    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;L'apartat 9.4. de la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA), de data 21 de maig&amp;nbsp;de 2020, &amp;nbsp;per la qual es convoquen, ajudes&amp;nbsp;&lt;strong&gt;&amp;nbsp;&lt;/strong&gt;per la Cooperació entre agents per desenvolupar cadenes curtes de comercialització&amp;nbsp;mitjaçant accions de promoció, corresponents a&amp;nbsp;l'&amp;nbsp;any 2020, especifica que la resolució expressa es notificarà a les persones interessades mitjançant la seva publicació al &lt;em&gt;&lt;em&gt;Butlletí Oficial de les Illes Balears &lt;/em&gt;&lt;/em&gt;d'acord amb els termes que preveu l'article 45.2 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;Els expedients han estat tramitats pel Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) en compliment del que disposa l'article 43 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;El vicepresident en matèria agrària del FOGAIBA, en data 1&amp;nbsp;d'agost&amp;nbsp;de 2021, va signar la següent resolució, &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;1.Resolució de la presidenta del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) per la qual es convoquen subvencions per a la cooperació entre agents per desenvolupar cadenes curtes de comercialització mitjançant accions de promoció per a l'any 2020.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;2.De conformitat amb l'apartat sisè de la resolució esmentada, el termini de presentació de sol·licituds va acabar el dia 15/07/2020, i varen tenir entrada en el Registre del Fons de Garantia Agrària i Pesquera de les Illes Balears un total de 20 sol·licituds d'ajuda. &lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;3.Els òrgans gestors del Servei d'Ajudes al Desenvolupament Rural han dut a terme el control administratiu de les sol·licituds i de la documentació aportada d'acord amb les normes reguladores d'aquesta ajuda.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;4.Els interessats, assenyalats a&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&amp;nbsp;l'Annex I adjunt, han presentat dins el termini establert i en la forma escaient, la documentació prevista a la convocatòria, i s'ha comprovat que compleixen amb els requisits exigits per poder ser beneficiaris d'aquesta ajuda i han acreditat el compliment dels criteris de selecció indicats.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;5. Atès l'&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Informe de determinació de procediment de dia&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&amp;nbsp;05/07/2021,&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&amp;nbsp;que inclou l'ampliació de crèdit publicada en BOIB el &lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;03/07/2021,&amp;nbsp;el crèdit actual existent cobreix la totalitat de les peticions d'aquesta convocatòria.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;2.Ordre del conseller d'Agricultura, Medi Ambient i Territori de 19 de febrer de 2015, per la qual s'estableixen les bases reguladores per a la concessió de subvencions en el marc del Programa de Desenvolupament Rural de les Illes Balears 2014-2020.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;3.&amp;nbsp;Llei 39/2015 de 1 d'octubre de règim jurídic de les administracions públiques.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;span style="line-height:114%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;INFORME I PROPOSTA &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;Per tot això, s'informa favorablement i propòs al vicepresident del FOGAIBA que dicti una resolució en els termes següents:&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;1. Concedir l'ajuda sol·licitada als beneficiaris pels imports i amb els terminis detallats a l' Annex I, que són un total de 6 expedients i que comença amb RAMADERS AGRUPATS SAT 4054 i acaba amb SOC. COOP LTDA PAGESA DE POLLENÇA, que suma un import total de &amp;nbsp;114.109,51 &amp;nbsp;euros, relativa a la línia d'ajuda “Subvencions per a la cooperació entre agents per desenvolupar cadenes curtes de comercialització mitjançant accions de promoció per a l'any 2020”. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;2. Autoritzar i disposar la despesa assenyalada a cada un dels beneficiaris amb càrrec als pressuposts i percentatges de cofinançament detallats a l'Annex I . &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;3. Determinar que, d'acord amb el que estableix la convocatòria de referència, les obligacions dels beneficiaris seran les indicades a l'Annex II.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;4. Notificar la resolució a cada un dels interessats de l'Annex I .&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:150%"&gt;&lt;em&gt;&lt;span style="line-height:150%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Interposició de recursos&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Contra aquesta resolució –que no exhaureix la via administrativa- es pot interposar recurs d'alçada davant el conseller d'Agricultura, Pesca i Alimentació, en el termini d'un mes, comptador des de l'endemà de la notificació de la resolució, d'acord amb l'article 58.4 de la Llei 3/2003, de 26 de març, de règim jurídic de l'Administració de la comunitat autònoma de les Illes Balears, i els articles 121 i 122, de la Llei 39/2015 del Procediment Administratiu Comú de les Administracions Públiques.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Realitzar les inversions o activitats auxiliades en el termini establert a l'Annex II&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Justificar les despeses relacionades amb la inversió per a la recepció dels fons comunitaris en els termes i terminis determinats a la Resolució de convocatòria.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Mantenir la inversió objecte de subvenció i la seva destinació durant al menys cinc anys comptats des de la data de pagament de l'ajuda, i també mantenir els requisits i condicions exigibles respecte a l'explotació i el beneficiari, durant aquest període.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;No efectuar a la inversió objecte de subvenció cap modificació important que afecti la seva naturalesa o les seves condicions d'execució o que proporcioni un avantatge inadequat a una empresa o a un organisme públic, i que resulti, ja sigui d'un canvi en la naturalesa del règim de propietat, d'una determinada infraestructura o bé de la interrupció o del canvi de localització d'una activitat productiva.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Complir les normes comunitàries aplicables a la inversió i en especial les relatives a la durabilitat de les operacions previstes a l'article 71 del Reglament (UE) núm. 1303/2013 del Parlament Europeu i del Consell, de 17 de desembre de 2013.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Adoptar les mesures que siguin necessàries per proporcionar informació al públic i donar-ne publicitat. Per a accions que suposin inversions que superin un cost total de 50.000 euros, el beneficiari haurà de col·locar una placa o tanca explicativa&lt;/em&gt;&lt;span style="color:#ff3300"&gt;&lt;em&gt;.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;En cas que sigui obligatòria la inscripció d'acord amb la normativa vigent, registrar les actuacions objecte de subvenció en el Registre sanitari o en el Registre d'establiments del sector de l'alimentació animal, abans de la data d'acabament del termini establert a l'Annex II.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;En el supòsit d'adquisició, construcció o rehabilitació i millora de béns inventariables, en el cas de béns inscriptibles en un registre públic, s'haurà de fer constar en l'escriptura que el beneficiari haurà de destinar els béns amb la finalitat per a la qual es va concedir la subvenció durant un mínim de cinc anys, així com l'import de la subvenció concedida, i&amp;nbsp; aquests extrems han de ser objecte d'inscripció en el registre públic corresponent.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Sotmetre's als controls que dugui a terme l'administració, necessaris per comprovar la correcta concessió de l'ajuda i el posterior manteniment dels compromisos.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
