&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;1.En el &lt;em&gt;Butlletí Oficial de les Illes Balears&lt;/em&gt; núm.168 de 2019, de 14 de desembre es va publicar la Resolució de la presidenta de l'Institut d'Indústries Culturals de les Illes Balears de 13 de desembre de 2019 per la qual es convoquen ajudes destinades al foment de les indústries culturals i creatives, mitjançant ajudes per a l'adquisició d'equips i maquinària nous.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;2. D'acord amb el punt quart de resolució &lt;/span&gt;&lt;span style="color:#000000"&gt;esmentada, el crèdit inicial total assignat a la convocatòria és de 600.000 € i amb possibilitat d'ampliar-lo, sempre que les disponibilitats pressupostàries ho permetin, mitjançant una resolució d'ampliació de crèdit.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;3. &lt;/span&gt;&lt;span style="color:#000000"&gt;El punt&lt;/span&gt;&lt;span style="color:#000000"&gt; novè de la convocatòria estableix que la selecció dels beneficiaris, atesa la naturalesa d'aquestes ajudes, es regeix pel criteri de resolució de rigorós&lt;/span&gt;&lt;span style="color:#000000"&gt; ordre d'entrada de les sol·licituds en el Registre General de l'ICIB, o en els registres i les oficines que preveu l'article 16 de la Llei 39/2015.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="background-color:#ffffff"&gt;4. Durant aquest termini, es varen presentar cinc al·legacions contra la Proposta de resolució.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#ff3333"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;5&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;. &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;El &lt;/span&gt;&lt;span style="color:#000000"&gt;29&lt;/span&gt;&lt;span style="color:#000000"&gt; d'octubre de 2020, &lt;/span&gt;&lt;span style="color:#000000"&gt;la directora de l'ICIB va resoldre &lt;/span&gt;&lt;span style="color:#000000"&gt;diverses sol·licituds de la convocatòria d'ajudes destinades al foment de les indústries culturals i creatives, mitjançant ajudes per a l'adquisi&lt;/span&gt;&lt;span style="color:#000000"&gt;ció d'equips i maquinària nous, línia B &lt;/span&gt;&lt;span style="color:#000000"&gt;(BOIB, núm.188, de 31 de desembre). &lt;/span&gt;&lt;span style="color:#000000"&gt;En aquest moment es va exhaurir el crèdit disponible, deixant sense concessió peticions que, tot i complir amb les condicions de la convocatòria, no podien ser aprovades per manca de crèdit pressupostari.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#ff3333"&gt;&lt;span style="color:#000000"&gt;6. &lt;/span&gt;&lt;span style="color:#000000"&gt;En el &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Butlletí Oficial de les Illes Balears&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt; núm.210 de 2020, de &lt;/span&gt;&lt;span style="color:#000000"&gt;1&lt;/span&gt;&lt;span style="color:#000000"&gt;7&lt;/span&gt;&lt;span style="color:#000000"&gt; de desembre&lt;/span&gt;&lt;span style="color:#000000"&gt; es va publicar la Resolució de la presidenta de l'Institut d'Indústries Culturals de les Illes Balears de &lt;/span&gt;&lt;span style="color:#000000"&gt;1&lt;/span&gt;&lt;span style="color:#000000"&gt;6 de &lt;/span&gt;&lt;span style="color:#000000"&gt;desembre&lt;/span&gt;&lt;span style="color:#000000"&gt; de 2020 per la qual &lt;/span&gt;&lt;span style="color:#000000"&gt;es modifiquen els punt primer, quart i onzè de la Resolució de 13 de desembre de 2019 per la qual es convoquen ajudes destinades al foment de les indústries culturals i creatives, mitjançant ajudes per a l'adquisició d'equips i maquinària nous.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Aquesta Resolució, d'una banda, &lt;/span&gt;&lt;span style="color:#000000"&gt;amplia en &lt;/span&gt;&lt;span style="color:#000000"&gt;100.000,00 euros &lt;/span&gt;&lt;span style="color:#000000"&gt;el crèdit assignat a la convocatòria,&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;amb càrrec al capítol 7 del pressupost de l'ICIB per al 2020 &lt;/span&gt;&lt;span style="color:#000000"&gt;i, d'altra,&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;el període subvencionable i el termini de justificació per a les subvencions de la línia B, que es concedeixin amb posterioritat a &lt;/span&gt;&lt;span style="color:#000000"&gt;la data de&lt;/span&gt;&lt;span style="color:#000000"&gt;l 30 de novembre de 2020, &lt;/span&gt;&lt;span style="color:#000000"&gt;s'amplia&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;fins &lt;/span&gt;&lt;span style="color:#000000"&gt;al 28 de desembre de 2020.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#ff3333"&gt;&lt;span style="color:#000000"&gt;7. Com a conseqüència de l'ampliació de crèdit, el 18&lt;/span&gt;&lt;span style="color:#000000"&gt; de &lt;/span&gt;&lt;span style="color:#000000"&gt;desembre&lt;/span&gt;&lt;span style="color:#000000"&gt; de 2020, la directora de l'ICIB &lt;/span&gt;&lt;span style="color:#000000"&gt;va e&lt;/span&gt;&lt;span style="color:#000000"&gt;m&lt;/span&gt;&lt;span style="color:#000000"&gt;e&lt;/span&gt;&lt;span style="color:#000000"&gt;tre la proposta de resolució de concessió de subvencions.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;8. D'acord amb el punt desè de la convocatòria, les persones interessades disposav&lt;/span&gt;&lt;span style="color:#000000"&gt;en d'un termini &lt;/span&gt;&lt;span style="color:#000000"&gt;de tres &lt;/span&gt;&lt;span style="color:#000000"&gt;dies hàbils per presentar al·legacions.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;9. Dins el termini establert, s'han presentat &lt;/span&gt;&lt;span style="color:#000000"&gt;tres al·legacions.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;10. En el &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Butlletí Oficial de les Illes Balears&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt; &lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;n&lt;/span&gt;&lt;span style="color:#000000"&gt;úm.&lt;/span&gt;&lt;span style="color:#000000"&gt;06&lt;/span&gt;&lt;span style="color:#000000"&gt;7&lt;/span&gt;&lt;span style="color:#000000"&gt; de 202&lt;/span&gt;&lt;span style="color:#000000"&gt;1&lt;/span&gt;&lt;span style="color:#000000"&gt;, de &lt;/span&gt;&lt;span style="color:#000000"&gt;22&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;de &lt;/span&gt;&lt;span style="color:#000000"&gt;maig&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;de 2021 &lt;/span&gt;&lt;span style="color:#000000"&gt;es va publicar&lt;/span&gt;&lt;span style="color:#000000"&gt; Resoluci&lt;/span&gt;ó del president de l'Institut d'Indústries Culturals de les Illes Balears per la qual es modifica la Resolució de la presidenta de l'Institut d'Indústries Culturals de les Illes Balears de 16 de desembre de 2020 per la qual es modifiquen els punts primer, quart i onzè de la Resolució de 13 de desembre de2019 per la qual es convoquen ajudes destinades al foment de les indústries culturals i creatives,mitjançant ajudes per a l'adquisició d'equips i maquinària nous, per ampliar el termini de justificacióde les activitats subvencionades&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;Fonaments de dret&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;1. El Text refós de la Llei de subvencions, aprovat pel Decret legislatiu 2/2005, de 28 de desembre.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;2. L'Ordre de la consellera d'Educació i Cultura d'1 de juliol de 2009 per la qual s'estableixen les bases reguladores de les subvencions en matèria d'educació i cultura (BOIB núm. 100, d'11 de juliol).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;3. L'article 20.&lt;em&gt;h&lt;/em&gt;) dels Estatuts de l'ICIB, aprovats pel Decret 50/2018, de 21 de desembre, que disposa que la directora de l'ICIB és l'òrgan competent per a la concessió de subvencions.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;4. L'apartat 10 de la Resolució de la presidenta de l'ICIB de 13 de desembre de 2019 per la qual es convoquen ajudes destinades al foment de les indústries culturals i creatives, mitjançant ajudes per a l'adquisició d'equips i maquinària nous, que estableix que correspon a la directora de l'ICIB resoldre'n motivadament la concessió i notificar-la.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;Per tot això, d'acord amb les competències que m'atorguen l'apartat 10 de la convocatòria de subvencions de 13 de desembre de 2019 i l'apartat &lt;em&gt;h&lt;/em&gt;) de l'article 20 dels Estatuts de l'ICIB, aprovats pel Decret 50/2018, de 21 de desembre, dict la següent :&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;Resolució&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;1. Aprovar i concedir subvencions per l'import total de 100.000,00 € a favor dels beneficiaris que s'inclouen en l'annex 1.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;2. Denegar de la concessió de subvencions les sol·licituds incloses en l'annex 2.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;3. Excloure de la concessió de subvencions les sol·licituds incloses en l'annex 3.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;4. Autoritzar i disposar la despesa indicada per a cadascun dels beneficiaris amb càrrec als pressuposts, amb els imports detallats en l'annex 1.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;5. Publicar aquesta Resolució en el &lt;em&gt;Butlletí Oficial de les Illes Balears&lt;/em&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;Interposició de recursos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;Contra aquesta Resolució, que no exhaureix la via administrativa, es pot interposar un recurs d'alçada davant la presidenta de l'ICIB, en el termini d'un mes comptador a partir de l'endemà d'haver-se publicat, d'acord amb l'article 122 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques, i l'article&amp;nbsp;58 de la Llei 3/2003, de 26 de març, de règim jurídic de l'Administració de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
