&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;1.&amp;nbsp; El dia 22 de juny de 2020, el batle de Pollença va emetre el certificat de l'acord del Ple de l'Ajuntament de Pollença de data 17 de juny de 2020 de la proposta de sol·licitud de concessió de la Creu al Mèrit Policial amb Distintiu Blanc a diversos membres del cos de policia local de Pollença. Concretament es va demanar per a l'inspector Jaume Martorell Plomer; per als oficials Juan Ferrer Ferragut, José Antonio Perelló Vives i Jaume Simó Amengual; i per als policies Esteban Miguel Cifre Seguí, Pedro Ferriol Gual, María Antonia García Martínez, Ignacio Llompart Salas, Monserrate Mercer Muñoz, Lorenzo Ramon Coll, Pablo Sánchez Raya i Bernardo Seguí Cánaves.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;2.&amp;nbsp; El dia 3 de juliol de 2020, el director general d'Emergències i Interior va dictar la resolució per la qual s'acorda l'inici del procediment per concedir la Creu al Mèrit Policial amb Distintiu Blanc a diversos membres del cos de policia local de Pollença, en la qual nomena l'instructor del procediment.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;3.&amp;nbsp; El dia 23 de juliol de 2020 l'instructor del procediment va emetre la proposta de resolució sobre la base dels aspectes següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;em&gt;a)&lt;/em&gt; Els agents proposats per a la condecoració han complit més de trenta anys de servei policial i no tenen cap expedient disciplinari en curs o sanció disciplinària pendent de cancel·lar.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;em&gt;b)&lt;/em&gt; Segons entrevistes amb agents del cos policial de Pollença, destaquen la professionalitat i dedicació dels agents proposats per a la condecoració.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;Fonaments de dret&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;1.&amp;nbsp; L'article 52 de la Llei 4/2013, de 17 de juliol, de coordinació de les policies locals de les Illes Balears, modificat per la Llei 11/2017, de 20 de desembre, de modificació de la Llei 4/2013, determina la possibilitat de concedir premis i distincions als membres de la policia local de les Illes Balears en els termes que s'estableixin reglamentàriament.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;2.&amp;nbsp; El capítol V del títol VIII del Decret 40/2019, de 24 de maig, pel qual s'aprova el Reglament marc de coordinació de les policies locals de les Illes Balears i es modifica el Decret 55/2017, de 15 de desembre, del Fons de Seguretat Pública de les Illes Balears, regula les característiques i la concessió de premis i condecoracions. En concret, l'article 132, regula les circumstàncies per les quals es pot atorgar la Creu al Mèrit Policial amb Distintiu Blanc; l'article 137, regula qui pot formular la proposta de sol·licitud de concessió del guardó; i l'article 138 regula el procediment ordinari de concessió.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;Per tot això, dict la següent&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;Resolució&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;1.&amp;nbsp; Acordar la concessió de la Creu al Mèrit Policial amb Distintiu Blanc als membres del cos de la policia local de Pollença que s'indiquen a continuació:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;― Inspector Jaume Martorell Plomer. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;― Oficial Juan Ferrer Ferragut.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;― Oficial José Antonio Perelló Vives.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;― Policia Pedro Ferriol Gual.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;― Policia María Antonia García Martínez.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;― Policia Ignacio Llompart Salas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;― Policia Monserrate Mercer Muñoz.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;― Policia Lorenzo Ramon Coll.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;― Policia Pablo Sánchez Raya.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;― Policia Bernardo Seguí Cánaves.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;2.&amp;nbsp; Notificar aquesta resolució als agents guardonats i a l'Ajuntament de Pollença.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;3.&amp;nbsp; Ordenar la inscripció d'aquest acord al Registre de policies locals en la forma legalment determinada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;4.&amp;nbsp; Ordenar la publicació en el &lt;em&gt;Butlletí Oficial de les Illes Balears&lt;/em&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;Interposició de recursos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;Contra aquesta Resolució, que exhaureix la via administrativa, es pot interposar un recurs potestatiu de reposició davant la consellera d'Administracions Públiques i Modernització en el termini d'un mes comptador des de l'endemà de la notificació, d'acord amb l'article 124 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques, i de l'article 57 de la Llei 3/2003, de 26 de març, de règim jurídic de l'Administració de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;També es pot interposar directament un recurs contenciós administratiu davant la Sala Contenciosa Administrativa del Tribunal Superior de Justícia de les Illes Balears en el termini de dos mesos comptadors des de l'endemà de la notificació, d'acord amb l'article 46 de la Llei 29/1998, de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
