    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="line-height:114%"&gt;L'apartat 8.4. de la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 19 de febrer de 2015 per la qual s'aprova la convocatòria de les ajudes, per al foment de&lt;strong&gt;&amp;nbsp;&lt;/strong&gt;les pastures per a l'aprofitament de la Ramaderia ecològica, per l'any 2015 especifica que la resolució expressa es notificarà a les persones interessades mitjançant la seva publicació al &lt;em&gt;&lt;em&gt;Butlletí Oficial de les Illes Balears &lt;/em&gt;&lt;/em&gt;d'acord amb els termes que preveu l'article 45.2 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:114%"&gt;Els expedients han estat tramitats pel Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) en compliment del que disposa l'article 43 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques. &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:114%"&gt;El vicepresident en matèria agrària del FOGAIBA, en data 9&amp;nbsp;de juny&amp;nbsp;de 2021, va signar la següent resolució, &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Antecedents&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;1.En data 26 de febrer de 2015, es va publicar el BOIB núm. 29 l'Ordre del conseller d'Agricultura, Medi ambient i Territori de 19 de febrer de 2015, per la qual s'estableixen les bases reguladores per a la concessió de subvencions en el marc del Programa de Desenvolupament Rural de les Illes Balears 2014-2020.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;2.En data de 28 de febrer de 2015 es va publicar, en el BOIB núm. 30, la Resolució del President del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) per la qual s'aprova la convocatòria per a l'any 2015 de les ajudes destinades al Foment de les pastures per a l'aprofitament de la Ramaderia Ecològica.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;3.En les dates 11 de juny de 2015 i 7 de juliol de 2016 (BOIB 87 i 86) es varen publicar unes modificacions de la Resolució citada anteriorment.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;4.De conformitat amb l'apartat sisè de l'esmentada Resolució de i l'ordre AAA/872/2015 de 2 de maig, publicat al BOE núm.114 del 13/05/2015 , el termini de presentació de sol·licituds va acabar el dia 15/06/2015 i varen tenir entrada en el Registre del Fons de Garantia Agrària i Pesquera de les Illes Balears un total de 104 sol·licituds d'ajuda.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;&lt;em&gt;5.En &lt;/em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;data 06 de febrer de 2020 es va publicar, en el BOIB núm. 16, la Resolució de la presidenta del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) per la qual s'aprova la convocatòria, per a l'any 2020, de les ajudes per prorrogar els compromisos assumits per al foment de pastures per a l'aprofitament de la ramaderia ecològica&lt;/em&gt;&lt;/span&gt;&lt;em&gt;.&lt;/em&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;6.En data 21 de març de 2020 es publicà al BOE núm. 78 la Ordre APA / 269/2020, de 19 de març, per la qual s'amplia el termini de presentació de la sol·licitud única, per a l'any 2020, que estableix l'article 95 de Reial Decret 1075/2014, de 19 de desembre, sobre la aplicació a partir de 2015 dels pagaments directes a l'agricultura i a la ramaderia i altres règims d'ajuda, així com sobre la gestió i control dels pagaments directes i dels pagaments a el desenvolupament rural.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;7.Els òrgans gestors del Servei d'Ajudes al Desenvolupament Rural han dut a terme el control administratiu de les sol·licituds i de la documentació aportada d'acord amb les normes reguladores d'aquesta ajuda.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;8.Els interessats assenyalats a l'Annex I adjunt han presentat, dins el termini establert i en la forma escaient, la documentació prevista a la convocatòria, i s'ha comprovat que compleixen amb els requisits exigits per poder ser beneficiaris d'aquesta ajuda.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;9.Una vegada avaluades les sol·licituds d'ajuda pels òrgans gestors, i d'acord amb els criteris d'elegibilitat de la convocatòria, als beneficiaris els hi correspon una ajuda màxima detallada a l'Annex I, després d'aplicar les reduccions de superfícies escaients descrites a l'Annex I.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;1.Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 27 de febrer de 2015 per la qual s'aprova la convocatòria per a l'any 2015 de les ajudes destinades al “Foment de les pastures per a l'aprofitament de la Ramaderia Ecològica”, la Resolució de modificació de &amp;nbsp;9 de juny de 2015 i de 30 de juny de 2016 per la qual es modifica la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 27 de febrer de 2015, per la qual s'aprova la convocatòria, per a l'any 2015, de les ajudes destinades al Foment de les pastures per a l'aprofitament de la Ramaderia Ecològica.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;2.Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA), de 22 de juliol BOIB núm. 95 de 28 de juliol de 2016 per la qual es modifiquen els crèdits i els cofinançaments de diverses convocatòries de subvencions del FOGAIBA, corresponents a les mesures contemplades en el Programa de Desenvolupament Rural de les Illes Balears 2014-2020.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;3.Reglament (UE) núm. 1305/2013 del Parlament Europeu i del Consell, de 17 de desembre de 2013, relatiu a l'ajuda al desenvolupament rural a través del Fons Europeu Agrícola de Desenvolupament Rural (FEADER) i pel qual es deroga el Reglament (CE) núm. 1698/2005 del Consell.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;16.Decret 65/2007, de 25 de maig, de constitució, organització i funcionament de l'Organisme Pagador de les despeses del Fons Europeu Agrícola de Garantia (FEAGA) i del Fons Europeu Agrícola de Desenvolupament Rural (FEADER), a la comunitat autònoma de les Illes Balears BOIB núm. 082 de 2007; en virtut de l'Ordre de la consellera d'Agricultura i pesca de 23 de desembre de 2005, per la qual es disposa l'assumpció de l'execució de la política de millora i foment dels sectors agrari i pesquer per part del Fons de Garantia Agrària i Pesquera de les Illes Balears, estableix a l'article 1 que el FOGAIBA assumeix l'execució de la política de la Conselleria d'Agricultura i Pesca referent a l'aplicació de les mesures de foment i millora dels sectors agrari i pesquer, a partir de l'1 de gener de 2006.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;17.Llei 30/1992, de 26 de novembre de règim jurídic de les administracions públiques i del procediment administratiu comú.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;18.Llei 39/2015, d'1 d'octubre del Procediment Administratiu Comú de les Administracions Públiques.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Proposta de resolució de concessió&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;1.Autoritzar i disposar la despesa assenyalada a cada un dels beneficiaris amb càrrec als pressuposts i percentatges de cofinançament detallats a l'Annex I .&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;2.Determinar que, d'acord amb el que estableix la convocatòria de referència, les obligacions dels beneficiaris seran les indicades a l'&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;Annex II.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Interposició de recursos.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:center"&gt;&lt;span style="line-height:120%"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="line-height:120%"&gt;&lt;strong&gt;&lt;em&gt;OBLIGACIONS DEL BENEFICIARI&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;a) Mantenir sense disminuir la superfície de pastures compromesa a la resolució de concessió d'ajuda, independentment que pugui variar la ubicació del cultiu dins de les parcel·les que integren l'explotació agrària o dels canvis de les parcel·les on s'ubica el conreu. Aquest compromís es considera complit amb una tolerància màxima de disminució de la superfície compromesa d'un 10%. El compliment d'aquest compromís es verificarà en control administratiu per comparació amb el SIGPAC.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;b) Complir a les parcel·les compromeses i amb el bestiar el que estableixen les normes genèriques i específiques sobre producció ecològica,com és el Reglament (CE) núm. 834/2007, de 28 de juny de 2007, del Consell, sobre producció i etiquetatge dels productes ecològics, així com les normes tècniques específiques sobre agricultura ecològica que per a cada cultiu o grup de cultius s'estableixin per part de la comunitat autònoma de les Illes Balears. El compliment d'aquest compromís es verificarà en control administratiu i es justificarà amb la inscripció al Registre d'operadors productors d'agricultura ecològica.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;c) Mantenir i actualitzar el quadern d'explotació específic per a l'agricultura ecològica on s'inscriuran operacions de cultiu i actuacions realitzades (adob, fitosanitaris, conreu, etc.) a cada una de les parcel·les (o grup de parcel·les, en cas de ser del mateix cultiu), amb indicació de la data de realització i les incidències, si n'hi hagués. El compliment d'aquest compromís es verificarà en control administratiu i es justificarà amb la inscripció en el CBPAE.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;d) Participar, durant el període de compromís, en activitats de formació relacionades amb l'agricultura ecològica. Per això, haurà de justificar l'assistència a algun curs o activitat de formació tècnica, relacionats amb la matèria, d'un mínim de 25 hores. Aquesta formació l'ha de rebre la persona que té a càrrec la direcció de l'explotació. El compliment d'aquest compromís es verificarà en control administratiu per certificació de l'entitat que ha impartit el curs. Aquest compromís es podrà substituir per una titulació en formació agrícola reglada de nivellFP2 o superior.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;e) Sotmetre's a les actuacions de comprovació i de control que siguin procedents per part de les administracions autonòmica, estatal i comunitària, la Sindicatura de Comptes o altres òrgans de control extern, necessàries per a comprovar la correcta concessió de l'ajuda i el posterior manteniment dels compromisos i aportar tota la documentació que sigui requerida en l'exercici d'aquestes actuacions.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;f) Complir, a la seva explotació, els requisits legals de gestió, així com les bones condicions agràries i mediambientals establertes en els articles 91, 92, 93, 94 i 95 del Reglament (UE) núm. 1306/2013 del Parlament europeu i del Consell, de 17 de desembre de 2013.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;g) Mantenir els requisits i condicions exigibles respecte a l'explotació i a la persona beneficiària, als quals fa referència l'apartat tercer d'aquesta Resolució.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;h) Complir, a la seva explotació, els requisits legals de gestió, així com les bones condicions agràries i mediambientals establertes en els articles 91, 92, 93, 94 i 95 del Reglament (UE) núm. 1306/2013 del Parlament Europeu i del Consell, de 17 de desembre de 2013.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;i) Mantenir els requisits &amp;nbsp;i condicions exigibles &amp;nbsp;respecte a l'explotació i a la persona beneficiària.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;j) Els beneficiaris es comprometen i obliguen, durant un període de 5 anys, inclòs el de la sol·licitud d'ajuda, a estar inscrits en el registre d'operadors del Consell Balear de la Producció Agrària Ecològica (CBPAE) com a titulars de les parcel·les inscrites.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
