&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El Decret 2/2021 de 25 de gener, pel qual s'aprova el Plec de condicions de la Denominació d'Origen Protegida Pebre Bord de Mallorca–Pimentón de Mallorca i se'n regula el Consell Regulador, va crear el Consell Regulador de la denominació i en el seu annex II en regula la seva composició, l'organització i les funcions.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;A la disposició transitòria tercera del Decret 2/2021, s'estableix que en un termini màxim de dotze mesos des de l'entrada en vigor d'aquest Decret s'haurà de constituir el Consell Regulador de la Denominació d'Origen Protegida Pebre Bord de Mallorca, d'acord amb el Decret 139/2002, de 22 de novembre, pel qual es regula el procés electoral per a la renovació dels membres dels consells reguladors de les denominacions de qualitat agroalimentària, per la qual cosa es procedent convocar les eleccions per a l'elecció dels vocals electes que han de formar el Consell Regulador de la Denominació d'Origen Protegida Pebre Bord de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Fonaments de dret&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. L'article 20 de principis de competència de la Llei 3/2003, de 26 de març, de règim jurídic de l'Administració de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Els articles 2 i 3 del Decret 139/2002, de 22 de novembre, pel qual es regula el procés electoral per a la renovació dels membres dels consells reguladors de les denominacions de qualitat agroalimentària.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. El Decret 2/2021 de 25 de gener, pel qual s'aprova el Plec de condicions de la Denominació d'Origen Protegida Pebre Bord de Mallorca–Pimentón de Mallorca i se'n regula el Consell Regulador, regula la composició, organització i funcions del seu Consell Regulador i a la seva disposició transitòria tercera s'estableix un termini màxim de dotze mesos per a constituir-se.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Per tot això, dict la següent&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Resolució&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Convocar eleccions, d'acord amb l'annex I, per a la elecció dels membres del Consell Regulador de la Denominació d'Origen Protegida Pebre Bord de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Aprovar el calendari electoral del procés electoral, inclòs a l'annex II.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. Facultar la Junta Electoral &lt;/span&gt;&lt;span style="color:#231f20"&gt;&lt;span style="background-color:null"&gt;de la &amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="background-color:null"&gt;Denominació d'Origen Protegida Pebre Bord de Mallorca perquè desenvolupi les actuacions que resultin adients per a la tramitació del procés electoral.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. Ordenar la publicació d'aquesta convocatòria al &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Butlletí Oficial de les Illes Balears&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;D'acord amb l'article 3 del Decret 139/2002, de 22 de novembre, pel qual es regula el procés electoral per a la renovació dels membres dels consells reguladors de les denominacions de qualitat agroalimentària, es convoquen eleccions per a la elecció dels membres del Consell Regulador de la Denominació d'Origen Protegida Pebre Bord de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;2. Calendari del procés electoral&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El calendari, referit a dies naturals, que ha de regir el procés electoral és el que figura en l'annex II.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En cas que algun dels dies que es fixen en el calendari electoral coincideixi amb diumenge o festiu, s'habilitarà, al mateix efecte, el dia hàbil següent.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;3. Terminis&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;D'acord amb el que preveu la disposició addicional segona del Decret 139/2002 i amb l'objectiu de poder complir els terminis de presentació d'escrits i recursos que s'estableixen en el calendari electoral, tots els terminis acaben a les 14.00&amp;nbsp;h i l'únic lloc on es poden presentar els documents és el Registre de la Conselleria d'Agricultura, Pesca i Alimentació, situat al carrer de la Reina Constança, 4, de Palma.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;4. Junta electoral&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;a)&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; Es constitueix la Junta Electoral de la Denominació d'Origen Protegida Pebre Bord de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;b)&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; Té la seu a les dependències de la Conselleria d'Agricultura, Pesca i Alimentació, situada al carrer de la Reina Constança, 4, de Palma.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;c)&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; Estarà composta per les persones següents:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;​​​​​​​&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Un president/a, designat/da i nomenat/da per la consellera d'Agricultura, Pesca i Alimentació.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Un representant de cadascuna de les organitzacions professionals agràries, de les unions de cooperatives agràries i de les associacions empresarials amb implantació a Mallorca. Seran nomenats per la consellera d'Agricultura, Pesca i Alimentació d'entre els que proposin aquestes entitats.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Dos funcionaris designats i nomenats per la consellera d'Agricultura, Pesca i Alimentació, un dels quals ha de ser llicenciat en dret.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La presidència i cada vocalia han de disposar d'un suplent designat de la mateixa manera que el titular.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Per proposar representants, les organitzacions professionals agràries, les unions de cooperatives agràries i les associacions empresarials han d'acreditar la inscripció en els registres corresponents, i la seva proposta ha de ser subscrita per qui en tingui la representació, d'acord amb els estatuts.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En cas que una organització estigui integrada en una altra d'ordre superior, no pot presentar candidatura si la superior en presenta.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Les propostes s'han de presentar davant la consellera d'Agricultura, Pesca i Alimentació en el termini que s'assenyala en el calendari electoral (annex II).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;5. Censos electorals&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;D'acord amb el Títol II de l'annex II&amp;nbsp; Decret 2/2021 de 25 de gener, pel qual s'aprova el Plec de condicions de la Denominació d'Origen Protegida Pebre Bord de Mallorca–Pimentón de Mallorca i se'n regula el Consell Regulador, els censos electorals són els següents:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. &amp;nbsp;Cens de productors i plantacions, constituït pels titulars de les explotacions agràries de Mallorca dedicades a la producció de pebreres de la varietat tap de cortí destinats a l'elaboració de Pebre Bord de Mallorca, inscrits en aquest cens.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Cens d'elaboradors - envasadors, constituït pels titulars d'instal·lacions per a l'elaboració i l'envasament de Pebre Bord de Mallorca, inscrits en aquest cens.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En els terminis que es preveuen en el calendari electoral,i d'acord amb la disposició &amp;nbsp;transitòria primera, com les tasques de gestió han estat assumides transitòriament per la Direcció General de Polítiques per a la Sobirania Alimentària, aquesta&amp;nbsp; presentarà els censos actualitzats, davant la Junta Electoral, la qual ha d'ordenar que s'exposin a la seu de la Junta Electoral. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;6. Candidatures&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Pot ser candidat a vocal del Consell Regulador qualsevol persona que, abans de la data d'entrada en vigor de la convocatòria, es trobi degudament inscrita i amb activitat en els censos definitius, en ple ús dels seus drets civils i que no hagi estat sancionada per resolució ferma amb la suspensió de la inscripció en el registre corresponent.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La sol·licitud d'inclusió com a candidat a vocal del Consell Regulador que s'ha de formalitzar en el model d'acceptació de candidatura s'ha d'acompanyar amb la documentació preceptiva que preveu l'article 16 del Decret 139/2002, pel qual es regulen els processos electorals dels consells reguladors.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Per a cada cens, s'elegiran el nombre de vocals següents:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Tres vocals en representació del sector productor, elegits pels inscrits en el Cens de productors i plantacions i d'entre aquests. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Tres vocals en representació del sector d'elaboradors-envasadors, elegits pels inscrits en el Cens d'elaboradors-envasadors i d'entre aquests&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;7. Mesa electoral&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;S'ha de constituir una mesa electoral per a la votació, ubicada a la seu de la Conselleria d'Agricultura, Pesca i Alimentació, i ha d'estar composta per un president i dos vocals, nomenats per resolució del president de la Junta Electoral en el termini que es preveu en el calendari electoral (annex II).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;8. Documentació electoral&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La documentació del procés electoral serà la següent:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Model d'acceptació de candidatura&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Model de declaració d'elegibilitat&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Model de documentació per poder exercir el vot per correu&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;9. Jornada de votació&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La jornada de votació del procés electoral s'iniciarà a les 9.00&amp;nbsp;h del dia que figura al calendari electoral (annex II), amb la constitució de la Mesa Electoral, inclosos els interventors, si n'hi ha.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En primer lloc, s'ha d'estendre l'acta de constitució de la Mesa, segons el model aprovat per la Junta Electoral i, posteriorment, començarà la votació.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El president, després de comprovar l'existència de tots els mitjans necessaris per al desenvolupament normal de la jornada de votació, ordenarà que comenci la jornada de votació, que durarà fins a les 13.00&amp;nbsp;h.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El desenvolupament de la jornada de votació s'ha d'adequar al Decret 139/2002, pel qual es regula el procés electoral per a la renovació dels membres dels consells reguladors de les denominacions de qualitat agroalimentària.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Una vegada conclosa la votació i acabat l'escrutini, els membres de la Mesa Electoral redactaran l'acta de la sessió, d'acord amb el model aprovat per la Junta Electoral, i completaran la documentació electoral, que es lliurarà a la Junta Electoral.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;10. Sessió constitutiva del Consell Regulador&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La constitució del Consell Regulador de la Denominació d'Origen Protegida Pebre Bord de Mallorca electe es durà a terme el dia que figura al calendari electoral.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En la sessió constitutiva, tal com preveu l'article 28 del Decret 139/2002, pel qual es regula el procés electoral per a la renovació dels membres dels consells reguladors de les denominacions de qualitat agroalimentària, els nous vocals electes prendran possessió.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
