<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">1. La consellera de Presidència, Funció Pública i Igualtat té atribuïda la competència per convocar i resoldre els procediments ordinaris de provisió de llocs de feina, establir-ne les bases i nomenar els membres dels òrgans de valoració.</span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">2. La Conselleria de Hisenda i Relacions Exteriors ha sol·licitat que es dugui a terme el procediment de provisió dels llocs de feina següents: </span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">- Cap de l'Oficina de Supervisió i Anàlisi Pressupostari (F0103000U), adscrit a la Direcció General de Pressuposts.</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">- Cap del Servei d'Informació i Assessorament (F0114002T), adscrit al Direcció General de Relacions Exteriors.</span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">3. La Conselleria de Presidència, Funció Pública i Igualtat ha sol·licitat que es dugui a terme el procediment de provisió del lloc de feina següent:</span></span></span></p>
<p style="margin-left:40px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">- Director/a de l'Institut d'Estudis Autonòmics (F01030043), adscrit a la Direcció General de Coordinació, Relacions amb el Parlament, Drets i Diversitat</span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">4. En data 11 de juny de 2021 la directora general de Funció Pública ha sol·licitat a l'Escola Balear de l'Administració Pública l'inici de la convocatòria per al proveïment dels llocs de treball esmentats. </span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">5. La Relació de llocs de feina de personal funcionari estableix la lliure designació com a sistema de provisió per als llocs descrits anteriorment, els quals es troben vacants i estan dotats pressupostàriament.</span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>Fonaments de dret</strong></span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">1. L'article 75 de la Llei 3/2007, de 22 de febrer, de la funció pública de la Comunitat Autònoma de les Illes Balears, disposa que els llocs de treball adscrits a personal funcionari s'han de proveir ordinàriament pels sistemes de concurs o de lliure designació, mitjançant una convocatòria pública.</span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">2. L'article 79 de la Llei 3/2007 estableix les categories de llocs que s'han de proveir pel sistema de lliure designació pel fet que impliquen una responsabilitat elevada o requereixen una confiança personal per exercir-ne les funcions i tenen establert expressament aquest sistema en la Relació de llocs de feina.</span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">3. El Reglament de provisió de llocs de treball i promoció professional del personal funcionari al servei de l'Administració de la Comunitat Autònoma de les Illes Balears, aprovat pel Decret 33/1994, de 28 de març, dedica el capítol III a regular el sistema de lliure designació com a procediment excepcional per proveir llocs de feina.</span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">4. El Decret 11/2017, de 24 de març, d'exigència del coneixement de la llengua catalana en els procediments selectius d'accés a la funció pública i per ocupar llocs de treball de l'Administració de la Comunitat Autònoma de les Illes Balears dedica el capítol II a la determinació d'aquests coneixements.</span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">5. Per tot això, d'acord amb la competència que preveu l'article 6.3. <em>f)</em> de la Llei 3/2007, de 27 de març, de la funció pública de la Comunitat Autònoma de les Illes Balears, dict la següent</span></span></span></p>
<p style="text-align:center"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>Resolució</strong></span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">1. Aprovar la convocatòria per proveir, pel sistema de lliure designació, els llocs de feina identificats amb els codis següents: </span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">- F0103000U, denominat Cap de l'Oficina de Supervisió i Anàlisi Pressupostari, adscrit a la Direcció General de Pressuposts de la Conselleria d'Hisenda i Relacions Exteriors.</span></span></span></p>

<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">- F01030043, denominat Director/a de l'Institut d'Estudis Autonòmics, adscrit a la Direcció General de Coordinació, Relacions amb el Parlament, Drets i Diversitat de la Conselleria de Presidència, Funció Pública i Igualtat.</span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">L'annex 2 d'aquesta Resolució mostra les característiques dels llocs de feina.</span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">2. Aprovar les bases que han de regir aquesta convocatòria, que s'adjunten com a annex 1.</span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">3. Especificar els codis corresponents a les característiques dels llocs de treball convocats, que s'enumeren en l'annex 2.</span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">4. Fer públic el model de sol·licitud i declaració responsable per participar en aquest procés que figuren en l'annex 3 d'aquesta Resolució.</span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">5. Fer públic el model de memòria que s'ha de presentar per als llocs de treball amb complement de destí de nivell 26 o superior, que s'adjunta com a annex 4.</span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">6. Fer públic el model d'acta que ha d'estendre el titular de l'òrgan directiu sobre l'entrevista personal per als llocs de treball amb complement de destí de nivell 26 o superior, que s'adjunta com a annex 5.</span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">7. Fer pública la informació sobre protecció de dades personals que figura en l'annex 6.</span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">8. Ordenar que aquesta Resolució es publiqui en el <em>Butlletí Oficial de les Illes Balears</em> (BOIB) i s'anunciï en el <em>Butlletí Oficial de l'Estat</em> (BOE).</span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>Interposició de recursos</strong></span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Contra aquesta Resolució, que posa fi a la via administrativa, es pot interposar un recurs potestatiu de reposició davant la consellera de Presidència, Funció Pública i Igualtat en el termini d'un mes, comptador des de l'endemà de la publicació, d'acord amb els articles 123 i 124 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.</span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">També es pot interposar un recurs contenciós administratiu davant el Jutjat Contenciós Administratiu de Palma en el termini de dos mesos, comptadors des de l'endemà de la publicació, d'acord amb els articles 8.2 i 46 de la Llei 29/1998, de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa. </span></span></span></p>

<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">L'objecte d'aquesta convocatòria és proveir amb personal funcionari els llocs de treball de l'Administració de la Comunitat Autònoma de les Illes Balears, vacants i dotats pressupostàriament, que figuren en l'annex 2.</span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>2. Forma de provisió</strong></span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">La provisió dels llocs de treball objecte d'aquesta convocatòria es du a terme pel sistema de lliure designació, que preveu l'article 79 de la Llei 3/2007, de 22 de febrer, de la funció pública de la Comunitat Autònoma de les Illes Balears, d'acord amb el que determinen els articles 28 i següents del Decret 33/1994, de 28 de març, que aprova el Reglament de provisió de llocs de treball i promoció professional.</span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>3. Requisits i condicions per participar-hi</strong></span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">3.1. D'acord amb l'establert a l'article 3.5 del Decret 33/1994, citat amb anterioritat, tot el personal funcionari al servei de l'Administració de la CAIB, qualsevol que en sigui la situació administrativa en la qual es trobin en el moment hàbil per fer-ho, excepte la de suspensió ferma i no acomplerta, podran participar en els sistemes de proveïment de llocs de treball que es convoquin, sempre que compleixin els requisits exigits a la convocatòria.</span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">3.2 .D'acord amb l'apartat 3 de l'article 81 de la Llei 3/2007, de 22 de febrer, de la funció pública de la CAIB, el personal funcionari titular d'un lloc de treball només pot participar en aquesta convocatòria si s'ha complert com a mínim dos anys des que en va prendre possessió, o el temps mínim de permanència indicat en la convocatòria mitjançant la qual se li va adjudicar amb caràcter definitiu, en el cas que aquest període de temps mínim sigui més llarg, ja sigui per haver obtingut destinació definitiva en un procés selectiu d'ingrés, pel torn lliure o pel torn de promoció interna (sens perjudici del que disposa l'apartat següent), o bé a través de l'adjudicació d'un lloc de treball mitjançant un sistema de provisió ordinari anterior, amb les excepcions que preveu l'article 81.4 de la Llei esmentada abans.</span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">En el supòsit que la persona interessada acrediti que el dia de presa de possessió del lloc es va ajornar per interès del servei, el termini ha de comptar des del dia en què prengueren possessió la resta de persones adjudicatàries del mateix procés de provisió o del mateix procés selectiu del seu cos, escala i torn.</span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000000">3.3. D'acord amb el que estableix l'article 81.3 de la Llei 3/2007, al personal que accedeix a un altre cos o a una altra escala per promoció interna o per integració i roman en el lloc de treball que ocupava com a titular, se li ha de computar també el temps de serveis prestats en aquest lloc en el cos o l'escala de procedència. Aquesta mateixa regulació s'ha d'aplicar al personal que va accedir a un altre cos o a una altra escala per promoció interna i va optar per la conversió directa de la plaça.</span></span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000000">3.4. Així mateix, al personal que ha estat objecte d'un canvi d'adscripció del seu lloc de treball en la forma que preveu l'article 91 de la Llei 3/2007, se li ha de computar el temps d'ocupació del lloc abans del canvi d'adscripció, des que en van obtenir la titularitat per un sistema reglamentari de provisió ordinària.</span></span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000000">3.5. Tamb</span>é pot participar en aquesta convocatòria el personal funcionari de totes les administracions públiques, sigui quina sigui la seva situació administrativa, llevat de la de suspensió ferma, respecte de tots els llocs amb codi A5 de l'apartat AP de l'annex 2, sempre que compleixi els requisits que estableix la convocatòria. No hi poden participar els funcionaris que no han complert el temps mínim establert legalment des que se'ls va adjudicar amb caràcter definitiu el lloc de treball del qual són titulars.</span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">3.6. Per poder optar a un lloc de feina, les persones interessades han de complir els requisits dels llocs en qüestió, així com els requisits de titulació o altres requisits d'ocupació que exigeix la Relació de llocs de feina, d'acord amb el que es detalla a l'annex 2.</span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">3.7. El compliment dels requisits que s'exigeixen a les persones candidates ha de referir-se a la data en què acabi el termini per presentar sol·licituds.</span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">3.8. Coneixements de llengua catalana</span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3.8.1. <span style="color:#000000">El nivell de coneixements de llengua catalana del personal funcionari es regeix d'acord amb el que es disposa en l'article 3 del Decret 11/2017, de 24 de març, d'exigència de coneixements de llengua catalana en els procediments selectius d'accés a la funció pública i per ocupar llocs de treball de l'administració de la Comunitat Autònoma de les Illes Balears, i que és el que figura com a requisit en la Relació de llocs de feina, segons el detall de les característiques del lloc convocat que s'adjunta com a annex 2. </span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Això no obstant i segons la disposició addicional sisena de l'esmentat Decret, el personal funcionari d'altres administracions que participa en un procediment de proveïment de llocs de treball de l'Administració autonòmica que tenguin establerta aquesta possibilitat en la relació de llocs de treball, si no pot acreditar el nivell mínim exigit de coneixements de llengua catalana corresponent al lloc de treball al qual opta, queda obligat a assolir-lo i a acreditar-lo en un termini de dos anys, comptadors a partir de la data d'ocupació del lloc de treball.</span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Si el personal esmentat no ha obtingut el nivell corresponent de català una vegada transcorregut aquest termini, serà remogut del lloc de treball per manca d'adequació a les funcions d'aquest, mitjançant un procediment contradictori i oïda la junta de personal corresponent.</span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">3.9. Llocs de treball amb complement de destí de nivell 26 o superior</span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Atès que tots els llocs de treball d'aquesta convocatòria tenen un complement de destí de nivell 26 o superior, les persones candidates hauran de presentar una memòria sobre les funcions del lloc de treball, en què s'inclogui un pla de treball i una descripció de les aportacions que farien en cas d'ocupar-lo.</span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">La memòria s'haurà de presentar d'acord amb el model que s'adjunta com a annex 3.</span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>4. Persones amb discapacitat</strong></span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Les persones interessades a participar en la convocatòria amb alguna discapacitat reconeguda davant l'Administració poden instar en la sol·licitud l'adaptació del lloc o llocs de feina sol·licitats que no suposi una modificació substancial del context de l'organització.</span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">L'Administració ha de demanar a la persona interessada la informació que consideri necessària, com també el dictamen dels òrgans tècnics de què disposa, sobre la procedència de l'adaptació i sobre la compatibilitat d'aquesta adaptació amb les tasques i les funcions del lloc en concret.</span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">En la resolució que posa fi a aquesta convocatòria de proveïment s'ha de resoldre, si escau, sobre l'adaptació sol·licitada del lloc o llocs de treball de què es tracti.</span></span></span></p>
<p><span style="line-height:1"><strong>5. Sol·licituds i documentació</strong></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">La sol·licitud s'ha de presentar d'acord amb el model oficial que s'adjunta com a annex 3 i que es troba a disposició de les persones interessades en la web de l'EBAP</span> (https://ebap.caib.es) <span style="color:#000000">i en la seu electrònica de la CAIB. </span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Les persones interessades han d'adjuntar a la sol·licitud la documentació següent:</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">a) Una declaració que compleix els requisits que s'exigeixen en la convocatòria per a l'exercici del lloc de treball corresponent, d'acord amb el model que s'adjunta com a annex 3.</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="color:#000000; font-family:"Times New Roman",Times,serif">b) Un currículum en el qual consti el cos o escala a què pertanyen, el grup o subgrup de classificació, les titulacions acadèmiques, l'antiguitat i els llocs de treball ocupats en l'Administració pública i en l'empresa privada, els estudis i els cursos realitzats, els coneixement d'idiomes i qualsevol altre mèrit que es consideri escaient.</span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="color:#000000; font-family:"Times New Roman",Times,serif">c) Una memòria sobre les funcions del lloc de treball, en què s'inclogui un pla de treball i una descripció de les aportacions que farien en cas d'ocupar-lo, d'acord amb el model que s'adjunta com a annex 4.</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">La documentació acreditativa dels requisits establerts i dels certificats, títols acadèmics o d'altre documentació al·legada al currículum s'haurà d'aportar mitjançant documents originals o còpies.</span></span></span></p>
<p><span style="line-height:1"><span style="color:#000000; font-family:"Times New Roman",Times,serif">Això no obstant, la persona interessada no ha d'aportar aquesta documentació si no s'oposa a què l'EBAP comprovi d'ofici mitjançant la plataforma d'intermediació de dades o altres sistemes habilitats a aquest efecte la documentació següent:</span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">- Titulacions acadèmiques oficials.</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">- Certificats de llengua catalana expedits per l'Escola Balear d'Administració Pública, o expedits o homologats per la conselleria competent en matèria de política lingüística.</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">- Serveis prestats a l'Administració de la Comunitat Autònoma de les Illes Balears.</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">- Aquella altra documentació que consti en l'expedient de personal de l'Administració de la CAIB. </span></span></span></p>
<p><span style="line-height:1"><span style="color:#000000; font-family:"Times New Roman",Times,serif">La sol·licitud i la resta de la documentació s'han de presentar dins el termini establert, en el Registre de l'EBAP, en el de la Conselleria Presidència, Funció Pública i Igualtat o en qualsevol altra de les formes que estableix l'article 16.4 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.</span></span></p>
<p><span style="line-height:1"><span style="color:#000000; font-family:"Times New Roman",Times,serif">El termini per presentar sol·licituds és de quinze dies hàbils comptadors des de l'endemà que s'hagi publicat la convocatòria en el </span><em>Butlletí Oficial de les Illes Balears</em><span style="color:#000000; font-family:"Times New Roman",Times,serif">, o bé l'anunci al </span><em>Butlletí Oficial de l'Estat </em><span style="color:#000000; font-family:"Times New Roman",Times,serif">si és posterior, data que s'informarà en la web de l'EBAP.</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">5.1. La presentació de la sol·licitud per participar en la convocatòria suposa el coneixement i l'acceptació inequívocs de la persona aspirant del tractament de les dades de caràcter personal a càrrec de l'òrgan competent i únicament per a les finalitats establertes. El tractament de la informació facilitada en les sol·licituds tindrà en compte les previsions del Reglament (UE) 2016/679 del Parlament Europeu i del Consell, de 27 d'abril de 2016, relatiu a la protecció de les persones físiques pel que fa al tractament de dades personals i a la lliure circulació d'aquestes dades, i de la Llei orgànica 3/2018, de 5 de desembre, de protecció de dades personals i garantia dels drets digitals.</span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>6. Desenvolupament del procés de provisió</strong></span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">6.1. En haver finalitzat el termini de presentació de sol·licituds, es publicarà en la web de l'EBAP (ebap.caib.es) la llista definitiva de persones candidates admeses.</span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Una vegada publicada aquesta llista, es lliurarà a cada conselleria o organisme públic on estigui adscrit el lloc de treball objecte de provisió la relació de persones candidates a aquest lloc, juntament amb la documentació aportada. </span></span></span></p>
<p><span style="line-height:1"><span style="color:#000000; font-family:"Times New Roman",Times,serif">6.2. En els llocs de treball amb complement de destí de nivell 26 o superior es convocaran les persones candidates per fer una entrevista personal amb la persona titular de l'òrgan directiu on està adscrit el lloc de treball, la qual ha de versar sobre el contingut de la memòria</span><span style="color:#000000; font-family:"Times New Roman",Times,serif"> i el currículum presentats, i s'han de valorar, ent</span><span style="color:#000000; font-family:"Times New Roman",Times,serif">re d'altres, les competències directives per ocupar el lloc de treball.</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">De totes les entrevistes realitzades se n'ha d'estendre una acta en la qual es deixi constància dels principals aspectes tractats i de la seva valoració, així com de la motivació d'aquesta, d'acord amb el model d'acta de l'annex 5.</span></span></span></p>
<p><span style="line-height:1"><span style="color:#000000; font-family:"Times New Roman",Times,serif">6.3. El conseller o la consellera o l'òrgan equivalent on està adscrit el lloc de treball en proposarà, de forma motivada, l'adjudicació. Aquesta proposta s'ha de fonamentar amb la idoneïtat de la persona proposada en relació amb el seu currículum, la memòria presentada i l'entrevista realitzada.</span></span></p>
<p><span style="line-height:1"><strong>7. Resolució de la convocatòria</strong></span></p>
<p><span style="line-height:1"><span style="color:#000000; font-family:"Times New Roman",Times,serif">7.1. El termini per resoldre la convocatòria és d'un mes, comptador des del dia que finalitzi el termini per presentar sol·licituds. La consellera Presidència, Funció Pública i Igualtat, mitjançant una resolució motivada, pot ampliar aquest termini fins a un altre mes.</span></span></p>
<p><span style="line-height:1"><span style="color:#000000; font-family:"Times New Roman",Times,serif">7.2. La resolució de la convocatòria i l'adjudicació dels llocs de feina dins el termini establert, d'acord amb la proposta que ha d'emetre el titular de la conselleria o organisme públic on es troben adscrits els llocs de feina, correspon a la consellera de Presidència, Funció Pública i Igualtat. Aquesta Resolució s'ha de publicar en el </span><em>Butlletí Oficial de les Illes Balears.</em></span></p>
<p><span style="line-height:1"><strong>8. Presa de possessió</strong></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">8.1. El termini per prendre possessió de la nova destinació obtinguda és de tres dies hàbils si la destinació radica a la mateixa localitat a la qual ja estava destinat, o d'un mes si la nova destinació radica a una localitat diferent.</span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">8.2. En els casos que la persona adjudicatària ho demani i, a més, ho justifiqui degudament, la consellera de Presidència, Funció Pública i Igualtat pot concedir una pròrroga del termini, tal com s'exposa en el punt 8.5.<em>b)</em></span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">8.3. El termini de presa de possessió comença a comptar a partir de l'endemà del cessament en el lloc de treball, el qual s'ha d'efectuar dins els tres dies hàbils següents a la publicació de la resolució del concurs en el <em>Butlletí Oficial de les Illes Balears</em>.</span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">8.4. La persona titular de la conselleria en què presta serveis el funcionari o funcionària que hagi de cessar en el lloc de treball pot proposar a la consellera de Presidència, Funció Pública i Igualtat, per necessitats del servei, que el cessament s'ajorni fins a un màxim de vint dies hàbils. La consellera Presidència, Funció Pública i Igualtat, tenint en compte la proposta, ha de resoldre.</span></span></span></p>
<p><span style="line-height:1"><span style="color:#000000; font-family:"Times New Roman",Times,serif">8.5. La consellera Presidència, Funció Pública i Igualtat pot, excepcionalment, acordar:</span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">a) Ajornar la data del cessament del funcionari o funcionària pel termini màxim d'un mes, completada la pròrroga que preveu l'apartat anterior, per exigències del funcionament normal dels serveis. En aquest cas, si el funcionari o funcionària ho sol·licita, se li han de respectar les retribucions del nou lloc de treball.</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">b) Prorrogar, per un termini de fins a vint dies hàbils, la incorporació del funcionari o funcionària a la nova destinació si implica canvi de localitat i s'al·leguen i s'acrediten raons justificades de la pròrroga sol·licitada.</span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">8.6. El còmput dels terminis de presa de possessió, en tot cas, s'ha d'iniciar quan finalitzin els permisos o les llicències que s'hagin pogut concedir a les persones interessades, tret que per causes justificades l'òrgan competent acordi suspendre'n el gaudi.</span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000000"><strong>9. Període mínim de permanència en el lloc de treball adjudicat</strong></span></span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000000">9.1. D'acord amb l'article 81 de la Llei 3/2007, els funcionaris als quals s'adjudiqui la titularitat d'un lloc de treball en aquesta convocatòria tendran l'obligació de romandre en el lloc de treball adjudicat un mínim de dos anys abans de participar en un altre procediment de provisió ordinari, sense perjudici que s'hi apliquin les excepcions que preveu l'apartat 4 de l'article 81 esmentat. </span></span></span></span></p>

<p><span style="line-height:1"><strong>Consentiment pel tractament de dades relatives a la salut: </strong><span style="color:#000000; font-family:"Times New Roman",Times,serif">La presentació de la sol·licitud per al procés selectiu suposa el coneixement i l'acceptació inequívocs de l'aspirant del tractament de les dades de caràcter personal que farà l'òrgan competent i únicament per als fins establerts. (Inclòs a dades relatives a la salut)</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000000"><strong>Destinataris de les dades personals: </strong>se cediran les dades als següents organismes o persones, a l'efecte de complir el que preveu la legislació vigent en matèria de selecció de personal:</span></span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000000">—</span> <span style="color:#000000"><strong>Conselleria o organisme públic on estigui adscrit el lloc de treball:</strong> per al desenvolupament i la valoració dels mèrits al·legats i acreditats del procés selectiu previstos en la convocatòria.</span></span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000000">—</span> <span style="color:#000000"><strong>Conselleria competent en matèria de funció pública: </strong>per al nomenament del personal funcionari.</span></span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000000">—</span> <span style="color:#000000"><em><strong>Butlletí Oficial de les Illes Balears</strong></em><strong>:</strong> en aplicació de les obligacions que preveu la normativa per seleccionar empleats públics amb les previsions que estableix la Llei orgànica 3/2018, de 5 de desembre, de protecció de dades personals i garantia dels drets digitals.</span></span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000000">—</span> <span style="color:#000000"><strong>Altres participants en el procediment de provisió:</strong> en virtut del principi de transparència que regeix els procediments de provisió, els aspirants podran sol·licitar la consulta dels mèrits al·legats per altres participants per comprovar el funcionament correcte del procés selectiu. En cap cas, podran obtenir les dades de contacte d'altres aspirants, com ara l'adreça postal, el número de telèfon o l'adreça de correu electrònic.</span></span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000000">—</span> <span style="color:#000000"><strong>Administració de justícia: </strong>en cas que algun jutjat o tribunal requereixi l'expedient del procediment.</span></span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000000">No se cediran les dades personals a altres organismes o tercers, tret que existeixi obligació legal o interès legítim, d'acord amb l'RGPD.</span></span></span></span></p>
<p><span style="line-height:1"><strong>Criteris de conservació de les dades personals: </strong><span style="color:#000000; font-family:"Times New Roman",Times,serif">els terminis de conservació de les dades seran els necessaris per complir la finalitat del procediment i els que preveu la legislació d'arxius per a les administracions públiques, d'acord amb l'article 26 de la Llei orgànica 3/2018.</span></span></p>
<p><span style="line-height:1"><strong>Existència de decisions automatitzades: </strong><span style="color:#000000; font-family:"Times New Roman",Times,serif">No es produiran decisions automatitzades, inclosa l'elaboració de perfils, amb les dades personals dels aspirants.</span></span></p>
<p><span style="line-height:1"><strong>Transferències de dades a tercers països:</strong><span style="color:#000000; font-family:"Times New Roman",Times,serif"> Les dades no es transferiran a tercers països.</span></span></p>
<p><span style="line-height:1"><strong>Exercici de drets i reclamacions: </strong><span style="color:#000000; font-family:"Times New Roman",Times,serif">les persones afectades pel tractament de dades personals tenen dret a sol·licitar a l'Escola Balear d'Administració Pública la confirmació que les seves dades són objecte de tractament, l'accés a les seves dades personals, la informació, la seva rectificació o supressió, la limitació o l'oposició al tractament i la no inclusió en tractaments automatitzats (i fins i tot, de retirar el consentiment, si s'escau, en els termes que estableix l'RGPD). També tenen dret a la portabilitat de les dades en els termes que l'exercici d'aquest dret pugui afectar al procés selectiu.</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000000">L'exercici d'aquests drets es pot sol·licitar davant el responsable del tractament esmentat abans (EBAP), mitjançant el procediment «Sol·licitud d'exercici de drets en matèria de protecció de dades personals», previst en la Seu Electrònica de la CAIB (<em>seuelectronica.caib.es</em>).</span></span></span></span></p>
<p><span style="line-height:1"><span style="color:#000000; font-family:"Times New Roman",Times,serif">Amb posterioritat a la resposta del responsable o al fet que no hi hagi resposta en el termini d'un mes, pot presentar la «Reclamació de tutela de drets» davant l'Agència Espanyola de Protecció de Dades (AEPD) (</span><em>https://www.aepd.es/</em><span style="color:#000000; font-family:"Times New Roman",Times,serif">).</span></span></p>
<p><span style="line-height:1"><strong>Conseqüències de no facilitar les dades personals: </strong><span style="color:#000000; font-family:"Times New Roman",Times,serif">No presentar les dades necessàries, implicarà que la persona interessada no pugui formar part del procediment selectiu.</span></span></p>
