&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;PROPOSTA D'ACORD:&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;PRIMER.- &lt;/strong&gt;APROVAR la convocatòria d'ajudes per al foment de la moda Adlib, per a l'any 2021, les seues bases i el seu extracte, que consten a l'expedient de 2021 núm13544D amb CSV núm13525177106717661721, de conformitat amb allò establert als articles 20.8 de la Llei 38/2003, de 17 de novembre, general de subvencions i l'article 4.1 de la Resolució de 10 de desembre de 2015, de la Intervenció General de l'Administració de l'Estat, per la qual es regula el procés de registre i publicació de convocatòries de subvencions i ajudes en el Sistema Nacional de Publicitat de Subvencions (BOE 299, de 15 de desembre de 2015).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;SEGON.- &lt;/strong&gt;APROVAR la dotació econòmica de la convocatòria per un import total màxim de CENT MIL EUROS (100.000,00 €), que aniran a càrrec de l'aplicació pressupostària 4220.77000 del vigent pressupost.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;TERCER.-&lt;/strong&gt; DELEGAR en la consellera executiva del Departament de Promoció Econòmica i Empresarial, i Cooperació Municipal, la concessió, l'abonament i la revocació de les ajudes objecte d'aquesta convocatòria, del qual en donarà compte al Consell Executiu&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;QUART.- &lt;/strong&gt;DESIGNAR com a membres de la comissió avaluadora prevista a la base desena de la convocatòria, les següents persones: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;1Objecte i finalitat de les ajudes&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;L'objecte d'aquestes ajudes és incrementar la competitivitat de la indústria de la moda Adlib a l'illa d'Eivissa a través la millora i modernització dels tallers i canals de comercialització&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Tot això amb la finalitat de millorar la infraestructura física de la indústria de la moda i la infraestructura digital que dona visibilitat a la moda Adlib i permet la seua comercialització i difusió &lt;span style="color:#000000"&gt;online&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Aquestes ajudes estan previstes al Pla Estratègic de Subvencions del Consell Insular d'Eivissa per a l'any 2020-2022, publicat al BOIB núm13, de 30 de gener de 2021.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;2. Règim jurídic&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Aquesta convocatòria es regirà per les disposicions contingudes a les presents bases, i per la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques (en endavant LPAC), per la Llei estatal 38/2003, de 17 de novembre, general de subvencions (en endavant LGS), i el seu Reglament, aprovat pel Reial decret 887/2006, de 21 de juliol, pel Decret legislatiu 2/2005, de 28 de desembre, pel qual s'aprova el text refós de la Llei de subvencions (TRLS en endavant), i la resta de normativa aplicable&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;En la realització de les activitats objecte d'aquesta convocatòria s'han d'observar les prescripcions contingudes a la Llei orgànica 3/2018, de 5 de desembre, de protecció de dades i garantia dels drets digitals, al Reglament (UE) 2016/679 del Parlament i del Consell d'Europa, de 27 d'abril de 2016, relatiu a la protecció de les persones físiques pel que fa al tractament de dades personals i a la lliure circulació d'aquestes dades i pel qual es deroga la Directiva 95/46/CE (Reglament general de protecció de dades) (DOUE 4.5.2016), i a la resta de legislació vigent en matèria de protecció de dades personals, que hi sigui d'aplicació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;3. Dotació econòmica&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;El pressupost total per a aquesta convocatòria de l'any 2021, és de CENT-MIL EUROS (100.000,00 €) del vigent pressupost del Consell Insular d'Eivissa, que aniran a càrrec de l'aplicació pressupostària&lt;span style="color:#ff0000"&gt; &lt;/span&gt;4220.77000.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;4. Despeses subvencionables &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Seran objecte de subvenció les actuacions i millores dutes a terme entre el dia 16 de setembre de 2018 i el 30 de juliol de 2021 (ambdós inclosos)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Són despeses subvencionables les derivades directament del desenvolupament de la pròpia activitat de la moda següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;- Despeses per adquirir maquinària, utensilis i altres tipus de materials no fungibles per elaborar i confeccionar els dissenys.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;- Despeses per adquirir instruments de suport per a l'exposició dels dissenys.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;- Despeses per crear pàgines webs del/de la dissenyador/a o l'empresa, així com per renovar les pàgines web (entès com la modernització de la pàgina completa, la inclusió de noves seccions, però, en cap cas, com l'actualització o traducció de continguts).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;- Despeses d'adquisició i/o subministrament de material promocional inventariable que millorin la imatge corporativa de la marca: panells amb imatges, roll-ups..No es considerarà material inventariable catàlegs promocionals, targetes de presentació de marca, pòsters i altre tipus de material d'un sol ús&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;- Despeses per instal·lar infraestructura de comercialització online: passarel·les de pagament, adaptació del software, adequació de pàgines web, etc&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Aquest material haurà de mantenir-se un mínim de 2 anys, i no podrà ser substituït en aquest període sense l'autorització prèvia del Consell Insular d'Eivissa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;En cap cas, no es consideraran despeses subvencionables:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;- Les despeses que no compleixin l'objecte de la convocatòria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;- Les despeses subvencionables, però l'import de les quals, en la seua adquisició, sigui superior al valor de mercat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;- Els interessos deutors dels comptes bancaris, els interessos, els recàrrecs i les sancions administratives i penals, i les despeses de procediments judicials.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;- Els impostos indirectes quan siguin susceptibles de recuperació o compensació, com és el cas de l'IVA.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;5. Persones beneficiàriesRequisits i obligacions&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;5.1 Requisits&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Podran sol·licitar les ajudes els dissenyadors i les dissenyadores de moda, complements i accessoris de moda Adlib que compleixin els requisits següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;- Haver participat en les campanyes de promoció de la moda Adlib promogudes pel Consell Insular d'Eivissa, durant els anys 2019, 2020 i 2021.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;- Estar donat d'alta en el Cens d'empresaris, professionals i retenidors gestionat per l'AEAT (a Hisenda, com a &lt;/span&gt;persones físiques i jurídiques privades, agrupacions de persones físiques o jurídiques privades, o comunitats de béns o qualsevol altre tipus d'unitat econòmica o patrimoni separat), &lt;span style="color:#000000"&gt;en l'epígraf corresponent i, en tot cas, en el moment de la sol·licitud de l'ajuda i fins a la data de justificació de l'activitat objecte de subvenció.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;- Tenir taller de confecció propi o contractat a l'illa d'Eivissa, especificant adreça i dades de contacte, horari, nombre de treballadors/ores i breu descripció de l'inventariEl taller ha d'estar inscrit o ha d'haver sol·licitat la inscripció al Registre Industrial del Govern de les Illes BalearsEl Consell Insular d'Eivissa podrà comprovar presencialment el compliment dels requisits esmentats abans.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;- Estar d'alta en la Seguretat Social, en tot cas en el moment de la sol·licitud de l'ajuda i fins a la data de justificació de l'activitat objecte de subvenció.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;- Estar al corrent en el compliment de les obligacions econòmiques amb el Consell Insular d'Eivissa i de les altres obligacions tributàries amb Hisenda (AEAT i ATIB) i amb la Seguretat Social imposades per la normativa vigent.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;- No incórrer en cap de les prohibicions per ser-ne beneficiari establertes a l'article 13 de la Llei 38/2003, de 17 de novembre, general de subvencions (en endavant LGS), i a l'article 10 de text refós de la Llei de subvencions (de les Illes Balears), aprovat pel Decret legislatiu 2/2005, de 28 de desembre (en endavant, TRLS).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;5.2 Obligacions de les persones beneficiàries&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;A més del que es disposa en l'article 14 de la LGS, així com l'article 11 del TRLS, són obligacions de les persones beneficiàries:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;- Justificar degudament la realització de l'activitat, com també el compliment dels requisits i de les condicions que determinin la concessió de la subvenció&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;- Sotmetre's a les actuacions de comprovació, seguiment i inspecció que pugui efectuar el Consell Insular d'Eivissa i aportar tota la informació i la documentació que li sigui requerida en l'exercici d'aquestes actuacionsEn aquest sentit, el Consell Insular d'Eivissa podrà inspeccionar les activitats subvencionades i el compliment dels requisits establerts (incloent realitzar visites als tallers), sense perjudici de les competències que puguin correspondre a altres organismes i institucions.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;- Comunicar al Consell Insular d'Eivissa la sol·licitud o l'obtenció d'altres subvencions per a la mateixa finalitat procedents de qualsevol administració o entitat pública o privada, nacional o internacional.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Aquesta comunicació ha de fer-se en el termini de deu dies hàbils a comptar a partir de la sol·licitud o l'obtenció de la subvenció concurrent.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;- Conservar els documents justificatius de l'aplicació dels fons percebuts, amb inclusió dels documents electrònics, mentre puguin ser objecte d'actuacions de comprovació i control.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;- Reintegrar els fons percebuts en els supòsits previstos legalment.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;- Adoptar mesures de difusió relatives al caràcter públic del finançament de l'activitat objecte de subvencióA aquest efecte, s'ha d'incloure de forma visible el suport del Consell Insular d'Eivissa o es donarà difusió de l'ajuda, mitjançant mencions, a les pàgines webs, xarxes socials, o altres mitjans de comunicació ordinaris (revistes, comunicats, etc.) de què disposi el/la beneficiari/ària.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#00000a"&gt;- Quan es tracti d'adquisició de béns, tot d'acord amb l'article 31.4 de la Llei 38/2003, general de subvencions, i l'article 40.4 del TRLS, aquests hauran de ser destinats per un període mínim de dos anys a la finalitat per la qual fou concedida la subvencióEs considerarà que en tot cas s'incompleix aquesta obligació si aquests béns son alienatsEn cas d'incompliment, les persones beneficiàries hauran de reintegrar la subvenció obtinguda per a la seva adquisició amb els corresponents interessos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Qualsevol alteració de les condicions tengudes en compte per concedir l'ajut, pot donar lloc a la modificació de la resolució de concessió.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;6. Import de les ajudes&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;6.1El pressupost total per a aquesta convocatòria, l'any 2021, és de CENT-MIL EUROS (100.000,00 €) del vigent pressupost del Consell Insular d'Eivissa, que aniran a càrrec de l'aplicació pressupostària&lt;span style="color:#ff0000"&gt; &lt;/span&gt;4220.77000.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Les ajudes consistiran en subvencionar un màxim del 75% de la despesa justificada de les actuacions subvencionables d'acord amb l'apartat quart.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Els beneficiaris no podran rebre cap ajuda que sigui superior al cost de l'actuació subvencionada&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;6.2 Distribució de les ajudes en cas que la quantia de la convocatòria fos insuficient: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Si la quantitat màxima prevista a aquesta convocatòria (N) no resultés suficient per fer front als imports sol·licitats pels beneficiaris, aquesta quantia (N) es prorratejarà proporcionalment entre les despeses sol·licitades i degudament justificades, entre tots els beneficiaris de la següent manera:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Les subvencions s'atorgaran a cada sol·licitant seguint un criteri proporcional en funció de la suma total (S) dels imports resultants de l'aplicació del valor dels mòduls entre totes les sol·licituds que es presentin i compleixin els requisits d'aquestes bases.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Una vegada obtingut l'import total de la suma realitzada en cada línia, s'aplicarà el criteri proporcional d'acord a la següent relació:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;K= A/ S&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;On:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;(A) és &lt;em&gt;Quantia total de les ajudes&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;(S) és la &lt;span style="color:#000000"&gt;&lt;em&gt;Suma de totes les despeses justificades subvencionables de totes les sol·licituds&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;(K) és una constant de proporcionalitat a obtenir en funció del import total sol·licitat i la quantia total disponible..&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;La quantia a atorgar per cada sol·licitud serà la següent:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;A&lt;/strong&gt;&lt;sub&gt;&lt;strong&gt;i&lt;/strong&gt;&lt;/sub&gt;&lt;em&gt;&lt;strong&gt; Quantia a atorgar&lt;/strong&gt;&lt;/em&gt;&lt;strong&gt; = K * S&lt;/strong&gt;&lt;sub&gt;&lt;strong&gt;i &lt;/strong&gt;&lt;/sub&gt;&lt;em&gt;&lt;strong&gt;sol·licitud&lt;/strong&gt; &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Les ajudes s'atorgaran amb informe previ del Departament instructor de les ajudes i sempre amb el límit de CENT-MIL EUROS (100.000,00 €) per al total de la convocatòria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;En cap cas l'ajuda efectivament pagada no podrà ser superior a la quantia degudament justificada; en tal supòsit la quantitat de l'ajuda es reduirà en la mateixa proporció.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;7. Procediment de concessió i compatibilitat&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;7.1 Procediment de concessió dels ajuts&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;D'acord amb l'article 30.7 de la Llei 38/2003 i l'article 39.7 del Decret legislatiu 2/2005, de 28 de desembre, pel qual s'aprova el text refós de la Llei de subvencions, el procediment de concessió d'aquestes ajudes es tramitarà en règim de concurrència competitiva, i d'acord amb els principis de publicitat, d'objectivitat, de transparència, d'igualtat i de no-discriminació&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Els ajuts no generen cap dret a l'obtenció d'altres ajuts en exercicis posteriors i no es poden al·legar com a precedent.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;7.2 Compatibilitat&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Les subvencions que s'atorguin d'acord amb aquesta convocatòria són compatibles amb les que puguin atorgar altres entitats públiques o privades.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;L'import de les subvencions en cap cas no pot ser d'una quantia tal que, aïlladament o en concurrència amb altres subvencions, ajuts, ingressos o recursos, superi el cost de l'activitat subvencionada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;La persona beneficiària ha de comunicar al Consell Insular d'Eivissa (vegeu Annex 1) l'obtenció d'altres subvencions, ajuts, ingressos o recursos per a l'activitat subvencionada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;8. Sol·licitudsTermini i documentació a presentar&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;8.1Forma i lloc de presentació de la sol·licitud&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Les sol·licituds de subvenció es formalitzaran mitjançant instància, segons el model normalitzat que figura com a Annex 1 d'aquesta convocatòria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Amb les sol·licituds de subvenció s'haurà d'aportar la documentació que es requereix en aquest punt de les basesEn moment de la sol·licitud, s'aportaran també els documents requerits per justificar l'activitat (base 9)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Les sol·licituds es dirigiran a la Presidència del Consell Insular d'Eivissa i es presentaran via telemàtica mitjançant la Seu electrònica del Consell Insular d'Eivissa (&lt;span style="color:#000080"&gt;https://seu.conselldeivissa.es&lt;/span&gt;) mitjançant el tràmit &lt;em&gt;Sol·licitud de subvencions per al foment de la indústria de la moda Adlib&lt;/em&gt;, de conformitat amb el previst a l'article 14 de la Llei 39/2015, d'1 d'octubre, de procediment administratiu comú de les administracions públiques (en endavant Llei 39/2015), publicada al BOE de 2 d'octubre de 2015.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;La informació al respecte de la present convocatòria, així com l'obtenció dels models annexos i l'enllaç al tràmit per a la sol·licitud de l'ajuda, també es podrà trobar a la pàgina web del Consell Insular d'Eivissa ajudes.conselldeivissa.es.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;No s'admetrà cap sol·licitud ni cap documentació que es presenti únicament a través de correu electrònic, en cap moment de la tramitació de l'expedient.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;El fet de presentar sol·licitud d'aquestes ajudes implica l'acceptació d'aquestes bases.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;8.2. Termini de presentació de sol·licituds&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;El termini per presentar les sol·licituds començarà el dia següent al de la publicació de l'extracte de la convocatòria al Butlletí Oficial de les Illes Balears (BOIB) i finalitzarà el 30 de juliol de 2021.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;8.3. Documentació a presentar amb la sol·licitud:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Les sol·licituds es presentaran amb la següent documentació:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;- Acreditació de la representació, si la sol·licitud es fa en nom d'una altra persona.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;- Imprès de sol·licitud de la subvenció (annex 1) degudament emplenat on s'inclou:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul style="margin-left:40px"&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Declaració responsable signada per la persona sol·licitant de no estar sotmesa a cap de les circumstàncies que determinen la impossibilitat d'obtenir la condició de beneficiari/ària de les subvencions públiques recollides en l'article 13 de la Llei 38/2003, de 17 de novembre, general de subvencions, i en l'article 10 del text refós de la Llei de subvencions (de les Illes Balears), aprovat pel Decret legislatiu 2/2005, de 28 de desembre, així com d'estar al corrent de les obligacions tributàries (amb AEAT i ATIB) i de la Seguretat Social davant l'Administració de l'Estat, així com d'estar al corrent de les obligacions econòmiques davant el Consell Insular d'Eivissa, i autorització a l'òrgan instructor per comprovar aquestes dades.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Declaració responsable en què es facin constar totes les subvencions o els ajuts obtenguts o sol·licitats per a la mateixa finalitat de qualsevol ens públic o privat, si escau, o una declaració expressa de no haver-ne sol·licitat cap.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;- Si el/la sol·licitant és persona jurídica, original o còpia acarada de l'escriptura de constitució o modificació, estatuts o reglament de funcionament inscrits en el registre corresponent. En el cas que així ho determinin els estatuts, s'ha d'adjuntar certificat de nomenament del representant legal habilitat per realitzar la sol·licitud així com acord adoptat per l'òrgan corresponent de l'entitat per sol·licitar l'ajuda.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;- Si el/la sol·licitant és una agrupació de persones físiques o jurídiques, comunitats de béns o altres agrupacions econòmiques sense personalitat jurídica pròpia, hauran de signar la sol·licitud totes les persones integrants i adjuntar-hi els seus DNI (o documentació acreditativa de la personalitat jurídica de cada un dels integrants); així mateix han de designar una persona com a representant únic a efectes de notificacions.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;En compliment de l'article 11.3 de la Llei 38/2003, de 17 de novembre, general de subvencions, quan es tracti de persones físiques o jurídiques sense personalitat, s'hauran de fer constar expressament a la sol·licitud els compromisos d'execució de cada membre fent referència a quina part de l'activitat ha executat cadascun d'ells, així com l'import de subvenció que sol·licita i que s'ha abonar a cada membre de l'agrupació, que tendran igualment la consideració de beneficiaris. En qualsevol cas, s'haurà de nomenar un representant o apoderat únic de l'agrupació amb poders per complir les obligacions que, com a beneficiària, correspon a l'agrupació. No es podrà dissoldre l'agrupació fins que hagi transcorregut el termini de prescripció previst als articles 39 i 65 de la citada llei.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;- Acreditació d'estar donat d'alta &lt;span style="color:#000000"&gt;a Hisenda, a l'epígraf&lt;/span&gt; corresponent.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;- Acreditació de l'alta a la Seguretat Social o, si és el cas, rebuts de pagament a la Seguretat Social per demostrar que ha estat d'alta en el moment de la sol·licitud de l'ajuda i fins a la data de justificació de l'activitat objecte de subvenció.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;- Declaració responsable en què el dissenyador/la dissenyadora informi si disposa de taller de confecció propi o aliè a l'illa d'Eivissa, així com adreça, dades de contacte, nombre de treballadors. Així mateix, s'haurà d'indicar el número de inscripció o de la sol·licitud d'inscripció al Registre Industrial del Govern de les Illes Balears, segons model que figura com a Annex 2.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;- Documentació de justificació de l'ajuda: junt amb la sol·licitud, s'aportaran també &lt;span style="color:#000000"&gt;els documents requerits per a la justificació, d'acord amb la base 9 d'aquesta convocatòria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;- L'imprès del Consell Insular de sol·licitud de transferència bancària, expedit necessàriament a nom del/de la sol·licitant de l'ajuda (persona física, jurídica o membre de la CB –persona física– que cobrarà l'ajuda) i segellat per l'entitat bancària. Podreu trobar aquest document a la Seu electrònica del Consell Insular d'Eivissa, o en aquesta URL:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Aquest imprès no caldrà presentar-lo en cas que s'hagi presentat anteriorment al Consell Insular d'Eivissa i no s'hagi produït cap canvi en les dades aportades en el seu moment.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;- Qualsevol altra documentació que la persona sol·licitant consideri convenient.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Les persones sol·licitants que ja hagin presentat en el Consell Insular d'Eivissa qualsevol d'aquestos documents només hauran d'aportar la documentació que sigui necessari actualitzar o renovar,&lt;span style="color:#000000"&gt; sempre que no hagin transcorregut més de cinc anys des que la documentació fou presentada i assenyalin la data i l'òrgan davant el qual es va presentar.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;El Consell Insular d'Eivissa pot requerir, a més, tota la documentació complementària que consideri necessària per avaluar correctament la sol·licitud.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;9. Justificació de les ajudes &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Per justificar degudament les despeses subvencionables s'haurà d'aportar la següent documentació: una memòria justificativa, una liquidació d'ingressos i despeses, factures i comprovants de pagament, presentats en la forma que s'estableix a continuació:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;9.1. Memòria justificativa del compliment de les condicions establertes per a la concessió de la subvenció: explicació del material adquirit, de la pàgina web creada o de l'acció duta a terme, i imatges del dit material i/o la millora realitzada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;9.2. Liquidació d'ingressos i despeses: document, degudament signat, amb la liquidació detallada d'ingressos i despeses de l'actuació desenvolupada, sempre dins del període subvencionable establert al punt 4 de les presents bases. Aquest document, d'acord amb el model de l'annex 3, haurà de tenir la informació següent: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;En l'apartat d'ingressos: s'hi informarà, si és el cas, d'altres ajudes rebudes per a la mateixa activitat, detallant:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;/ul&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;En l'apartat de despeses: relació o llistat de factures o els documents probatoris que la despesa s'ha efectuat i pagat degudament i els justificants presentats. Per a cada factura o document probatori s'ha d'especificar:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Concepte: relacionat directament amb l'actuació per la qual es demana subvenció &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Import: desglossant IVA si n'és el cas&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Data de pagament de la factura &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;9.3. Factures i comprovants de pagament de les despeses objecte de subvenció:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;- Totes les factures o els documents probatoris del pagament de la despesa que, en el seu cas, s'aportin per a la justificació de la despesa subvencionable hauran d'estar emesos en una data dins del període subvencionable, entre el &lt;/span&gt;dia 16 de setembre de 2018 i el 30 de juliol de 2021 (ambdós inclosos).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;- Els documents probatoris o les factures que es presentin per justificar la subvenció hauran d'estar emesos en una de les dues llengües oficials de la Comunitat Autònoma de les Illes Balears o aportar traducció jurada del document a alguna d'aquestes llengües oficials.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;- Per a aquelles despeses que estiguin subjectes a altres subvencions i per qualsevol motiu que ho aconselli, els justificants originals presentats es marcaran amb una estampilla indicant-hi la subvenció per a la justificació de la qual ha estat presentada, i si l'import del justificant s'imputa totalment o parcialment a la subvenció. En aquest darrer cas, s'indicarà a més la quantia exacta que resulti afectada per la subvenció. Després, s'acceptarà la còpia acarada d'aquesta factura estampillada, subjecta a altres subvencions.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;- S'haurà d'acreditar el pagament de les factures/els documents probatoris de la despesa efectuada en alguna de les següents formes, depenent del mitjà de pagament:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;a) En el cas que el pagament s'hagi realitzat per transferència bancària, s'acompanyarà documentació acreditativa de la transferència bancària. La persona beneficiària ha de ser titular del compte bancari des del qual s'hagi efectuat el pagament i així ho haurà d'acreditar.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;b) En el cas que el pagament s'hagi realitzat mitjançant targeta electrònica, s'haurà d'aportar la liquidació dels pagaments de la targeta electrònica. La liquidació ha d'estar efectuada en un número de compte bancari del qual la persona beneficiària sigui titular i així ho haurà d'acreditar.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;c) En el cas que el pagament s'hagi realitzat en efectiu dins dels límits permesos per&lt;span style="color:#000000"&gt; la legislació vigent en matèria de lluita contra el frau&lt;/span&gt;, s'haurà d'acreditar el seu pagament al comptat bé fent constar a la factura la signatura, la identificació (nom i DNI) de la persona que ha rebut l'import, la data de recepció de l'import i el segell del proveïdor, o bé aportant un document de rebut de l'import, en què constin el concepte, la quantia abonada, la data de pagament, la identificació (nom i DNI) de la persona que ha rebut l'import i el segell del proveïdor.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;10. Comissió d'avaluació&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;La comissió d'avaluació és l'òrgan col·legiat al qual corresponen les funcions següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;- Qualificar les sol·licituds, d'acord amb les bases establertes en aquesta convocatòria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;- Emetre una acta amb un informe que ha de servir de base per elaborar la proposta de resolució.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;La comissió d'avaluació estarà integrada per un/a president/a, un/a secretari/ària i un nombre de vocals no inferior a tres, designats en la resolució de la convocatòria d'aquestes ajudes, d'acord amb criteris de competència professional i d'experiència.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;11. Òrgans competents per a l'ordenació, la instrucció i la resolució&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;11.1 El Departament Promoció Econòmica i Empresarial i Cooperació Municipal és el competent per instruir el procediment d'aquesta convocatòria, de conformitat amb allò establert a l'article tercer, apartat 5.b), del Decret de Presidència núm. 2020000768, de modificació del Decret de Presidència núm. 2019000471, de data 10-7-2019, d'estructura del govern del Consell Insular d'Eivissa i creació de departaments, i del Decret de Presidència núm. 2019000484, de data 16-7-2019, de determinació de les atribucions corresponents als diferents òrgans del Consell Insular d'Eivissa (BOIB núm. 153, de 5 de setembre de 2020). &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;11.2 Dins d'aquest Departament correspon a la consellera executiva l'ordenació del procediment, en virtut de l'article primer, apartat i, del Decret de Presidència núm. 484/2019, de data 16 de juliol de 2019, de determinació de les atribucions corresponents als diferents òrgans del Consell Insular d'Eivissa(BOIB núm. 98 Ext., de 17-7-2020; modificacions al BOIB núm. 175, de 31-12-2019, i al BOIB núm. 101, de 4-6-2020 ).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;11.3. Pel que fa a la competència per aprovar aquestes bases i convocatòria, de conformitat amb l'establert a l'article tercer, apartat e, del Decret de Presidència núm. 484/2019, de data 16 de juliol, de determinació de les atribucions corresponents als diferents òrgans del Consell Insular d'Eivissa, modificat pel Decret de Presidència núm. 768 de 2020 (BOIB 153 de 5 de setembre de 2020), correspon al Consell Executiu “Aprovar i resoldre les convocatòries d'ajuts o subvencions a particulars o entitats públiques o privades d'import superior a quinze mil euros (15.000 €).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;11.4 Aquestes ajudes es concediran i es pagaran, per delegació del Consell Executiu, mitjançant resolució de la consellera executiva del Departament de Promoció Econòmica i Empresarial, i Cooperació Municipal, de la qual es donarà compte al Consell Executiu d'aquest Consell d'Eivissa en la propera sessió que se'n celebri.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;12. Instrucció. Esmena i millora de la sol·licitud &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;El Departament de Promoció Econòmica i Empresarial, i Cooperació Municipal, del Consell Insular d'Eivissa és el competent per instruir el procediment de tramitació de les sol·licituds.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Després de valorar les sol·licituds, es requerirà a les persones interessades, si la sol·licitud no reuneix els requisits establerts en aquestes bases, que l'esmenin, d'acord amb el que disposa l'article 68.1 de la LPAC. Les persones interessades podran esmenar la seua sol·licitud en el termini de deu dies hàbils, comptadors des del dia després d'haver rebut la notificació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Si en el termini de deu dies hàbils l'interessat/da no fa la rectificació reclamada o no presenta la complementació requerida, el Consell Insular d'Eivissa, després d'haver pres la resolució pertinent, considerarà que l'entitat interessada desisteix de la seua petició. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;L'òrgan instructor podrà requerir, en qualsevol moment de la tramitació de l'expedient, els documents complementaris que es considerin necessaris, a l'efecte de garantir la inversió correcta dels recursos pressupostaris destinats a les ajudes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Les notificacions per les quals es requereixi l'esmena de la documentació aportada es realitzaran mitjançant la publicació corresponent a la seu electrònica del Consell Insular d'Eivissa. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;13. Proposta de resolució provisional i al·legacions&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Amb fonament en l'informe de la comissió d'avaluació i de conformitat amb l'article 24.4 de la Llei 38/2003, de 17 de novembre, general de subvencions, i l'article 16 del TRLS, l'òrgan instructor formularà la proposta de resolució provisional, degudament motivada, que expressarà la relació de persones beneficiàries per a les quals es proposa la concessió de l'ajuda i la seua quantia; igualment, si és el cas, en les sol·licituds excloses o per a les quals es proposa la desestimació/denegació, s'indicarà la causa d'exclusió o desestimació/denegació, i s'obrirà un termini de deu dies hàbils per presentar-hi al·legacions, comptador a partir del dia següent de la seva notificació, que es realitzarà mitjançant la publicació corresponent a la seu electrònica del Consell Insular d'Eivissa. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Una vegada resoltes les al·legacions, si n'hi ha, es formularà la proposta de resolució definitiva i la posterior resolució de concessió de les subvencions, aprovada per l'òrgan competent.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;div style="page-break-after:always"&gt;&lt;span style="display:none"&gt;&amp;nbsp;&lt;/span&gt;&lt;/div&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;14. Resolució i notificació&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;El procediment de concessió d'aquests ajuts és el de concurrència competitiva. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;La resolució de concessió determinarà la quantia concedida i incorporarà, si escau, les condicions, obligacions i determinacions accessòries al fet que hagi de subjectar-se el beneficiari.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Els expedients es resoldran en un termini màxim de SIS MESOS a comptar des de la finalització del termini de presentació de les sol·licituds a què es refereix cada línia de la convocatòria. Transcorregut aquest termini sense que s'hagi dictat resolució expressa, la sol·licitud s'ha d'entendre desestimada. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;L'òrgan instructor notificarà la resolució a les persones interessades, que tendran un termini de deu dies des de la seva recepció, per presentar al·legacions o l'acceptació de l'ajuda. Tanmateix, l'acceptació s'entendrà produïda automàticament si en el referit termini no es fa constar el contrari. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Les notificacions de la resolució de concessió es realitzaran mitjançant la publicació corresponent a la seu electrònica del Consell Insular d'Eivissa. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;15. Pagament de les subvencions&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;L'import de l'ajuda que atorgui el Consell Insular d'Eivissa, es farà efectiva una sola vegada mitjançant transferència bancària, després que es dicti la resolució definitiva de concessió, es notifiqui i hagi passat el termini d'acceptació de la mateixa sense cap al·legació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Per a efectuar el pagament els beneficiaris han de trobar-se al corrent de les obligacions tributàries (AEAT i ATIB) i amb la Seguretat Social, així com de les obligacions econòmiques amb el Consell Insular d'Eivissa. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Tota alteració de les condicions que s'han tengut en compte per concedir la subvenció i, en tot cas, l'obtenció concurrent de subvencions o ajudes atorgades per altres administracions o ens, públics o privats, nacionals o internacionals, pot donar lloc a la modificació de la resolució de la concessió.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Per al pagament de la subvenció es podrà sol·licitar qualsevol altra documentació o informes tècnics que els serveis del Consell Insular d'Eivissa considerin adients.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;16. Revocació i reintegrament&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;16.1. L'incompliment de l'obligació de justificar la finalitat de l'ajuda econòmica rebuda en la forma i els terminis establerts suposarà, a més de la revocació, la impossibilitat de participar en pròximes convocatòries d'ajudes del Consell Insular d'Eivissa mentre no es faci la devolució de l'import reclamat. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;16.2. Les ajudes concedides es podran revocar, per delegació del Consell Executiu, mitjançant resolució de la consellera executiva del Departament de Promoció Econòmica i Empresarial, i Cooperació Municipal. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;16.3. Si durant la instrucció de l'expedient o en el transcurs dels 4 anys posteriors a la concessió de les ajudes s'observen incompliments parcials o totals de les activitats objecte de les ajudes aquestes poden ser sotmeses a reintegrament,&lt;em&gt; &lt;/em&gt;així com l'exigència de l'interès de demora des de la data del pagament de la subvenció fins que s'acordi la procedència del reintegrament d'aquesta. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;En aquest sentit, de conformitat amb l'article 17.3.n de la Llei general de subvencions, en relació amb l'article 37.2 de la mateixa llei, i els articles 13.n i 44 del TRLS, s'estableixen el següents criteris de graduació del possible incompliment material de l'activitat objecte d'aquesta subvenció, i sempre que els beneficiaris acreditin una actuació inequívoca tendent a la satisfacció dels seus compromisos: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;En particular procedirà el reintegrament total de l'ajuda en el supòsit de falsedat de les declaracions responsables presentades, així com en cas d'alienació de béns adquirits que hagin comptat amb subvenció d'aquesta convocatòria. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;16.4. L'òrgan instructor aplicarà aquests criteris per determinar, si s'escau, l'import a reintegrar per part de l'entitat o persona beneficiària. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;16.5. D'acord amb el que disposa l'article 43 del Decret legislatiu 2/2005, de 28 de desembre, pel qual s'aprova el text refós de la Llei de subvencions, s'ha de revocar la subvenció quan, posteriorment a la resolució de concessió vàlida i ajustada a dret, el beneficiari incompleix totalment o parcialment les obligacions o els compromisos contrets als quals està condicionada l'eficàcia de l'acte de concessió de la subvenció. En tal cas, quedarà sense efecte l'acte de concessió, totalment o parcialment, i es reintegraran les quantitats percebudes indegudament a més de l' interès de demora corresponent. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;16.6. El reintegrament es realitzarà pel procediment establert al Títol II de la Llei general de subvencions, en el qual s'ha de garantir l'audiència a les entitats interessades. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;16.7. Les quantitats reintegrables tenen la consideració d'ingressos de dret públic i poden ser exigides per la via de constrenyiment.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;17. Règim d'infraccions i sancions&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;El règim d'infraccions i sancions administratives aplicables serà l'establert en el títol IV de la LGS, i en el títol V del text refós de la Llei de subvencions, aprovat pel Decret legislatiu 2/2005, de 28 de desembre (de les Illes Balears). Tot això sense perjudici de les responsabilitats penals o civils en què es pugui incórrer.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;18. Règim de Recursos &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;18.1. L'acord del Consell Executiu que aprova les bases reguladores d'aquestes ajudes no exhaureix la via administrativa. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;18.2. Les resolucions de la consellera executiva del Departament de Promoció Econòmica i Empresarial, i Cooperació Municipal, dictades per delegació, i que s'han de considerar dictades per l'òrgan delegant (en aquest cas el Consell Executiu), no exhaureixen la via administrativa. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;18.3. Contra l'acord del Consell Executiu d'aprovació de les bases reguladores de les ajudes i les resolucions del consellera executiva del Departament de Promoció Econòmica i Empresarial, i Cooperació Municipal, dictades per delegació del Consell Executiu, es podrà interposar davant la Comissió de Govern el recurs d'alçada previst als articles 112.1, 121 i 122 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques, en el termini d'un mes des de l'endemà de la seua notificació, tot això en virtut del que disposen els articles 22.2 de la Llei 8/2000, de 27 d'octubre, de consells insulars i l'article 147.1 del Reglament orgànic del Consell Insular d'Eivissa (publicat al BOIB núm. 136, de 18-09-10; correcció al BOIB núm. 148, de 14-10-10; modificació al BOIB núm. 48, de 16-04-16). &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;El recurs haurà de resoldre's en el termini de tres mesos, transcorreguts els quals sense que s'hagi dictat resolució expressa s'entendrà desestimat i quedarà oberta la via contenciosa administrativa. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;19. Publicitat &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Les bases de la present convocatòria s'enviaran a publicar al &lt;em&gt;Butlletí Oficial de les Illes Balears&lt;/em&gt; (BOIB) i, una vegada publicades, en compliment del que disposen els articles 17.3, 18 i 20.8 de la LGS, i l'article 34 del TRLS, s'enviarà la convocatòria i un extracte d'aquesta a la &lt;em&gt;Base de Dades Nacional de Subvencions&lt;/em&gt; (BDNS), que donarà trasllat de l'extracte al BOIB. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;- &lt;/strong&gt;Que em trob al corrent de les obligacions davant l'Administració tributària (estatal i autonòmica), davant la Seguretat Social i davant la hisenda del Consell Insular d'Eivissa, segons l'establert a la normativa vigent (Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques) per obtenir el reconeixement d'un dret o facultat o per al seu exercici; dispòs de la documentació que així ho acredita, i la pos a disposició de l'administració quan em sigui requerida; així mateix, em compromet a mantenir el compliment de les anteriors obligacions durant el període de temps inherent al dit reconeixement o exercici, i en el cas que hi hagi alguna variació, a comunicar-ho a aquesta administració en el termini no superior a tres dies.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;- Declaració responsable en què es facin constar totes les subvencions o els ajuts obtenguts o sol·licitats per a la mateixa finalitat de qualsevol ens públic o privat, si escau, o una declaració expressa de no haver-ne sol·licitat cap.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;En compliment de l'article 11.3 de la Llei 38/2003, de 17 de novembre, general de subvencions, i l'article 9.3 del TRLS, quan es tracti de persones físiques o jurídiques sense personalitat, s'hauran de fer constar expressament a la sol·licitud els compromisos d'execució de cada membre fent referència a quina part de l'activitat ha executat cadascun d'ells, així com l'import de subvenció que sol·licita i que s'ha abonar a cada membre de l'agrupació, que tendran igualment la consideració de beneficiaris. En qualsevol cas, s'haurà de nomenar un representant o apoderat únic de l'agrupació amb poders per complir les obligacions que, com a beneficiària, correspon a l'agrupació. No es podrà dissoldre l'agrupació fins que hagi transcorregut el termini de prescripció previst als articles 39 i 65 de la citada llei.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
