    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;L'apartat 9.3. de la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 6&amp;nbsp;de juliol&amp;nbsp;de 2017&amp;nbsp;per la qual es convoquen, subvencions per a la creació d'empreses per a activitats no agràries a les zones rurals, corresponents a&amp;nbsp;l'any 2017, especifica que la resolució expressa es notificarà a les persones interessades mitjançant la seva publicació al &lt;em&gt;&lt;em&gt;Butlletí Oficial de les Illes Balears &lt;/em&gt;&lt;/em&gt;d'acord amb els termes que preveu l'article 45.2 de la Llei 39/2015, d'1 &amp;nbsp;d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;Els expedients han estat tramitats pel Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) en compliment del que disposa l'article 43 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;El vicepresident en matèria agrària del FOGAIBA, en data 28&amp;nbsp;de maig de 2021, va signar la següent resolució, &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;strong&gt;&lt;em&gt;“INFORME/PROPOSTA/RESOLUCIÓ DE CONCESSIÓ DE PRÒRROGA DEL TERMINI PER A LA JUSTIFICACIÓ DE LA INVERSIÓ SUBVENCIONABLE&lt;/em&gt;&lt;/strong&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;1.El &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;17 d'octubre de 2021 el vicepresident del FOGAIBA va dictar Resolució de concessió d'ajudes per a la creació d'empreses per a activitats no agràries a les zones rurals, publicada en el Butlletí Oficial de les Illes Balears núm. 133, de 25 d'octubre de 2018, en relació amb l'ajuda concedida a l'empara de la Resolució del president del &lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 6 de juliol de 2017, per la qual es convoquen, per a l'any 2017,&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;&amp;nbsp;subvencions per a la creació d'empreses per a activitats no agràries a les zones rurals, a la beneficiària ISABEL LLODRÀ RIERA&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;, &lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;amb&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;&amp;nbsp;NIF ***2391** i núm. d'expedient CENA2017_1/025, amb un termini d'execució de 9 mesos per a l'inici del pla empresarial i 5 anys per a l'execució des de la data de notificació de la resolució.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;2.&lt;/em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;El &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;10 de maig de 2021, per registre electrònic, amb registre entrada núm. 7170970, la beneficiària&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;va presentar una sol·licitud d'ampliació dels terminis establerts per a la justificació del projecte, fins al 15 d'abril de 2026, degut a la demora en la concessió de les llicències d'obra i activitats de l'Ajuntament i, per tant, retard en les obres i no poder comercialitzar fins a obtenir la certificació final d'obra i justificar els 3 anys d'ingressos que ha d'acreditar. &lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;3.&lt;/em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;L'aparta&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;t&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&amp;nbsp;o&lt;/em&gt;&lt;/span&gt;&lt;em&gt;nzè, justificació i pagament de les ajudes, de la Resolució del president del FOGAIBA de 6 de juliol de 2017, estableix que el termini màxim per notificar i justificar el compliment del pla empresarial és de cinc anys, a comptar de l'endemà de la data de notificació de la resolució de concessió de l'ajuda. No obstant això, aquest termini no podrà superar l'1 de desembre del 2023.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;4.&lt;/em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;La concessió de l'ajuda es va notificar &lt;/em&gt;&lt;/span&gt;&lt;em&gt;el 25 d'octubre de 2018, per tant el termini màxim per a la justificació de la inversió proposada acabava el 26 d'octubre de 2023 (5 anys). La persona interessada va presentar la sol·licitud de pròrroga el dia 10 de maig de 2021, i per tant dins de termini. &lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;5.&lt;/em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;D'acord amb l'aparta&lt;/em&gt;&lt;/span&gt;&lt;em&gt;t 2 de l'article 20 de l'Ordre del conseller d'Agricultura, Medi Ambient i Territori de 19 de febrer de 2015, per la qual s'estableixen les bases reguladores per a la concessió de subvencions en el marc del Programa de Desenvolupament Rural de les Illes Balears 2014-2020, regula que, amb caràcter excepcional i per raons degudament justificades, les persones beneficiàries de les ajudes podran sol·licitar l'ampliació o reobertura dels terminis establerts a la respectiva convocatòria, amb excepció del termini de presentació de sol·licituds. Aquesta sol·licitud s'ha de presentar abans del venciment del termini que es tracti.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;El FOGAIBA pot acordar l'ampliació sol·licitada sempre que amb això no es perjudiquin drets de terceres persones. L'acord d'ampliació s'ha de notificar individualment a l'interessat i no és susceptible de recurs.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Atès el Decret 64/2005, de 10 de juny, de creació del FOGAIBA; en virtut de l'Ordre de la consellera d'Agricultura i Pesca de 23 de desembre de 2005 es disposa que el FOGAIBA assumeix l'execució de la política de la Conselleria d'Agricultura i Pesca referent a l'aplicació de les mesures de foment i millora dels sectors agrari i pesquer a partir de l'1 de gener de 2006.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;6.Atès que la sol·licitud de la pròrroga s'ha &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;presentat abans del venciment del termini de j&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;ustificació de la realització de la inversió i està degudament motivada&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;, s'ha de concedir la pròrroga &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;sol·licitada, segons l'apartat onzè de la convocatòria, fins a l'1 de desembre de 2023, d'acord amb l&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;'apartat 2 de l'article 20 de l'Ordre del conseller d'Agricultura, Medi Ambient i Territori de 19 de febrer de 2015.&amp;nbsp;&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;&lt;em&gt;Fonaments de dret&lt;/em&gt;&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;1.Resolució de 6 de juliol de 2017 del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) per la qual es convoquen, per a l'any 2017, subvencions per &lt;/em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;a la creació d'empreses per a activitats no agràries a les zones rurals&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;2.Ordre del conseller d'Agricultura, Medi Ambient i Territori de 19 de febrer de 2015, per la qual s'estableixen les bases reguladores per a la concessió de subvencions en el marc del Programa de Desenvolupament Rural de les Illes Balears 2014-2020.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;3.Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Proposta de resolució de concessió pròrroga&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Per tot això, s'informa favorablement i es proposa al vicepresident en matèria agrària del FOGAIBA que dicti una resolució en els termes següents:&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;1.Concedir la pròrroga fins a l'1 de desembre de 2023 a ISABEL LLODRÀ RIERA&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;, &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;amb&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;NIF***2391**, &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;expedient número&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&amp;nbsp;CENA 2017_1/025. P&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;er tant&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;, &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;el termini màxim per a la justificació de la&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;inversió aprovada serà de 5 anys, 1 mes i cinc dies, des de el 26 d'octubre de 2018 fins a l'1 de desembre de 2023.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;2.Notificar aquesta resolució a la persona interessada mitjançant la publicació en el Butlletí Oficial de les Illes Balears. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Aquesta resolució no és susceptible de recurs.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
