&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La vicepresidenta del Consorci Serra de Tramuntana Patrimoni Mundial, en data 27 d'agost de 2021, ha dictat la següent resolució:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&amp;lt;&amp;lt;Antecedents&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. La vicepresidenta del Consorci Serra de Tramuntana Patrimoni Mundial, va resoldre en data 21 de maig de 2021, entre d'altres, aprovar la convocatòria de subvencions per a entitats que promoguin i fomentin la custòdia del territori a la Serra de Tramuntana per a l'any 2021.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. La indicada convocatòria de subvencions es va publicar al BOIB núm. 68, de dia 25 de maig de 2021.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. Durant el període de 30 dies hàbils per presentar sol·licituds, des del 26 de maig de 2021 fins el 7 de juliol de 2021, es varen presentar 5&amp;nbsp; sol·licituds.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. Revisada la documentació administrativa i tècnica presentada, l'instructor de l'expedient i d'acord amb les bases cinquena i setena de la convocatòria, va requerir l'esmena de la documentació de quatre sol·licitants dels quals s'havien detectat deficiències. Aquest requeriment es va publicar al BOIB núm. 100, de 27 de juliol de 2021, així, atorgant-se un termini de deu dies hàbils, fins dia 10 d'agost de 2021, per esmenar les deficiències detectades a les sol·licituds inicials.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. Una vegada revisada la documentació les esmenes, i verificada que era correcta, la Comissió Tècnica d'Avaluació, es va reunir el dia 13 d'agost de 2021 per valorar les sol·licituds presentades. D'aquesta sessió es va emetre acta que fonamenta la proposta de resolució d'atorgament de les subvencions, en els termes de la base dotzena de la convocatòria esmentada..&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;6. El cap de Servei jurídic de la Unitat de Paratges Culturals del Departament de Territori, el dia 25 d'agost de 2021, va emetre l'informe sobre el compliment dels requisits de la convocatòria per part de les entitats sense ànim de lucre proposades com a beneficiàries i ha emès informe jurídic favorable sobre els aspectes jurídics de la proposta de resolució de concessió de les subvencions que ens ocupa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;7. La Intervenció delegada ha fiscalitzat de conformitat aquest expedient en data 27 d'agost de 2021.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Fonaments de dret.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. El procediment de concessió de les&lt;strong&gt; &lt;/strong&gt;subvencions regulades per la present convocatòria pública s'ha dut a terme mitjançant règim de concurrència competitiva, d'acord amb els principis d'objectivitat, transparència, igualtat, no discriminació i publicitat, en els termes de la base sisena de la convocatòria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Per determinar l'import que es proposa concedir a cada beneficiari s'ha valorat la seva sol·licitud, d'acord amb els criteris de puntuació prevists a la base onzena de la convocatòria i els límits regulats a la base segona, en concordança amb la base quinzena de la convocatòria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. La base dotzena de la convocatòria preveu l'existència de la Comissió Tècnica d'Avaluació que té, entre d'altres, la funció d'examinar i valorar les sol·licituds de subvenció, d'acord amb els criteris establerts a la convocatòria, i també li correspon emetre l'acta que ha de fonamentar la proposta de resolució de la convocatòria. Amb aquestes finalitats l'esmentat òrgan col·legiat es va reunir formalment el dia 13 d'agost de 2021.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. La base tercera de la convocatòria regula la condició de beneficiari d'aquestes subvencions, i estableix, entre d'altres, que no poden ser beneficiaris els que, en el moment que l'òrgan instructor de la convocatòria ha de fer la proposta d'acord definitiva, no estan al corrent en el compliment de les obligacions tributàries davant l'Administració de l'Estat i amb el Consell de Mallorca i de les obligacions amb la Seguretat Social. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;div style="page-break-after:always"&gt;&lt;span style="display:none"&gt;&amp;nbsp;&lt;/span&gt;&lt;/div&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En el sentit indicat, l'informe de l'instructor, emès el dia 25 d'agost de 2021 es pronuncia favorablement sobre el compliment d'aquests requisits, per part de les entitats sense ànim de lucre proposades com a beneficiàries. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Per altra banda, l'apartat 6 de la base tercera exclou aquelles sol·licituds per executar actuacions en finques o parcel·les en les quals hagi recaigut una resolució sancionadora en matèria d'infracció urbanística. Com que hi ha entitats sense ànim de lucre que només ha aportat la sol·licitud del certificat d'inexistència d'infracció urbanística davant l'ajuntament respectiu, d'acord amb el mateix informe de 25 d'agost de 2021, al moment de la justificació de la subvenció, aquests hauran d'aportar el certificat municipal de què la parcel·la a on discorri l'actuació subvencionada no té cap resolució ferma d'infracció urbanística d'acord amb els requisits de l'apartat 6 de la base tercera.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. La base tretzena de la convocatòria, en el seu apartat primer determina que la instrucció de l'expedient correspon al cap de servei jurídic del Servei de Gestió de Paratges Culturals del Departament de Territori i que l'indicat òrgan instructor és el competent per dictar la proposta de resolució de la convocatòria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;6. La proposta de resolució s'ajusta al que estableix la base tretzena de la convocatòria, en el sentit que ha d'incloure la relació de persones beneficiàries, amb indicació del seu CIF, el concepte, el pressupost, la quantia sol·licitada, els punts obtinguts i l'import concedit, a més de la resta de sol·licituds desestimades o excloses.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;7. La base segona de la convocatòria disposa que per fer front a aquesta convocatòria, es destina la quantitat total de cinquanta mil euros (50.000,00 €). L'import màxim subvencionable per a cada projecte serà de 10.000,00 €.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;8. L'òrgan competent per a la resolució de la present convocatòria és la vicepresidència del Consorci Serra de Tramuntana Patrimoni Mundial, tal com s'estableix a la base tretzena de la convocatòria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Per això, resolc:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Resolució&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Concedir a les entitats sense ànim de lucre que es detallen a l'Annex 1 adjunt, la quantitat total de quaranta-set mil sis-cents setanta-dos euros amb noranta-quatre cèntims (47.672,94 €) amb càrrec a l'aplicació pressupostària 00.33615.48900 del pressupost de despeses del Consorci Serra de Tramuntana per a l'any 2021 (A 220210000156), i disposar-ne la despesa a favor seu. A l'annex 1 consta l'import que es concedeix i l'operació comptable D provisional que va associada a cada expedient.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Anular la diferència de crèdit del document comptable A 220210000156 de la partida pressupostària 00.33615.48900 del pressupost de despeses del Consorci Serra de Tramuntana per a l'any 2021 i dels seus anteriors, per un import de dos mil tres-cents vint-i-set euros amb sis cèntims (2.327,06 €) – (A/ 920210000349).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. Requerir als beneficiaris que justifiquin la subvenció rebuda al termini més aviat possible una vegada executat el projecte subvencionat d'acord amb la base dissetena de la convocatòria, i que, acreditin que compleixen l'apartat 5 de la base tercera de la mateixa convocatòria mitjançant la presentació del certificat municipal d'inexistència d'infracció urbanística, si és que no l'han aportat ja amb anterioritat, ja que l'abonament de l'ajut es supeditarà a l'aportació de l'esmentat certificat.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. R&lt;span style="color:black"&gt;emetre aquesta resolució a la Base de Dades Nacional de Subvencions, i publicar-la al Butlletí Oficial de les Illes Balears i a la pàgina web del Consorci de la Serra de Tramuntana (www.serradetramuntana.net).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. Contra aquesta resolució que no posa fi a la via administrativa es pot interposar, el recurs d'alçada davant la presidència del Consorci Serra de Tramuntana Patrimoni Mundial dins el termini d'un mes, comptador a partir del dia següent al de la publicació de la present resolució en el Butlletí Oficial de les Illes Balears. Contra la desestimació expressa del recurs d'alçada podrà interposar-se el recurs contenciós administratiu, en el termini de dos mesos, comptadors a partir del dia següent al de la notificació de la desestimació de l'esmentat recurs.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Contra la desestimació per silenci del recurs d'alçada podrà interposar-se el recurs contenciós administratiu, en el termini de sis mesos, comptadors a partir del dia següent a la desestimació presumpta (tres mesos des de la interposició del recurs sense que s'hagi notificat la resolució).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Un cop transcorreguts tres mesos des de la interposició del recurs sense que s'hagi notificat la resolució, podrà interposar-se el recurs contenciós administratiu, contra la desestimació presumpta del recurs d'alçada, sense limitació temporal, mentre no hi hagi resolució expressa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Tot això de conformitat amb la Llei 29/1998, de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa i la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&amp;gt;&amp;gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
