    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;El Pla Estratègic de Subvencions del Pressupost General del CIM del 2021 preveu, entre els eixos i les línies estratègiques d'actuació, millorar les ajudes socials, especialment les dirigides a les famílies i els col·lectius més vulnerables, per tal de donar resposta a les seves necessitats bàsiques, i compta a través del Departament d'Ocupació, Habitatge Social i Cooperació Local amb una línia de subvenció específica d'ajuts per incidir sobre els propietaris &lt;/span&gt;&lt;span style="color:#00000a"&gt;que, per diversos motius, tenen immobles buits o que els lloguen per temporades curtes, amb la finalitat d'aconseguir que posin aquests immobles al mercat de lloguer de llarga durada a preus assequibles per a persones i famílies a les quals els resulta impossible accedir a un pis de lloguer en les condicions de mercat actual, que va apujant els preus de lloguer any rere any.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;El Consell Executiu del Consell Insular de Menorca, en la sessió de caràcter ordinari de 28 de gener de 2019, va aprovar el Programa pilot Lloguer Ètic, destinat a facilitar l'accés a l'habitatge a les famílies en risc d'exclusió residencial mitjançant la concessió d'una sèrie d'ajuts als propietaris d'habitatges buits que compleixin els requisits del programa. Aquest programa va ser modificat per sengles acords de Consell Executiu de dia 1 de juny de 2020 i de 29 de març de 2021 per tal de:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#00000a"&gt;Actualitzar el nom del programa 23110 «Servei pel Dret a l'Habitatge».&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#00000a"&gt;Eliminar les quanties d'ajuts per alguns conceptes que s'especificaven en el programa del 2020 per tal que siguin les bases anuals les que ho determinin en funció del que pugui canviar d'any en any.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#00000a"&gt;Simplificar la presentació de documentació, tant per a l'adhesió com per a la sol·licitud d'ajuts.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#00000a"&gt;Matisar i especificar algunes qüestions i millorar-ne la redacció per tal de no donar peu a més d'una interpretació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#00000a"&gt;Eliminar la part que feia referència a la contractació d'una empresa per al manteniment de la web que dóna suport al programa, atès que a partir del 2021 el responsable d'aquest manteniment és SILME.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#00000a"&gt;Atès &lt;/span&gt;&lt;span style="color:#000000"&gt;l'informe de necessitat emès per la directora insular d'Habitatge Social i Participació Ciutadana dia 7 d'abril de 2021, favorable a la convocatòria d'ajuts al lloguer d'habitatges que s'inclouen en el Programa pilot Lloguer Ètic del Consell Insular de Menorca per l'any 2021;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Atès l'informe jurídic favorable de data 12 d'abril de 2021;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Atesa la proposta de la consellera executiva del Departament d'Ocupació, Habitatge i Cooperació Local;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;El Consell executiu, per unanimitat i en votació ordinària, adopta els acords següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Primer. &lt;/strong&gt;Aprovar les bases i els annexos que regeixen la convocatòria d'ajuts al lloguer d'habitatges que s'inclouen en el Programa &lt;/span&gt;&lt;span style="color:#000000"&gt;pilot Lloguer Ètic del Consell Insular de Menorca, que s'adjunten al final com a annex únic.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Segon. &lt;/strong&gt;&lt;/span&gt;Aprovar, simultàniament, la convocatòria corresponent a l'any 2021, que es regirà per les bases a què s'ha fet referència en el punt anterior, d'acord amb les condicions següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;a) Import global màxim dels ajuts i crèdit pressupostari. Les ajudes concedides s'atendran amb càrrec a les partides pressupostàries i pels imports màxims que s'indiquen més avall, sens perjudici que els imports puguin ser ampliats en el supòsit d'aportacions expresses de tercers per contribuir al finançament de l'objecte de la convocatòria, concretats posteriorment a la seva aprovació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;* La despesa es podrà aplicar a qualsevol altra partida adequada i vinculada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;b) L'import màxim que es podrà concedir per sol·licitud és de 525,24 € en el cas dels ajuts de la línia 1 d'aquesta convocatòria, i de 2.575 € en el cas que els ajuts siguin de la línia 2.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;c) El termini de presentació de sol·licituds restarà obert a partir de l'endemà d'haver-se publicat &lt;/span&gt;&lt;span style="color:#000000"&gt;aquesta convocatòria en el &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Butlletí Oficial de les Illes Balears &lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;(BOIB) fins &lt;/span&gt;&lt;span style="color:#000000"&gt;a&lt;/span&gt;&lt;span style="color:#000000"&gt;l 2 de novembre de 2021&lt;/span&gt;&lt;span style="color:#000000"&gt;, o fins que hi hagi crèdit en la partida corresponent.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;c) La instructora de l'expedient és la senyora Silvia Garcia Porcel, treballadora social del Programa pilot Lloguer Ètic del CIM.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;d) Comunicar l'aprovació de la present convocatòria a la Base de Dades Nacional de Subvencions (BDNS), amb la resta d'informació que es requereixi, en compliment de l'art. 20.8 &lt;em&gt;a&lt;/em&gt; de la Llei 38/2003, de 17 de novembre, general de subvencions.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Antecedents&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;El Programa p&lt;/span&gt;&lt;span style="color:#000000"&gt;ilot Lloguer Ètic té una doble vessant, per una part incidir sobre els propietaris d'immobles que els volen llogar i per l'altra sobre aquelles persones i famílies que volen accedir a un pis de lloguer en el marc d'aquest programa i &lt;/span&gt;&lt;span style="color:#000000"&gt;a les quals, per les seves condicions i característiques socials, laborals i econòmiques, els és impossible accedir a un pis de lloguer a preus de mercat i pels seus propis mitjans.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Aquest programa va ser aprovat per acord del Consell Executiu de data 28 de gener de 2019 i modificat per acord de Consell Executiu dia 1 de juny de 2020 i per a&lt;/span&gt;&lt;span style="color:#000000"&gt;cord de Consell Executiu de 29 de març de 2021 &lt;/span&gt;&lt;span style="color:#00000a"&gt;en el sentit de: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#00000a"&gt;Actualitzar el nom del programa pressupostari 23110 «Servei pel Dret a l'Habitatge».&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;

&lt;/ul&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Les presents bases s'adeqüen, per tant, al programa actualment vigent i que, com s'ha dit, es va aprovar per Consell Executiu dia 29 de març de 2019.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Primera. &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Objecte i finalitat &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;L'objecte d'aquestes bases és establir i regular els ajuts econòmics del Consell Insular de Menorca (en endavant CIM) destinats a subvencionar el lloguer d'habitatges en condicions ètiques, adherits al Programa pilot Lloguer Ètic.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;La finalitat d'aquests ajuts és facilitar que els titulars d'un habitatge adherit al Programa pilot Lloguer Ètic es puguin estalviar part de les despeses derivades de la subscripció de contractes de lloguer ètic.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Segona. &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Activitat &lt;/strong&gt;&lt;/span&gt;&lt;strong&gt;subvencionable: r&lt;/strong&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;equisits i condicions&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;D'acord amb l'apartat 5 del Programa pilot Lloguer Ètic,&lt;/span&gt;&lt;span style="color:#00000a"&gt; s'estableixen 2 línies d'ajuts diferenciades:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;a) Línia 1: &lt;span style="color:#00000a"&gt;Ajuts dirigits a propietaris que &lt;/span&gt;&lt;span style="color:#00000a"&gt;hi &lt;/span&gt;&lt;span style="color:#00000a"&gt;adhereix&lt;/span&gt;&lt;span style="color:#00000a"&gt;i&lt;/span&gt;&lt;span style="color:#00000a"&gt;n &lt;/span&gt;&lt;span style="color:#00000a"&gt;un &lt;/span&gt;&lt;span style="color:#00000a"&gt;immoble que tenen llogat &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#00000a"&gt;Aquests ajuts van destinats&lt;/span&gt;&lt;span style="color:#00000a"&gt; als propietaris que ja tenen un immoble llogat i la ren&lt;/span&gt;&lt;span style="color:#00000a"&gt;d&lt;/span&gt;&lt;span style="color:#00000a"&gt;a &lt;/span&gt;&lt;span style="color:#00000a"&gt;del qual &lt;/span&gt;&lt;span style="color:#00000a"&gt;que cobren als inquilins &lt;/span&gt;&lt;span style="color:#00000a"&gt;es &lt;/span&gt;&lt;span style="color:#00000a"&gt;corres&lt;/span&gt;pon amb la proposada a través del Programa pilot Lloguer Ètic. Aquesta línia té dues finalitats, per una banda incentivar i reconèixer el propietari que ja està actuant dins els paràmetres del Programa pilot Lloguer Ètic i, per altra banda, aconseguir més propietaris que s'adhereixin a la línia 2 del programa una vegada finalitzi la relació contractual amb l'inquilí actual.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;b) Línia 2: Ajuts dirigits a propietaris d'immobles buits que adhereixin els seus immobles perquè es lloguin dins el Programa pilot Lloguer Ètic &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Aquests ajuts van destinats als propietaris d'immobles buits que es troben adherits al Programa pilot Lloguer Ètic. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Per tant, per ser beneficiaris de les línies 1 i 2, els propietaris han d'estar adherits al Programa pilot Lloguer Ètic.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Els habitatges adherits al Programa pilot Lloguer Ètic han de complir els requisits següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Han de ser habitatges llogats amb una renda de lloguer ètic (Línia 1).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Han de ser habitatges desocupats i estar en condicions de ser llogats (Línia 2).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Han de ser habitatges destinats al lloguer d'estades curtes que vulguin destinar a lloguer de llarga durada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Els habitatges adherits al Programa pilot Lloguer Ètic han de complir les condicions següents: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

	&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Estar ubicats en els nuclis tradicionals, entenent per aquests els definits en l'article 45 del Pla Territorial Insular (PTI) vigent: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

		&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Article 45.2: Llucmaçanes, es Murtar, Cala Mesquida, es Grau, Binixíquer, l'Argentina, Son Vitamina, Torret, s'Ullastrar, es Pou Nou, Consell, Cala Sant Esteve, Trebalúger, Son Vilar, Sínia Riera, Calescoves, Lloc Nou i Vorera esquerra de Santandria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
		&lt;/li&gt;

	&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;E&lt;span style="color:#00000a"&gt;star ubica&lt;/span&gt;&lt;span style="color:#00000a"&gt;st en altres zones fora dels nuclis tradicionals descrits en el punt anterior, sempre que en aquests es permeti l'ús residencial.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
	&lt;li&gt;
	&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Tenir cèdula d'h&lt;/span&gt;&lt;span style="color:#000000"&gt;abitabilitat i &lt;/span&gt;&lt;span style="color:#000000"&gt;c&lt;/span&gt;&lt;span style="color:#000000"&gt;ertificat d'&lt;/span&gt;&lt;span style="color:#000000"&gt;eficiència energètica o estar en condicions d'obtenir- los.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
	&lt;li&gt;
	&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#00000a"&gt;Estar buits i en disposició de lloguer d'acord amb la Llei d'arrendaments u&lt;/span&gt;&lt;span style="color:#00000a"&gt;rbans (LAU)&lt;/span&gt;&lt;span style="color:#00000a"&gt;, o estar llogats i complir les condicions establertes en el programa i en aquestes bases de la convocatòria anual d'ajuts.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
	&lt;li&gt;
	&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Comptar amb les condicions per poder ser habitables de forma immediata i amb una sèrie de característiques com: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

	&lt;ul&gt;
		&lt;li&gt;
		&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Aigua corrent freda i calenta.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
		&lt;/li&gt;
		&lt;li&gt;
		&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Estar d'alta i amb un comptador individual dels subministraments bàsics com aigua i electricitat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
		&lt;/li&gt;
		&lt;li&gt;
		&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Tenir el mobiliari i els electrodomèstics bàsics de cuina.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
		&lt;/li&gt;
		&lt;li&gt;
		&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Tenir una adequada ventilació segons la normativa bàsica d'habitabilitat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
		&lt;/li&gt;
	&lt;/ul&gt;
	&lt;/li&gt;
&lt;/ul&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Tercera. &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Despeses subvencionables&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Poden ser objecte de subvenció les despeses següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#00000a"&gt;a) Línia 1: Ajuts dirigits a propietaris que hi adhereixi&lt;span style="color:#00000a"&gt; &lt;/span&gt;un immoble que ja tenen llogat &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;
	&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;El cost&lt;strong&gt; &lt;/strong&gt;del certificat d'eficiència energètica (CEE) i d'habitabilitat, si s'escau, fins a un màxim de 250,00 € en el supòsit que l'immoble a llogar dins del programa no els tengui i estigui en condicions d'obtenir-los.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
	&lt;li&gt;
	&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;El pagament de la taxa corresponent a la tramitació de la cèdula d'habitabilitat, que per a l'any 2021 és de 25,24 €, en el supòsit que l'immoble a llogar dins el programa no la tengui o hagi caducat, i estigui en condicions d'obtenir-la.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
	&lt;li&gt;
	&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;El cost del 100 % de l'impost de béns immobles (IBI) fins a un màxim de 250,00 € a l'any mentre duri l'adhesió de l'immoble al programa. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;b) Línia 2: Ajuts dirigits a propietaris que hi adhereixin el seu immoble perquè es llogui dins el programa&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;

	&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;El cost del certificat d'habitabilitat i del d'eficiència energètica fins a un màxim de 250,00 € en el supòsit que l'immoble a llogar dins del programa no els tengui i estigui en condicions d'obtenir-los.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
	&lt;li&gt;
	&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;El pagament de la taxa corresponent a la tramitació de la cèdula d'habitabilitat, que per a l'any 2021 és de 25,24 €, en el supòsit que l'immoble a llogar dins el programa no la tengui o hagi caducat, i estigui en condicions d'obtenir-la.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
	&lt;li&gt;
	&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;El cost del 100 % de l'impost de béns immobles (IBI) fins a un màxim de 450,00 € a l'any mentre duri l'adhesió de l'immoble al programa. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
	&lt;li&gt;
	&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;El cost de l'assegurança de la llar fins a un màxim de 350,00 € a l'any, que inclogui la reclamació de danys causats per l'inquilí i l'impagament del lloguer.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
	&lt;li&gt;
	&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Pagament d'un ajut corresponent a la quantia que resulti del preu mensual de lloguer ètic multiplicat pels mesos que l'immoble tardi a ser llogat &lt;span style="color:#00000a"&gt;per una família per raó dels tràmits que &lt;/span&gt;&lt;span style="color:#00000a"&gt;sigui &lt;/span&gt;&lt;span style="color:#00000a"&gt;necessari realitzar&lt;/span&gt; per formalitzar el contracte &lt;span style="color:#00000a"&gt;amb l'inquilí del Programa &lt;/span&gt;&lt;span style="color:#00000a"&gt;p&lt;/span&gt;&lt;span style="color:#00000a"&gt;ilot Lloguer Ètic, fins un màxim de tres mensualitats i sempre que no &lt;/span&gt;&lt;span style="color:#00000a"&gt;se superin els 1.500 €.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Aquests ajuts es faran efectius al propietari sempre que l'immoble adherit al programa sigui adjudicat a una persona o família adherida com a demandant d'habitatge. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Finançament i import màxim&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Els ajuts que s'atorguin en el marc d'aquestes bases es pagaran amb càrrec a les partides i per l'import màxim que s'estableixin a la convocatòria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;a) Línia 1: Ajuts dirigits a propietaris que hi adhereixin un immoble que ja tenen llogat&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#00000a"&gt;Import màxim de 2.575,24 €&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Atès que existeixen aquestes dues línies d'ajuts, s'estableix que en el cas que s'exhaureixin els crèdits d'una de les dues línies d'ajuts es podrà disposar dels crèdits de l'altra línia fins a exhaurir la totalitat dels crèdits corresponents a la partida pressupostària.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Cinquena. &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Règim de compatibilitat amb altres ajuts&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Els ajuts que s'atorguin de conformitat amb aquestes bases són compatibles amb la concessió d'altres ajuts per la mateixa finalitat, sens perjudici de l'obligació de les persones beneficiàries de comunicar-ho al CIM en la forma establerta en aquestes bases.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;L'import de les subvencions o els ajuts que es concedeixin no pot superar en cap cas, de manera aïllada o en concurrència amb altres ajuts, el cost de l'activitat subvencionada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Sisena. &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Requisits dels beneficiaris i sol·licitants dels ajuts &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Poden ser-ne beneficiàries les persones físiques o jurídiques o agrupacions de persones físiques o jurídiques, les comunitats de béns o qualsevol altre tipus d'unitat econòmica o de patrimoni sep&lt;span style="color:#000000"&gt;arat sens personalitat jurídica, sempre que es compleixin les condicions següents: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;a&lt;/em&gt;) Que siguin titulars d'un o més habitatges buits en condicions de ser llogats.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;b&lt;/em&gt;) Que siguin titulars d'un o més habitatges destinats al lloguer d'estades curtes i que vulguin destinar a lloguer de llarga durada. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;S'entén com a titular d'un habitatge els que ostentin un dret real sobre el mateix que els faculta a llogar-lo com arrendador (en règim de propietat, lloguer, usdefruit o qualsevol altre dret que els faculti per cedir-ne l'ús).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;c&lt;/em&gt;) Que estiguin adherits al Programa pilot Lloguer Ètic i hagin formalitzat un contracte de lloguer ètic en el moment de presentar la sol·licitud.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;En q&lt;span style="color:#000000"&gt;ualsevol cas, no poden ser-ne beneficiàries les persones o entitats en les quals concorri alguna de les prohibicions establertes en l'art. 13 de la Llei 38/2003, de 17 de novembre, &lt;/span&gt;&lt;span style="color:#000000"&gt;g&lt;/span&gt;&lt;span style="color:#000000"&gt;eneral de &lt;/span&gt;&lt;span style="color:#000000"&gt;s&lt;/span&gt;&lt;span style="color:#000000"&gt;ubvencions&lt;/span&gt; (en endavant LGS).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Setena. &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Presentació de les sol·licituds, terminis i documentació necessària&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Pel que fa a la durada del programa, atès que es tracta d'un programa pilot, amb l'objectiu de valorar la seva continuïtat d'una forma més estable en funció dels resultats que s'obtenguin i que està lligat al funcionament de l'Oficina Integral d'Habitatge per la complementarietat mútua existent, serà la mateixa que la del contracte de serveis subscrit pel CIM amb l'Associació Provivienda per la gestió de l'Oficina Integral de l'Habitatge, Servei d'Acompanyament, la vigència del qual finalitza el dia 21 de novembre de 2021.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;La sol·licitud l'ha de signar la persona o persones que tenguin la propietat o un dret real sobre l'habitatge i es trobin adherits al Programa pilot lloguer Ètic. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Les sol·licituds s'han de formalitzar mitjançant el model normalitzat que s'adjunta com a &lt;strong&gt;annex I&lt;/strong&gt; d'aquestes bases i que es pot descarregar a la seu electrònica del CIM. Aquesta sol·licitud també es pot descarregar a través de l'aplicació informàtica creada per donar suport al programa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;A la sol·licitud, s'ha d'adjuntar la documentació següent:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Do&lt;span style="color:#000000"&gt;cumentació administrativa general&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Els sol·licitants han de presentar la documentació administrativa general per adherir-se al Programa pilot Lloguer Ètic, que és la següent: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;a&lt;/em&gt;) Còpia del document d'identificació fiscal del sol·licitant (DNI o NIF).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;b&lt;/em&gt;) En el cas d'empreses (si és un requisit) han de presentar la documentació justificativa d'estar d'alta en l'impost d'activitats econòmiques corresponent. Si l'empresa no està obligada a estar d'alta de l'impost esmentat, ha d'acreditar aquesta circumstància mitjançant una declaració responsable. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;c&lt;/em&gt;) Declaració responsable signada pel sol·licitant o pel seu representant legal de no estar sotmès a cap de les circumstàncies que determinen la impossibilitat d'obtenir la condició de&lt;span style="color:#000000"&gt; beneficiari o entitat col·laboradora de les subvencions públiques recollides en l'art. 13.2 de la Llei 28/2003, de 17 de novembre, &lt;/span&gt;&lt;span style="color:#000000"&gt;g&lt;/span&gt;&lt;span style="color:#000000"&gt;eneral de &lt;/span&gt;&lt;span style="color:#000000"&gt;s&lt;/span&gt;&lt;span style="color:#000000"&gt;ubvencions (BOE núm. 276 de 18 de novembre de 2003). &lt;/span&gt;Aquesta declaració està inclosa en l'imprès de sol·licitud.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;d&lt;/em&gt;) Declaració responsable signada pel sol·licitant o pel seu representant legal relativa a les subvencions o ajudes obtingudes o sol·licitades d'altres institucions públiques o privades per fer la mateixa activitat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;e&lt;/em&gt;) Declaració responsable signada pel sol·licitant o pel seu representant legal del compliment de les obligacions tributàries amb l'Administració de l'Estat i amb la Seguretat Social. &lt;/span&gt;Aquesta declaració està inclosa en l'imprès de sol·licitud.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;f&lt;/em&gt;) E&lt;span style="color:#000000"&gt;ls beneficiaris poden autoritzar el CIM a comprovar el compliment de les obligacions tributàries i &lt;/span&gt;&lt;span style="color:#000000"&gt;amb &lt;/span&gt;&lt;span style="color:#000000"&gt;la Seguretat Social davant l'&lt;/span&gt;&lt;span style="color:#000000"&gt;A&lt;/span&gt;&lt;span style="color:#000000"&gt;dministració de l'Esta&lt;/span&gt;&lt;span style="color:#000000"&gt;t. &lt;/span&gt;Aquesta autorització està inclosa en l'imprès de sol·licitud.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;g&lt;/em&gt;) &lt;span style="color:#000000"&gt;Document de designació de compte ban&lt;/span&gt;&lt;span style="color:#000000"&gt;cari de l'empresa o del seu representant segons model facilitat pel Consell Insular de Menorca, llevat que ja constin a la Tresoreria General del CIM, &lt;/span&gt;&lt;span style="color:#000000"&gt;la qual &lt;/span&gt;&lt;span style="color:#000000"&gt;cosa s'ha de fer constar expressament &lt;/span&gt;&lt;strong&gt;(annex II).&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Documen&lt;span style="color:#000000"&gt;tació específica requerida per a la concessió dels ajuts&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;h&lt;/em&gt;) Justificant d'haver presentat la fiança a l'IBAVI. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;i&lt;/em&gt;) Còpia de la cèdula d'habitabilitat de l'immoble que es troba adherit al Programa pilot Lloguer Ètic &lt;span style="color:#000000"&gt;o, en cas de no tenir-la, document que acrediti que s'ha sol·licitat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;j&lt;/em&gt;) &lt;/span&gt;Còpia del certificat d'eficiència energètica de l'immoble &lt;span style="color:#000000"&gt;o, en cas de no tenir-l&lt;/span&gt;&lt;span style="color:#000000"&gt;o, document que acrediti que s'ha sol·licitat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;n&lt;/em&gt;) Còpia de la pòlissa d'assegurança en vigor de l'immoble (només en el cas dels ajuts de la línia 2).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;D'acord amb l'art. 28.3 i l'art. 53&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;em&gt;c&lt;/em&gt; de la Llei 39/2015, d'1 d'octubre,&lt;/span&gt;&lt;span style="color:#000000"&gt; de &lt;/span&gt;&lt;span style="color:#000000"&gt;p&lt;/span&gt;&lt;span style="color:#000000"&gt;rocediment &lt;/span&gt;&lt;span style="color:#000000"&gt;a&lt;/span&gt;&lt;span style="color:#000000"&gt;dministratiu &lt;/span&gt;&lt;span style="color:#000000"&gt;c&lt;/span&gt;&lt;span style="color:#000000"&gt;omú de les &lt;/span&gt;&lt;span style="color:#000000"&gt;a&lt;/span&gt;&lt;span style="color:#000000"&gt;dministracions &lt;/span&gt;&lt;span style="color:#000000"&gt;p&lt;/span&gt;&lt;span style="color:#000000"&gt;úbliques &lt;/span&gt;(en endavant L&lt;span style="color:#000000"&gt;PACAP), les persones interessades no tenen l'obligació de presentar documents originals, llevat que, amb caràcter excepcional, la normativa reguladora aplicable exigeixi el contrari. En qualsevol cas, les persones interessades són responsables de la veracitat dels documents que presentin (art. 28.7 de l'LPACAP).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Així mateix, les administracions públiques no han de requerir als interessats dades o documents no exigits per la normativa reguladora aplicable o que l'interessant hagi aportat anteriorment a qualsevol administració. A aquests efectes, l'interessat ha d'indicar en quin moment i davant quin òrgan administratiu va presentar els esmentats documents, i les administracions públiques elsl han de recaptar. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;D'acord amb l'art. 28.5 de l'LPACAP, excepcionalment, quan la rellevància d'un document de l'expedient aportat per l'interessat ho exigeixi, o existeixin dubtes derivats de la qualitat de la còpia, el CIM pot sol·licitar de manera motivada l'autenticació de les còpies aportades per la persona interessada, per a la qual cosa pot requerir l'exhibició del document o de la informació original. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Pel fet de presentar-se a aquesta convocatòria la persona interessada presta al CIM els consentiments següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;a&lt;/em&gt;) Per consultar i comprovar la veracitat de la documentació i de les dades presentades per l'interessat que tenguin en el seu poder altres administracions públiques, principalment mitjançant les plataformes d'interoperabilitat, les xarxes corporatives o altres sistemes electrònics habilitats a aquest efecte i als quals el CIM tengui accés.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;b&lt;/em&gt;) Per consultar l'existència i veracitat de la documentació i de les dades que eventualment l'interessat hagi considerat oportú no presentar acollint-se al dret de no fer-ho pel fet que hagin estat elaborades per les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Els esmentats consentiments només es consideraran atorgats quan no consti en l'expedient l'oposició expressa a l'esmentada consulta o quan la llei especial que sigui aplicable al cas en requereixi el consentiment exprés. En aquest darrer cas serà obligatori que l'administració el requereixi i que l'interessat el presti. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;La sol·licitud i tota la documentació s'han de presentar dins el termini establert en la convocatòria, per mitjans electrònics o presencialment, d'acord amb el &lt;/span&gt;&lt;span style="color:#000000"&gt;que preveu legalment l'article 16.4 de la Llei 39/2015 (LPACAP) pels subjectes no obligats i adreçats al&lt;/span&gt;&lt;span style="color:#000000"&gt;'òrgan administratiu competent al CIM.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Si la sol·licitud o la documentació fossin incorrectes o incompletes, el CIM en requerirà la rectificació o el complement necessaris. Si en el termini de deu dies hàbils, comptats des de l'endemà d'havaer rebut el requeriment d'esmena de la sol·licitud, la persona interessada no fa la rectificació reclamada o no presenta la documentació requerida, s'entendrà que ha desistit de la seva petició de conformitat amb l'article 68 de l'LPACAP.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Vuitena. &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Criteris objectius que es tindran en compte per a la concessió dels ajuts&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;D'acord amb la base desena, atès que el procediment no es tramitarà per concurrència competitiva, no es preveuen criteris objectius per a l&lt;span style="color:#000000"&gt;a concessió d&lt;/span&gt;&lt;span style="color:#000000"&gt;els ajuts.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Novena. &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Determinació de l'import de la subvenció&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;D'acord amb el que s'ha establert en la base quarta, l'import màxim de la subvenció per beneficiari no podrà ser superior a 525,24 € en el cas dels ajuts de la línia 1 d'aquesta convocatòria, i de 2.575 € en el cas que els ajuts siguin de la línia 2, quantia resultant de la suma dels imports màxims que es poden atorgar per cada concepte de cada línia descrits en l'esmentada clàusula.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Desena. &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Procediment i òrgans competents per a la concessió dels ajuts&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Els ajuts es concediran d'acord amb els principis d'objectivitat, transparència, igualtat, no discrimina&lt;span style="color:#000000"&gt;ció i publicitat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Els ajuts es concediran quan s'hagi formalitzat el contracte de lloguer ètic, a mesura que es vagin presentant les sol·licituds dels participants en el Programa&lt;/span&gt; pilot Llogu&lt;span style="color:#000000"&gt;er Ètic, d'acord amb les característiques de l'objecte de la convocatòria. El període subvencionable va&lt;/span&gt; del 3 de novembre de 2020 al 2 de novembre de 2021.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;En aquest procediment, d'acord amb l'art 17 del Decret legislatiu 2/2005, de 28 de desembre, pel qual s'aprova el Text refós de la Llei de subvencions (en endavant TRLS), no és necessària la comparació i l&lt;span style="color:#000000"&gt;a prelació entre les sol·licituds presentades i es poden resoldre individualment, encara que no hagi acabat el termini de presentació de sol·licituds. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Si s'exhaureixen els crèdits destinats a la convocatòria&lt;/span&gt; que es faci amb aquestes bases a&lt;span style="color:#000000"&gt;bans d'acabar el termini de presentació, s'ha de suspendre la concessió de noves ajudes mitjançant una resolució publicada en el &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Butlletí Oficial de les Illes Balears &lt;/em&gt;(BOIB).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;L'inici de l'expedient s'efectuarà per mitjà de l'aprovació i publicació de la convocatòria i les bases que regulen la concessió d'ajuts. El termini de presentació de sol·licituds començarà l'endemà d'haver-se publicat la convocatòria al BOIB i s'estendrà fins al 2 de novembre de 2021. El text de la convocatòria i la resta de documentació que es requereixi es comunicarà a la Base de Dades Nacional de Subvencions (d'ara en endavant BDNS) i es publicarà l'extracte de la convocatòria en el BOIB, en compliment de l'art. 20.8 de la Llei general de subvencions.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;La instrucció correspon a la tècnica en treball social assignada al Programa pilot Lloguer Ètic del Departament d'Ocupació, Habitatge Social i Cooperació Local del CIM, que ha de realitzar d'ofici totes les actuacions necessàries per a la determinació, el coneixement i la comprovació de les dades en vir&lt;span style="color:#000000"&gt;tut de les quals s'ha de dictar resolució sobre la concessió dels ajuts.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Totes les sol·licituds presentades dins el termini establert en la convocatòria se sotmetran a l'examen de la instructora de l'expedient, la qual es reunirà prèviament amb la resta de l'equip tècnic del Programa pilot L&lt;/span&gt;&lt;span style="color:#000000"&gt;loguer Ètic per tal de valorar i emetre conjuntament l'informe que ha de servir de base per elaborar la proposta de resolució&lt;/span&gt;&lt;span style="color:#0000ff"&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Una vegada examinades les sol·licituds, i després que s'emeti l'informe esmentat, la consellera executiva n'elevarà la corresponent proposta de resolució a l'òrgan competent, que en aquest cas és el Consell Executiu del CIM, el qual dictarà resolució sobre la concessió o denegació dels ajuts.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;La resolució de l'expedient d'atorgament de les subvencions ha de ser expressa i motivada, i ha de fixar, amb caràcter definitiu, la quantia específica de cada una de les subvencions concedides.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;El termini màxim per dictar i notificar la resolució expressa de concessió de subvenció és &lt;/span&gt;&lt;span style="color:#000000"&gt;de sis mesos comptats des de la data de presentació de les sol·licituds de l'ajut. Això no obstant, aquest termini es &lt;/span&gt;&lt;span style="color:#000000"&gt;pot &lt;/span&gt;&lt;span style="color:#000000"&gt;reduir si s'estableix expressament en la convocatòria dels ajuts. El silenci administratiu &lt;/span&gt;&lt;span style="color:#000000"&gt;té caràcter desestimatori.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;La resolució de l'expedient de concessió o denegació dels ajuts s'ha de remetre&lt;/span&gt;&lt;span style="color:#000000"&gt; a la BDNS en compliment de l'art. 20.8 de l&lt;/span&gt;&lt;span style="color:#000000"&gt;'&lt;/span&gt;&lt;span style="color:#000000"&gt;LGS, i &lt;/span&gt;&lt;span style="color:#000000"&gt;s'ha de &lt;/span&gt;&lt;span style="color:#000000"&gt;publicar en el &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Butlletí Oficial de les Illes Balears&lt;/em&gt;, sens perjudici de notificar-la individualment a les persones interessades.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;La resolució de concessió ha d'expressar, com a mínim, la necessitat que s'atén i el límit que cobreix, amb expressió de l'import total de l'ajut concedit, així com la persona beneficiària i la forma de pagament. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;La resolució de denegació ha d'expressar, com a mínim, els motius de la desestimació i el règim de recursos que es poden interposar contra aquesta.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Onzena. &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Abonament dels ajuts&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Els ajuts que s'atorguin en el marc d'aquestes bases es faran efectius amb càrrec a les partides i pels imports màxims que s'estableixin a la convocatòria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Els ajuts s'abonaran en el termini màxim de 60 dies comptats a partir de la correcta justificació, sempre que la disponibilitat de tresoreria ho permeti. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Les subvencions que es paguin a persones físiques restaran subjectes a retenció d'acord amb la n&lt;span style="color:#000000"&gt;ormativa que regula l'impost sobre la renda de les persones físiques. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Dotzena. &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Justificació de les despeses &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;La persona beneficiària de l'ajut ha de justificar les despeses en el moment de presentar la sol·licitud d'ajut, atès que per calcular la quantia que se li ha d'atorgar són necessaris els justificants de les despeses efectuades que són objecte de subvenció. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;La documentació acreditativa per justificar les despeses és la següent:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Línia 1 d'ajuts: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;a&lt;/em&gt;) Presentació de la factura justificativa del pagament del c&lt;/span&gt;&lt;span style="color:#000000"&gt;ertificat d'&lt;/span&gt;&lt;span style="color:#000000"&gt;e&lt;/span&gt;&lt;span style="color:#000000"&gt;ficiència &lt;/span&gt;&lt;span style="color:#000000"&gt;energètica o d'habitabilitat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Línia 2 d'ajuts: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;a&lt;/em&gt;) Les factures justificatives del pagament de l'assegurança de la llar i còpia de la pòlissa, que ha d'incloure la reclamació de danys causats per l'inquilí i l'impagament del lloguer.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;b&lt;/em&gt;) Presentació de la factura justificativa del pagament del &lt;/span&gt;&lt;span style="color:#000000"&gt;c&lt;/span&gt;&lt;span style="color:#000000"&gt;ertificat d'eficiència &lt;/span&gt;&lt;span style="color:#000000"&gt;energètica o d'habitabilitat. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;c&lt;/em&gt;) Justificant del pagament de la taxa de la &lt;/span&gt;&lt;span style="color:#000000"&gt;cèdula d'habitabilitat. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;d&lt;/em&gt;) Presentació dels darrers rebuts de l'&lt;/span&gt;&lt;span style="color:#000000"&gt;i&lt;/span&gt;&lt;span style="color:#000000"&gt;mpost de &lt;/span&gt;&lt;span style="color:#000000"&gt;béns immobles (IBI). &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Si la documentació presentada fos incompleta o incorrecta, el servei responsable demanarà al beneficiari que en faci la rectificació oportuna en el termini improrrogable de deu dies hàbils.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Si la despesa justificada excedeix de l'import concedit, la possible desviació pressupostària anirà a càrrec de la persona subvencionada. Si, pel contrari, la despesa justificada és inferior a l'import del pressupost sol·licitat i subvencionat, es reduirà proporcionalment la subvenció concedida.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;El CIM podrà inspeccionar les activitats subvencionades, sens perjudici de les competències que puguin correspondre, per normativa legal o reglamentària, a altres organismes o institucions.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Tretzena. &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Obligacions d&lt;/strong&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;e les persones beneficiàries &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Les persones beneficiàries accepten, pel sols fet de ser-ho, les obligacions següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;a&lt;/em&gt;) Comunicar al CIM l'acceptació de la subvenció en els termes en què aquesta es concedeixi. En qualsevol cas la subvenció s'entendrà acceptada tàcitament un cop transcorreguts quinze dies hàbils d'ençà de la publicació de l'anunci de concessió en el BOIB.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;b&lt;/em&gt;) Destinar l'import de l'ajut a l'objecte pel qual s'ha sol·licitat aquest. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;c&lt;/em&gt;) Proporcionar la informació sobre l'activitat subvencionada que li demani el CIM.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;d&lt;/em&gt;) Sotmetre's a les actuacions de comprovació que efectuï&lt;/span&gt;&lt;span style="color:#000000"&gt;n el CIM i la resta d'organismes competents per a la fiscalització dels comptes públics.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;e&lt;/em&gt;) Comunicar al CIM la sol·licitud i l'obtenció de subvencions i ajudes per a la mateixa finalitat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;f&lt;/em&gt;) Mantenir l'immoble adherit al Programa pilot Lloguer Ètic i a un preu mensual de lloguer considerat com a lloguer ètic. Per calcular aquest import s'ha partit de la premissa que una persona no hauria de destinar més del 30&lt;span style="color:#000000"&gt; &lt;/span&gt;% dels seus ingressos mensuals al pagament de l'habitatge, a fi de disposar de suficients estalvis per cobrir altres aspectes vitals de la persona, com l'alimentació, la vestimenta o l'educació. (En la clàusula tretzena del Programa pilot Lloguer Ètic es detallen els criteris que s'han tingut en compte per calcular el preu de lloguer ètic en cada cas).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;g&lt;/em&gt;) Mantenir vigent el contracte de lloguer ètic i la seva adhesió al Programa &lt;/span&gt;&lt;span style="color:#000000"&gt;p&lt;/span&gt;&lt;span style="color:#000000"&gt;ilot Lloguer Ètic mentre aquest darrer estigui vigent, que inicialment serà fins &lt;/span&gt;&lt;span style="color:#000000"&gt;al &lt;/span&gt;&lt;span style="color:#000000"&gt;21 de novembre de 2021, d'acord amb la base&lt;/span&gt;&lt;span style="color:#ce181e"&gt; &lt;/span&gt;setena.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;h&lt;/em&gt;) Fer-se càrrec del pagament de les quotes de la comunitat de propietaris i de la part de l'IBI que no li queda subvencionada per aquest programa. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Catorzena. &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Revocació i reintegrament dels ajuts. Criteris de graduació de possibles incompliments&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;No es considera un incompliment total o parcial en els casos de rescissió del contracte en els supòsits següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;a&lt;/em&gt;) Els previstos en la Llei d'arrendaments urbans (LAU), concretament en els articles 12 a 16 i en l'article 22.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;b&lt;/em&gt;) Quan la rescissió del contracte sigui per causes imputables a l'inquilí. En aquest cas, el servei que gestiona el programa cercarà un nou inquilí.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Pel que fa a la revocació i el reintegrament dels ajuts s'aplicaran els articles 43 i 44 del TRLS i la resta de normativa aplicable. En cas d'incompliment, s'haurà de reintegrar la quantia rebuda mitjançant l'aplicació d'un percentatge de minoració en funció de la naturalesa de l'incompliment. Aquest percentatge s'ha de fixar amb l'informe previ de l'instructor i s'ha de notificar al beneficiari. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Les causes de reintegrament i el procediment per a la seva exigència es regeixen&lt;/span&gt;&lt;span style="color:#000000"&gt; pel que estableix l'article 44 del &lt;/span&gt;TRLS.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Quan la causa del reintegrament determini la invalidesa de la resolució de concessió, s'ha de revisar prèviament aquesta resolució en els termes establerts en l'article 25 del &lt;/span&gt;TRLS&lt;span style="color:#000000"&gt; i en la resta de disposicions aplicables.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Les quantitats que s'hagin de reintegrar tenen la consideració d'ingressos de dret públic i es poden exigir per la via de constrenyiment.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;L'obligació de reintegrament establerta en aquest article és independent de les sancions que en el seu cas siguin exigibles.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Quinzena. &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Infraccions i sancions&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;El règim d'infraccions i sancions administratives aplicables és el que estableixen el títol V del TRLS i el títol IV de l'LGS.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;L'òrgan competent per imposar les sancions que es derivin d'infraccions de l'establert en aquestes bases i de la normativa aplicable en matèria de subvencions és la Presidència del CIM, d'acord amb el que estableix l'art. 9 de la Llei 8/2000, de 28 d'octubre, de consells insulars.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Setzena. &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Altres dispo&lt;/strong&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;sicions&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Recursos administratius:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Els acords del Consell Executiu pels quals s'aproven les bases i les convocatòries i es concedeixen o deneguen els ajuts no exhaureixen la via administrativa i són susceptibles de rebre recurs d'alçada davant la Comissió de Govern del CIM.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Normativa general aplicable:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;En tot el que no prevegin expressament aquestes bases regeixen les disposicions que siguin aplicables al Consell Insular de Menorca en matèria de subvencions, especialment les contingudes en les norme&lt;span style="color:#000000"&gt;s següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
