2021-06-12 CAIB 650517 24053 2021-06-10 ca 24051 CAIB CAIB text/html 2021-06-12 430 236214 ![CDATA[<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Antecedents</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1.- Mitjançant la Resolució del conseller de Treball, Comerç i Indústria i president del Servei d'Ocupació de les Illes Balears, de 4 de juny de 2019, (BOIB núm. 77 d'11 de juny), es va aprovar la convocatòria SOIB Jove Beques d'Èxit per a l'estudi, del programa de segona oportunitat per a persones desocupades de més de 16 i menys de 30 anys inscrites en el Sistema Nacional de Garantia Juvenil, cofinançada pel Fons Social Europeu a través del Programa Operatiu d'Ocupació Juvenil, per al període 2014-2020, i de la Iniciativa d'Ocupació Juvenil, per al període 2019-2020.&nbsp;</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2.- D'acord amb el punt primer de l'annex 1 de la Resolució de la convocatòria esmentada, aquestes beques estan adreçades a les persones joves desocupades que cursin entre d'altres cursos de segon, tercer o quart d'educació secundària de persones adultes (ESPA) en els centres educatius de persones adultes de les Illes Balears per al període 2019-2020.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3.- D'acord amb l'apartat 9 de l'Annex 1 de la Resolució de convocatòria esmentada, el SOIB ha de tramitar la proposta de pagament una vegada finalitzat el curs escolar i comprovar d'ofici que compleix amb els requisits que estableix aquesta convocatòria.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">4.- Les persones beneficiàries han presentat una declaració responsable d'estar al corrent de les obligacions amb la Seguretat Social i de les obligacions tributàries amb l'administració de l'Estat.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">5.- S'ha comprovat que els alumnes que consten en l'annex d'aquesta resolució estan al corrent en el compliment de les seves obligacions tributàries amb la Hisenda de la Comunitat Autònoma de les Illes Balears.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">6.- S'ha comprovat que les persones beneficiàries compleixen les obligacions que consten en el punt &nbsp;5.1 de l'Annex 1 de la Resolució de convocatòria i en la resta de normativa aplicable.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">7. En data 2 de febrer de 2021, el cap de servei de Gestió de Programes d'Ocupació 5, amb el vistiplau de la cap del Departament de Gestió administrativa i jurídica, va emetre un informe favorable sobre la concessió de subvencions en concepte de beques en el marc de la convocatòria esmentada,&nbsp;</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">8. El dia 10 de febrer de 2021 la directora del Servei d'Ocupació de les Illes Balears va emetre una proposta de resolució de concessió a favor de les persones beneficiàries, en la qual se'ls concedia un termini de 10 dies hàbils, comptador des del dia següent al de la data de la publicació de la proposta de resolució, per aportar les al·legacions, els documents o les informacions que consideressin convenients.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">9. D'acord amb l'article 45 de la Llei 39/2015, les propostes de resolució es varen notificar a les persones interessades mitjançant publicació en la pàgina web del Servei d'Ocupació de les Illes Balears, del 26 de novembre a l'11 de desembre de 2020. A data d'avui no s'han presentat al·legacions.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">10. Hi ha crèdit adequat i suficient a la partida pressupostària 76101 322D11 48000 00 19114 dels pressuposts de la Comunitat Autònoma de les Illes Balears per a l'any en curs.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Fonaments de dret</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1.- Resolució del conseller de Treball, Comerç i Indústria i president del Servei d'Ocupació de les Illes Balears, de 4 de juny de 2019, (BOIB núm. 77 d'11 de juny), per la qual s'aprova la convocatòria SOIB Jove Beques d'Èxit per a l'estudi, del programa de segona oportunitat per a persones desocupades de més de 16 i menys de 30 anys inscrites en el Sistema Nacional de Garantia Juvenil, cofinançada pel Fons Social Europeu a través del Programa Operatiu d'Ocupació Juvenil, per al període 2014-2020, i de la Iniciativa d'Ocupació Juvenil, per al període 2019-2020.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2.- L'article 2.2 del Decret 22/2020, de 24 de juliol, de aprovació del Texte consolidat del Decreto de aprovació dels Estatuts del Servei d'Ocupació de les Illes Balears (BOIB núm. 131, de 25 de juliol) estableix que el SOIB, per a l'acompliment dels seus fins, pot dur a terme, entre altres, les funcions necessàries per gestionar les polítiques actives d'ocupació; gestionar el conjunt de programes i mesures d'orientació, ocupació, formació i formació amb alternança amb l'ocupació, que tenen per objecte millorar les possibilitats d'accés a la col·locació de les persones desocupades en el mercat de treball, per compte propi o d'altri; l'adaptació de la formació i requalificació per a l'ocupació dels treballadors, així com les altres accions destinades a fomentar l'esperit empresarial, l'economia social i a millorar les condicions dels treballadors.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3.- D'acord amb els apartats g i i de l'article 9.4 del Decret 22/2020, de 24 de juliol, de aprovació del Texte consolidat del Decreto de aprovació dels Estatuts del Servei d'Ocupació de les Illes Balears (BOIB núm. 131, de 25 de juliol), és funció del president del SOIB autoritzar despeses, contreure obligacions i proposar pagaments del servei, així com concedir ajuts i subvencions.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">4.- La Llei 38/2003, de 17 de novembre, general de subvencions, té per objecte la regulació del règim jurídic general de les subvencions atorgades per les administracions públiques (BOE 276, de 18 de novembre).</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">5.- El Decret legislatiu 2/2005, de 28 de desembre, pel qual s'aprova el text refós de la Llei de subvencions (BOIB núm. 196, de 31 de desembre); té per objecte determinar el règim jurídic de les subvencions, la gestió de les quals correspon a l'Administració de la comunitat autònoma de les Illes Balears o a les entitats públiques que en depenen.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">6.- D'acord amb l'article 39.7 del Decret legislatiu 2/2005, de 28 de desembre, les subvencions que es concedeixen en consideració a la concurrència d'una determinada situació en el perceptor, no requereixen cap altra justificació que l'acreditació per qualsevol mitjà admissible en dret de la situació esmentada prèviament a la concessió, sense perjudici dels controls que es puguin establir per verificar-ne l'existència.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">7.- Ordre de la consellera d'Educació, Cultura i Universitats, de 10 d'octubre de 2013, per la qual s'estableixen les bases reguladores de les subvencions en matèria de polítiques actives d'ocupació gestionades pel Servei d'Ocupació de les Illes Balears (BOIB núm. 146, de 24 d'octubre).</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">8.- D'acord amb l'article 7.3 de l'Ordre de la consellera d'Educació, Cultura i Universitats, de 10 d'octubre de 2013, la selecció dels beneficiaris es pot dur a terme per procediments que no són de concurs quan no siguin necessàries la comparació i la prelació, en un únic procediment, de totes les sol·licituds entre si (d'acord amb l'article 17.2 del Decret legislatiu 2/2005, de 28 de desembre)</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">9.- La Llei 13/2014, de 29 de desembre, de pressuposts generals de la Comunitat- Autònoma de les Illes Balears per l'any 2015, en la disposició final setena modifica l'article 1 de la Llei 7/2000, de 15 de juny, de creació del Servei d'Ocupació de les Illes Balears, i el defineix com un organisme autònom dotat de personalitat jurídica pròpia i plena capacitat d'obrar, adscrit a la conselleria competent en matèria de treball.&nbsp;</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">10.- D'acord amb el Decret 11/2021, de 15 de febrer, de la presidenta de les Illes Balears, &nbsp;pel qual s'estableixen les competències i l'estructura orgànica bàsica de les conselleries de l'Administració de la Comunitat Autònoma de les Illes Balears , (BOIB núm. 21, de 15 de febrer de 2021), el SOIB està adscrit a la Conselleria de Model Econòmic, Turisme i Treball.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Per tot això, dict la següent&nbsp;</span></p> <p style="text-align:center"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Resolució</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. Concedir una subvenció per un import total de 11.928 € en concepte de beca per assistència a les persones beneficiàries que consten en l'annex d'aquesta Resolució en el marc de la convocatòria SOIB Jove Beques d'Èxit per a l'estudi, del programa de segona oportunitat per a persones desocupades de més de 18 i menys de 30 anys inscrites en el Sistema Nacional de Garantia Juvenil, que hagin cursat segon, tercer o quart d'educació secundària de persones adultes (ESPA) en els centres educatius de persones adultes de les Illes Balears, durant el quadrimestre que va des de febrer a juny de 2020.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">L'import total de la beca que correspon a cada alumne s'ha de calcular d'acord amb el que estableix l'apartat 10 de l'annex 1 de la Resolució del conseller de Treball, Comerç i Indústria i president del SOIB, de 4 de juny de 2019: 568 euros per àmbit de coneixement cursat en qualsevol dels dos cursos acadèmics.&nbsp;</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Autoritzar i disposar la despesa per l'import global de 11.928 € a favor de las persones beneficiàries que consten en l'annex d'aquesta Resolució, amb càrrec a la partida pressupostària 76101 322D11 48000 00 19114 dels pressuposts de la Comunitat Autònoma de les Illes Balears per a l'any 2021.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Reconèixer l'obligació i proposar el pagament per l'import global de 11.928 € a favor de les persones beneficiàries que consten en l'annex d'aquesta Resolució, amb càrrec a la partida pressupostària 76101 322D11 48000 00 19114 dels pressuposts de la Comunitat Autònoma de les Illes Balears per a l'any 2021.&nbsp;</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">4.
