La Resolució esmentada es va modificar en data 26 d'abril de 2016 (BOIB núm. 54, de 30 d'abril de 2016), modificada per la Resolució del president del FOGAIBA de 26 de juny de 2018 (BOIB núm. 80, de 28 de juny de 2018).</em></span></em></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em><span style="background-color:#ffffff"><span style="color:#000000"><em>2.El 26 de juny de 2019 (amb registre d'entrada núm. 17.697), MARIA CRISTINA MARTIN VÁZQUEZ</em></span></span>&nbsp;<span style="background-color:#ffffff"><span style="color:#000000"><em>va presentar la sol·licitud d'ajuda corresponent a l'expedient núm. CEJA2019_1/103. En el Pla Empresarial que adjunta manifesta que l'inici de l'activitat és la instal·lació com a jove agricultor d'una explotació agrària prioritària d'orientació productiva horticultura i per altra banda, que també es dedica o dedicarà a la producció ecològica.</em></span></span></em></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em><span style="background-color:#ffffff"><span style="color:#000000"><em>3. El 15 de desembre de 2020, el vicepresident en matèria agrària del FOGAIBA va dictar la Resolució de concessió d'ajudes per a la creació d'empreses de joves agricultors (R1), publicada en el BOIB núm. 215, de 29 de desembre de 2020, en la qual s'inclou una concessió a favor de MARIA CRISTINA MARTIN VÁZQUEZ, amb NIF ***7600**, amb un import d'ajuda per concurrència de 70.000,00 €, amb núm. d'expedient CEJA2019_1/103.</em></span></span></em></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em><span style="background-color:#ffffff"><span style="color:#000000"><em>4. L'expedient esmentat ha estat objecte d'una revisió sistemàtica per part d'un superior, d'acord amb el que estableix l'article 3.2 de la Circular de Coordinació 18/2019, per la campanya 2019, s'ha detectat que en la concessió es varen produir els errors següents:</em></span></span></em></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em><span style="background-color:#ffffff"><span style="color:#000000"><em>a) Es varen concedir 70.000,00 € quan només corresponen 55.000,00€ en concepte prima base 25.000,00€, d'incorporació a una explotació agrària prioritària 10.000,00€, d'orientació horticultura 10.000,00€ i per dedicació a producció ecològica 10.000,00€. </em></span></span></em></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:120%"><em><span style="background-color:#ffffff"><span style="color:#000000"><em>5.</em></span></span>&nbsp;<span style="background-color:#ffffff"><span style="color:#000000"><em>L'article 43 del Text refós de la Llei de subvencions, aprovat per Decret legislatiu 2/2005, de 28 de desembre, disposa que “Pertoca la revocació de la subvenció quan, posteriorment a la resolució de concessió vàlida i ajustada a dret, el beneficiari incompleix totalment o parcialment les obligacions o els compromisos contrets als quals està condicionada l'eficàcia de l'acte de concessió de la subvenció. Com a conseqüència de la revocació de la subvenció, queda sense efecte, totalment o parcialment, l'acte de concessió i pertoca el reintegrament de les quantitats percebudes indegudament”.</em></span></span></em></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:120%"><em><span style="background-color:#ffffff"><span style="color:#000000"><em>6. En data 7 de juny de 2021 es notifica a la persona interessada, mitjançant la publicació al web, l'Informe/Proposta provisional de resolució de modificació i de revocació parcial de 2 de juny de 2021, per un import d'ajuda de 55.000,00 €, i dur a terme una revocació parcial de 15.000,00 €, pels conceptes abans esmentats (apartat a d'aquesta resolució),atès que no sol·licita per cap concepte més que es pugui incrementar la prima fins als 70.000,00 euros. Modificar la Resolució del vicepresident en matèria agrària de 15 de desembre de 2020 de concessió (R1), per l'import i les dades detallades en l'annex 1 d'aquesta resolució, que és un total d'1 expedient i comença amb MARIA CRISTINA MARTIN VÁZQUEZ i acaba amb MARIA CRISTINA MARTIN VÁZQUEZ, que suma un import total de 55.000,00 €, relativa a la línia d'ajuda «Creació d'empreses de joves agricultors», a conseqüència de la revisió sistemàtica.</em></span></em></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:120%"><em><span style="background-color:#ffffff"><em>2. Revocar parcialment la Resolució d'ajuda concedida abans esmentada concedida al beneficiari per l'import i amb les dades detallades en l'annex 2 d'aquesta resolució, que és un total d'1 expedient i que comença amb MARIA CRISTINA MARTIN VÁZQUEZ i acaba amb MARIA CRISTINA MARTIN VÁZQUEZ, que suma un import total de 15.000,00 €, relativa a la línia d'ajuda «Creació d'empreses de joves agricultors», ja que no va </em><span style="color:#000000"><em>sol·licitar per cap concepte més que es pugui incrementar la prima fins als 70.000,00 euros. </em></span></span></em></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:120%"><em><span style="background-color:#ffffff"><span style="color:#000000"><em>3.
