que l'entitat no ha demostrat en cap moment que s'hagin donat circumstàncies que alterin o dificultin el desenvolupament de les inversions que van ser concedides. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;7.Atès l'anteriorment exposat, es proposa la denegació de la modificació de les inversions concedides ja que l'entitat, per una banda, no especifica el moment de l'aparició de les circumstàncies que modifiquin les actuacions subvencionades i, per altra banda, no ha justificat la modificació del contingut de les inversions.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;8.El beneficiari va presentar al·legacions el&lt;/em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&amp;nbsp;dia 8 de juliol de 2021, on exposa que la construcció del magatzem no és viable ja que l'ajuntament de Es Mercadal encara no ha atorgat la llicència d'obres, i per això s'ha vist obligat a montar una estructura mòbil per poder albergar la maquinària, li ha costat 18.000 € i te unes dimensions de 470 m2.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;9.La inversió proposada és la compra d'una picadora, per un import superior a l'ajuda concedida, essent l'inversió auxiliable 208.986,50 euros, i l'ajuda condedida de 104.493,25 euros, aquest import no es poden augmentar.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;10.Les inversions proposades son ben&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;s&amp;nbsp;mobles i per tant tenen un termini de 6 mesos des de la publicació de la resolució d'acceptació de modificació.&amp;nbsp;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;&lt;em&gt;Fonaments de dret&lt;/em&gt;&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;1.Resolució &amp;nbsp;del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA)&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;de 10 de juliol de 2015, &amp;nbsp;per la qual es convoquen, per als anys 2015 a 2019, subvencions per a inversions a les explotacions agràries.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;3.&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;Llei 39/2015, d'1 d'octubre, de&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;l Procediment administratiu comú &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;de les &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;A&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;dministracions &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;Públiques.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;I per tot això dict la següent &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;Resolució&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;d'acceptació de modificacions i pròrroga&lt;/em&gt;&amp;nbsp;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;1. Acceptar la modificació proposada pel beneficiari per l'import i amb les dades detallades en l'annex d'aquesta resolució.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;2.Concedir una pròrroga de 6 mesos des de la publicació de la resolució al Butlletí Oficial de les Illes Balears.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;3. Notificar aquesta resolució a la persona beneficiària mitjançant la publicació al Butlletí Oficial de les Illes Balears.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
