    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Vist l'informe tècnic amb proposta de resolució de dia 19 d'abril de 2021, i d'acord amb l'article 10.1.a) del Decret 4/2018, de 23 de febrer, pel qual s'aproven l'organització, les funcions i el règim jurídic de la Comissió de Medi Ambient de les Illes Balears (CMAIB) (BOIB núm. 26 de 27 de febrer de 2018),&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;RESOLC FORMULAR:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;L'informe d'impacte ambiental sobre &lt;span style="color:#000000"&gt;el&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;projecte d'urbanització de l'UE &lt;/span&gt;&lt;span style="color:#000000"&gt;86-05&lt;/span&gt;&lt;span style="color:#000000"&gt;, Sant&lt;/span&gt;&lt;span style="color:#000000"&gt; Jordi, &lt;/span&gt;&lt;span style="color:#000000"&gt;T.M. &lt;/span&gt;&lt;span style="color:#000000"&gt;Palma&lt;/span&gt;&lt;span style="color:#000000"&gt;, &lt;/span&gt;&lt;span style="color:#000000"&gt;promogut per JUNTA DE COMPENSACIÓ UE/86-05 SANT JORDI., en els termes següents: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;1.Determinació de subjecció a avaluació ambiental i tramitació&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;El projecte es tramita com una avaluació d'impacte ambiental simplificada ja que l'article 14 de la llei 12/2016, de 17 d'agost d'avaluació ambiental a les Illes Balears, indica al seu punt 2.a que &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;"Han de ser objecte d'avaluació d'impacte ambiental simplificada els projectes següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;- Els projectes inclosos en l'annex II de la Llei 21/2013, de 9 de desembre, d'avaluació ambiental, o en l'annex 2 d'aquesta llei."&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;El projecte que s'avalua està inclòs en el grup 4 (Projectes d'infraestructures) punt 1 de l'annex II, que inclou projectes d'urbanització en general. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;2.Descripció i ubicació del projecte&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;El projecte que es presenta consisteix en la urbanització d'una unitat d'execució (UE-86-05) prevista en sòl urbà, en el nucli de Sant Jordi. D'acord amb el document ambiental l'objecte del projecte és definir les obres necessàries per a la implementació dels serveis urbanístics que donin servei a les edificacions previstes a la UE 86-05. Comprèn la xarxa viària, aigua potable, aigües residuals, telefonia, xarxa de mitja i baixa tensió, enllumenat públic i adequació de la zona verda (plaça). No comprèn les edificacions ni regula els usos ni la seva capacitat de població.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;El promotor és la &lt;/span&gt;&lt;span style="color:#000000"&gt;JUNTA DE COMPENSACIÓ UE/86-05 SANT JORDI&lt;/span&gt;&lt;span style="color:#000000"&gt;, SL &lt;/span&gt;&lt;span style="color:#000000"&gt;i l'òrgan substantiu &lt;/span&gt;&lt;span style="color:#000000"&gt;és &lt;/span&gt;&lt;span style="color:#000000"&gt;l'Ajuntament de &lt;/span&gt;&lt;span style="color:#000000"&gt;Palma.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;La UE 86-05 se situa en sòl urbà al nucli de Sant Jordi, preveu la connexió viària en forma de T, connectant amb dos punts del carrer Sant Jordi (portals 109 i 113) i amb el carrer Vadell.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;D'acord amb la fitxa d'unitat d'execució UE/86-05 de l'ajuntament de Palma, inclosa a l'informe de la tècnica de medi ambient de planejament urbanístic, es pot construir fins a 80 habitatges. &lt;span style="color:#000000"&gt;Les obres d'urbanització cont&lt;/span&gt;&lt;span style="color:#000000"&gt;e&lt;/span&gt;&lt;span style="color:#000000"&gt;mplades en el projecte són &lt;/span&gt;&lt;span style="color:#000000"&gt;demolició d'edificacions,&lt;/span&gt;&lt;span style="color:#000000"&gt; moviment de terres, excavacions i preparació del terreny, la pavimentació de les calçades, aparcaments, voreres &lt;/span&gt;&lt;span style="color:#000000"&gt;amb arbrat compost per l'&lt;/span&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;arbre de l'amor&lt;/span&gt;&lt;/em&gt;&lt;span style="color:#000000"&gt; o &lt;/span&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;arbre&lt;/span&gt;&lt;/em&gt;&lt;span style="color:#000000"&gt; de Judea (Cercis siliquastrum)&lt;/span&gt;&lt;span style="color:#000000"&gt;, pas de vianants, l'execució de les xarxes de distribució d'aigua potable de reg i hidrants contraincendis, la construcció de les xarxes de clavegueram, &lt;/span&gt;&lt;span style="color:#000000"&gt;no hi ha&lt;/span&gt;&lt;span style="color:#000000"&gt; recollida &lt;/span&gt;&lt;span style="color:#000000"&gt;d'aigües&lt;/span&gt;&lt;span style="color:#000000"&gt; pluvials &lt;/span&gt;&lt;span style="color:#000000"&gt;(el drenatge es realitza cap el terreny de l'entorn)&lt;/span&gt;&lt;span style="color:#000000"&gt;, la xarxa de distribució d'energia elèctrica, centres de transformació i escomesa de mitja tensió, la dotació d'enllumenat públic. Respecte als espais lliures, s'ha &lt;/span&gt;&lt;span style="color:#000000"&gt;dissenyat un espai lliure públic amb estructura de plaça &lt;/span&gt;&lt;span style="color:#000000"&gt;de 446 m&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;sup&gt;2&lt;/sup&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;, amb àrees enjardinades, bancs i una zona de jocs infantils.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;El document ambiental indica que no són competència de l'estudi l'avaluació dels efectes ambientals dels habitatges, "ni de los consumos o exumos", perquè el planejament urbanístic no és objecte de reavaluació ambiental.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Per tant, no es tenen en compte els impactes produïts per l'ocupació permanent del sòl i reducció de la superfície de sòl productiu, el consum d'aigua, no només pel manteniment dels equipaments i espais enjardinats, sinó pel consum dels habitants dels habitatges prevists i també per incrementar la producció d'aigües residuals.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El document ambiental no inclou mesures per tal de reduir l'efecte del projecte sobre el canvi climàtic.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Presenten una addenda al document ambiental en data 04 de febrer de 2021 aportant una taula amb la identificació dels efectes de la implantació i usos dels habitatges. Identifiquen els següents impactes: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;-Qualitat de l'aire, emissions de pols i renou. Valorat com a compatible.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;-Canvi climàtic, emissions de CO2 derivades del consum de població. Valorat com a compatible.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;-Aigua, consum d'aquest recurs. Valorat com a compatible.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;-Usos del territori, ocupació permanent del sòl i reducció de la superfície de sòl productiu. Valorat com a compatible.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;-Infraestructures i equipaments. Valorat com a compatible.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;-Paisatge, disminució de la qualitat paisatgística per la introducció de nous elements. Valorat com a compatible.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;El projecte no afecta cap dels espais de rellevància ambiental definits en la Llei 5/2005, de 26 de maig LECO (ENP i XN2000) ni la LEN (Llei 1/91, de 30 de gener). No es localitza cap espai Xarxa Natura 2000 a l'emplaçament del projecte o el seu entorn. Tampoc està afectat per Àrees de Prevenció de Riscos (APRs) d'erosió o esllavissaments. Referent a Inundacions, limita al Nord-oest amb un APR d'inundació i part de l'àrea d'execució es troba dins plana geomorfològica d'inundació. No es veu afectat per Àrees de Risc Potencial Significatiu per Inundació. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;El projecte d'urbanització està afectat per una Àrea de Prevenció de Riscos d'Incendis, de risc b&lt;span style="color:#000000"&gt;aix &lt;/span&gt;segons el IV Pla Forestal de les Illes Balears (2015-2024). Quant a la protecció de les aigües subterrànies, el projecte s'ubica a la Massa d'Aigua Subterrània (MAS) 1814M2 «&lt;span style="color:#000000"&gt;Sant Jordi&lt;/span&gt;» amb deteriorament estructural, &lt;span style="color:#000000"&gt;m&lt;/span&gt;&lt;span style="color:#000000"&gt;al&lt;/span&gt; estat quantitatiu i químic i presència de clorurs i nitrats. Presenta vulnerabilitat &lt;span style="color:#000000"&gt;alta&lt;/span&gt; a la contaminació d'aqüífers.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;No es troba en la zona d'execució del projecte cap Hàbitat d'Importància Comunitària (HIC) segons consulta al visor de la IDEIB.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;El paisatge que l'envolta està conformat per paisatge urbà en contacte amb un entorn agrícola. No afecta cap element classificat com Bé d'Interès Cultural (BIC) o Bé Catalogat. A pocs metres de la zona d'execució trobem molins de vent d'extracció d'aigua catalogats, que no resulten afectats per les obres. També es troba dins els límits d'afecció de les servituds aeronàutiques de l'aeroport de Palma de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;3.Avaluació dels efectes previsibles&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;L'execució del projecte d'urbanització produirà els majors impactes durant la fase d'execució per l'emissió de pols i renous pel moviment de terres i la circulació de vehicles i maquinària pesa&lt;span style="color:#000000"&gt;nt&lt;/span&gt;, que causaran molèsties a la població dels habitatges propers i efectes negatius a la qualitat de l'aire. També hi haurà ocupació del sòl i risc de contaminació del sòl per possibles vessaments. &lt;span style="color:#000000"&gt;Els treballs d&lt;/span&gt;&lt;span style="color:#000000"&gt;e &lt;/span&gt;&lt;span style="color:#000000"&gt;condicionament i desbrossament elimina&lt;/span&gt;&lt;span style="color:#000000"&gt;ran&lt;/span&gt;&lt;span style="color:#000000"&gt; la vegetació &lt;/span&gt;&lt;span style="color:#000000"&gt;agrícola &lt;/span&gt;&lt;span style="color:#000000"&gt;existent en les parcel·les afectades. A més, es produirà una disminució de l'hàbitat de les espècies de fauna existents en la zona.&lt;/span&gt;&lt;span style="color:#000000"&gt; El paisatge es veurà alterat per la presència de la maquinària, vehicles i zones d'acopi provisionals de l'obra.&lt;/span&gt;&lt;span style="color:#000000"&gt; Es produiran impactes positius sobre la població per la creació de &lt;/span&gt;&lt;span style="color:#000000"&gt;llocs de feina.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Les actuacions d'eliminació de la capa vegetal, desbrossament i moviments de terra, demolició de l'habitatge i&lt;span style="color:#000000"&gt; &lt;/span&gt;magatzem existent i excavacions de les rases produiran un volum important de residus de construcció i demolició (RCD). &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Els impactes durant la fase d'explotació seran positius per a la població per la millora dels equipaments i el funcionament dels vials, i negatius per l'ocupació permanent del sòl i reducció de la superfície de sòl productiu; augment de sòl pavimentat; augment d'escolament superficial; emissions de gasos contaminants i d'efecte hivernacle pel trànsit de vehicles i la contaminació lumínica de l'enllumenat públic, consum d'aigua, generació d'aigües residuals, consum energètic, risc de contaminació d'aqüífer, efectes sobre la flora i la fauna, paisatge i el risc d'inundació. &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Els efectes sobre la fauna i la vegetació seran de baixa incidència, ja que la presència d'animals terrestres i avifauna en la zona &lt;span style="color:#000000"&gt;é&lt;/span&gt;s limitada, atès l'ús agrícola abandonat imperant. S'ha consultat el Bioatles per determinar la presència d'espècies catalogades a la zona del projecte, i per les dimensions i situació del projecte les afeccions seran mínimes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Es produirà una afectació en el paisatge que no es considera significativa, atès l'entorn de caràcter urbà en el qu&lt;span style="color:#000000"&gt;a&lt;/span&gt;&lt;span style="color:#000000"&gt;l&lt;/span&gt; s'emmarca el projecte i del seu entorn. Els majors impactes visuals es produiran durant la fase de construcció per la presència de maquinària d'obra. &lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;No s'afectaran els &lt;/span&gt;&lt;span style="color:#000000"&gt;molins de vent d'extracció d'aigua catalogats, que no resulten afectats per les obres&lt;/span&gt;&lt;span style="color:#000000"&gt;. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Entre els impactes negatius més importants es troben:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;-El consum d'aigua, no només pel manteniment dels equipaments i espais enjardinats, sinó pel consum dels habitants dels 80 habitatges prevists.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;-L'augment en la producció d'aigües residuals a conseqüència del nou creixement d'habitatges associat al desenvolupament urbanístic empitjorarà la capacitat de sanejament de l'EDAR Palma I.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;-Consum energètic.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;-Contaminació d'aqüífer, no preveuen instal·lar un decantador/separador de graves i greixos/hidrocarburs que reculli les aigües pluvials potencialment hidrocarburades produïdes en els paviments abans del seu abocament.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;-Referent al risc d'inundació, part de la parcel·la d'actuació es troba a zona inundable o potencialment inundable, d'acord amb&lt;/span&gt;&lt;span style="color:#000000"&gt; l'informe del Servei de Gestió del Domini Públic Hidràulic no &lt;/span&gt;&lt;span style="color:#000000"&gt;disposen d'un &lt;/span&gt;&lt;span style="color:#000000"&gt;estudi hidrològic-hidràulic que permeti comprovar que els usos pretesos per aquesta àrea siguin compatibles amb la normativa hidràulica, a més, serà necessària una autorització administrativa prèvia de la DG de Recursos Hídrics.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;4.Consultes a les administracions públiques afectades i persones interessades&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;D'acord amb l'article 46 de la Llei 21/2013, de 9 de desembre, d'avaluació ambiental, s'ha consultat a la Direcció General de Territori i Paisatge (RS SAA núm. 175), Direcció General de Recursos Hídrics (RS SAA núm. 176), a la Direcció General de Salut Pública (RS CMAT núm. 4579), AENA (RS CMAT núm.4580), a la Direcció General de Canvi Climàtic (RS CMAT núm.4581), a la Direcció Insular de Territori i Paisatge (RS L30S4582/2020), a la Direcció Insular d'Urbanisme (RS L30S4583/2020) i a la Direcció Insular de Patrimoni (RS L30S4584/2020).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;-En data 07 de juliol de 2020 s'ha rebut &lt;span style="color:#000000"&gt;l'informe del Servei d'&lt;/span&gt;&lt;span style="color:#000000"&gt;Ordenació del Territori i Urbanisme&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;que indica&lt;/span&gt;:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;DL 9/2020, de mesures urgents de protecció del territori de les Illes Balears. En relació a l'article 2, Determinacions sobre sòl urbà amb urbanització no consolidada, es considera que no és d'aplicació, ja que almenys no es compleix l'apartat 1.d, a l'estar envoltat amb més de dos terços del seu perímetre per sols que tenen la condició d'urbans. No obstant correspon a l'Ajuntament a l'àmbit de les seves competències efectuar tal apreciació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;Caldria valorar la següent observació ambiental: Un dels dos nous vials que es preveu a la UA, serà el futur límit del nucli urbà. Es nota a faltar una valoració paisatgística de la integració del front del nucli de població en relació amb el medi físic que el rodeja, dins els límits que permet un PU, que en paraules del document ambiental és viari amb il·luminació i arbrat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;-En data 07 d'agost &lt;/span&gt;&lt;span style="color:#000000"&gt;de 2020 s&lt;/span&gt;&lt;span style="color:#000000"&gt;'ha rebut &lt;/span&gt;&lt;span style="color:#000000"&gt;l'informe d&lt;/span&gt;&lt;span style="color:#000000"&gt;'A&lt;/span&gt;&lt;span style="color:#000000"&gt;ENA &lt;/span&gt;&lt;span style="color:#000000"&gt;indica&lt;/span&gt;&lt;span style="color:#000000"&gt;: &lt;span style="background-color:#ffffff"&gt;«Según los datos proporcionados acerca del "Proyecto de Urbanización UE 86-05 Sant Jordi", éstos quedarían situados dentro de los límites de afección de las Servidumbres Aeronáuticas del Aeropuerto de Palma de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;Conforme al Decreto 584/1972, de 24 de febrero, de Servidumbres Aeronáuticas, modificado por el Real Decreto 297/2013, de 26 de abril, en desarrollo del artículo 51 de la Ley 48/1960, de 21 de julio, sobre Navegación Aérea, se deberá contar, previamente a la ejecución de los proyectos, con el acuerdo favorable de la Agencia Estatal de Seguridad Aérea (AESA), debiéndose cursar las propuestas de proyectos a desarrollar directamente a dicho Organismo dependiente del Ministerio de Fomento, Avenida del General Perón nº 40, Edificio MAPFRE 4ªplanta, 28020 Madrid.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;El incumplimiento o la incorrecta aplicación de lo anterior, que afecte o suponga un riesgo para la seguridad y operatividad de la aviación y aeronavgabilidad correspondientes al Aeropuerto de Palma de Mallorca y/o al Aeropuerto de Son Bonet devengará la correspondiente responsabilidad contenida en la Ley 21/2003, de 7 de julio, de Seguridad Aérea, pudiéndose incoar, en su caso, el oportuno expediente sancionador. Asimismo, dicho incumplimiento o incorrecta aplicación del punto expresado en el condicionado conllevará la revocación y la pérdida de validez y legitimidad del presente documento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;Por último, reseñar que, teniendo en cuenta todo lo expuesto, no se encuentran observaciones a los proyectos referidos en lo que a las competencias de esta Dirección de Planificación y Medio Ambiente se refiere.»&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;-En data 31 d'agost de 2020 té entrada l'informe per part del Servei de Salut Ambiental, ens informa del següent:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;S'informa que no s'han observat factors que puguin afectar a la salut pública.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;La xarxa d'aigua potable plantejada s'haurà d'executar seguint la normativa vigent referent a l'aigua de consum humà i les seves instal·lacions.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;-En data 14 d'abril de 2021 té entrada l'informe del &lt;/span&gt;&lt;span style="color:#000000"&gt;Servei d'Estudis i Planificació i indica que serà necessària la presentació de la següent documentació complementària:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;1) Indicar si en l'àmbit del Pla Parcial aquesta UE va ésser informada en quan a suficiència hídrica.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;2) Segons l'art. 66 del PHIB 2019, ja que la realització del Projecte implicarà la construcció de noves vivendes, un increment de la demanda de recursos hídrics i la seva capacitat de sanejament, i com el fet d'ésser zona urbana no assegura la disponibilitat d'aigua ni la capacitat de sanejament, s'haurà de presentar:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:120px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;-Un informe o certificat de l'empresa subministradora d'aigua que asseguri els recursos hídrics disponibles i les propostes per atendre la nova demanda.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:120px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;-Un certificat de l'entitat responsable de la depuració que asseguri que els volums generats d'aigües residuals podran ser tractats per l'Edar existent i no interferiran en els valors límits imposats en l'autorització d'abocament, que també s'ha d'incloure.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;La quantificació d'aquest augment previst es calcularà amb els habitants per habitatge que preveu el Reglament de la LOUS (2,5 habitants per habitatge) i amb la dotació real de subministrament del municipi (243,221 litres de mitjana per persona i dia).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;3) A la zona de vialitat i aparcaments, per a l'evacuació de les aigües produïdes en els seus paviments impermeabilitzats, per semblança amb l'art. 60.4 de l'PHIB 2019, com són pluvials potencialment hidrocarburades, i abans del seu abocament, s'haurà d'instal·lar sempre un decantador/separador de graves i greixos/hidrocarburs enterrat, el qual no s'ha previst al Document Ambiental.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;4) En quan al reg de les zones verdes urbanes i als tipus d'arbres utilitzats, segons l'art. 63.1 i 63.2 del PHIB-2019, es prioritzarà la utilització d'aigües pluvials i aigües regenerades s'utilitza aigua potable de la xarxa). i s'utilitzaran preferentment espècies vegetals autòctones i de baix requeriment hídric (es preveu la plantació d'arbres no autòctons).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;-En data 14 d'abril de 2021 té entrada l'informe del Servei de Gestió del Domini Públic Hidràulic i realitza les següents conclusions:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;a) S'informa que una part de les obres es desenvolupa en zona potencialment inundable. &lt;/span&gt;L'art. 105 del Pla Hidrològic de les Illes Balears indica que les actuacions en zones inundables, s'han de regir per les disposicions del Reglament del &lt;span style="color:#000000"&gt;Domini Públic Hidràulic.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;b) El Reglament del Domini Públic Hidràulic estableix una sèrie de limitacions als usos del sòl en zona inundable, que són més greuges en cas d'estar en l'anomenada zona de flux preferent, una zona d'alt risc per a persones i béns en cas d'avinguda.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;La Direcció General de Recursos Hídrics no disposa d'un estudi hidrològic-hidràulic d'aquesta zona, fet pel qual, tal com estableix l'art. 104 del Pla Hidrològic de les Illes Balears, el promotor ha d'elaborar-lo. (el contingut i les metodologies estan descrites en el PHIB).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Pot ser que les limitacions que imposa la normativa hidràulica, atesos els estudis hidràulics, siguin incompatibles amb els usos pretesos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;c) Aquest informe no és una autorització. Les actuacions/activitats que es desenvolupin a la parcel·la, localitzades en zona inundable o potencialment inundable, requeriran autorització administrativa prèvia de la DG de Recursos Hídrics, sense perjudici de les que siguin exigibles per altres administracions públiques, i, si escau, dels propietaris de terrenys particulars.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;5.Anàlisi dels criteris de l'annex III de la Llei 21/2013&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;S'han analitzat els criteris de l'annex III de la Llei 21/2013, d'avaluacions ambientals i es contempla que el projecte pot tenir efectes significatius sobre el medi ambient:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Característiques del projecte: l'objecte del projecte és definir les obres necessàries per a la implementació dels serveis urbanístics que donin servei a les edificacions previstes a la UE 86-05. Comprèn la xarxa viària, aigua potable, aigües residuals, telefonia, xarxa de mitja i baixa tensió, enllumenat públic i adequació de la zona verda (plaça). El nombre d'habitants prevists per a la unitat d'execució 86-05 al PGOU de Palma és de 240 i el nombre màxim d'habitatges 80.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;2. Ubicació del projecte: La UE 86-05 se situa en sòl urbà al nucli de Sant Jordi, preveu la connexió viària en forma de T, connectant amb dos punts del carrer Sant Jordi (portals 109 i 113) i amb el carrer Vadell.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="display:inline-block"&gt;&lt;span style="color:#000000"&gt;L'àmbit no està integrat dins &lt;span style="color:#000000"&gt;Xarxa Natura 2000 ni forma part de cap espai natural protegit. No s'hi troben hàbitats d'interès comunitari ni espècies amenaçades. El projecte es troba fora dels perímetres de restriccions dels pous de proveïment urbà. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;Tampoc està afectat per Àrees de Prevenció de Riscos (APRs) d'erosió o esllavissaments, per &lt;span style="color:#000000"&gt;Hàbitat&lt;/span&gt;&lt;span style="color:#000000"&gt;s&lt;/span&gt;&lt;span style="color:#000000"&gt; d'Importància Comunitària (HIC), &lt;/span&gt;&lt;span style="color:#000000"&gt;ni per &lt;/span&gt;&lt;span style="color:#000000"&gt;cap element classificat com Bé d'Interès Cultural (BIC) o Bé Catalogat&lt;/span&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;El projecte d'urbanització està afectat per una Àrea de Prevenció de Riscos d'Incendis, de risc b&lt;span style="color:#000000"&gt;aix.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;S'ubica a la Massa d'Aigua Subterrània (MAS) 1814M2 «&lt;span style="color:#000000"&gt;Sant Jordi&lt;/span&gt;» amb vulnerabilitat &lt;span style="color:#000000"&gt;alta&lt;/span&gt; a la contaminació d'aqüífers. &lt;span style="color:#000000"&gt;El paisatge que l'envolta està conformat per paisatge urbà en contacte amb un entorn agrícola &lt;/span&gt;&lt;span style="color:#000000"&gt;i dins els límits d'afecció de les servituds aeronàutiques de l'aeroport de Palma de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Referent a Inundacions, limita al Nord-oest amb un APR d'inundació i part de l'àrea d'execució es troba dins plana geomorfològica d'inundació. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;3. Característiques del potencial impacte: L'execució del projecte d'urbanització produirà els següents&lt;/span&gt;&lt;span style="color:#000000"&gt; impactes &lt;/span&gt;&lt;span style="color:#000000"&gt;temporals &lt;/span&gt;&lt;span style="color:#000000"&gt;durant la fase d'execució:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;-Emissió de pols i renous &lt;/span&gt;&lt;span style="color:#000000"&gt;causats &lt;/span&gt;&lt;span style="color:#000000"&gt;pel moviment de terres, &lt;/span&gt;&lt;span style="color:#000000"&gt;demolició de l'habitatge i magatzem existents&lt;/span&gt;&lt;span style="color:#000000"&gt; i &lt;/span&gt;&lt;span style="color:#000000"&gt;per &lt;/span&gt;&lt;span style="color:#000000"&gt;la circulació de vehicles i maquinària pesan&lt;/span&gt;&lt;span style="color:#000000"&gt;t&lt;/span&gt;&lt;span style="color:#000000"&gt;, que causaran molèsties a la població dels &lt;/span&gt;&lt;span style="color:#000000"&gt;habitatges&lt;/span&gt;&lt;span style="color:#000000"&gt; propers i &lt;/span&gt;&lt;span style="color:#000000"&gt;perjudicaran la qualitat de l'aire. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;-O&lt;/span&gt;&lt;span style="color:#000000"&gt;cupació del sòl i risc de contamina&lt;/span&gt;&lt;span style="color:#000000"&gt;ció d'aqüífers. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;-E&lt;/span&gt;&lt;span style="color:#000000"&gt;liminació de la vegetació existent: &lt;/span&gt;&lt;span style="color:#000000"&gt;les actuacions d'eliminació de la capa vegetal, desbrossament i moviments de terra.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;-D&lt;/span&gt;&lt;span style="color:#000000"&gt;isminució de l'hàbitat de les espècies de fauna no protegida existents en la zona, així com risc d'atropellament &lt;/span&gt;&lt;span style="color:#000000"&gt;d'amfibis i rèptils. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;-Es g&lt;/span&gt;&lt;span style="color:#000000"&gt;enerar&lt;/span&gt;&lt;span style="color:#000000"&gt;à un volum important de residus de construcció i demolició (RCD). &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;-Afecció al paisatge. &lt;/span&gt;&lt;span style="color:#000000"&gt;El paisatge es veurà alterat per la presència de la maquinària, vehicles i zones d'acopi provisionals de l'obra. &lt;/span&gt;&lt;span style="color:#000000"&gt;L'&lt;/span&gt;&lt;span style="color:#000000"&gt;afecció en el paisatge no es considera significativa, atès l'entorn de caràcter urbà en el qu&lt;/span&gt;&lt;span style="color:#000000"&gt;al&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;s'emmarca&lt;/span&gt;&lt;span style="color:#000000"&gt; el projecte i del seu entorn. Es produiran impactes positius sobre la població per la creació de &lt;/span&gt;&lt;span style="color:#000000"&gt;llocs de feina.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Els impactes durant la fase d'explotació seran positius per a la població per la millora dels equipaments i el funcionament dels vials, i negatius per l'ocupació permanent del sòl i reducció de la superfície de sòl productiu, emissions de gasos contaminants i d'efecte hivernacle pel trànsit de vehicles, contaminació lumínica, paisatge, consum d'aigua i energia, generació d'aigües residuals, risc de contaminació d'aqüífer i el risc d'inundació de l'àrea del projecte situada dins la plana geomorfològica d'inundació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El document ambiental únicament proposa mesures preventives o correctores durant la fase d'execució, no aporten mesures correctores i preventives específiques que assegurin reduir les principals afeccions del projecte que són majoritàriament a la fase de funcionament, a més, no s'indica com es realitzarà el seguiment ambiental d'aquestes mesures. No es té en compte la perspectiva climàtica, mesures per reduir consum d'aigua, mesures per evitar la contaminació de l'aqüífer i no s'aporta un estudi hidrològic-hidràulic que asseguri la viabilitat del projecte pel risc d'inundació. Per aquests motius no es pot assegurar que els efectes sobre el medi ambient siguin mínims, sense afectació significativa.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Conclusions de l'informe d'impacte ambiental&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Primer: S&lt;span style="color:#000000"&gt;ubjectar a a&lt;/span&gt;valuació d'impacte ambiental ordinària el &lt;span style="color:#000000"&gt;projecte d'urbanització de l'UE &lt;/span&gt;&lt;span style="color:#000000"&gt;86-05&lt;/span&gt;&lt;span style="color:#000000"&gt;, Sant&lt;/span&gt;&lt;span style="color:#000000"&gt; Jordi, &lt;/span&gt;&lt;span style="color:#000000"&gt;T.M. &lt;/span&gt;&lt;span style="color:#000000"&gt;Palma&lt;/span&gt;&lt;span style="color:#000000"&gt;, &lt;/span&gt;&lt;span style="color:#000000"&gt;promogut per JUNTA DE COMPENSACIÓ UE/86-05 SANT JORDI&lt;/span&gt;&lt;span style="color:#000000"&gt;,&lt;/span&gt; d'acord amb els criteris de l'annex III de la Llei 21/2013, de 09 de desembre, d'avaluació ambiental.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;L'estudi d'Impacte Ambiental contindrà com a mínim el que estableixen, l'article 35 de la Llei 21/2013 de 9 de desembre, d'avaluació ambiental, en els termes desenvolupats a l'Annex VI, i l'article 21 del Text refós de la Llei d'avaluació ambiental de les Illes Balears, aprovat per Decret legislatiu 1/2020, de 28 d'agost, així com les consideracions següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;- Cal &lt;/span&gt;&lt;span style="color:#000000"&gt;analitzar &lt;/span&gt;&lt;span style="color:#000000"&gt;els requeriments de l'informe del &lt;/span&gt;&lt;span style="color:#000000"&gt;Servei de Gestió del D&lt;/span&gt;&lt;span style="color:#000000"&gt;omini &lt;/span&gt;&lt;span style="color:#000000"&gt;P&lt;/span&gt;&lt;span style="color:#000000"&gt;úblic &lt;/span&gt;&lt;span style="color:#000000"&gt;H&lt;/span&gt;&lt;span style="color:#000000"&gt;idràulic, &lt;/span&gt;&lt;span style="color:#000000"&gt;prestant especial atenció a les actuacions en zones inundables; el promotor haurà d'aportar un estudi hidrològic-hidràulic d'aquesta zona, tal com indica l'art. 104 del Pla Hidrològic de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;-S'hauran de preveure mesures preventives i correctores per a totes les fases del projecte.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;-S'haurà de preveure un pla de vigilància ambiental que defineixi uns indicadors clars i específics per fer el seguiment objectiu i documentat de l'efectivitat de les mesures correctores i preventives a cada una de les fases del projecte. A més, d'incloure les actuacions que es duran a terme en el cas que les mesures no obtinguin el resultat desitjat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;- L'Estudi d'Impacte Ambiental:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;1- Hauria d'indicar com es gestionaran els residus de construcció i demolició generats i el procediment que s'ha de seguir en el cas que durant les obres es generin residus amb amiant.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;2- A l'hora de dissenyar la zona verda haurà d'analitzar si es dona compliment:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:120px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;a) Les prescripcions del reglament tècnic de parcs i jardins de l'ajuntament de Palma. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:120px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;b) L'establert a l'article 63.2 del PHIB, utilitzant preferentment espècies vegetals autòctones i de baix requeriment hídric i es prioritzarà la utilització d'aigües pluvials i aigües regenerades, excepte per raons de salut pública acreditades degudament, segons estableix l'article 63.1 del PHIB.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;3- Cal indicar com es realitza el tractament de les aigües pluvials recollides als paviments impermeabilitzats. Si es preveu un decantador/separador de graves i greixos/hidrocarburs, s'haurà d'indicar on es localitzarà, dimensions, etc.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;4- Analitzar quins sistemes de drenatge sostenible s'adoptaran per tal de complir amb l'article 60.6 del Pla Hidrològic de les Illes Balears (PHIB) 2015-2021, s'haurà d'analitzar com minimitzar l'impacte de les aigües pluvials a les xarxes de sanejament i drenatge i, al seu torn, i que permetin l'emmagatzematge per a un ús posterior o la reincorporació al medi.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="display:inline-block"&gt;&lt;span style="color:#000000"&gt;5&lt;span style="color:#000000"&gt;- Cal incloure la perspectiva climàtica i incloure mesures per tal de reduir el canvi climàtic, d'acord amb la Llei 10/2019, de 22 de febrer, de canvi climàtic i transició energètica.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;6- Quines mesures implementaran per tal reduir la petjada de carboni de les fases de construcció i explotació del projecte d'urbanització.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;7- S'haurà d'indicar si es dona compliment als articles 65 (reserva d'aparcament) i 66 (Punts de recàrrega per a vehicles elèctrics en aparcaments) de la Llei 10/2019, de 22 de febrer, de canvi climàtic i transició energètica.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;D'acord amb l'article 39 de la Llei 21/2013 dintre el procediment substantiu, juntament amb la documentació exigida per la legislació sectorial, el promotor presentarà una sol·licitud d'inici de l'avaluació d'Impacte Ambiental ordinària, juntament amb la documentació següent:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;A. Document tècnic del projecte.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;B. Estudi d'Impacte Ambiental.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;D'acord amb l'article 36 de la Llei 21/2013 l'òrgan substantiu sotmetrà el projecte i l'estudi d'Impacte Ambiental a informació pública per un termini no inferior a trenta dies, mitjançant la publicació en el BOIB i a la seva seu electrònica. A més, tal com es preveu a l'article 37 de la Llei 21/2013, simultàniament al tràmit d'informació pública, l'òrgan substantiu consultarà les administracions públiques afectades i a les persones interessades. Es considera que les administracions públiques afectades i les persones interessades a consultar són les següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;-Direcció General de Territori i Paisatge.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;-Direcció General de Recursos Hídrics.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;-Direcció General de Salut Pública.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;-AENA.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;-Direcció General de Canvi Climàtic.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;-Direcció Insular de Territori i Paisatge.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;-Direcció Insular d'Urbanisme.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;-Direcció Insular de Patrimoni.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Segon.- El present informe d'Impacte Ambiental , que actua com a document d'abast, es publicarà a la seu electrònica de la CMAIB i al Butlletí Oficial de les Illes Balears, d'acord amb el que disposa l'article 47.3 de la Llei 21/2013, de 9 de desembre, d'avaluació ambiental. A més, es donarà compte al Ple de la CMAIB i al subcomitè d'AIA.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Tercer.- L'informe d'Impacte Ambiental no serà objecte de cap recurs, sense perjudici del que, si és el cas, escaigui en via administrativa o judicial davant de l'acte, si és el cas d'autorització del projecte, d'acord amb el que disposa l'article 47.5 de la Llei 21/2013.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="display:inline-block"&gt;&lt;span style="color:#000000"&gt;Quart.- Aquesta proposta de resolució s'emet sense perjudici de les competències urbanístiques, de gestió o territorials de les administracions competents i de les autoritzacions o informes necessaris per a l'obtenció de l'autorització.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
