Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 10 de juliol de 2015 per la qual es convoquen, per als anys 2015 a 2019, subvencions per a inversions en les explotacions agràries. La Resolució esmentada es va modificar en data 17 de desembre de 2015 (BOIB núm. 185), en data 22 de juny de 2016, (BOIB núm. 81) i en data 26 de juny de 2018 (BOIB núm.&nbsp;80).</em></span></span></em></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:120%"><em><span style="background-color:#ffffff"><span style="color:#000000"><em>2. Una vegada analitzada tota la documentació presentada, el vicepresident del FOGAIBA va resoldre favorablement la concessió de l'ajuda a favor de FARTARITX RAMADERIA MALLORQUINA, SL, notificada en data de 25 d'octubre de 2019 a la Delegació comarcal del FOGAIBA </em></span></span></em><em><span style="background-color:#ffffff"><span style="color:#000000"><em>S</em></span></span></em><em><span style="background-color:#ffffff"><span style="color:#000000"><em>a Pobla a la persona amb DNI ***6833** amb les dades i els imports corresponents </em></span></span></em><em><span style="background-color:#ffffff"><span style="color:#000000"><em>(amb un import concedit de 39,759,38€).</em></span></span></em></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:120%"><em><span style="background-color:#ffffff"><span style="color:#000000"><em>3. Atesa la Resolució de concessió de l'ajuda esmentada, i d'acord amb el que estableix l'apartat dotzè de la convocatòria abans esmentada, el beneficiari s'obliga, entre altres, a realitzar les actuacions auxiliades dins el termini establert i a justificar les despeses relacionades amb la inversió per a la recepció dels fons comunitaris en la manera i els terminis determinats en la convocatòria. </em></span></span></em></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:120%"><em><span style="background-color:#ffffff"><span style="color:#000000"><em>4. Dins el termini legalment establert per a la justificació de les inversions aprovades, l'interessat presenta la sol·licitud de pagament, com també la documentació exigida, però, una vegada revisada aquesta, es comprova que la inversió a la concessió dins el capítol de béns immobles, la factura número 49 de la inversió de construcció d'un import elegible de 14.910,12 euros no és auxiliable, ja que la data és de 27 d'abril de 2016 és anterior a la sol·licitud d'ajuda presentada el 30 de juny de 2016, per tant fora del termini establert, segons el punt 2 de l'apartat dotzè, l'actuació subvencionada haurà d'estar realitzada i pagada pel beneficiari en el període comprès entre la data de començament del període d'elegibilitat previst en l'apartat quart de la Resolució, que en el punt 3 de l'article 23 estableix que de conformitat amb el que disposa l'Ordre del conseller d'Agricultura, Medi Ambient i Territori de 19 de febrer de 2015, per la qual s'estableixen les bases reguladores per a la concessió de subvencions en el marc del Programa de Desenvolupament Rural de les Illes Balears 2014-2020, només seran subvencionables les despeses realitzades desprès de la presentació de la sol·licitud d'ajuda i el termini, en aquest cas d'inversió immoble, de dotze mesos comptadors des de l'endemà de la data de notificació de la Resolució de concessió de l'ajuda.</em></span></span></em></span></span></p> <div style="page-break-after:always"><span style="display:none">&nbsp;</span></div> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:120%"><em><span style="background-color:#ffffff"><span style="color:#000000"><em>5. L'article 43 del Text refós de la Llei de subvencions, aprovat pel Decret legislatiu 2/2005, de 28 de desembre, disposa que “Pertoca la revocació de la subvenció quan, posteriorment a la resolució de concessió vàlida i ajustada a dret, el beneficiari incompleix totalment o parcialment les obligacions o els compromisos contrets als quals està condicionada l'eficàcia de l'acte de concessió de la subvenció. Com a conseqüència de la revocació de la subvenció, queda sense efecte, totalment o parcialment, l'acte de concessió i pertoca el reintegrament de les quantitats percebudes indegudament”.</em></span></span></em></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:120%"><em><span style="background-color:#ffffff"><span style="color:#000000"><em>6. Atès tot això, es proposa fer la revocació parcial ja que l'actuació subvencionable no s'ajusta al que estableix el punt 2 de l'apartat dotzè de la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) per la qual es convoquen, per als anys 2015 a 2019, subvencions per a inversions a les explotacions agràries.</em></span></span></em></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:120%"><em><span style="background-color:#ffffff"><span style="color:#000000"><em>7. En data 23 d'agost de 2021 es notifica a la persona interessada, mitjançant la publicació al web, l'Informe/Proposta provisional de resolució de revocació parcial de 20 d'agost de 2021, a l'efecte de complir amb el tràmit d'audiència per dur a terme les al·legacions. Una vegada transcorreguts els 10 dies hàbils, la persona interessada no ha presentant cap al·legació.</em></span></span></em></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:120%"><em><span style="background-color:#ffffff"><span style="color:#000000"><em>8.
