    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;En data 6 de febrer de 1995 el Consell Insular de Menorca va assumir, en virtut de la Llei 6/1994, de 13 de desembre, les competències autonòmiques determinades en la Llei 16/1985, de 25 de juny del patrimoni històric espanyol.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;L'ajuntament des Migjorn Gran, mitjançant l'escrit núm. 26.671 del RE del CIM de dia 16 de novembre de 2020, demanà la modificació de l'àrea de protecció del jaciment de Binicodrell de Darrere BCD-01 per tal poder dur a terme l'execució d'una residència geriàtrica a la parcel·la amb referència cadastral 9522572EE8292S0001HF de la seva propietat.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;El poblat de Binicodrell de Darrere va ser declarat monument historicoartístic pel Decret 2563/1966, de 10 de setembre, i mitjançant la disposició addicional primera de la Llei 16/1985, de patrimoni històric espanyol, passà a tenir la consideració de bé d'interès cultural, de manera que quedà sotmès al règim jurídic que la Llei estableix.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;L'article 11.2 de l'esmentada llei i l'article 7.4 &lt;em&gt;b&lt;/em&gt; de la Llei 12/1998 del patrimoni històric de les Illes Balears, preveuen que en el cas de béns immobles s'ha de delimitar l'entorn afectat per la declaració. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;L'article 11 de la Llei 12/1998 del patrimoni històric de les Illes Balears diu que les delimitacions o modificacions que es vulguin fer als entorns de protecció dels béns declarats d'interès cultural han de seguir el mateix procediment i la mateixa tramitació que per a la declaració d'un bé d'interès cultural.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;El Ple del Consell Insular de Menorca, en la sessió de 19 de desembre de 2003, aprovà la delimitació de l'entorn de protecció de la zona arqueològica del poblat de Binicodrell de Darrere (BOIB 21 de 12 de febrer de 2004).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;El Consell Executiu, en la sessió de dia 30 de novembre de 2020, acordà d'incoar l'expedient de modificació de la delimitació de l'entorn de protecció de la zona arqueològica del poblat talaiòtic de Binicodrell de Darrere, es Migjorn Gran.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Aquest acord s'ha notificat a l'Ajuntament des Migjorn Gran i s'ha publicat al BOIB núm. 216 de 31 de desembre de 2020 i al BOE núm. 21 de 25 de gener de 2021. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;La Comissió de Govern, en la sessió de dia 15 de març de 2021, va admetre a tràmit el recurs d'alçada interposat per Elies Coll Moll contra l'acord del Consell Executiu de dia 30 de novembre de 2020 que va aprovar la incoació de l'expedient de modificació de la delimitació de l'entorn de protecció de la la zona arqueològica del poblat de Binicodrell de Darrere, i desestimà el recurs d'alçada d'acord amb les consideracions de l'informe tècnic del Servei de Patrimoni Històric de dia 12 de febrer de 2021. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Vist l'escrit de la delegada de Presidència per a la Cultura de la Conselleria de Presidència, Cultura i Igualtat del Govern de les Illes Balears, amb RE núm. 1133 de 26 de gener de 2021, en el qual comunica que el codi d'identificació del bé és el 07902 – 2 – 2 – 55 – 0 – 3118;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Vist l'informe favorable de l'Institut Menorquí d'Estudis emès en la reunió de la Secció d'Història i Arqueologia de dia 10 de març de 2021;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Vist l'escrit de la Direcció General de Cultura de la Conselleria de Fons Europeus, Universitat i Cultura de dia 11 de març de 2021, en què comunica que s'ha inscrit en el Registre General de Béns d'Interès Cultural del Ministeri de Cultura amb el codi preventiu d'identificació 30231;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Vist el certificat de la secretària del CIM, que diu que en el termini d'exposició al públic s'ha presentat un recurs d'alçada resolt per la Comissió de Govern de 15 de març de 2021 i que en el període d'informació pública no s'ha presentat cap altra al·legació o recurs; &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Vist l'informe de la TAE del Servei de Patrimoni Històric, de dia 20 d'abril de 2021, que diu que s'ha comprovat que &lt;/span&gt;&lt;span style="color:#000000"&gt;en&lt;/span&gt;&lt;span style="color:#000000"&gt; l'expedient consten tots &lt;/span&gt;&lt;span style="color:#000000"&gt;els documents que són preceptius segons l'article 9 de la Llei 12/1998, de 21 de desembre, del patrimoni històric de les Illes Balears, i recomana la declaració definitiva de la modificació delimitació de l'entorn de protecció;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Vist l'informe favorable de la Comissió Tècnica Assessora de Patrimoni Històric, emès en la sessió de caràcter extraordinari de dia 23 d'abril de 2021;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Vista la proposta del conseller executiu del Departament de Cultura, Educació, Joventut i Esports, en exercici de les competències atribuïdes pel Decret de P&lt;/span&gt;&lt;span style="color:#000000"&gt;residència núm. 425/2019&lt;/span&gt;&lt;span style="color:#000000"&gt;,&lt;/span&gt;&lt;span style="color:#000000"&gt; de 10 de juliol (BOIB núm. 95 ext. d'11 de juliol de 2019)&lt;/span&gt;&lt;span style="color:#000000"&gt;,&lt;/span&gt;&lt;span style="color:#000000"&gt; en relació amb els &lt;/span&gt;&lt;span style="color:#000000"&gt;d&lt;/span&gt;&lt;span style="color:#000000"&gt;ecrets de &lt;/span&gt;&lt;span style="color:#000000"&gt;P&lt;/span&gt;&lt;span style="color:#000000"&gt;residència núm. 421/2019 i núm. 422/2019&lt;/span&gt;&lt;span style="color:#000000"&gt;, de 9 de juliol (BOIB núm. 93 ext. de 10 de juliol de 2019).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;El Ple del Consell Insular de Menorca per unanimitat adoptà l'acord següent: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Primer.&lt;/strong&gt; Declarar definitivament la modificació de la delimitació de l'entorn de protecció de la zona arqueològica del poblat talaiòtic de Binicodrell de Darrere, es Migjorn Gran, segons la descripció i la planimetria que figuren a l'annex.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Segon.&lt;/strong&gt; Els efectes d'aquesta declaració són els que genèricament estableixen la Llei 12/1998 del patrimoni històric de les Illes Balears i la normativa concordant.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Tercer. &lt;/strong&gt;Notificar l'acord a l'Ajuntament des Migjorn Gran.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Quart.&lt;/strong&gt; Notificar l'acord a la Direcció General de Cultura de la Conselleria de Fons Europeus, Universitat i Cultura, als efectes de la seva inscripció definitiva en el Registre de Béns d'Interès Cultural, amb especial esment de la informació que s'ha de remetre al Registre del Ministeri de Cultura. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Cinquè. &lt;/strong&gt;Procedir a la corresponent anotació en el Registre de BIC del Consell Insular de Menorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Sisè. &lt;/strong&gt;Publicar l'acord en el BOIB i en el BOE.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Setè. &lt;/strong&gt;Inscriure la delimitació en el Registre de la Propietat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;La qual cosa es fa pública per general coneixement i perquè tengui els efectes que corresponguin, al mateix temps que es fa saber que contra l'acord precedent, que posa fi a la via administrativa, es poden interposar els recursos següents:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;- En el termini d'un mes a partir de l'endemà de la publicació d'aquest edicte en el Butlletí Oficial de les Illes Balears, recurs potestatiu de reposició davant el Ple. &lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;DESCRIPCIÓ I ESTAT DE CONSERVACIÓ&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Assentament talaiòtic amb dos talaiots. Antigament era un poblat de grans dimensions que descriu la bibliografia antiga. Ramis (1818) cita 4 talaiots ben conservats i 2 en runes. Blasco (1879) en cita 5. Actualment el talaiot del N, el que està més a prop de les cases, és el millor conservat. Té una rampa d'accés l'antiguitat de la qual alguns investigadors han posat en dubte. El talaiot del S, el que està més a prop del cementiri, està molt degradat i el seu parament està reconstruït amb pedra menuda. Segons la planimetria d'Hernández Mora (1922) tenia un portal d'entrada, corredor i cambra circular. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;En superfície hi ha fragments de ceràmica talaiòtica, tardopúnica, romana i islàmica.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;DESCRIPCIÓ DE LA MODIFICACIÓ DE LA DELIMITACIÓ DE L'ENTORN&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;La nova delimitació de l'entorn de protecció de la zona arqueològica és la que es projecta en el plànol annex i travessa la parcel·la de l'ajuntament per la paret seca existent fins a la paret mitgera amb les cases de Binicodrell de Darrere. L'àrea del jaciment és la que figura amb trama ratllada en el plànol adjunt. L'àrea de l'entorn de protecció és la que abraça una distància màxima de 70 metres al voltant de les restes adaptada als límits de parets i carreteres i que figura amb línia contínua en el plànol adjunt. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Les intervencions sobre el bé o el seu entorn de protecció han d'anar encaminades a la protecció, la investigació, l'estudi i lavaloració del bé. S'hi permeten els treballs agrícoles si aquests es fan amb erxos i tractors de rodes de goma i no afecten les estructures arquitectòniques; en l'àrea del jaciment cal avisar el Servei de Patrimoni del CIM perquè practiqui les oportunes inspeccions. Igualment també és necessària l'autorització de la Conselleria de Cultura per mantenir bestiar porquí a l'àrea del jaciment, però no en l'àrea de l'entorn.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
