El 18 d'octubre de 2019 (R.S.33627), Redexis Gas, SA, va sol·licitar una autorització d'execució d'instal·lacions i, en concret, de declaració d'utilitat pública per al projecte d'execució d'un ramal de distribució de gas natural canalitzat a la bugaderia Més Blanca al terme municipal de sa Pobla.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Les característiques principals de la instal·lació, indicades al projecte d'execució firmat digitalment dia 9 d'agost de 2019 per l'enginyer industrial José Roig Gómez (col.&nbsp;12392, pel Col·legi d'Enginyers Industrials de Madrid, COIMM) sense visar, son les següents:</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Gas que s'ha de subministrar:</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Gas natural amb un PCS (Hs) entre un mínim de 10,26&nbsp;kWh/m³ i un màxim de 13,26&nbsp;kWh/m³, en funció de la seva procedència.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Descripció de la instal·lació:</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Connexió consistent en la xarxa de distribució MOP&nbsp;10&nbsp;bar de 6.100&nbsp;metres lineals de canonada de polietilè d'alta densitat PE100&nbsp;DN&nbsp;110&nbsp;SDR&nbsp;11.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">El traçat, en direcció sud-est, travessa l'autovia Ma-13, el torrent de Sant Miquel i la carretera Ma-3433, mitjançant procediment de perforació horitzontal dirigida. La resta del traçat es fa per camins agrícoles i altres asfaltats dels termes municipals de Campanet, Búger i sa Pobla, i un tram transita per carrers urbanitzats del nucli urbà de sa Pobla.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Pressupost: 471.132,47&nbsp;euros</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. El 31 d'octubre de 2019 (R.S.32435), el Servei de Transport i Distribució d'Energia i Generació Tèrmica va requerir esmena de deficiències a la sol·licitud realitzada per Redexis Gas, SA, i entre d'altres qüestions se li requereixen les separates tècniques del projecte, relatives a les afeccions d'organismes i empreses de serveis públics.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. El 6 de novembre de 2019, Redexis Gas, SA, va registrar documentació per esmenar les deficiències detectades pel Servei en el requeriment de 31&nbsp;d'octubre de 2019.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. El 12 de novembre de 2019, el Servei de Transport i Distribució d'Energia i Generació Tèrmica va requerir completar les deficiències detectades el 31&nbsp;d'octubre de 2019 a la sol·licitud realitzada per Redexis Gas, SA, i on entre d'altres qüestions se li requereixen les separates tècniques del projecte relatives a les afeccions d'organismes i empreses de serveis públics.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">5. El 12 de març de 2020, Redexis Gas, SA, va esmenar les deficiències detectades pel Servei en el requeriment de 31&nbsp;d'octubre de 2019.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">6. Atès que el projecte objecte d'autorització no figura entre els inclosos en els annexos de la Llei&nbsp;12/2016, de 17 d'agost, d'avaluació ambiental de les Illes Balears, ni en els annexos de la Llei&nbsp;21/2013, de 9 de desembre, d'avaluació ambiental, es pot considerar exclòs d'avaluació ambiental.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">7. El 04 de juny de 2020 es va publicar en el <em>Butlletí Oficial de les Illes Balears</em> l'anunci d'informació pública de la sol·licitud d'aprovació del projecte d'execució i de reconeixement, en concret, de la utilitat pública del projecte d'un ramal de distribució de gas natural canalitzat a la bugaderia Més Blanca al terme municipal de sa Pobla (Mallorca).</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">El 18 de juny de 2020 es va publicar l'anunci d'informació pública en el <em>Butlletí Oficial de l'Estat</em>.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">El 10 de juny es varen publicar els anuncis d'informació pública en els diaris <em>Última Hora</em> i <em>Diario de Mallorca</em>, i es va publicar a la pàgina web de la Direcció General d'Energia i Canvi Climàtic.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Del 18 de juny al 17 de juliol de 2020, l'Ajuntament de sa Pobla va publicar en el seu taulell d'anuncis la informació pública del projecte, segons el certificat de publicació en el taulell d'anuncis registrat a la Direcció General d'Energia i Canvi Climàtic el 23 de juliol de 2020.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">L'Ajuntament de Campanet va publicar en el seu taulell d'anuncis la informació pública del projecte, segons el certificat de publicació en el taulell d'anuncis registrat a la Direcció General d'Energia i Canvi Climàtic el 28 de maig de 2021.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Durant 20 dies hàbils, concloent el dia 19 d'agost de 2020, l'Ajuntament de Búger va publicar en el seu taulell d'anuncis la informació pública del projecte, segons el certificat de publicació en el taulell d'anuncis registrat a la Direcció General d'Energia i Canvi Climàtic el 15 de setembre de 2020. A aquest servei no li consta presentació de cap al·legació al respecte.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">9. El 29 de juny del 2020, Servidumbres Aeronáuticas de la Agencia Estatal de Seguridad Aérea sol·licita aportar la informació addicional següent:</span></p> <ul> <li style="list-style-type:none"> </li> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px">Plànols acotats de la planta i de l'alçària de l'actuació, inclosos els medis auxiliars.</span></li> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:13.0pt">Aportar la documentació amb la taula de sol·licitud de coordenades.</span></span></li> </ul> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:13.0pt">Es remet a Redexis Gas, SA, per tal de poder esmenar-ho.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">11. El 23 de juliol del 2020, l'Ajuntament de sa Pobla informa que, vist que les instal·lacions seran soterrades evitant així qualsevol impacte ambiental, es dona conformitat tècnica a la sol·licitud d'autorització de construcció i de declaració, en concret, d'utilitat pública, del ramal de distribució de gas natural abans indicat, a realitzar amb canonada PEAD de DN&nbsp;110&nbsp;(SDR 11) i longitud total de 4,48&nbsp;km.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">12. El 18 d'agost del 2020 venç el termini de reiteració marcat per l'article&nbsp;80 del Reial decret&nbsp;1434/2002, de 27 de desembre, pel qual es regulen les activitats de transport, distribució, comercialització, subministrament i procediments d'autorització d'instal·lacions de gas natural. Segons indica aquest article, El Departament d'Urbanisme i Territori del Consell Insular de Mallorca, vençut aquest termini, va donar la conformitat per a l'autorització de la instal·lació.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">14. El 18 d'agost del 2020 venç el termini de reiteració marcat per l'article&nbsp;80 del Reial decret&nbsp;1434/2002, de 27 de desembre, pel qual es regulen les activitats de transport, distribució, comercialització, subministrament i procediments d'autorització d'instal·lacions de gas natural. Segons indica aquest article, el Departament de Mobilitat i Infraestructures del Consell Insular de Mallorca, vençut aquest termini, va donar la conformitat per a l'autorització de la instal·lació.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">15. El 18 d'agost del 2020 venç el termini de reiteració marcat per l'article&nbsp;80 del Reial decret&nbsp;1434/2002, de 27 de desembre, pel qual es regulen les activitats de transport, distribució, comercialització, subministrament i procediments d'autorització d'instal·lacions de gas natural. Segons indica aquest article, el Servei d'Aigua de la Regidoria de Manteniment i Serveis de l'Ajuntament de sa Pobla, vençut aquest termini, va donar la conformitat per a l'autorització de la instal·lació.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">16. El 19 d'agost del 2020 venç el termini de reiteració marcat per l'article&nbsp;80 del Reial decret&nbsp;1434/2002, de 27 de desembre, pel qual es regulen les activitats de transport, distribució, comercialització, subministrament i procediments d'autorització d'instal·lacions de gas natural. Segons indica aquest article, la Direcció General de Recursos Hídrics de la Conselleria de Medi Ambient i Territori, vençut aquest termini, va donar la conformitat per a l'autorització de la instal·lació.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">17. El 28 d'agost del 2020, Telefónica de España, SA, comunica que no té objecció en l'execució del projecte sempre que es compleixi la normativa vigent.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">18. El 9 de setembre de 2020, Redexis Gas, SA, dona trasllat a la Direcció General d'Energia i Canvi Climàtic per correu electrònic de la conformitat municipal de l'Ajuntament de Búger respecte a la instal·lació de ramal de distribució de gas natural canalitzat per a la bugaderia Més Blanca al TM de sa Pobla, acord adoptat per Junta de Govern Local el 20 de juliol de 2020.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">19 El 10 de setembre de 2020, Redexis Gas, SA, dona trasllat a la Direcció General d'Energia i Canvi Climàtic de l'atorgament de conformitat municipal de l'Ajuntament de Campanet respecte a la instal·lació del ramal de distribució de gas natural canalitzat per a la bugaderia Més Blanca al TM de sa Pobla, acord adoptat per Junta de Govern Local el 6 d'agost de 2020.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">20. El 24 de setembre de 2020, Redexis Gas, SA, presenta part de la informació addicional sol·licitada per Servidumbres Aeronáuticas de la Agencia Estatal de Seguridad Aérea. El 10 de novembre de 2020, Redexis Gas, SA, presenta la resta d'informació addicional sol·licitada.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">21. El 26 de novembre de 2020, Servidumbres Aeronáuticas de la Agencia Estatal de Seguridad Aérea autoritza l'execució la instal·lació del ramal de distribució presentat amb el compliment de les condicions següents:</span></p> <ul> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">No superar els valors d'alçària i elevació indicats en l'acord de l'Agencia Estatal de Seguridad Aérea en matèria de servituds aeronàutiques (exp.&nbsp;I20-0402) per al projecte del ramal de distribució de gas natural canalitzat per a la bugaderia Més Blanca, des dels punts V-006 fins al V-80 i per als tres camions grua, la rasadora i per a les dues màquines excavadores, inclosos tots els elements o qualsevol afegit sobre aquests.</span></span></li> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">Si és necessària la utilització d'altres mitjans auxiliars que superin l'alçària i elevació autoritzades, s'haurà de sol·licitar la corresponent autorització de manera prèvia i preceptiva a la seva instal·lació, fent referència a aquest expedient.</span></span></li> </ul> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">22. El 10 de maig de 2021 venç el termini de reiteració marcat per l'article&nbsp;80 del Reial decret&nbsp;1434/2002, de 27 de desembre, pel qual es regulen les activitats de transport, distribució, comercialització, subministrament i procediments d'autorització d'instal·lacions de gas natural. Segons indica aquest article, Endesa Distribución Eléctrica, SLU, vençut aquest termini, dona la conformitat per a l'autorització de la instal·lació.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Fonaments de dret</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:13.0pt">1. La Llei&nbsp;34/1998, de 7 d'octubre, del sector d'hidrocarburs.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:13.0pt">2. El Reial decret&nbsp;1434/2002, de 27 de desembre, que regula les activitats de transport, distribució, comercialització, subministrament i autorització d'instal·lacions de gas natural.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:13.0pt">3. El Reial decret&nbsp;919/2006, de 28 de juliol, pel qual s'aprova el Reglament tècnic de distribució i utilització de combustibles gasosos i les seves instruccions tècniques complementàries ICG&nbsp;01 a 11.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:13.0pt">4. El Decret&nbsp;96/2005, de 23 de setembre, d'aprovació definitiva de la revisió del Pla Director Sectorial Energètic de les Illes Balears.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:13.0pt">5. El Decret llei&nbsp;3/2014, de 5 de desembre, de mesures urgents destinades a potenciar la qualitat, la competitivitat i la desestacionalització turística a les Illes Balears.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Per tot això, dict la següent</span></p> <p style="text-align:center"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Resolució</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. Atorgar l'autorització administrativa prèvia i de construcció al projecte per al ramal de distribució de gas natural canalitzat a la bugaderia Més Blanca al terme municipal de sa Pobla, redactat i firmat digitalment el 9 d'agost de 2019 pel senyor José Roig Gómez, enginyer industrial, amb els condicionants següents:</span></p> <ul> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px">No superar els valors d'alçària i elevació indicats en l'acord de la Agencia Estatal de Seguridad Aérea, en matèria de servituds aeronàutiques (exp.&nbsp;I20-0402) per al projecte del ramal de distribució de gas natural canalitzat per a la bugadera Més Blanca, des dels punts V-006 fins al V-80, i per als tres camions grua, una rasadora i dues màquines excavadores, inclosos tots els seus elements o qualsevol afegit sobre aquests.</span></li> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px">Si és necessària la utilització d'altres mitjans auxiliars que superin l'alçària i elevació autoritzades, s'haurà de sol·licitar la autorització corresponent de manera prèvia i preceptiva a la seva instal·lació, fent referència a aquest expedient.</span></li> </ul> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Aquesta autorització habilita el titular per a la construcció de la instal·lació, sense perjudici d'altres autoritzacions, llicències o permisos, si són necessaris per a la seva execució.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Reconèixer, en concret, la utilitat pública d'aquesta instal·lació, d'acord amb l'article 103 de la Llei&nbsp;34/1998, de 7 d'octubre, del sector d'hidrocarburs.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Determinar que, d'acord amb la disposició addicional segona del Decret&nbsp;96/2005, de 23 de setembre, d'aprovació definitiva de la revisió del Pla Director Sectorial Energètic de les Illes Balears, modificada per l'article 19 del Decret llei&nbsp;3/2014, de 5 de desembre, de mesures urgents destinades a potenciar la qualitat, la competitivitat i la desestacionalització turística a les Illes Balears, els ramals de canonada que connecten gasoductes de transport primari i secundari, així com les xarxes de distribució de gas natural, poden ser declarats d'utilitat pública i tenir els mateixos efectes prevists en els articles 25, 26.5 i 26.6 del Pla Director Sectorial Energètic. Per tant, en aquest cas, com que es tracta d'una instal·lació de distribució de gas natural i s'ha seguit el procediment de declaració d'utilitat pública regulat en l'article&nbsp;3 de la Llei&nbsp;13/2012, de 20 de novembre, de mesures urgents per a l'activació econòmica en matèria d'indústria i energia, noves tecnologies, residus, aigües, altres activitats i mesures tributàries, la declaració d'utilitat pública ha de tenir els mateixos efectes que els previstos en els articles 25, 26.5 i 26.6 del Pla Director Sectorial Energètic de les Illes Balears.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">En conseqüència, i d'acord amb la disposició addicional i els apartats 5 i 6 de l'article&nbsp;26 del Decret&nbsp;96/2005, l'obra autoritzada es farà en execució de les determinacions del Pla Director Sectorial, atès que està recollit amb detall suficient per poder avaluar les seves característiques fonamentals, són d'aplicació plena, directa i immediata i, a més a més, l'obra autoritzada no se sotmetrà als actes de control preventiu municipal a què es refereix l'article 84.1.<em>b)</em> de la Llei&nbsp;7/1985, de 2 d'abril, reguladora de les bases de règim local, perquè es tracta d'activitats d'interès supramunicipal, i queda exempta de la subjecció al règim de llicències, autoritzacions i informes que estableix la Llei&nbsp;8/1995, de 30 de març, d'atribució de competències als consells insulars en matèria d'activitats classificades i parcs aquàtics, reguladora del procediment i de les infraccions i sancions. D'altra banda, les obres autoritzades quedaran subjectes al règim impositiu establert en l'article&nbsp;29 del Decret&nbsp;96/2005.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. Atorgar el termini de dos anys, comptadors des de la notificació d'aquesta Resolució, per a l'execució de la instal·lació. La Direcció General d'Energia i Canvi Climàtic, per causes justificades i motivades, pot ampliar aquest termini.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">5. Indicar que, una vegada executades totalment o parcialment les instal·lacions objecte d'aquesta autorització, el titular ha de presentar la sol·licitud de posada en servei a la qual ha d'acompanyar un certificat de final d'obra subscrit per un tècnic facultatiu, així com les proves reglamentàries i la resta de documentació que exigeix la reglamentació vigent.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">6. Disposar que el sol·licitant haurà de constituir, en el termini màxim d'un mes comptador des de la data de la publicació de la Resolució d'autorització en el <em>Butlletí Oficial de les Illes Balears</em>, una fiança per un import de 9.422,64&nbsp;euros, equivalent al 2&nbsp;% del pressupost que figura en l'expedient, a l'efecte de garantir el compliment de les seves obligacions d'acord amb l'article&nbsp;73.4 de la Llei&nbsp;34/1998, de 7 d'octubre, d'hidrocarburs.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">La fiança esmentada es constituirà a la Caixa General de Dipòsits de la Tresoreria General del Govern de les Illes Balears. El sol·licitant ha de trametre a la Direcció General d'Energia i Canvi Climàtic la documentació acreditativa del dipòsit de la fiança esmentada dins el termini de 30 dies comptadors des de la seva constitució. La fiança es retornarà al sol·licitant una vegada que, autoritzades i construïdes les instal·lacions en els terminis que estableixin les autoritzacions per al seu muntatge, la Direcció General d'Energia i Canvi Climàtic en formalitzi la posada en servei.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">7.
