&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La vicepresidenta del Consorci Serra de Tramuntana Patrimoni Mundial, en data 10 d'agost de 2021, ha dictat la següent resolució:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;“Antecedents&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. La vicepresidenta del Consorci Serra de Tramuntana Patrimoni Mundial, en data 26 de novembre de 2020, va resoldre aprovar la convocatòria de subvencions per a propietaris afectats per la catàstrofe meteorològica de dia 29 d'agost de 2020 a l'àmbit territorial de la Serra de Tramuntana.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. L'extracte de la indicada convocatòria de subvencions es va publicar al BOIB núm. 203, de dia 3 de desembre de 2020.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. Durant el període de 30 dies hàbils per presentar sol·licituds, des del 4 de desembre de 2020 fins el 22 de gener de 2021, es varen presentar 32&amp;nbsp; sol·licituds.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. Revisada la documentació administrativa i tècnica presentada, l'instructor de l'expedient i d'acord amb les bases novena i dotzena de la convocatòria, va requerir l'esmena de la documentació dels sol·licitants dels quals s'havien detectat deficiències. Aquest requeriment es va publicar al BOIB núm. 35, de 13 de març de 2021, així com a la pàgina web www.serradetramuntana.net , atorgant-se un termini de deu dies hàbils, fins dia 22 de març de 2021, per esmenar les deficiències detectades a les sol·licituds inicials.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. Revisada la documentació presentada per les esmenes, els tècnics del Servei d'Autoritzacions Territorials del Departament de Territori, i del Servei de Medi Ambient del Departament de Sostenibilitat i Medi Ambient, han emès els corresponents informes tècnics, dels quals es fonamenta la viabilitat tècnica dels projectes sol·licitats i es proposa la concessió que es reflecteixen a l'annex 1, així com també han informat d'aquells expedients que es consideraven no justificats tècnicament i que es recullen a l'annex 2. &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Així mateix, i respecte d'aquells sol·licituds que no es varen esmenar dins termini, qui subscriu ha emès el corresponent informe jurídic, del qual es recull la succinta motivació a l'annex 2 del present informe; i respecte d'aquelles sol·licituds que no reuneixen els requisits de la convocatòria, també s'han emès els informes tècnics i/o jurídics adients i que també es recullen a l'annex 2.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Per altra banda, a l'annex 3 s'ha recollit l'acceptació d'una renúncia d'un sol·licitant a continuar amb la tramitació de la sol·licitud de subvenció, que s'ha fonamentat en base a un informe jurídic de l'instructor de l'expedient.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;6. L'instructor de l'expedient, el dia 5 d'agost de 2021, va emetre l'informe sobre el compliment dels requisits de la convocatòria per part dels sol·licitants proposats com a beneficiaris i ha emès informe jurídic favorable sobre els aspectes jurídics de la proposta de resolució de concessió de les subvencions que ens ocupa.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;7. En data 5 d'agost de 2021, la Intervenció Delegada ha fiscalitzat de conformitat aquest expedient.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Fonaments de dret&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. El procediment de concessió de les&lt;strong&gt; &lt;/strong&gt;subvencions regulades per la present convocatòria pública s'ha dut a terme, mitjançant règim de concurrència no competitiva, d'acord amb els principis publicitat, objectivitat, igualtat i no discriminació, en els termes de la base cinquena de la convocatòria.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Per determinar l'import que es proposa concedir a cada beneficiari s'ha valorat la seva sol·licitud, d'acord amb les regles previstes a la base sisena i els límits regulats a les bases segona i tercera, en concordança amb la base quinzena de la convocatòria.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La base quarta de la convocatòria disposa que per fer front a aquesta convocatòria, es destina la quantitat total de cent vuitanta mil d'euros (180.000,00 €) distribuïts en funció dels destinataris de la següent manera: &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;“...&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;a.&amp;nbsp;&amp;nbsp; &lt;em&gt;Cent vint mil euros (120.000,00 €) per a particulars, entitats sense ànim de lucre, comunitats de bens, agrupacions de persones físiques i comunitats de regants, que es preveuran a la partida pressupostària 00.33615.78900 del Pressupost de despeses del Consorci Serra de Tramuntana de l'any 2021.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;b.&amp;nbsp;&amp;nbsp; &lt;em&gt;Seixanta mil euros (60.000,00 €) per a persones jurídiques, que es preveuran a la partida pressupostària 00.33615.77900 del Pressupost de despeses del Consorci Serra de Tramuntana de l'any 2021&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;...”&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;I que d'acord amb la base sisena de la convocatòria es distribuirà de la manera següent:&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;“...&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;1. El pressupost per a cada tipus de beneficiari (per una banda els 120.000,00 € per particulars, entitats sense ànim de lucre, comunitats de bens, agrupacions de persones físiques i comunitats de regants; i per l'altra els 60.000,00 € per a persones jurídiques) destinat a aquesta convocatòria, es repartirà per a cada sol·licitant que compleixi els requisits i condicions de la convocatòria per poder-se concedir. &lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;L'import a concedir (fins un màxim de 5.000,00 €) serà el que resulti d'aplicar la distribució del crèdit entre cada tipus de beneficiari en proporció amb la totalitat de projectes presentats que compleixin els requisits d'aquesta convocatòria. És a dir, de la totalitat de projectes presentats per tipus de beneficiari es traurà la seva suma i s'assignarà a cada projecte un percentatge proporcional de l'import sol·licitat sobre la suma total. Aquest percentatge proporcional obtingut, s'aplicarà sobre el pressupost previst, donant com a resultat l'import màxim a concedir per a cada projecte, que en cas de què es superés l'import sol·licitat s'ajustarà a aquest import sol·licitat. En cas de que la suma dels imports sol·licitats no superés el crèdit total previst per a cada tipus de beneficiari es concedirà l'import màxim sol·licitat.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;...”&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;3. &lt;/span&gt;La base dotzena estableix les funcions de l'instructor de l'expedient, que “ha de dur a terme totes les actuacions o els actes de tràmit necessaris per vetllar pel compliment dels requisits de la convocatòria, a més d'exercir les facultats previstes en l'article 24 i concordants de la LGS, i les que s'esmenten en l'Ordenança General de Subvencions del Consell de Mallorca. L'òrgan instructor pot requerir a les entitats sol·licitants els informes o els aclariments que consideri convenients”. Sent el Consorci Serra de Tramuntana el centre gestor responsable del seguiment de les subvencions.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Amb aquesta finalitat, l'instructor de l'expedient amb la col·laboració del personal del Consorci des d'un punt de vista administratiu i jurídic, i dels tècnics del d'Autoritzacions Territorials del Departament de Territori i del Servei de Medi Ambient del Departament de Sostenibilitat i Medi Ambient, des d'un punt de vista tècnic, han dut a terme tota aquesta tasca.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. La base segona regula la condició de beneficiari d'aquestes subvencions i estableix, entre d'altres, que no poden ser beneficiaris els que, en el moment que l'òrgan instructor de la convocatòria ha de fer la proposta d'acord definitiva, no estan al corrent en el compliment de les obligacions tributàries i amb la Seguretat Social davant l'Administració de l'Estat i amb les obligacions tributàries amb el Consell de Mallorca. Igualment, la base segona estableix que les esmentades circumstàncies s'han d'acreditar abans de la proposta de resolució de concessió i en el moment de pagament.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En el sentit indicat, l'informe de l'instructor de l'expedient, emès el dia 16 de juliol de 2021 es pronuncia favorablement sobre el compliment d'aquests requisits, per part dels ajuntaments proposats com a beneficiaris.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. Per altra banda, tots els sol·licitants admesos han acreditat, com a mínim, la sol·licitud davant l'ajuntament respectiu sobre la certificació de no infracció urbanística de la parcel·la on discorreix l'actuació a subvencionar. Per no endarrerir més el procediment de les subvencions, la concessió es supeditarà a què al moment de la justificació de la subvenció aquells particulars, entitats sense ànim de lucre, comunitat de regants, comunitats de bens i persones jurídiques admesos que no ho haguessin fet en el seu moment, aportin el certificat municipal de què la finca o parcel·la a on discorri l'actuació subvencionada no té cap resolució ferma d'infracció urbanística d'acord amb els requisits de l'apartat 4 de la base segona i l'apartat 6 de la base dotzena de la convocatòria.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;6. La proposta de resolució s'ajusta al que estableix la base dotzena de la convocatòria, en el sentit que ha d'incloure la relació d'entitats beneficiàries, atès que inclou la relació de persones beneficiàries, amb indicació del beneficiari, el NIF parcial, el concepte, el pressupost, la quantia sol·licitada i l'import concedit, a més de la resta de sol·licituds desestimades o excloses.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;7. La proposta de resolució de la convocatòria s'ajusta al que es disposa en la base sisena de la convocatòria, i als criteris de distribució de les quanties que s'hi estableixen.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Així, d'acord amb les sol·licituds presentades pels sol·licitants, un cop feta la valoració de les actuacions d'acord amb els informes tècnics, la distribució de la quantia total de cent vuitanta mil euros (180.000,00 €)&amp;nbsp; per la concessió de les subvencions s'ha de realitzar de la forma següent:&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Cent vint mil euros (120.000,00 €) per particulars, entitats sense ànim de lucre, comunitats de bens, agrupacions de persones físiques i comunitats de regants.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Seixanta mil euros (60.000,00 €) per a persones jurídiques. &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En conseqüència, s'ha constatat que el crèdit inicialment previst de cent vuitanta- mil euros (180.000,00 €) resulta ser suficient per la distribució de totes les subvencions sol·licitades i que compleixen els requisits de la convocatòria, de tal manera que no fa falta fer un repartiment proporcional d'acord amb la base sisena.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;8. L'òrgan competent per a la resolució de la present convocatòria és la vicepresidència del Consorci Serra de Tramuntana Patrimoni Mundial, tal com s'estableix a la base dotzena de la convocatòria.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Per tot el que s'ha exposat i d'acord amb la base dotzena de la convocatòria, resolc:&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Resolució&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Denegar les sol·licituds que es detallen a l'Annex 2 adjunt, pels motius que s'hi indiquen, atès que no compleixen els requisits establerts a la present convocatòria de subvencions.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Acceptar els desistiments i les renúncies presentats per les persones que es detallen en l'Annex 3 adjunt.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. Concedir als sol·licitants que es detallen als Annexes 1.A i 1.B adjunts, la quantitat total de vuitanta mil nou-cents cinquanta-nou euros amb seixanta-sis cèntims (80.919,86 €) i disposar-ne la despesa a favor seu.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;D'aquesta quantitat total, setanta-cinc mil nou-cents dinou euros amb vuitanta-sis cèntims (75.919,86 €) va destinada a particulars, entitats sense ànim de lucre, comunitats de bens, agrupacions de persones físiques i comunitats de regants, i s'ha d'imputar a l'aplicació pressupostària 00.33615.78900 del pressupost de despeses del Consorci Serra de Tramuntana per a l'any 2021 i al projecte amb finançament afectat 2021/2/33615/1/1 (A 220210000014). A l'annex 1.A consta l'import que es concedeix i la operació comptable D provisional que va associada a cada expedient.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;I cinc mil euros (5.000,00 €) va destinades a persones jurídiques, i s'ha d'imputar a l'aplicació pressupostària 00.33615.77900 del pressupost de despeses del Consorci Serra de Tramuntana per a l'any 2021 i al projecte amb finançament afectat 2021/2/33615/1/1 (A 22021000013). A l'annex 1.B consta l'import que es concedeix i&amp;nbsp; l'operació comptable D provisional que va associada a cada expedient.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. Anular la diferència de crèdit del document comptable A 220210000014 de la partida pressupostària 00.33615.78900 del pressupost de despeses del Consorci Serra de Tramuntana per a l'any 2021, per un import de quaranta-quatre mil vuitanta euros amb catorze cèntims (44.080,14 €)- (A/ 920210000338).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. Anular la diferència de crèdit del document comptable A 220210000013 de la partida pressupostària 00.33615.77900 del pressupost de despeses del Consorci Serra de Tramuntana per a l'any 2021, per un import de cinquanta-cinc mil (55.000,00 €) - (A/ 920210000319).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;6. Requerir als beneficiaris prevists a l'annex 1.A i 1.B perquè complin amb les obligacions previstes a la base tretzena de la convocatòria, i també executin i justifiquin la subvenció rebuda d'acord amb els terminis prevists a aquesta base tretzena. És a dir, les beneficiàries o els beneficiaris, sempre que no ho hagin fet abans per urgència, hauran d'acabar les actuacions dins un termini màxim de dos (2) mesos i presentar la justificació de les despeses en un termini de tres (3) mesos comptadors ambdós terminis des de la publicació de la concessió de les subvencions al Butlletí Oficial de les Illes Balears (BOIB).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;7. Ordenar-ne la publicació en el BOIB.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;8. Contra aquesta resolució que no posa fi a la via administrativa es pot interposar, el recurs d'alçada davant la presidència del Consorci Serra de Tramuntana Patrimoni Mundial dins el termini d'un mes, comptador a partir del dia següent al de la publicació de la present resolució en el Butlletí Oficial de les Illes Balears. Contra la desestimació expressa del recurs d'alçada podrà interposar-se el recurs contenciós administratiu, en el termini de dos mesos, comptadors a partir del dia següent al de la notificació de la desestimació de l'esmentat recurs.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Contra la desestimació per silenci del recurs d'alçada podrà interposar-se el recurs contenciós administratiu, en el termini de sis mesos, comptadors a partir del dia següent a la desestimació presumpta (tres mesos des de la interposició del recurs sense que s'hagi notificat la resolució).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Un cop transcorreguts tres mesos des de la interposició del recurs sense que s'hagi notificat la resolució, podrà interposar-se el recurs contenciós administratiu, contra la desestimació presumpta del recurs d'alçada, sense limitació temporal, mentre no hi hagi resolució expressa.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;No obstant l'anterior, es pot exercitar, si n'és el cas, qualssevol altres recursos que s'estimi oportú i pertinent. Tot això de conformitat amb la Llei 29/1998, de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa i la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques..”&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;/p&gt;

			&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:10px"&gt;&lt;em&gt;“En data 28/04/2021 els tècnics del Consell de Mallorca varen realitzar una visita per comprovar l'adequació tècnica de l'actuació a la convocatòria i, més concretament, la medició de la partida d'obra declarada. La medició va resultar coincident, però el preu unitari de la partida no s'ajusta al que estableix el punt 5 de l'apartat tercer de les bases de la convocatòria.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

			&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:10px"&gt;&lt;em&gt;Segons la certificació d'obra aportada, s'ha aplicat un preu unitari de 108,20 €/m², mentre que l'apartat 3.5 de les bases limita aquest preu a l'aplicació del mòdul que el Programa de Desenvolupament Rural de la Conselleria de Medi Ambient, Agricultura i Pesca del Govern de les Illes Balears estableix per a les actuacions etnològiques de recuperació d'obra de pedra en sec als marges, que és de 73,00 €/m², incrementable en un 20% en aquest cas per la complexitat de la intervenció a la parcel·la. Així doncs, la quantitat subvencionable ascendeix a: 18,96 m² x 73,00 €/m² x 1,20 = 1.660,89 €, sense IVA.”&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
