    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;L'apartat 9.3. de la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 10 de juliol de 2015 per la qual es convoquen, subvencions per a inversions a les explotacions agràries, corresponents als anys 2015-2019, especifica que la resolució expressa es notificarà a les persones interessades mitjançant la seva publicació al &lt;em&gt;&lt;em&gt;Butlletí Oficial de les Illes Balears &lt;/em&gt;&lt;/em&gt;d'acord amb els termes que preveu l'article 45.2 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;Els expedients han estat tramitats pel Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) en compliment del que disposa l'article 43 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;El vicepresident en matèria agrària del FOGAIBA, en data 1&amp;nbsp;de&amp;nbsp;juny&amp;nbsp;de 2021, va signar la següent resolució, &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;“&lt;/em&gt;&lt;/em&gt;&lt;strong&gt;&lt;em&gt;&lt;strong&gt;&lt;em&gt;INFORME/PROPOSTA&lt;/em&gt;&lt;/strong&gt;&lt;/em&gt;&lt;/strong&gt;&lt;strong&gt;&lt;em&gt;&lt;strong&gt;&lt;em&gt;/RESOLUCIO&amp;nbsp;DE DENEGACIÓ DE PRÒRROGA DEL TERMINI PER A LA JUSTIFICACIÓ DE LA INVERSIÓ SUBVENCIONABLE&lt;/em&gt;&lt;/strong&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;1. &lt;/em&gt;&lt;/span&gt;&lt;em&gt;El 5 de juny de 2018, el vicepresident del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) va dictar Resolució de concessió (R7) d'ajudes per inversions en les explotacions agràries, publicada en el Butlletí Oficial de les Illes Balears núm. 86, de 12 de juliol de 2018, en relació amb l'ajuda concedida a l'empara de la Resolució del president del FOGAIBA de 10 de juliol de 2015, per la qual es convoquen, per als anys 2015 a 2019, subvencions per a inversions a les explotacions agràries, modificada mitjançant les resolució de 17 de desembre de 2015, 22 de juny de 2016 i 26 de juny de 2018. Entre altres persones beneficiàries hi ha CARME SIRVENT MESTRE, amb NIF &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;***8869**, i núm. d'expedient INEA2016_1/048, amb un termini d'execució de 12 mesos.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;2&lt;/em&gt;&lt;/span&gt;&lt;em&gt;. El 22 de maig de 2019, CARME SIRVENT MESTRE&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;, &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;amb&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;NIF ***8869**, va presentar una sol·licitud de pròrroga del termini d'execució (RGE 15401) a FOGAIBA , degut a la modificació de l'emplaçament per anomalies geotècniques. Es va concedir una primera pròrroga de 12 mesos que finalitza el 10 de juliol de 2020.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;3&lt;/em&gt;&lt;/span&gt;&lt;em&gt;. El 23 de juny de 2020, JOSE MARIA SIRVENT CERDÀ&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;, &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;amb&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;NIF ***2839**, &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;en representació de CARME SIRVENT MESTRE&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;em&gt;va presentar una sol·licitud de pròrroga del termini d'execució (RGE 15407) a FOGAIBA , degut a la pandèmia soferta pel Covid 19 han quedat anul·lats els encàrrecs de carn per la qual cosa passaran a situació de liquidat zero, per tal de fer front a les inversions de l'ajuda de l'expedient de referència.&amp;nbsp;&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;4&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;. El 4 de maig de 2021, JOSE MARIA SIRVENT CERDÀ&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;, &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;amb&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;NIF ***2839**, &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;en representació de CARME SIRVENT MESTRE&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;em&gt;&lt;em&gt;va presentar una sol·licitud de pròrroga del termini d'execució (GOIBE149203) a FOGAIBA, degut a la pandèmia soferta pel Covid 19 en aquests dos anys, tots els encàrrecs de carn van quedar anul·lats oer la qual cosa passaran a una situació de liquiditat zero degut al tancament d'Hotels i Restaurants de l'Illa, els seus clients en l'actualitat segueixen tancats pel que no hi ha perspectives que puguen vendre la seva carn.&lt;/em&gt;&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;5&lt;/em&gt;&lt;/span&gt;&lt;em&gt;. L'aparta&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;t&amp;nbsp;dotzè, justificació i pagament de les ajudes, de la Resolució del president del FOGAIBA de 10 de juliol de 2015, estableix que el termini màxim per a la notificació i la justificació de la realització de la inversió proposada és de 12 mesos per a les inversions immobles i de 6 mesos per a les inversions mobles, a comptar des de l'endemà de la data de notificació de la resolució de concessió de l'ajuda. Per raons justificades de demora en la concessió de llicències per part dels ajuntaments, baixes laborals i incidències greus que no siguin imputables al sol·licitant, els beneficiaris podran sol·licitar l'ampliació del termini de realització i justificació establert a la resolució de concessió. Aquesta sol·licitud d'ampliació s'ha de presentar durant el termini d'execució.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;6&lt;/em&gt;&lt;/span&gt;&lt;em&gt;. El termini de concessió de la primera pròrroga acaba el 30 de juliol de 2021. L'interessat CARME SIRVENT MESTRE&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;, va presentar la sol·licitud de pròrroga el dia 4 de maig de 2021, i per tant dins de termini.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;7. D'acord amb l'apartat 2 de l'article 20 de l'Ordre del conseller d'Agricultura, Medi Ambient i Territori de 19 de febrer de 2015, per la qual s'estableixen les bases reguladores per a la concessió de subvencions en el marc del Programa de Desenvolupament Rural de les Illes Balears 2014-2020, regula que, amb caràcter excepcional i per raons degudament justificades, les persones beneficiàries de les ajudes podran sol·licitar l'ampliació o reobertura dels terminis establerts a la respectiva convocatòria, amb excepció del termini de presentació de sol·licituds. Aquesta sol·licitud s'ha de presentar abans del venciment del termini que es tracti.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;El FOGAIBA pot acordar l'ampliació sol·licitada sempre que amb això no es perjudiquin drets de terceres persones. L'acord d'ampliació s'ha de notificar individualment a l'interessat i no és susceptible de recurs.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Atès el Decret 64/2005, de 10 de juny, de creació del FOGAIBA; en virtut de l'Ordre de la consellera d'Agricultura i Pesca de 23 de desembre de 2005 es disposa que el FOGAIBA assumeix l'execució de la política de la Conselleria d'Agricultura i Pesca referent a l'aplicació de les mesures de foment i millora dels sectors agrari i pesquer a partir de l'1 de gener de 2006.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;8. Encara que la sol·licitud de la pròrroga s'ha presentat abans del venciment del termini de j&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;ustificació de la realització de la inversió, una vegada revisat l'expedient, es comprova que la persona interessada ha donat de baixa la seva explotació en el corresponent &lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;R&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;egistre agrari insular, requisit exigit per la convocatòria, per tant, s'ha de denegar la pròrroga sol·licitada. &lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Fonaments de dret&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;-Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 10 de juliol de 2015 per la qual es convoquen, per als anys 2015 a 2019, subvencions per a inversions en les explotacions agràries. &lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;-Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;Proposta de denegació de concessió de pròrroga&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Per tot l'exposat anteriormen&lt;/em&gt;&lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;t, s'informa favorablement la denegació de pròrroga i propòs al vicepresident del FOGAIBA que dicti una resolució en el termes següents:&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;1.
