19944 ca 649524 CAIB ![CDATA[Acord del Consell Executiu en sessió de caràcter ordinari de 12 d’abril de 2021, relatiu a la convocatòria dels ajuts ADS 2020: concessió i modificació de les bases (exp. 3408-2020-000001)]] ![CDATA[<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><strong>Antecedents </strong></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">1. El Consell Executiu del Consell Insular de Menorca, en la sessió de caràcter ordinari de 5 d'octubre de 2020, va aprovar la convocatòria d'ajuts a les agrupacions de defensa sanitària per a l'any 2020 (BOIB núm. 195 de 14 de novembre de 2020).</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Aquesta convocatòria es regeix per les bases reguladores aprovades pel CIM en la sessió de caràcter ordinari de 5 de març de 2018 (BOIB núm. 75 de 19 de juny de 2018), amb les substitucions següents: </span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">1. Se substitueixen les referències a l'any 2018 per l'any 2020.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">2. On deia 30 de novembre de 2018 ha de dir 31 de desembre de 2020.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">3. En compliment de l'article 9 del Regalment (CE) núm. 702/2014, el número de registre del document validat per a l'aplicació SANI (programa informàtic específic per a les comunicacions d'ajuts a la Comunitat Europea) se substituiria pel nombre que es validés per a la convocatòria de l'any 2020.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">4. La base 7.2 <em>p</em> es redacta de la manera següent : </span></span></span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"> </p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><em>p</em>) Relació de ramaders que constitueixen l'ADS en el moment de la sol·licitud i dels codis d'explotació, d'acord amb l'article 5 del Reial decret 479/2004, de 26 de març, pel qual s'estableix i es regula el Registre General d'Explotacions Ramaderes (REGA), així com la relació de veterinaris que formen part de l'ADS i presten serveis als ramaders integrants de l'associació.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"> </p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">5. L'associació de defensa sanitària Ovella de Menorca va justificar el 93,30 % de l'ajut que se li va concedir, mentre que l'associació de defensa sanitària de Boví Menorca va justificar l'ajut en la seva totalitat. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">3. La partida pressupostària, l'import màxim de l'ajut i el crèdit pressupostari són: </span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">- Partida 5.41240.4890002 Control Sanitari ADS </span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">- Quantia màxima: 65.000 euros</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">4. L'objecte d'aquest ajut és compensar el cost, des de la data de presentació de les sol·licituds fins al 31 de desembre de 2020, de les actuacions de vigilància, erradicació i control de malalties dels animals incloses en els programes sanitaris i zootècnics de les agrupacions de defensa sanitària ramadera (ADS) d'oví i boví de l'illa de Menorca aprovats per la Direcció General de Medi Rural i Marí del Govern de les Illes Balears. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Aquestes ajudes es concedeixen d'acord amb el Reglament (CE) núm. 702/2014 de la Comissió, de 25 de juny de 2014, pel qual es declaren determinades categories d'ajuda en els sectors agrícola i forestal i en zones rurals compatibles en el mercat interior en aplicació dels articles 107 i 108 del Tractat de Funcionament de la Unió Europea. També es tindran en compte les previsions del Reial decret 81/2015, de 13 de febrer, pel qual s'estableixen les bases que regulen les subvencions estatals destinades a les agrupacions de defensa sanitària ramaderes, que constitueix normativa bàsica d'acord amb la disposició final primera de l'esmentada disposició. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">5. La finalitat d'aquests ajuts és aconseguir, mitjançant la posada en pràctica d'un programa sanitari comú, la millora sanitària i productiva de les explotacions ramaderes.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">6. La base 4 d'aquests ajuts estableix quines són les activitats subvencionables i la base 8 indica els criteris que es tindran en compte per a la concessió dels ajuts i per a la determinació de l'import de la subvenció.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">La base 8.1 diu que sempre que es compleixin els requisits de la convocatòria s'atorgaran els ajuts sol·licitats, amb els límits fixats en la convocatòria i en les bases, i dins del crèdit disponible. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">7. Dia 16 de març de 2021 es va reunir la comissió avaluadora d'aquests ajuts, que va examinar la proposta de resolució de la instructora, que anava acompanyada de l'expedient corresponent, i va emetre informe sobre la proposta de resolució per a la distribució dels fons.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">8. La base 12.1 diu que el termini màxim per justificar l'acompliment dels compromisos adquirits era dia 3 de desembre de 2020. Tenint en compte que no ha estat possible complir aquest termini, la comissió avaluadora d'aquests ajuts proposa ampliar-lo fins al desè dia posterior al de la publicació de la concessió dels ajuts en el BOIB.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">9. El Consell Executiu del CIM, en la sessió de dia 5 d'octubre de 2020, va acordar que el president de la comissió avaluadora d'aquests ajuts fos el conseller d'Economia i Territori. Ara bé, pel Decret de Presidència núm. 54, de 12 de febrer de 2021 (BOIB núm.19 de 13-2-2021), el senyor Miquel Company Pons va cessar com a conseller d'Economia i Territori, i pel Decret de Presidència núm. 69/2021, de 26 de febrer, es va nomenar el senyor Josep Pastrana Huguet com a nou conseller d'Economia i Territori, per la qual cosa va ser aquest qui va presidir la comissió avaluadora d'aquests ajuts reunida dia 16 de març de 2021. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Atesa la proposta del conseller executiu del Departament d'Economia i Territori;</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">El Consell executiu, per unanimitat dels 7 membres presents i en votació ordinària, adopta els acords següents:</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><strong>Primer. </strong>Ratificar la modificació de la Presidència de la Comissió, que passa a ser exercida pel nou conseller d'Economia i Territori, senyor Josep Pastrana Huguet, nomenat pel Decret de Presidència núm. 69/2021 de 26 de febrer. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><strong>Segon.</strong> Concedir la quantitat total de 60.500 €, de la partida 5.41240.4890002 del pressupost del CIM per l'any 2021, als sol·licitants que s'indiquen, com a ajut del CIM a les agrupacions de defensa sanitària de Menorca (ADS), ajuts que es concedeixen d'acord amb el Reglament (CE) núm. 702/2014 de la Comissió, de 25 de juny de 2014, pel qual es declaren determinades categories d'ajuda en els sectors agrícola i forestal i en zones rurals compatibles en el mercat interior en aplicació dels articles 107 i 108 del Tractat de Funcionament de la Unió Europea.
