    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Transcorregut el termini d'exposició a el públic de l'acord inicial relatiu al Reglament d'ajuts econòmics d'urgència social de l'Ajuntament de Lloseta, aprovat en sessió plenària de la corporació de dia 2021.03.31, i no s'han presentat reclamacions, s'eleva a definitiu dit acord, segons preveu l'article 49 LBRL de 1985. el text íntegre del Reglament es publicarà al BOIB i serà d'aplicació a partir de l'endemà de la seva publicació al BOIB&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;EXPOSICIÓ DE MOTIUS&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;L'Ajuntament de Lloseta contempla l'atenció a persones i nuclis familiars en situació de vulnerabilitat social, en compliment de la Constitució Espanyola (articles 39 i següents), de la Llei 4/2009, d'11 de juny, de Serveis Socials de les Illes Balears i la resta de normativa de desplegament. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;El conjunt d'ajuts regulats en el present reglament tendeixen, en primera instància, a pal·liar necessitats socials i econòmiques de les famílies, però contemplant l'objectiu, a mig i llarg termini, d'incidir en la consecució de l'autonomia personal de les mateixes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;La majoria de les prestacions regulades al present reglament estan vinculades al pla de treball individual i familiar de la persona , i de la prestació per assolir, no únicament un ajut reactiu, sinó també, la incidència en les causes originàries de la situació amb l'activació de la persona en principis de col·laboració, motivació o voluntarietat. El present reglament preveu l'element discrecional o facultatiu del personal tècnic de referència dels serveis socials comunitaris bàsics el qual, de forma fonamentada, pot proposar l'atorgament de prestacions tot i no concórrer la integritat de requisits per l'accés. El motiu no és altre que la necessitat de combinar l'exigència de regulació amb la de flexibilitat, atesa la complexitat de les situacions d'exclusió social.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Així mateix el present reglament dóna compliment als principis que, en funció de la Llei 40/2015, d'1 d'octubre, de règim jurídic del sector públic, han de guiar l'actuació pública en matèria d'objectivitat, transparència, proporcionalitat, confiança legítima, bona fe, eficàcia i eficiència dels serveis públics, particularment en un àmbit tant sensible com és el de l'atenció a les persones en situació de vulnerabilitat i exclusió social.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;CAPITOL I&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;DISPOSICIONS GENERALS&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Article 1.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Prestacions&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;1.1.- Les ajudes econòmiques d'urgència social per l'atenció de necessitats socials, són instruments de la unitat de Serveis Socials Comunitaris Bàsics que possibiliten la cobertura de necessitats bàsiques, i/o complementàries, pel desenvolupament de les activitats de la vida quotidiana.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Van dirigides a individus i/o famílies que passen momentàniament per situacions de necessitat relacionades amb la manca de mitjans de subsistència. Aquestes mancances podran estar motivades per la manca de recursos propis (ingressos inexistents o insuficients en relació a les necessitats bàsiques) o bé ser producte de circumstàncies excepcionals provocades per situacions que requereixen una ràpida resposta davant una situació greu de precarietat social, en què la persona no és la responsable directa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;1.2.- Característiques de les ajudes econòmiques d'urgència social:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Són ajudes finalistes, és a dir, s'apliquen a la finalitat per les quals han estat concedides.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Són ajudes puntuals no periòdiques.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Són complementàries del treball social. Actuaran sempre com a complement d'un treball més ample que es desenvolupa amb els perceptors, dirigit a aconseguir un major nivell d'autonomia personal i social.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- En casos fonamentats, són complementàries a les prestacions que es donin des d'altres institucions i/o entitats per la mateixa necessitat, i la persona i/o família en tingui dret, entenent-se que la part que es cobrirà des de l'Ajuntament serà aquella que no és coberta per una altra institució i/o entitat.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Són ajudes amb consignació pressupostària anual no permanent, depenent en cada exercici de les previsions que s'hi puguin establir.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Article 2.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Modalitats de prestacions&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;2.1 L'Ajuntament de Lloseta concedirà a les persones que compleixin els requisits, ajudes econòmiques pels següents apartats i conceptes:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Carència o insuficiència de recursos econòmics per a l'accés o manteniment de l'habitatge habitual i/o de les despeses derivades del mateix:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Ajuts per garantir els subministraments bàsics.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Ajuts per lloguers endarrerits i ajuts per lloguer d'habitatge habitual.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Ajuts a les despeses per a fer front a la pèrdua temporal o permanent d'habitatge per desnonament.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Ajuts a allotjaments temporals.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Avançament de fiances, avals, pagaments puntuals de quotes d'hipoteques&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Ajuts per l'adquisició d'equipament bàsic.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Ajuts per mantenir les condicions mínimes d'higiene de l'habitatge.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;o Necessitats bàsiques primàries:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Ajuts per alimentació i necessitats bàsiques de subsistència&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Ajuts per dietes especials.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Ajuts per alimentació infantil i higiene/lactància.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Ajuts per a roba i calçat.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Ajuts per necessitats farmacològiques.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Atenció als infants:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Ajuts individualitzats a l'escolarització a l'Educació infantil 0-3 anys.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Ajuts per a material escolar.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Ajuts per a menjador escolar complementàries, amb caràcter excepcional.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Ajuts per a activitats extraescolars i de lleure.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Suport a la integració sociolaboral:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Ajuts individuals per a promoure la integració sociolaboral.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Ajuts al transport.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Altres&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Ajudes per a l'atenció de situacions d'urgent i greu necessitat que no puguin ser ateses per cap dels conceptes contemplats en els epígrafs anteriors.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;2.2 Les prestacions econòmiques establertes en el present reglament es podran pagar directament a la persona beneficiària de l'ajut o bé directament al proveïdor del servei, així com a qui autoritzi la persona beneficiària.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Article 3. &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Naturalesa jurídica dels ajuts&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;3.1. Els ajuts contemplats al present reglament seran, a tots els seus efectes, considerats despesa de dret públic.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;3.2. Els ajuts tenen un caràcter eventual i voluntari, no essent de contingut jurídic impossible ni contradictori amb l'anterior prescripció el fet que el personal tècnic de referència dels Serveis Socials Comunitaris Bàsics pugui limitar els ajuts a persones físiques que reuneixin els requisits objectius contemplats a l'article 5.2., i en cas necessari, cal prioritzar els casos de major puntuació segons el barem establert.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;3.3. La persona beneficiària de l'ajut no podrà exigir l'augment o revisió de l'ajut. No obstant això, les persones interessades, sol·licitants de l'ajut, podran, en qualsevol moment, demanar la vista de l'expedient que ha estat instruït per la concessió de l'ajut.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Per qualsevol incidència que es pugui presentar s'acordarà el que es consideri més ajustat al present reglament i prèvia audiència per un termini no menor de 10 dies a la persona interessada.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;L'Ajuntament és el competent per la interpretació de les qüestions que pugui suscitar l'aplicació d'aquest reglament&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Article 4. &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Dotació pressupostària .&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;4.1. L'Ajuntament de Lloseta consigna en una única partida pressupostària el conjunt de prestacions econòmiques de signe social destinades a persones en situació de vulnerabilitat social.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;4.2. La esmentada partida podrà ser incrementada en funció de les modificacions de crèdits que eventualment pugui aprovar la corporació davant de circumstància d'exhauriment de la dotació i a conveniència de la disponibilitat pressupostària de l'entitat.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;4.3. Les prestacions econòmiques vinculades, en la seva font de finançament, a l'activitat de foment o subvencions, no gaudiran de l'efecte de la consolidació de les mateixes en el pressupost municipal del següent exercici, restant condicionades, en conseqüència, a la disponibilitat efectiva de liquidés condicionada per l'aprovació del programa o subvenció.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;4.4. A l'execució de la despesa li serà d'aplicació el present reglament independentment de la font de finançament, ja sigui dotació específica de l'Ajuntament, ja subscrigui amb l'Ajuntament un altre ens.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;CAPITOL II.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;PERSONES BENEFICIÀRIES I REQUISITS&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Article 5.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Persones beneficiaries, requisits i obligacions.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;5.1.- Podrà ser beneficiari dels ajuts qualsevol persona i/o família que es trobi en situació de dificultat socioeconòmica i no tenen cobertura d'altres sistemes de protecció social.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Tindran un accés prioritari aquelles persones i/o famílies que es trobin en les situacions de necessitat en compliment de l'art. 6 de la Llei 4/2009, d'11 de juny de serveis socials de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;5.2.- Requisits:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Les persones sol·licitants de les prestacions han de complir els següents requisits:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Ser major de 18 anys o estar emancipades legalment o, en el seu defecte, haver iniciat el tràmit legal d'emancipació.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Estar empadronades en el terme municipal de Lloseta amb més de 6 mesos d'antelació al moment de la concessió de l'ajut econòmic, excepte en els supòsits d'extrema necessitat, acreditats i informats favorablement pel personal tècnic de referència. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Podran accedir a les prestacions les persones i unitats familiars que no disposin d'una renta per càpita superiors al següents percentatges del IPREM de forma mensual:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Entenem per renta per càpita, els ingressos de la unitat de convivència menys l'import del rebut de lloguer o hipoteca, dividit pel nombre de membres de la unitat de convivència. Es consideraran membres de la unitat de convivència el conjunt de persones que conviuen al mateix domicili independentment del seu grau de parentesc i/o relació.&amp;nbsp; &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Entenem per ingressos de la unitat de convivència, la suma de tots els ingressos nets de totes les persones que conviuen en el domicili per 14 pagues dividit entre 12 mesos, a excepció d'aquells nuclis familiars que conviuen de forma provisional o són unitats familiars independents.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Es computaran com ingressos tots aquells que siguin percebuts pels següents conceptes:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Nòmines, pensions i altres prestacions econòmiques&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Beneficis i pèrdues del treball per compte pròpia&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Rendes de patrimoni&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Interessos bancari&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Col·laboracions familiars i pensions alimentàries&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Prestacions socials&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Ingressos percebuts per infants a càrrec&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Resultats de declaracions d'impostos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- No disposar de béns mobles, immobles -diferents a l'habitatge habitual- envers els quals es disposi de dret de propietat, possessió o usdefruit; ni rendes de l'activitat econòmica, ni finalment rendes del capital. Amb caràcter general no disposar de recursos alternatius que demostrin l'existència de mitjans suficients per atendre la necessitat per a la qual se sol·licita l'ajut.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- No tenir accés a prestacions econòmiques atorgades per altres administracions que puguin cobrir la necessitat sorgida.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- No haver sol·licitat ajut econòmic a aquesta Corporació en els darrers 6 mesos, a excepció feta de casos que requereixin renovar l'atenció urgent i immediata o bé en els casos de manca de resolució de la necessitat durant el primer atorgament de prestació econòmica.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;5.3.- Els professionals encarregats de la tramitació dels ajuts comprovaran el compliment dels requisits establerts en l'apartat 5.2, sol·licitant als interessats tota aquella documentació necessària per acreditar els mateixos. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Pel que fa a la determinació dels ingressos de la unitat de convivència, atenent a cada cas concret, el professional es podrà limitar la comprovació dels ingressos referits als darrers 6 mesos. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;5.4.- Obligacions de les persones beneficiàries&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Acreditar els requisits exigits per tenir accés a les ajudes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Acceptar ofertes de treball tutelat i/o protegit formulades pels serveis públics d'ocupació o altres institucions competents, sempre que no s'acrediti impediment i a discreció de l'informe tècnic de referència dels Serveis Socials Comunitaris Bàsics. .&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Comunicar als serveis socials municipals les variacions o canvis existents en la situació social i econòmica de la persona o de la unitat convivència que pugin modificar les circumstàncies que van donar lloc a la sol·licitud i resolució.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Destinar la prestació a la finalitat que la va motivar (ajut al lloguer, medicaments, aliments, etc.).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Amb caràcter general l'atorgament de l'ajut resta condicionat a l'acceptació de l'obligació de seguir un pla de treball individual i familiar per part de la persona usuària.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Justificar l'ajuda mitjançant la presentació de factures acreditatives de la despesa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Comunicar als serveis socials de l'Ajuntament l'obtenció d'altres ajudes per a la mateixa finalitat.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Sotmetre's a les actuacions de comprovació i control financer que efectuï l'Ajuntament de Lloseta i facilitar quanta informació i documentació li sigui requerida.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Reintegrar els imports concedits quan no s'apliquin per a les finalitats per a les quals es van concedir.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Mantenir l'empadronament i la residència efectiva en el municipi de LLOSETA durant el temps de percepció de l'ajuda.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Qualsevol altre obligació relacionada directament amb l'objecte de l'ajuda i que específicament s'estableixi en l'acord de concessió d'aquesta, i que serà proposada conforme al criteri professional dels serveis socials municipals.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;5.5. Drets dels beneficiaris&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Dret a ser informats de les possibles modificacions que puguin produir-se en el règim prestació.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Dret a la intimitat i tractament confidencial de la documentació de caràcter personal inclosa a l'expedient. Tant el/la regidor/a de l'Àrea de Benestar social, com els tècnics que tramitin les ajudes estan obligats a mantenir el secret de la informació dels expedients, ja que la intimitat de les persones està afectada, i resta subjecta a reserva i tractament confidencial, d'acord a l'art.18 de la Constitució Espanyola, i al que disposa la Llei Orgànica 15/1999, de 13 de desembre, de protecció de dades de caràcter personal.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Dret a exercir el seu dret a queixa conforme a les disposicions vigents.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Dret a l'abandonament efectiu de l'ajuda o prestació, una vegada s'hagi resolt la mateixa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- I a més, els drets reconegut dins de la llei 4/2009 d'11 de juny de Serveis Socials de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;5. 6. Obligacions específiques segons tipologies d'ajut.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Cada tipologia d'ajut tindrà unes obligacions concretes i específiques que es detallaran a la resolució que concedeixi l'ajut o, en el seu cas, en la convocatòria ad hoc que publiqui l'Ajuntament per a la seva concessió.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Article 6.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Criteris d'atorgament&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;6.1. D'acord amb l'article 4 del present reglament l'atorgament de les prestacions restarà subjecte en general a la disponibilitat pressupostària d'aquest Ajuntament.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;6.2. L'informe tècnic es sustentarà en els requisits contemplats a l'apartat segon de l'article 5, sense perjudici que el mateix professional pugui fer de forma fonamentada excepcions de casos quan la situació així ho requereixi i depassant la casuística concreta que així ho requereixi.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;En tot cas l'informe que, de forma originària, genera la prestació anirà acompanyat d'un model formalitzat de valoració socioeconòmica. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;6.3. Les prestacions concedides no podran ser invocades com a precedent per a l'obtenció de noves prestacions.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;6.4. És un criteri rellevant per a l'atorgament que la prestació econòmica atorgada contribueixi la resolució de la situació de carència.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;6.5 Les prestacions regulades en el present reglament són intransferibles i, per tant, no podran oferir-se en garantia d'obligacions, ser objecte de cessió total o parcial, compensació o descompte, excepte per al reintegrament de les prestacions indegudament percebudes, i/o retenció o embargament, excepte en els supòsits i amb els límits previstos en la legislació general de l'Estat que resulti aplicable.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;6.6 En el supòsit que concorrin varies persones sol·licitants d'una mateixa unitat de convivència per fer front a la mateixa despesa, només podrà ser concedida a una d'elles, promovent l'acord entre les parts interessades.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;CAPITOL III.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;QUANTIA DE LES PRESTACIONS&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Article 7.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Quantia de les prestacions&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;7.1. Les prestacions econòmiques d'urgència social seran de quantia variable, i es determinaran &amp;nbsp;segons el resultat de la suma de les puntuacions obtingudes al barem socioeconòmic.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;En el cas d'extrema i severa necessitat el import serà íntegrament finançat per part de la Corporació.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;La forma d'acreditació de la prestació i subsegüent despesa és guiarà per qualsevol de les formes habitualment admeses en dret en matèria de justificació material i econòmica.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;7.3. El màxim d'ajut per concepte de prestacions econòmiques d'aquest ajuntament i per família amb criteri d'anualitat es fixa en la quantia de 2 vegades de el import mensual de l'IPREM. No obstant això, i de forma acreditada en l'expedient, es podran esdevenir casos de superació de la esmentada quantia per necessitats socials justificades i en casos excepcionals.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;El import de les ajudes concedides en cap cas podrà ser de tal quantia que, aïllada o en concurrència amb altres subvencions o ajudes superi el cost de l'activitat subvencionada.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;7.4. Actualització de les quanties&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Al tractar-se d'un dret discrecional, i que no pot ser revisat per part del persona perceptora, l'Ajuntament podrà revisar l'augment o disminució de les quanties màximes dels ajuts en casos que així resti justificat per necessitats socials.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;CAPITOL VI.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;EL PROCEDIMENT DE CONCESSIÓ&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Article 8.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Òrgan competent per resoldre i òrgan gestor&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;8.1. L'òrgan competent per resoldre sobre la concessió o denegació de les ajudes sol·licitades és l'Alcaldia Presidència que podrà delegar aquesta facultat en la Junta de Govern Local o en el/la regidor/ra o tinent d'alcalde de l'àrea de serveis socials de l'Ajuntament de Lloseta.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;8.2. La gestió administrativa de les prestacions sol·licitades correspon a l'Àrea de Serveis Socials.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Article 9.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Procediment normalitzat de les ajudes&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Els ciutadans podran sol·licitar les ajudes al servei per pròpia iniciativa, o bé seran tramitades a proposta de la regidoria de benestar social o del professional de referència quant es tracti de persones amb les que ja s'està efectuant una intervenció social o professional.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Les ajudes són tramitades pel Treballador/a Social dels Serveis Socials de Lloseta. La sol·licitud, es presentarà en la Unitat de Treball Social (UTS) de l'ajuntament de LLOSETA.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Una vegada rebuda la sol·licitud, en el cas que no s'hagi aportat tota la documentació necessària, és requerirà al sol·licitant que l'aporti, informant que el incompliment del requeriment suposarà l'arxiu de l'expedient sense més tràmits. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Rebuda la documentació s'emetrà informe per part del treballador/a social, en el que es proposarà la concessió o no de l'ajuda sol·licitada, i, en el seu cas, de la quantia de l'ajuda.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;La resolució de la concessió d'ajuda serà del regidor/a de l'Àrea de Benestar Social o batlle/batllessa atorgant o denegant l'ajuda; ambdós participaran igualment del deure de mantenir en secret, al qual està obligat/a per ètica professional el treballador/a social. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Una vegada resolt per l'autoritat resolutòria l'expedient, es comunicarà al sol·licitant, indicant-ne la quantia i condicions de l'ajuda ( concepte, utilització de la prestació, duració i pla de treball, si n'és el cas), així com els recursos administratius i jurídics en el cas de desitjar la impugnació de l'acord. Posteriorment es presentarà al departament d'intervenció la resolució de la regidoria de Serveis Socials perquè es pugui fer efectiu el pagament de la quantia concedida d'acord amb les condicions que s'estableixin. En cas de resolució negativa es comunicarà per escrit la resposta&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;L'abonament de l'ajuda es pot realitzar directament al destinatari, o a l'entitat prestadora del servei.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Article 10.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Documentació que ha d'acompanyar a la sol·licitud.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;10.1 La documentació relacionada en aquest article serà considerada com a màxima i es reclamarà, en cada cas, al sol·licitant la necessària per a realitzar la valoració econòmica i social d'una forma fidedigna.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Documentació general per a qualsevol tipus d'ajut:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Sol·licitud d'ajuda, segons model normalitzat, degudament complimentat.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Original i fotocòpia del DNI de la persona sol·licitant i dels majors de 16 anys de la unitat convivència o documentació acreditativa de la identitat. En el supòsit de persones que no tinguin la nacionalitat espanyola original i fotocòpia del NIE, passaport o document que legalment els substitueixi.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Certificat d'empadronament i de convivència on consti l'antiguitat.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Justificació d'ingressos del beneficiari i de la unitat familiar.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Declaració de responsabilitat, inclosa en la sol·licitud.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Declaració jurada d'ingressos de la unitat convivència.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Documentació Específica: altres documents específics segons les circumstàncies o necessitat.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Acreditació de la composició de la unitat de convivència familiar i , si s'escau, certificat de discapacitat d'alguns dels seus membres.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Original i fotocòpia del Llibre de Família complert i, en el seu cas, sentència de separació o divorci, o conveni regulador on consti pensió alimentaria i custodia de fills.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Fotocòpia del títol de família nombrosa, en el cas que correspongui.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- En el cas que el persona sol·licitant o algun altre membre de la unitat convivència estigui afectat per algun tipus de discapacitat o discapacitat física, psíquica o sensorial, dictamen de valoració del grau de discapacitat certificat per l'òrgan o entitat que correspongui.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- En cas de malaltia greu d'algun membre de la unitat convivència, informes mèdics o altres documents que ho acreditin.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Si en la unitat convivència hi ha algun cas d'acolliment el corresponent document acreditatiu d'aquesta situació.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Certificat i fotocòpia de la targeta d'atur o millora de l'ocupació dels majors de 16 anys que es trobin en situació d'atur laboral.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Certificat del SOIB que acrediti si perceben prestació per atur de tots els membres adults de la unitat convivència i de el import de la prestació o, en el seu cas certificat negatiu.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Certificat d'altes i baixes de la Seguretat Social dels membres adults de la unitat convivència ( certificat de vida laboral).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Original i fotocòpia de la declaració de la renta o certificat negatiu d'Hisenda del darrer any.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- En el cas de treballadors per compte aliena: original i fotocòpia del contracte de treball i de les sis darreres nòmines dels majors de 16 anys que realitzin activitat laboral.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Certificat de percebre o no pensions de l'Administració Pública i en cas afirmatiu de la seva quantia.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Justificant del capital mobiliari en el que constin els rendiments i els saldos de tots els comptes oberts a nom del persona sol·licitant.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Justificació de despeses fixes mensuals: contracte de lloguer de l'habitatge, últims rebuts de préstecs bancaris, despeses d'aigua, llum i gas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- En cas de separació o divorci, document notarial, els justificants d'interposició de la demanda, la sentència judicial o altres documents que demostrin aquesta situació.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Declaració acreditativa de la reclamació de la pensió d'aliments ( en cas de separació i quan no es compleix aquesta mesura).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Qualsevol altra documentació que per a la correcta valoració de la sol·licitud pugui ser requerida durant la seva tramitació, que podrà ser sol·licitada pel personal tècnic de referència dels serveis socials o aportada per la persona interessada si ho considera convenient.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;10.4. Protecció de dades&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Es garantirà la confidencialitat de les dades i el seu processament adequat, respectant en tot cas allò que estableix Llei Orgànica de Protecció de Dades. El sol·licitant ha de signar l'autorització expressa de tractament de dades de caràcter personal&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Article 11.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Justificació&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;En la resolució de concessió s'expressarà l'obligació del/de la beneficiari/beneficiària de justificar l'aplicació de l'ajuda a la situació de necessitat a què s'orientava.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;La justificació de l'ajuda es realitzarà en el termini màxim d'un mes des de la seva concessió, mitjançant la presentació de factures, rebuts o justificants que acreditin les despeses realitzades.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Les factures i justificants presentats als efectes de la justificació han de ser originals i contenir, com a mínim, les dades del seu emissor i destinatari, on farà constar el seu número d'identificació fiscal, el bé o servei objecte de la contraprestació i el import d'aquest, amb indicació de la part corresponent a l'IVA, i la data d'expedició d'aquesta. Atès el caràcter d'aquestes ajudes, excepcionalment s'admetran altres formes de justificació que l'àrea de Serveis Socials i la Intervenció Municipal valoraran.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Article 12.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Denegació de la prestació&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Podran ser denegades aquelles sol·licituds en les que, tot i complir amb els requisits establerts en l'article 5.2, pugui concórrer alguna de les següents circumstàncies:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- La falta de tots o alguns dels requisits necessaris per a la seva concessió.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Que la persona sol·licitant no resideixi, efectivament, al municipi.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Dificultar la tasca tècnica de valoració de la sol·licitud rebuda.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Que existeixi una persona legalment obligada i amb possibilitat de prestar ajuda a la persona sol·licitant.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Que l'ajuda sol·licitada no sigui adequada per la resolució de la problemàtica plantejada o que la seva mera concessió no sigui suficient per la resolució de la problemàtica plantejada.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Que no existeixi crèdit suficient per l'atenció de la sol·licitud.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Que en el termini dels 12 mesos anteriors a la sol·licitud li hagi estat extingida o revocada qualsevol altra ajuda o prestació social per incompliment de les condicions establertes en la seva concessió.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- El falsejament o ocultació de qualsevol de les dades declarades per les persones sol·licitants podrà donar lloc a la denegació de l'ajuda sol·licitada, inclòs quan la persona sol·licitant reuneixi els requisits per la concessió.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Que es demostri que la persona sol·licitant pot satisfer adequadament les necessitats per si mateixa i/o amb el recolzament dels seus familiars, representants legals o guardadors de fet.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Que l'atenció de la persona sol·licitant per raó de la naturalesa de la prestació o per raó de residència correspongui a una altra administració pública.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Qualsevol altre motiu que, atenent a les circumstàncies i prèvia valoració dels serveis bàsics d'atenció social, estimin la seva denegació de forma motivada.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;​​​​​​​&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Article 13.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Modificació de la prestació.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;La prestació es pot modificar per:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Modificació del nombre de membres de la unitat econòmica de convivència independent.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Modificació de les circumstàncies que generaren la sol·licitud de la prestació.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Modificació dels recursos que s'hagin utilitzat de base per al càlcul de la prestació.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Article 14.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Suspensió Cautelar de la prestació&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Independentment que s'hagi iniciat o no un procediment d'extinció, bé d'ofici o a instància de part es pot procedir a la suspensió cautelar del pagament de la prestació quan es detectin, en la unitat econòmica de convivència independent, indicis d'una situació que impliqui la pèrdua d'algun dels requisits exigits per al reconeixement o manteniment d'aquesta.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;S'ha de resoldre sobre el manteniment, suspensió o extinció de la prestació en un termini màxim de tres mesos des de l'adopció de la suspensió cautelar.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Article 15.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Extinció de la prestació&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Es produirà l'extinció de la prestació pels motius següents:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Per mort, renúncia o trasllat del sol·licitant fora del municipi.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Per la desaparició de la situació de necessitat.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Per ocultament o falsedat en les dades que han s'han tingut en compte per concedir la prestació.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Per la pèrdua d'alguns dels requisits o condicions exigides per ser beneficiari de la prestació.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Por no destinar la prestació a l'objecte d'aquesta..&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Per manteniment d'una situació de suspensió per un període continuat superior a 3 mesos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Article 16.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Revocació de la prestació.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Procedirà la revocació de les prestacions, mitjançant resolució d'Alcaldia i prèvia audiència a la persona interessada, per alguna de les següents causes:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- En cas d'incompliment dels requisits per part de la persona de signe subjectiu (compliment del pla de treball individualitzat, acceptació d'ofertes de treball i escolarització dels infants). Seran els serveis bàsics d'atenció social qui determinaran en una proposta de resolució la valoració sobre el compliment o eventual incompliment d'aquests extrems.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Quan la persona beneficiària incompleixi totes o algunes de les obligacions adquirides amb l'acceptació de l'ajut.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Falsejar, ocultar o mostrar obstrucció a les actuacions de comprovació empreses per part del personal municipal de serveis socials i serveis econòmics, tot i reunir la persona sol·licitant els requisits per a la concessió.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Que hagi transcorregut el termini de tres mesos des de l'atorgament de l'ajut, sense que l' ingrés hagi pogut fer-se efectiu per causes imputables a la part interessada.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- La utilització de l'ajuda per finalitat diferent a aquella per a la qual fou concedida, constituirà causa determinant de la revocació de l'ajuda i del seu immediat reintegrament, previ requeriment per l'òrgan competent que, de no ser atès, promourà l'acció executiva que correspongui, sens perjudici de les actuacions civils, penals o d'altre ordre que en cada cas procedeixi.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Desaparició de totes o algunes de les circumstàncies que van donar lloc a la seva concessió.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Per l'aparició de causes sobrevingudes que produeixin la impossibilitat material de continuar amb la prestació de l'ajuda.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Per ser beneficiari simultàniament d'una altra prestació amb la mateixa finalitat, és a dir, que tingui la mateixa naturalesa i atengui les mateixes necessitats, sense que tal circumstància hagi estat comunicada a l'Ajuntament.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- La reiteració de les causes que motivaren la suspensió temporal de la prestació, de conformitat amb el que s'estableix a l'apartat corresponent d'aquest reglament.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Altres causes de caràcter greu imputables al beneficiari no contemplades en els apartats anteriors.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- La revocació de l'ajuda donarà lloc a la tramitació, en el seu cas, del corresponent expedient de reintegrament de les quantitats indegudament percebudes per part de la persona beneficiària i, en els supòsits previstos en què sigui pertinent, a la tramitació d'un expedient sancionador. En tot cas, i en funció de las circumstàncies econòmiques i&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;personals concurrents, l'Ajuntament podrà establir formes de devolució fraccionada.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;L'acte de revocació, extinció, suspensió... anirà precedit per un tràmit d'audiència, per un termini de 10 dies hàbils, durant el qual la persona beneficiària podrà al·legar i presentar els documents i les justificacions que consideri pertinents.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Article 17.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Desistiment i Renúncia&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;La persona sol·licitant pot desistir de la seva sol·licitud o renunciar al seu dret, a la prestació reconeguda, mitjançant escrit dirigit a l'Ajuntament. Aquest dictarà resolució on s'expressi la circumstància en què concorre tot indicant els fets produïts i les normes aplicables.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Article 18.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Reintegrament&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Es reintegraran les quantitats obtingudes en concepte d'ajuda econòmica, amb l'exigència del interès de demora establert legalment, en els casos següents:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Obtenir l'ajuda falsejant i ocultant dades que haguessin determinat la seva denegació.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Destinar l'ajuda a altres fins diferents d'aquells que es van especificar en la resolució de concessió.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- No justificar l'aplicació de l'ajuda , o justificar-la fora de termini.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- En la resta de supòsits que preveu la legislació reguladora de subvencions.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Article 19.&amp;nbsp;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Procediment d'Urgència&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Excepcionalment, en el cas d'urgència degudament justificada i valorada pels/per les professionals dels serveis socials comunitaris bàsics, es concedirà una part proporcional de l'ajuda precisa amb la major rapidesa possible sens perjudici de l'adopció de les mesures necessàries que garanteixin la seva finalitat i l'aprovació posterior de l'òrgan competent.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Detectada la situació de necessitat el personal tècnic de referència dels serveis socials bàsics emetran un informe-proposta, en el qual constarà la proposta d'atorgament de l'ajut així com la seva quantia. El personal tècnic de referència donarà trasllat de l'informe-proposta a la regidoria, qui donarà la conformitat a la concessió de l'ajut.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;CAPITOL V.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;POTESTAT SANCIONADORA, INFRACCIONS I SANCIONS&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Article 20.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Potestat sancionadora.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;La potestat sancionadora correspon a l'Alcaldia, dins de l'àmbit de les seves competències, sens perjudici de comunicar si escau a les Autoritats governatives i judicials, en el cas que puguin constituir un objecte constitutiu de delicte o manca de les conductes i infraccions la sanció i inspecció de les quals tinguin atribuïdes legalment o reglamentàriament, sempre amb incoació prèvia de l'expedient administratiu corresponent.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Article 21.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Infraccions.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Constitueixen infracció administrativa les vulneracions dels deures i de les obligacions que el present Reglament fixa per als usuaris i usuàries de les prestacions de serveis socials.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;21.1 Són faltes lleus les infraccions que no estan qualificades com a greus o molt greus, a més de les següents:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- No facilitar informació sobre els canvis en la situació personal, familiar, econòmica i social&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- No complir els acords relacionats amb el servei concedit.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- No destinar la prestació a la finalitat per a la qual va ser concedida.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- No comunicar als responsables del servei l'absència del domicili, sense una justificació vinculada a una incidència.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;21.2 Són faltes greus:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- La comissió de dues faltes lleus en el període de sis mesos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- No comparèixer davant l'òrgan que li ha atorgat el servei.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- La manca de respecte al personal que presta el servei.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;21.2 Són faltes molt greus:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- La comissió de dues faltes greus en el període de sis mesos&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- L'agressió física o psicològica al personal que presta el servei.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- El incompliment dolós dels compromisos acordats.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- La falsedat en la documentació presentada o la ocultació d'informació prioritària per a la prestació del servei.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Article 22.- Sancions&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;22.1 Les infraccions lleus es poden sancionar amb una amonestació o una multa per un import de fins a 100 euros.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;22.2 Les infraccions greus es poden sancionar amb la pèrdua del dret a ser beneficiari de prestacions econòmiques per un període de fins a &amp;nbsp;6 mesos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;22.3 Les infraccions molt greus es poden sancionar amb la pèrdua del dret a ser beneficiari de prestacions econòmiques per un període de fins a&amp;nbsp; 12 mesos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;A l'hora de determinar la sanció corresponent, la resolució que es dicti garantirà l'adequació deguda entre la gravetat del fet constitutiu de la infracció i la sanció aplicada; es consideraran especialment els criteris següents:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;a) L'existència d'intencionalitat o reiteració.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;b) La naturalesa dels perjudicis causats, atenent a la gravetat del dany derivat de la infracció, a l'alteració social causada i al grau d'afectació que la dita infracció hagi tingut en la salut i seguretat de les persones.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Disposició Final&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
