&lt;p style="margin-top:6,0000pt; text-align:justify"&gt;&lt;span&gt;&lt;span&gt;&lt;span&gt;&lt;span&gt;&lt;span style="line-height:114%"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;"&gt;&lt;span style="font-size:11,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;L'apartat 9.3. de la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 13 de novembre de 2015 per la qual es convoquen, subvencions per a inversions no productives vinculades a la realització de compromisos d'agroambient i clima, corresponents als anys 2015-2019, especifica que la resolució expressa es notificarà a les persones interessades mitjançant la seva publicació al &lt;/span&gt;&lt;/span&gt;&lt;em&gt;&lt;span style="font-size:11,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;em&gt;Butlletí Oficial de les Illes Balears &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;span style="font-size:11,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;d'acord amb els termes que preveu l'article 45.2 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0,0000pt; text-align:justify"&gt;&lt;span&gt;&lt;span&gt;&lt;span&gt;&lt;span&gt;&lt;span style="line-height:114%"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;"&gt;&lt;span style="font-size:11,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;Els expedients han estat tramitats pel Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) en compliment del que disposa l'article 43 de la Llei 43/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:0,0000pt; text-align:justify"&gt;&lt;span&gt;&lt;span&gt;&lt;span&gt;&lt;span style="line-height:114%"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;"&gt;&lt;em&gt;&lt;span style="font-size:11,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;span&gt;&lt;em&gt;1.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="font-size:11,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;span&gt;&lt;em&gt;En data &amp;nbsp;17 de novembre de 2015 es va publicar, en el Butlletí Oficial de les Illes Balears núm. 169, la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) per la qual es convoquen subvencions per a les inversions no productives vinculades a la realització de compromisos d'agroambient i clima, corresponents a l'any 2015 a 2019. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:0,0000pt; text-align:justify"&gt;&lt;span&gt;&lt;span&gt;&lt;span&gt;&lt;span style="line-height:114%"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;"&gt;&lt;em&gt;&lt;span style="font-size:11,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;span&gt;&lt;em&gt;2.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="font-size:11,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;span&gt;&lt;em&gt;De conformitat amb l'apartat sisè de la Resolució esmentada, el termini per presentar les sol·licituds va acabar el dia 30 de juny de 2017. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0,0000pt; margin-left:0,0000pt"&gt;&lt;span&gt;&lt;span&gt;&lt;em&gt;&lt;span style="font-size:11,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;span&gt;&lt;em&gt;3.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="font-size:11,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;span&gt;&lt;em&gt;Amb &amp;nbsp;les dates que figuren a &amp;nbsp;l'annex I es varen notificar les Resolucions de concessió als distints beneficiaries que figuren a l'esmentat annex. Amb l'import concedit i &amp;nbsp;amb les obligacions i compromisos que havien de complir.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0,0000pt; margin-left:0,0000pt"&gt;&lt;span&gt;&lt;span&gt;&lt;em&gt;&lt;span style="font-size:11,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;span&gt;&lt;em&gt;4.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="font-size:11,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;span&gt;&lt;em&gt;L' apartat dotzè &amp;nbsp;de la Resolució de la convocatòria &amp;nbsp;estableix les obligacions del beneficiari.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0,0000pt; margin-left:0,0000pt"&gt;&lt;span&gt;&lt;span&gt;&lt;em&gt;&lt;span style="font-size:11,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;span&gt;&lt;em&gt;5.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="font-size:11,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;span&gt;&lt;em&gt;A data d'avui, les persones beneficiàries que figuren a l'annex I &amp;nbsp;no han justificat les inversions objecte de la subvenció pel motiu que es reflexa a l'esmentat annex, per la qual cosa la inversió no pot ser objecte de subvenció. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0,0000pt; margin-left:0,0000pt"&gt;&lt;span&gt;&lt;span&gt;&lt;em&gt;&lt;span style="font-size:11,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;span&gt;&lt;em&gt;6.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="font-size:11,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;span&gt;&lt;em&gt;L'article 21.1 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques estableix l'obligació de l'Administració a dictar resolució expressa i a notificar-la. En el seu paràgraf segon especifica que “En els casos de prescripció, renúncia del dret, caducitat del procediment o desistiment de la sol·licitud, així com la desaparició sobrevinguda de l'objecte del procediment, la resolució consistirà en la declaració de la circumstància que concorri en cada cas, amb la indicació dels fets produïts i les normes aplicables”.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0,0000pt; margin-left:0,0000pt"&gt;&lt;span&gt;&lt;span&gt;&lt;em&gt;&lt;span style="font-size:11,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;span&gt;&lt;em&gt;7.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="font-size:11,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;span&gt;&lt;em&gt;L'article 43 del Text refós de la Llei de subvencions, aprovat per Decret legislatiu 2/2005, de 28 de desembre, disposa que “Pertoca la revocació de la subvenció quan, posteriorment a la resolució de concessió vàlida i ajustada a dret, el beneficiari incompleix totalment o parcialment les obligacions o els compromisos contrets als quals està condicionada l'eficàcia de l'acte de concessió de la subvenció. Com a conseqüència de la revocació de la subvenció, queda sense efecte, totalment o parcialment, l'acte de concessió i pertoca el reintegrament de les quantitats percebudes indegudament”.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0,0000pt; margin-left:0,0000pt"&gt;&lt;span&gt;&lt;span&gt;&lt;em&gt;&lt;span style="font-size:11,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;span&gt;&lt;em&gt;8.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="font-size:11,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;span&gt;&lt;em&gt;Atès tot això, es proposa fer la revocació total a causa de l'incompliment de l'obligació de realitzar i justificar les inversions concedides en el termini establert . &amp;nbsp;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0,0000pt; margin-left:0,0000pt"&gt;&lt;span&gt;&lt;span&gt;&lt;em&gt;&lt;span style="font-size:11,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;span&gt;&lt;em&gt;9.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="font-size:11,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;span&gt;&lt;em&gt;En relació a les dates de l'Annex I es notifica, mitjançant publicació a la pàgina &amp;nbsp;web&lt;span style="color:null"&gt; http://www.caib.es&lt;/span&gt;, l'esmentada proposta &amp;nbsp;als interessats, concedint-los un termini de 10 dies per presentar les al·legacions escaients.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0,0000pt; margin-left:0,0000pt"&gt;&lt;span&gt;&lt;span&gt;&lt;em&gt;&lt;span style="font-size:11,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;span&gt;&lt;em&gt;10.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;em&gt;&lt;span style="font-size:11,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;span&gt;&lt;em&gt;A dia d'avui, i una vegada finalitzat el termini, els interessats relacionats a l'annex I adjunt no han presentat al·legacions.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
