    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#00000a"&gt;Mitjançant el Decret de la Presidència del Consell Insular de Menorca núm. 423/2019&lt;/span&gt;&lt;span style="color:#00000a"&gt;,&lt;/span&gt;&lt;span style="color:#00000a"&gt; de 10 de juliol, es determina l'estructura interna dels departaments.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#00000a"&gt;Per donar cobertura als llocs de treball que es volen proveir,&lt;/span&gt;&lt;span style="color:#00000a"&gt; d'acord amb el que&lt;/span&gt;&lt;span style="color:#00000a"&gt; estableix el Catàleg de llocs de feina del Consell Insular de Menorca, el procediment és la provisió per lliure designació, regulada per l'article 80 del Re&lt;/span&gt;&lt;span style="color:#00000a"&gt;i&lt;/span&gt;&lt;span style="color:#00000a"&gt;al &lt;/span&gt;&lt;span style="color:#00000a"&gt;d&lt;/span&gt;&lt;span style="color:#00000a"&gt;ecret &lt;/span&gt;&lt;span style="color:#00000a"&gt;l&lt;/span&gt;&lt;span style="color:#00000a"&gt;egislatiu 5/2015, de 30 d'octubre, pel qual s'aprova el text refós de l'EBEP&lt;/span&gt;&lt;span style="color:#00000a"&gt;;&lt;/span&gt;&lt;span style="color:#00000a"&gt; pe&lt;/span&gt;&lt;span style="color:#00000a"&gt;r l'&lt;/span&gt;&lt;span style="color:#00000a"&gt;article 79 i següents de la Llei 3/2007, de 27 de març, de la &lt;/span&gt;&lt;span style="color:#00000a"&gt;f&lt;/span&gt;&lt;span style="color:#00000a"&gt;unció &lt;/span&gt;&lt;span style="color:#00000a"&gt;p&lt;/span&gt;&lt;span style="color:#00000a"&gt;ública de la CAIB, i pel Decret 33/1994, de 28 de març, pel qual s'aprova el Reglament de proveïment de llocs de treball i promoció professional dels funcionaris al servei de l'Administració de la CAIB.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#00000a"&gt;A la present provisió de llocs de treball hi poden accedir els funcionaris de carrera.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#00000a"&gt;El Consell Executiu del Consell Insular de Menorca, en data de 19 d'octubre de 2020, va aprovar la convocatòria de provisió de quatre llocs de treball de &lt;/span&gt;&lt;span style="color:#00000a"&gt;s&lt;/span&gt;&lt;span style="color:#00000a"&gt;ecretari/ària de conseller del Consell Insular de Menorca per lliure designació, publicada en el BOIB núm. 190 de 5 de novembre de 2020.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Aquests llocs corresponen a: &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#00000a"&gt;- Secretari/ària de la conselleria de Medi Ambient i Reserva de Biosfera&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#00000a"&gt;- Secretari/ària de la conselleria d'Economia i Territori&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#00000a"&gt;- Secretari/ària de la conselleria de Benestar Social&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#00000a"&gt;- Secretari/ària de la conselleria de Mobilitat&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#00000a"&gt;Un únic aspirant funcionari de carrera es va presentar a la convocatòria de provisió, i hi renuncià mitjançant &lt;/span&gt;&lt;span style="color:#00000a"&gt;l'&lt;/span&gt;&lt;span style="color:#00000a"&gt;escrit amb registre d'entrada núm. 7444 de 22/03/2021, &lt;/span&gt;&lt;span style="color:#00000a"&gt;de manera que &lt;/span&gt;&lt;span style="color:#00000a"&gt;la convocatòria quedà deserta.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#00000a"&gt;També s'hi van presentar quatre aspirants funcionaris interins i dos aspirants que no eran funcionaris.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#00000a"&gt;Pel Decret de la P&lt;/span&gt;&lt;span style="color:#00000a"&gt;resid&lt;/span&gt;&lt;span style="color:#00000a"&gt;ència&lt;/span&gt;&lt;span style="color:#00000a"&gt; del Consell Insular de Menorca núm. 69/2021&lt;/span&gt;&lt;span style="color:#00000a"&gt;,&lt;/span&gt;&lt;span style="color:#00000a"&gt; de 26 de febrer&lt;/span&gt;&lt;span style="color:#00000a"&gt;,&lt;/span&gt;&lt;span style="color:#00000a"&gt; &lt;/span&gt;&lt;span style="color:#00000a"&gt;es nomenaren &lt;/span&gt;&lt;span style="color:#00000a"&gt;el senyor Josep Pastrana Huguet&lt;/span&gt;&lt;span style="color:#00000a"&gt; com a&lt;/span&gt;&lt;span style="color:#00000a"&gt; conseller executiu d'Economia i Territori i la senyora Noemí Gomila Carretero com a consellera executiva de Serveis Generals.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#00000a"&gt;En data 23/03/2021 la secretària del Departament de Serveis Generals va presentar un escrit &lt;/span&gt;&lt;span style="color:#00000a"&gt;en què &lt;/span&gt;&lt;span style="color:#00000a"&gt;manifestava la seva intenció de no seguir ocupant l'esmentat lloc de treball, &lt;/span&gt;&lt;span style="color:#00000a"&gt;de manera que ha &lt;/span&gt;&lt;span style="color:#00000a"&gt;quedat vacanat el lloc de secretari/ària de la consellera de Serveis Generals.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#00000a"&gt;El lloc de secretari/ària del conseller de Cultura, Educació, Joventut i Esports&lt;span style="color:#00000a"&gt; &lt;/span&gt;també quedarà vacant el proper 5 d'abril de 2021.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#00000a"&gt;L'article 87 de la Llei 3/2007, de 27 de març, de la funció &lt;/span&gt;&lt;span style="color:#00000a"&gt;p&lt;/span&gt;&lt;span style="color:#00000a"&gt;ública de la CAIB, de comissió de serveis forçosa, estableix que «&lt;/span&gt;&lt;span style="color:#000000"&gt;La comis&lt;/span&gt;&lt;span style="color:#000000"&gt;s&lt;/span&gt;&lt;span style="color:#000000"&gt;ió de serv&lt;/span&gt;&lt;span style="color:#000000"&gt;eis amb &lt;/span&gt;&lt;span style="color:#000000"&gt;car&lt;/span&gt;&lt;span style="color:#000000"&gt;à&lt;/span&gt;&lt;span style="color:#000000"&gt;cter &lt;/span&gt;&lt;span style="color:#000000"&gt;forçós &lt;/span&gt;&lt;span style="color:#000000"&gt;es procedente &lt;/span&gt;&lt;span style="color:#000000"&gt;quan és &lt;/span&gt;&lt;span style="color:#000000"&gt;urgent&lt;/span&gt;&lt;span style="color:#000000"&gt; proveir un lloc de treball que ha &lt;/span&gt;&lt;span style="color:#000000"&gt;queda&lt;/span&gt;&lt;span style="color:#000000"&gt;t&lt;/span&gt;&lt;span style="color:#000000"&gt; vacant desp&lt;/span&gt;&lt;span style="color:#000000"&gt;r&lt;/span&gt;&lt;span style="color:#000000"&gt;és d&lt;/span&gt;&lt;span style="color:#000000"&gt;'&lt;/span&gt;&lt;span style="color:#000000"&gt;una convocat&lt;/span&gt;&lt;span style="color:#000000"&gt;ò&lt;/span&gt;&lt;span style="color:#000000"&gt;ria de provisió &lt;/span&gt;&lt;span style="color:#000000"&gt;i no hi ha &lt;/span&gt;&lt;span style="color:#000000"&gt;personal funcionari inter&lt;/span&gt;&lt;span style="color:#000000"&gt;í &lt;/span&gt;&lt;span style="color:#000000"&gt;en condicions d'ocupar-lo.»&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Per la qual cosa, atès que és urgent proveir aquests llocs de feina, es dóna l'oportunitat al personal interí de manifestar la seva disponibilitat.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Atesa la proposta de la consellera executiva del Departament de Serveis Generals,&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;El Consell executiu, per unanimitat i en votació ordinària, adopta els següents acords:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#00000a"&gt;&lt;strong&gt;Primer.&lt;/strong&gt; Declarar deserta la convocatòria de provisió de quatre llocs de treball de &lt;/span&gt;&lt;span style="color:#00000a"&gt;s&lt;/span&gt;&lt;span style="color:#00000a"&gt;ecretari/ària de &lt;/span&gt;&lt;span style="color:#00000a"&gt;c&lt;/span&gt;&lt;span style="color:#00000a"&gt;onseller del Consell Insular de Menorca per lliure designació, publicada en el BOIB núm. 190 de 5 de novembre de 2020.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#00000a"&gt;&lt;strong&gt;Segon.&lt;/strong&gt; Aprovar les bases i la convocatòria per a la provisió dels llocs de treball de secretari/ària de les conselleries següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Secretari/ària de la Conselleria de Serveis Generals: 1 lloc&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#00000a"&gt;&lt;strong&gt;Tercer.&lt;/strong&gt; Ordenar la publicació de la nova convocatòria i de &lt;/span&gt;&lt;span style="color:#00000a"&gt;les bases esmentades que es transcriuen més avall.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#00000a"&gt;&lt;strong&gt;Segon. &lt;/strong&gt;Les sol·licituds per prendre part en aquesta convocatòria s'han de presentar en el format oficial que el Consell Insular de Menorca posa a l'abast dels candidats.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#00000a"&gt;Les sol·licituds s'han de presentar únicament telemàticament, segons l'article 14.2&lt;span style="color:#00000a"&gt; &lt;/span&gt;&lt;em&gt;e&lt;/em&gt; de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques, mitjançant DNI electrònic o un certificat digital vàlid. La sol·licitud queda registrada directament.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#00000a"&gt;El termini de presentació de sol·licituds és de &lt;strong&gt;quinze dies hàbils &lt;/strong&gt;comptadors &lt;/span&gt;&lt;span style="color:#00000a"&gt;a partir &lt;/span&gt;&lt;span style="color:#00000a"&gt;de l'endemà d&lt;/span&gt;&lt;span style="color:#00000a"&gt;'haver-se publicat la convocatòria en el &lt;em&gt;Butlletí Oficial de les Illes Balears.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#00000a"&gt;A efectes informatius, també es publicarà en el web del Consell Insular de Menorca i al tauler d'anuncis.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#00000a"&gt;En la sol·licitud s'ha de &lt;/span&gt;&lt;span style="color:#00000a"&gt;consignar amb claredat el lloc o &lt;/span&gt;&lt;span style="color:#00000a"&gt;els &lt;/span&gt;&lt;span style="color:#00000a"&gt;llocs als quals es vol optar i, mitjançant un número, si escau, l'ordre de preferència entre ells. S'hi &lt;/span&gt;&lt;span style="color:#00000a"&gt;ha d'adjuntar &lt;/span&gt;&lt;span style="color:#00000a"&gt;la documentació que acrediti la titulació o titulacions, el curriculum vitae i els altres requisits exigits en el Catàleg de llocs de feina.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;La data de referència per al compliment dels requisits exigits al·legats és el dia que acabi el termini de presentació de sol·licituds.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#00000a"&gt;&lt;strong&gt;Tercer. &lt;/strong&gt;Finalitzat el termini de presentació de sol·licituds, la consellera executiva de Serveis Generals, després d'escoltar els consellers dels respectius departaments, dictarà una resolució per la qual aprovarà la llista dels aspirants designats i l'assignació específica dels aspirants seleccionats a cada lloc de treball que ha estat convocat. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#00000a"&gt;&lt;strong&gt;Quart. &lt;/strong&gt;Si no hi hagués suficients aspirants funcionaris de carrera, es nomenaran,&lt;/span&gt;&lt;span style="color:#00000a"&gt; d'acord &lt;/span&gt;&lt;span style="color:#00000a"&gt;amb &lt;/span&gt;&lt;span style="color:#00000a"&gt;l'article 87 de la Llei 3/2007, de 27 de març, de la &lt;/span&gt;&lt;span style="color:#00000a"&gt;f&lt;/span&gt;&lt;span style="color:#00000a"&gt;unció &lt;/span&gt;&lt;span style="color:#00000a"&gt;p&lt;/span&gt;&lt;span style="color:#00000a"&gt;ública de la CAIB, els candidats funcionaris interins que hi manifestin la seva disponibilitat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#00000a"&gt;&lt;strong&gt;Cinquè. &lt;/strong&gt;La incorporació al lloc de treball assignat ha de ser immediata, llevat de raons degudament justificades.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Aquesta incorporació suposa la pèrdua del lloc de treball de procedència.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Contra la convocatòria i bases es pot interposar recurs d'alçada davant la Comissió de Govern en el termini d'un mes comptador a partir de l'endemà d'haver-se publicat.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;El termini màxim per dictar i notificar la resolució és de tres mesos. Si, un cop transcorregut aquest termini, no s'ha dictat una resolució, es pot entendre desestimat el recurs, excepte en el supòsit previst a l'article 24.1, tercer paràgraf, de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Davant la desestimació es pot interposar recurs contenciós administratiu en el termini de dos mesos a partir del dia que es publiqui davant la Sala Contenciosa Administrativa del Tribunal Superior de Justícia de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
