    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;En data 14 de març de 2020 el Govern de l'Estat espanyol va aprovar el Reial decret 463/2020 de 14 de març (BOE núm. 67, de 14/03/2020), pel qual es va declarar la situació d'alarma a tot l'estat espanyol, amb la finalitat d'afrontar la situació d'emergència sanitària provocada per la Covid-19. El Reial decret, que inicialment tenia una vigència de 15 dies naturals, va ser prorrogat mitjançant Reials decrets 487/2020, de 10 d'abril, i 492/2020, de 24 d'abril. Una vegada finalitzada la vigència d'aquest estat d'alarma, han estat les Comunitats Autònomes les que encarregades d'anar establint, d'acord amb la situació de la pandèmia en cada zona, un seguit de mesures extraordinàries d'efecte immediat, encaminades a protegir la salut i la seguretat dels ciutadans, contenir la progressió de la malaltia i reforçar el sistema de salut pública. En data 25 d'octubre de 2020 el Govern de l'Estat espanyol va decretar una nova declaració d'estat d'alarma que es va traduir en restriccions de la mobilitat i d'horaris per tal de controlar l'expansió de la pandèmia, restriccions que han de gestionar les Comunitats Autònomes. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;Davant aquest context, les administracions públiques han prioritzat les polítiques d'impuls de l'activitat econòmica i han destinat recursos extraordinaris a garantir actuacions dirigides a fomentar la inversió pública, cercant així una reactivació immediata però també a mig i llarg termini que permeti consolidar l'activitat durant uns anys.&amp;nbsp; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;En aquest sentit, tenint en compte les noves restriccions de l'activitat econòmica derivades de l'Acord del Consell de Govern de data 11 de gener de 2021, en data &lt;/span&gt;15 de gener de 2021, en el marc del Pacte de reactivació econòmica i diversificació social signat el mes de juliol de 2020, es varen acordar noves mesures econòmiques per ajudar a pal·liar els efectes dels tancaments dels diferents sectors econòmics afectats per les mesures dràstiques adoptades per aturar l'expansió de la crisi sanitària provocada per la COVID-19. Dins d'aquestes mesures es troba la creació d'un fons obert a tots els sectors productius afectats per les restriccions, dotat amb 30 milions d'euros, finançat a parts iguals entre el Govern de les Illes Balears i els consells insulars.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;La Llei 2/2020, de 15 d'octubre, de mesures urgents i extraordinàries per a l'impuls de l'activitat econòmica i la simplificació administrativa en l'àmbit de les administracions públiques de les Illes Balears per pal·liar el efectes de la crisi ocasionada per la Covid-19, concretament en l'art. 32, modificat &lt;span style="color:black"&gt;per&lt;/span&gt; la disposició final primera del Decret llei 1/2021, de 25 de gener (BOIB núm. 11 de 26 de gener de 2021) i que preveu que “(...) els municipis i els consells insulars, i també els ens instrumentals o dependents respectius, sens perjudici de l'exercici, en qualsevol moment, de les competències esmentades i de la resta de competències que els són pròpies d'acord amb la normativa local, poden atorgar ajudes o subvencions a les persones o entitats afectades i, en general, acordar totes les accions de foment que estimin pertinents amb la finalitat de coadjuvar a la recuperació econòmica en els territoris municipals i insulars respectius.”&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;El Consell Insular d'Eivissa va aprovar, en el Consell Executiu de data 1 de febrer de 2021, un conveni amb l'Administració de la Comunitat Autònoma de les Illes Balears per concedir ajudes adreçades a pal·liar les conseqüències de les restriccions motivades per la crisi sanitària de la COVID-19 en els sectors econòmics de la restauració i altres que consta en el present expedient amb CSV núm. 13525176567727511730.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;El Consell Insular d'Eivissa va aprovar les bases de la convocatòria extraordinària d'ajudes adreçades a pal·liar les conseqüències de les restriccions motivades per la crisi sanitària de la Covid-19 en els sectors econòmics de la restauració i altres, que varen ser publicades al Butlletí Oficial de les Illes Balears (BOIB) núm. 16, de 6 de febrer de 2021, i l'extracte de la convocatòria el dia 9 de febrer de 2021, en el BOIB núm. 17. Aquestes bases varen ser publicades a la Base Nacional de Dades de Subvencions (BNDS), amb núm. referència IGAE 548016.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;La línea de subvencions està inclosa en el Pla Estratègic de Subvencions 2020-2022 (BOIB núm. 20 de data 15-02-20), amb modificació publicada en el BOIB núm. 13, de data 30 de gener de 2021. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;L'objectiu principal que es pretén assolir amb aquesta convocatòria és concedir ajudes a les persones físiques i jurídiques amb establiments oberts a l'illa d'Eivissa i que s'han vist afectats &lt;span style="color:black"&gt;per les restriccions aprovades per l'Acord del Consell de Govern de dia 11 de gener de 2021 pel qual es declarava la fase 4, per tal de mitigar els efectes econòmics de les restriccions i garantir la continuïtat de l'activitat dels sectors afectats. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;El crèdit previst per a aquesta convocatòria és de quatre milions set-cents setanta mil euros (4.770.000 €), import cofinançat pel Govern de les Illes Balears, de conformitat amb el Conveni formalitzat amb la Comunitat Autònoma el dia 1 de febrer de 2021. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;D'aquesta quantia, les bases estableixen una distribució per a cadascun dels municipis calculat d'acord amb els mateixos criteris i les xifres d'autònoms utilitzades pel Govern de les Illes Balears per fer el repartiment de la seua aportació per illes, i que és la següent:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Dins el termini establert a la convocatòria i al seu extracte, ha tengut entrada al Consell Insular d'Eivissa de forma telemàtica la sol·licitud i documentació prevista en la convocatòria per part de la persona relacionada al punt primer i segon de l'acord.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;El Decret de Presidència núm. 2020000768, de modificació del Decret de Presidència núm. 2019000471, de data 10-7-2019, d'estructura del govern del Consell Insular d'Eivissa i creació de departaments, i del Decret de Presidència núm. 2019000484, de data 16-7-2019, de determinació de les atribucions corresponents als diferents òrgans del Consell Insular d'Eivissa (BOIB núm. 153, de 5 de setembre de 2020), atribueix al Departament de Promoció Econòmica i Empresarial, i Cooperació Municipal, “l'activitat competencial pròpia del Consell Insular d'Eivissa en relació amb la matèria d'artesania; promoció de la moda; comerç i desenvolupament empresarial; industria i vigilància de marques.”&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;El Decret de Presidència núm. 2019000484, de data 16-7-2019, de determinació de les atribucions corresponents als diferents òrgans del Consell Insular d'Eivissa (BOIB núm. 98 EXT., de 17-7-2019; modificacions al BOIB núm. 175, de 31-12-2019, BOIB núm. 101, de 4-6-2020 i al BOIB núm. 153, de 5 de setembre de 2020), en el seu punt tercer, apartat e), atribueix al Consell Executiu la competència per aprovar i resoldre les convocatòries d'ajuts o subvencions d'import superior a quinze mil euros (15.000,00 €), fet pel qual correspon a aquest òrgan l'aprovació d'aquest convocatòria per import de quatre milions set-cents setanta mil euros (4.770.000,00 €).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;No obstant l'anterior, en data 3 de febrer de 2021, de conformitat amb la base 8 de la convocatòria, el Consell Executiu va delegar en la consellera executiva del Departament de Promoció Econòmica i Empresarial, i Cooperació Municipal la concessió i abonament de les ajudes&lt;strong&gt; &lt;/strong&gt;adreçades a pal·liar les conseqüències de les restriccions motivades per la crisi sanitària de la COVID-19 en els sectors econòmics de la restauració i altres.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Vist l'informe proposta de la cap de Secció d'Indústria de data de 5 de juliol de 2021, de resolució i rectificació d'errors en relació a la convocatòria d'ajudes adreçades a pal·liar les conseqüències de les restriccions motivades per la crisi sanitària de la COVID-19 en els sectors econòmics de la restauració i altres, cofinançades pel Govern de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Que han de complir les obligacions establertes al punt 9 de les bases de la convocatòria d'ajudes adreçades a pal·liar les conseqüències de les restriccions motivades per la crisi sanitària de la COVID-19 en els sectors econòmics de la restauració i altres.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Que han de presentar al Departament de Promoció Econòmica i Empresarial, i Cooperació Municipal del Consell Insular d'Eivissa el document Annex III que es troba adjunt a les bases de la convocatòria, en el cas de l'obtenció d'altres subvencions per a la mateixa finalitat en el termini de tres dies hàbils des de l'obtenció de la subvenció concurrent.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Que els incompliments i falsedat de les condicions requerides per obtenir les ajudes són causes de reintegrament previstes en l'article 44 del Decret legislatiu 2/2005, de 28 de desembre, mitjançant el qual s'aprova el text refós de la Llei de subvencions. &lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
