CAIB CAIB text/html ca CAIB 2021-06-17 ![CDATA[<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">BDNS (552624)</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">El Consell Executiu del Consell de Mallorca, reunit en sessió ordinària de 16 de juny de 2021,&nbsp; entre d'altres, ha adoptat el següent:</span></span></p> <p style="text-align:center"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>ACORD</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>“ Fets</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. El Consell Executiu del Consell Insular de Mallorca, a la sessió ordinària de dia 10 de març de 2021, va aprovar la convocatòria de subvencions per donar suport als serveis municipals d'informació turística per a l'any 2021, (BOIB núm. 35, de13 de març de 2021 i publicació a la seu electrònica del Consell Insular de Mallorca).</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. En el pressupost de despeses del Consell de Mallorca de 2021 hi ha &nbsp;crèdit adequat i suficient per fer front a la despesa derivada de la present convocatòria&nbsp; per un import total de 450.000€ amb càrrec a la aplicació pressupostaria 30.43210.76200 denominada “Convocatòria de subvencions per donar suport als serveis municipals d'informació turística”, de finançament afectat núm. projecte 2021 2 30FIT-1, i el núm. de document comptable A núm. 220210007682.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. El dia 27 de maig de 2021, la Comissió avaluadora constituïda dins els actes de tràmit per vetllar pel compliment dels requisits establerts a la convocatòria va valorar els projectes presentats. Aquesta valoració serveix de base a la proposta d'Acord que proposa el secretari tècnic de Turisme i Esports, com a òrgan instructor de la convocatòria.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. L'òrgan instructor dia 2 de juny de 2021, ha emès un informe favorable sobre el compliment dels requisits segons estableix la convocatòria per a poder ser subjecte de concessió. </span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">5. El dia 2 de juny de 2021 la TAG de Turisme, ha emès un informe jurídic favorable sobre la proposta d'aprovació de la concessió de les subvencions.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">6. L'òrgan instructor de la convocatòria ha emès la proposta d'Acord de la concessió definitiva que el conseller de Turisme i Esports &nbsp;elevarà al Consell Executiu. </span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">7. Dia 11 de juny de 2021, la Intervenció delegada ha fiscalitzat de conformitat la proposta d'aprovació de la concessió de les presents subvencions.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Fonaments de dret</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. El Departament de Turisme i Esports té atribuïdes les competències relatives a informació i promoció turística i suport a oficines locals d'informació turística, d'acord amb el que disposa l'article 10 del Decret d'Organització del Consell Insular de Mallorca modificat pel Decret de dia 6 de març de 2020 i pel decret de dia 22 de maig de 2020. (BOIB núm. 167, de 12 de desembre de 2019, BOIB núm. 29, de 87 de març de 2020; BOIB núm. 95, de 28 de maig de 2020).</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. El Reglament orgànic del Consell de Mallorca (BOIB núm. 89, de dia 19 de juliol de 2018) a l'article 39.2.h) &nbsp;juntament amb la base 23.4 de les Bases d'execució del pressupost de despeses vigent del Consell de Mallorca, disposen que entre les atribucions del Consell Executiu estan entre d'altres Aprovar i resoldre subvencions, així com autoritzar i disposar despeses de quantia superior a dos-cents cinquanta mil euros (250.000,00€). Dels preceptes esmentats es determina que el Consell Executiu, és el competent per aprovar la concessió d'aquestes subvencions i per disposar la corresponent despesa que se'n deriva.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Ordenança general de subvencions del Consell de Mallorca (BOIB núm. 21, de 18 de febrer de 2017) que n'estableix les bases reguladores. </span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. L'article 18.2.c) i d) de l'Ordenança general de subvencions del Consell Insular de Mallorca, l'òrgan instructor del procediment és el secretari tècnic del Departament de Turisme i Esports, el qual ha de dur a terme les actuacions i actes de tràmit necessaris per vetllar pel compliment del requisits de la convocatòria, i específicament, ha d'emetre un informe en què consti que, de la informació en poder seu, es desprèn que les persones beneficiaries compleixen tots els requisits necessaris per accedir-hi.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">5. La convocatòria s'adequa a les bases 33 i 34 de les d'execució del pressupost de despeses del Consell de Mallorca per al 2021, relatives a la regulació de la percepció i la justificació de les subvencions.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">6. El punt 10 de la convocatòria fixa com a obligació dels beneficiaris acreditar amb una declaració responsable, abans de dictar la proposta d'acord de concessió de la subvenció, el compliment de les obligacions tributàries amb l'Estat i amb el Consell Insular de Mallorca i els organismes autònoms que en depenen, i de les obligacions amb la Seguretat Social.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">7. El punt 5 de la convocatòria, estableix que el procediment de selecció de les entitats beneficiàries es dur a terme mitjançant concurrència no competitiva, s'exceptua del requisit de fitxar un ordre de prelació en el cas de que les sol·licituds presentades reuneixin els requisits establerts i el crèdit sigui suficient, ja que el crèdit previst es dividirà entre totes les sol·licituds presentades atorgant en un primer moment el mateix import a cada sol·licitud, ja que d'acord amb l'import cert el màxim atorgable a cada subvenció és la quantia sol·licitada, el romanent que resulti es tornarà a repartir entre les sol·licituds que han demanat un import superior. sempre i quan l'expedient s'hagi complimentat correctament i acompanyat dels documents preceptius, fins exhaurir el total del crèdit pressupostari assignat a la convocatòria.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">8. El punt 12.3 de la convocatòria estableix que dins els actes de tràmit, es constitueix una comissió avaluadora per vetllar pel compliment dels requisits establerts en la convocatòria. La seva valoració servirà de base a la proposta d'Acord que l'òrgan instructor presentarà, i que conté les sol·licituds admeses (detallant el pressupost sol·licitat i la subvenció concedida).</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">9. L'expedient de despesa està sotmès al règim de fiscalització&nbsp; i intervenció limitada prèvia d'acord amb l'acord de Ple del Consell de Mallorca de 12 de desembre de 2019&nbsp; i els extrems que l'òrgan interventor ha de comprovar són els establerts en la fitxa 4.1.1) de l' Annex 1 d'aquest Acord.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">10. El punt 12.2 de la convocatòria juntament amb l'article 18 de Ordenança general de subvencions del Consell de Mallorca (BOIB núm. 21, de 18 de febrer de 2017) es determina que s'adjuntarà un informe del secretari tècnic fent constar que de la informació obrant en l'expedient es desprèn que els beneficiaris compleixen tots els requisits necessaris per ser beneficiaris de la subvenció.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">11. La proposta d'acord de concessió de l'òrgan instructor s'ajusta el previst en el punt 12 de la convocatòria, atès que inclou les sol·licituds admeses, i si s'escau les reduïdes, les desistides i les excloses,&nbsp; amb el detall del pressupost subvencionable i la subvenció concedida. Annex I </span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Per tot això, en ús de les atribucions conferides en l'article 36.f) del Reglament orgànic del Consell de Mallorca el Consell Executiu adopta el següent,</span></span></p> <p style="text-align:center"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>ACORD</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1.<strong>CONCEDIR </strong>&nbsp;les subvencions econòmiques per donar suport als serveis municipals d'informació turística per a l'any 2021, als beneficiaris que es relacionen a l'annex I que s'adjunta, per les quantitats que hi consten.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. <strong>DISPOSAR</strong> una despesa total de 450.000,00 € (quatre-cents cinquanta mil euros) a favor dels ajuntaments que es relacionen a l'Annex I que s'adjunta, per les quanties que hi figuren, amb càrrec a l'aplicació pressupostaria 70.43210.76200 denominada “Convocatòria de subvencions per donar suport als serveis municipals d'informació turística”, de finançament afectat núm. projecte 2021 2 30FIT-1, i el núm. de document comptable A núm. 220210007682</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. <strong>ORDENAR</strong> la publicació d'aquest Acord de concessió de les subvencions per donar suport als serveis municipals d'informació turística per a l'any 2021, en el <em>Butlletí Oficial de les Illes Balears i </em>en el web del Consell Insular de Mallorca<em>.</em></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">4.<strong> INFORMAR, </strong>a les persones interessades del següent: </span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Contra aquest acord, que no posa fi a la via administrativa, podeu interposar el recurs d'alçada en el termini d'un mes, comptador a partir de l'endemà de rebre aquesta notificació. El recurs es pot interposar formalment davant aquest Consell Executiu o davant la Comissió de Govern del Consell Insular de Mallorca, que és l'òrgan competent per resoldre'l.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Contra la desestimació expressa d'aquest recurs d'alçada, hi podeu interposar el recurs contenciós administratiu davant (el Jutjat Contenciós Administratiu de Palma que correspongui o la Sala Contenciosa Administrativa del Tribunal Superior de Justícia de les Illes Balears), en el termini de dos mesos, comptadors a partir de l'endemà de rebre la notificació de la desestimació de l'esmentat recurs d'alçada. </span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Si han transcorregut tres mesos des de la interposició del recurs d'alçada i no n'heu rebut la notificació de resolució expressa, s'entén desestimat per silenci i podeu interposar el recurs contenciós administratiu davant (el Jutjat Contenciós Administratiu de Palma que correspongui o la Sala Contenciosa Administrativa del Tribunal Superior de Justícia de les Illes Balears), en el termini de sis mesos, comptadors a partir de l'endemà de la desestimació presumpta.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">No obstant l'anterior, podeu interposar, si escau, qualsevol altre recurs que considereu oportú.
