    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:106%"&gt;Vist que en data 02.06.2021 s'ha dictat Decret de l'Alcaldia núm. 2021-1759 d'&lt;em&gt;incoació d'expedient de declaració de ruïna i acord de mesures derivades de la ruïna imminent de l'immoble denominat “Cantos Rodados” o “Apartamentos Don Pepe” situats en el TM de Sant Josep de sa Talaia. (expedient 5624/2021)&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:106%"&gt;Vist l'estipulat en l'article 45.1.a) de la Llei 39/2015, de 1 d'octubre, del Procediment Administratiu&lt;em&gt; &lt;/em&gt;Comú de les Administracions Públiques, a la vista de la pluralitat indeterminada d'interessats que pot existir i a fi de garantir la notificació a tots, sense perjudici a les notificacions individualment realitzades, es&lt;em&gt; &lt;/em&gt;publica aquesta resolució en el Butlletí Oficial de la Comunitat Autònoma i en el tauler d'anuncis de l'Ajuntament de Sant Josep de sa Talaia, sense dades personals, d'acord amb la Llei Orgànica 3/2018, de 5 de desembre, de Protecció de Dades Personals i garantia dels drets digitals.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;“DECRETO DE LA ALCALDIA&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;ASUNTO: INCOACIÓN DE EXPEDIENTE DE DECLARACIÓN DE RUINA Y ACUERDO DE MEDIDAS DERIVADAS DE LA RUINA INMINENTE DEL INMUEBLE DENOMINADO “CANTOS RODADOS” O “APARTAMENTOS DON PEPE” SITUADOS EN EL TM DE SANT JOSEP DE SA TALAIA. (EXPEDIENTE 5624/2021)&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Visto que en fecha 04.06.2020 se dictó Decreto de la Concejalía de Urbanismo y Actividades núm. 2020-1808 que resolvió:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="color:black"&gt;“PRIMERO. - ORDENAR &lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;em&gt;&lt;span style="color:black"&gt;de manera inmediata, el &lt;strong&gt;desalojo de los ocupantes &lt;/strong&gt;de las viviendas situadas en la Escalera 1 (bajo izquierda, primero derecha, primero izquierda, segundo derecha, segundo izquierda, tercero derecha, tercero izquierda, cuarto derecha y cuarto izquierda) del edificio llamado Cantos Rodados “apartamentos Don Pepe”, dado el riesgo inminente que supone para la seguridad de las personas, según lo establecido en el informe técnico de fecha 3 de junio de 2020, anteriormente transcrito.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="color:black"&gt;SEGUNDO. - ADVERTIR &lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;em&gt;&lt;span style="color:black"&gt;a los residentes de las viviendas detalladas en el punto anterior, que en caso de incumplimiento de la orden de desalojo inmediato por riesgo inminente para su seguridad, y una vez recibida la notificación del mismo, el Ayuntamiento lo ejecutará de manera forzosa.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="color:black"&gt;TERCERO. - ORDENAR &lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;em&gt;&lt;span style="color:black"&gt;a los propietarios de las viviendas detalladas en el punto primero, para que en relación con las deficiencias estructurales existentes en el edificio llamado Cantos Rodados “apartamentos Don Pepe”, escalera 1 , TM Sant Josep de sa Talaia, y de acuerdo a lo establecido en el informe técnico de fecha 3 de junio de 2020, se lleven a cabo las siguientes actuaciones: &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;-De manera inmediata el apuntalamiento pertinente de la estructura de la escalera 1 del conjunto denominado Cantos Rodados, bajo la dirección de técnico competente.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;-De manera inmediata realizar el estudio/diagnóstico de la estructura por técnico competente, para comprobar la estabilidad estructural de los dos bloques que conforman el conjunto denominado Cantos Rodados. El cual, consta encargado por la Concejalía de Urbanismo y Actividades del Ayuntamiento de Sant Josep.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="color:black"&gt;CUARTO. - ADVERTIR &lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;em&gt;&lt;span style="color:black"&gt;a los propietarios de las viviendas detalladas en el punto primero que, si en el plazo de 72 horas, no se ha dado cumplimiento a la orden de apuntalamiento pertinente de la estructura de la escalera 1, el Ajuntamiento procederá a la ejecución subsidiaria de las mismas.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;QUINTO. - NOTIFICAR &lt;/em&gt;&lt;/strong&gt;&lt;em&gt;la presente resolución a los interesados, con los recursos correspondientes.”-----&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Visto que en fecha 23.06.2020 se dictó Decreto de la Concejalía de Urbanismo y Actividades núm. 2020-2011 que resolvió:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="color:black"&gt;“PRIMERO. - ORDENAR &lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;em&gt;&lt;span style="color:black"&gt;de manera inmediata, el &lt;strong&gt;desalojo de los ocupantes &lt;/strong&gt;de las viviendas situadas en la Escalera 2, del bloque A (bajo izquierda, primero derecha, primero izquierda, segundo derecha, segundo izquierda, tercero derecha, tercero izquierda, cuarto derecha y cuarto izquierda) del edificio llamado Cantos Rodados “apartamentos Don Pepe”, dado el riesgo inminente que supone para la seguridad de las personas, según lo establecido en el informe técnico de fecha 22 de junio de 2020, anteriormente transcrito.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="color:black"&gt;SEGUNDO. - ADVERTIR &lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;em&gt;&lt;span style="color:black"&gt;a los residentes de las viviendas detalladas en el punto anterior, que, en caso de incumplimiento de la orden de desalojo inmediato por riesgo inminente para su seguridad, y una vez recibida la notificación del mismo, el Ayuntamiento lo ejecutará de manera forzosa.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="color:black"&gt;TERCERO. - ORDENAR &lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;em&gt;&lt;span style="color:black"&gt;a los propietarios de las viviendas detalladas en el punto primero, para que en relación con las deficiencias estructurales existentes en el edificio llamado Cantos Rodados “apartamentos Don Pepe”, bloque A, escalera 2, TM Sant Josep de sa Talaia, y de acuerdo a lo establecido en el informe técnico de fecha 22 de junio de 2020, se lleven a cabo las siguientes actuaciones: &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;-De manera inmediata el apuntalamiento pertinente de la estructura de la escalera 2 del conjunto denominado Cantos Rodados, bajo la dirección de técnico competente, que permita las operaciones del estudio/diagnóstico de la estructura ordenado en el Decreto 2020-1808 ya citado.”&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="color:black"&gt;CUARTO. - ADVERTIR &lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;em&gt;&lt;span style="color:black"&gt;a los propietarios de las viviendas detalladas en el punto primero que, si en el plazo de 72 horas, no se ha dado cumplimiento a la orden de apuntalamiento pertinente de la estructura de la escalera 2, el Ajuntamiento procederá a la ejecución subsidiaria de las mismas.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;QUINTO. - NOTIFICAR &lt;/em&gt;&lt;/strong&gt;&lt;em&gt;la presente resolución a los interesados, con los recursos correspondientes.”-----&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Visto el informe de los técnicos Iván Torres Ramón (arquitecto) y Juan Planells Ramón (arquitecto técnico), que tuvo entrada en este Ayuntamiento en fecha 31.08.2020 y NRE 2020-E-RE-5851, que concluye:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;“&lt;/em&gt;&lt;strong&gt;&lt;em&gt;6.2 CONCLUSIONES&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;El esquema estructural estático inicial adolece de su capacidad resistente por la acción del paso del tiempo, de los agentes climáticos agresivos, de la falta de mantenimiento y de procesos de deterioros patológicos de considerable gravedad que afectan su uso en relación a la seguridad de las personas que puedan residir. Asimismo, las patologías observadas en el esquema estructural básico de apoyo de la edificación, la resistencia de los materiales y su disposición constructiva denotan un claro riesgo imprevisible que afecta directamente a la habitabilidad y seguridad de las personas.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Los ensayos y sondeos realizados nos han permitido determinar que la patología detectada esta muy extendida por la Escalera 1 y que si bien es particularmente grave su alcance en planta baja también hay presencia en las viviendas. Sin embargo, los sondeos de las viviendas cambiaban mucho de unas a otras sin una lógica determinada lo que hace pensar que se trata de una &lt;/em&gt;&lt;strong&gt;&lt;em&gt;patología imprevisible &lt;/em&gt;&lt;/strong&gt;&lt;em&gt;y que como demuestra el desprendimiento en la vivienda del 4º1ª, el estado de la vivienda no es indicativo del alcance de la patología en los forjados ya que esta no avisa, actúa &lt;/em&gt;&lt;strong&gt;&lt;em&gt;sin dar muestras sintomatológicas previas&lt;/em&gt;&lt;/strong&gt;&lt;em&gt;.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;El encargo y los ensayos y sondeos realizados corresponden únicamente a la Escalera 1 por lo que solo podemos hablar con seguridad del estado de la misma. Sin embargo, la extensión de la patología de los forjados de manera general en toda la escalera, el hecho de que las causas (el clima y la calidad de la construcción) sean comunes a todo el conjunto y el estado en el que están las fachadas de ambos bloques hace pensar que &lt;/em&gt;&lt;strong&gt;&lt;em&gt;presumiblemente existe el mismo problema en todo el edificio.&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Sin analizar el resto de las escaleras no se puede saber su nivel de deterioro ni determinar cuando se presentarán más problemas, pero lo que si esta claro es que mientras el edificio permanezca expuesto sin apenas protección a las inclemencias del clima &lt;/em&gt;&lt;strong&gt;&lt;em&gt;el problema va a seguir avanzando &lt;/em&gt;&lt;/strong&gt;&lt;em&gt;hasta que se produzcan nuevos desprendimientos.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Los elementos estructurales analizados tanto verticales como horizontales y con más énfasis en el interior de las viviendas (conjunto resistente del forjado), el grado evidente de la oxidación de las armaduras de acero liso, la ausencia de la capa de compresión, la fragilidad de las bovedillas de hormigón y la acción expansiva de la corrosión de las armaduras derivan directamente en un pronunciamiento conservador de que el conjunto estructural se encuentra en fase de &lt;/em&gt;&lt;strong&gt;&lt;em&gt;fatiga estructural&lt;/em&gt;&lt;/strong&gt;&lt;em&gt;. Se acusa riesgo evidente hacia las personas y sobre todo no se asegura el uso y la habitabilidad del interior de las viviendas por la manifestación de signos o evidencias que podrían dar lugar a nuevos desprendimientos inesperados que afectarán a la seguridad de las personas.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Por su parte, el problema que presenta la jácena de planta baja que comparten las escaleras 1 y 2 es extremadamente alarmante pero se trata de un &lt;/em&gt;&lt;strong&gt;&lt;em&gt;problema puntual &lt;/em&gt;&lt;/strong&gt;&lt;em&gt;ya que por un lado es un elemento constructivo que no se repite en el resto del edificio - las plantas bajas del resto de escaleras, presuponiendo la inexistencia de cambios de origen, albergan viviendas y por lo tanto mantienen el muro de carga hasta la cimentación – y por otro su degeneración se ha visto acelerada por la fuga de agua de una bajante. Sería conveniente, sin embargo, comprobar el estado del sistema de saneamiento en el resto del edificio para asegurar que no existen problemas similares en otros puntos que deriven en la afección de otros elementos estructurales ocultos.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;El avanzado estado de la patología en los forjados de toda la escalera 1 especialmente en planta baja donde ya han comenzado a colapsar y el problema localizado en la jácena de planta baja que esta claramente comprometida lleva a recomendar que aunque los trabajos de estudio hayan finalizado se mantenga &lt;/em&gt;&lt;strong&gt;&lt;em&gt;la Escalera 1 apuntalada, se continúe apuntalando la Escalera 2 y en todo caso que las viviendas de las Escaleras 1 y 2 permanezcan desalojadas, &lt;/em&gt;&lt;/strong&gt;&lt;em&gt;para garantizar la seguridad de las personas y evitar el colapso de la estructura que podría arrastrar el resto del edificio.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;El apuntalamiento ejecutado en la escalera 1 y parte de la escalera 2 garantizan el posible colapso estructural de los elementos que conforman la estructura de la escalera 1 y parte de la escalera 2, se evidencian manifestaciones patológicas clásicas del hormigón armado por lo expresado en el punto número 1.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Se quiere hacer constar también que durante la primera visita se observaron varios puntos de la planta baja apuntalados y durante los trabajos de apuntalamiento se localizó en el forjado de la terraza que esta en voladizo y en la jácena de planta baja comprometida la aplicación incorrecta de mortero estructural de reparación. Se desconoce quién y por orden de quién se ejecutaron estos trabajos, lo que si que queda claro es que se tenía constancia de los problemas mencionados en el presente estudio.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;En definitiva, y según nuestro leal y saber entender, la edificación de la escalera 1 por completo y las partes observadas de la escalera 2 presentan una falta de estabilidad acusada, con un evidente riesgo para la seguridad, el uso y la habitabilidad de las personas y concluimos que estamos ante una edificación con riesgo de colapso imprevisible, fortuito e inesperado que podría llega a afectar al resto del conjunto del edificio.”------------------------------------------&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Visto el informe de los Servicios Técnicos Municipales emitido el 30.09.2020, cuyas conclusiones son:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:150%"&gt;&lt;em&gt;“&lt;/em&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="line-height:150%"&gt;Conclusió&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;D'acord amb els resultats de les proves i assajos que s'han dut a terme en diferents elements constructius, amb l'estudi-diagnosi realitzat pels tècnics Iván Torres Ramón i Joan Planells Ramón, i amb les visites d'inspecció, procedeix la &lt;/em&gt;&lt;strong&gt;&lt;em&gt;declaració de l'estat ruïnós&lt;/em&gt;&lt;/strong&gt;&lt;em&gt; de l'edifici segons l'article 126 de la Llei 12/2017, de 29 de desembre, d'Urbanisme de les Illes Balears (LUIB), almenys, per les següents raons:&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;
	&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Atès que l'edificació es troba en situació de &lt;/em&gt;&lt;strong&gt;&lt;em&gt;fora d'ordenació&lt;/em&gt;&lt;/strong&gt;&lt;em&gt; de l'art.129.2b de la LUIB, incorre en el &lt;/em&gt;&lt;strong&gt;&lt;em&gt;supòsit de ruïna urbanística &lt;/em&gt;&lt;/strong&gt;&lt;em&gt;establert al punt 2c de l'art.126 LUIB; és a dir, les actuacions imprescindibles per assegurar l'estabilitat i seguretat de la construcció&lt;/em&gt;&lt;strong&gt;&lt;em&gt; no són autoritzables&lt;/em&gt;&lt;/strong&gt;&lt;em&gt; en virtut de l'ordenament urbanístic en vigor.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

	&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;L'edifici també incorre en el supòsit de &lt;/em&gt;&lt;strong&gt;&lt;em&gt;ruïna tècnica&lt;/em&gt;&lt;/strong&gt;&lt;em&gt; del punt 2c del mateix article (126 LUIB) ja que presenta un &lt;/em&gt;&lt;strong&gt;&lt;em&gt;esgotament generalitzat&lt;/em&gt;&lt;/strong&gt;&lt;em&gt; dels elements estructurals fonamentals i, a més a més, les &lt;/em&gt;&lt;strong&gt;&lt;em&gt;patologies i danys&lt;/em&gt;&lt;/strong&gt;&lt;em&gt; existents comporten la necessitat d'una autèntica &lt;/em&gt;&lt;strong&gt;&lt;em&gt;reconstrucció de l'immoble&lt;/em&gt;&lt;/strong&gt;&lt;em&gt;.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;/ul&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Tot això sense prejudici de que, amb una &lt;/em&gt;&lt;strong&gt;&lt;em&gt;valoració econòmica&lt;/em&gt;&lt;/strong&gt;&lt;em&gt; (exhaustiva i per partides) de totes les actuacions necessàries per rehabilitar l'edificació en qüestió, molt probablement també es concorri en el supòsit de &lt;/em&gt;&lt;strong&gt;&lt;em&gt;ruïna econòmica&lt;/em&gt;&lt;/strong&gt;&lt;em&gt;.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Atès que en la parcel.la de projecte s'hi han executat obres sense les preceptives &lt;strong&gt;autoritzacions&lt;/strong&gt; i que, almenys en part, &lt;strong&gt;no es troben prescrites&lt;/strong&gt; i atès que les obres s'ubiquen en un sòl rústic protegit de l'art. 19.1 de la Llei 6/1999, de 3 d'abril, de les directrius d'ordenació territorial de les Illes Balears (concretament, dins d'AANP i en APT de costes), procedeix donar trasllat de la documentació al Consell Insular d'Eivissa d'acord amb el punt 3 de l'article 166 de la LUIB per a que, en el cas que escaigui, iniciïn els corresponents expedients en matèria de disciplina urbanística.”&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Vista la Diligencia de los Servicios Técnicos Municipales de fecha 31.05.2021, sobre llamada recibida en el Departamento de Urbanismo del Ayuntamiento el día 28.05.2021.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Vista el Acta de la Policía Local de fecha 31.05.2020, sobre llamada recibida en el Departamento de Urbanismo del Ayuntamiento el día 28.05.2021.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;SEGUNDO.-&lt;/strong&gt; Atendido que la edificación sita en Edificio A, calle Es Codolar s/n, parcela 208 del polígono 4, de la parroquia de Sant Francesc de s'Estany (referencia catastral 07048A00400208), de esta localidad, se encuentra en situación de ruina inminente con peligro para las personas y las cosas, DISPONER que por parte de la propiedad y/o los moradores de cada una de las viviendas, con carácter inmediato, y en todo caso en un plazo máximo de 72 horas desde la recepción de la presente resolución se adopten las siguientes medidas: &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;-&amp;nbsp;inmediato desalojo del inmueble por parte de los ocupantes/moradores de las viviendas situadas en la Escalera 3, 4 y 5 del Edificio A, los cuales, en caso de necesidad, pueden ponerse en contacto con los Servicios Sociales Municipales a fin de garantizarles una solución habitacional por el plazo máximo de 2 meses.&amp;nbsp; &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;-&amp;nbsp;el cerco perimetral del edificio por parte de la propiedad.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En caso de incumplimiento de alguna de estas dos medidas en el plazo señalado, el Ayuntamiento procederá a la ejecución forzosa de las medidas dispuestas con carácter de urgencia, a costa del obligado, en su caso. &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La adopción de las presentes medidas lo será sin perjuicio de proseguir la tramitación de expediente de declaración de ruina por los trámites normales.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;TERCERO.-&lt;/strong&gt; EN RELACIÓN AL INICIO DEL EXPEDIENTE DE DECLARACIÓN DE RUINA, poner el expediente de manifiesto a las personas propietarias y a los demás titulares de derechos afectados, de conformidad con lo dispuesto en el artículo 126 de la Ley 12/2017, de 29 de diciembre, de urbanismo de las Illes Balears, dándoles traslado, de los informes técnicos, para que en un plazo de 15 días , aleguen y presenten por escrito los documentos y justificaciones que estimen pertinentes en defensa de sus respectivos derechos. &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;CUARTO.-&lt;/strong&gt; EN RELACIÓN A LAS MEDIDAS ADOPTADAS EN EL PUNTO SEGUNDO, indicar que de conformidad con el artículo 126 de la Ley 12/2017, de 29 de diciembre, de Urbanismo de les Illes Balears -LUIB-&amp;nbsp; no resulta, en este caso, preceptiva la audiencia a las personas interesadas a tenor del carácter de urgencia. &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;QUINTO.-&lt;/strong&gt; ORDENAR A LA POLICÍA LOCAL la inspección de las Escaleras 1 y 2 del mismo bloque A, cuyo desalojo se dictó anteriormente mediante los Decretos 2020-1808 y 2020-2011 de 04.06.2020 y 23.06.2020 respectivamente, para que revise el efectivo desalojo de la totalidad del edificio, y si se detectase algún morador, lo identifique y le notifique el presente decreto.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;SEXTO.&lt;/strong&gt;- ADJUNTAR a la notificación del presente Decreto los informes de los SSTT externos Ayuntamiento (Iván Torres y Juan Planells) de 31.08.2020 y de los SSTT Ayuntamiento de Sant Josep de sa Talaia de 30.09.2020, todo ello a efectos de motivación del presente Decreto. &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;SÉPTIMO.-&lt;/strong&gt; PUBLICAR esta resolución en base al artículo 45.1.a) de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas&amp;nbsp; en el Boletín Oficial de la Comunidad Autónoma y en el tablón de anuncios del Ayuntamiento de Sant Josep de sa Talaia a la vista de la pluralidad de indeterminada de interesados que puede existir a fin de garantizar la notificación a todos, todo lo anterior, sin perjuicio a las notificaciones individualmente realizadas.&lt;/span&gt;&lt;/p&gt;
