    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;L'apartat 9.3. de la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 13 de novembre de 2015 per la qual es convoquen, subvencions per a inversions no productives vinculades a la realització de compromisos d'agroambient i clima, corresponents als anys 2015-2019, especifica que la resolució expressa es notificarà a les persones interessades mitjançant la seva publicació al &lt;em&gt;&lt;em&gt;Butlletí Oficial de les Illes Balears &lt;/em&gt;&lt;/em&gt;d'acord amb els termes que preveu l'article 45.2 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;Els expedients han estat tramitats pel Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) en compliment del que disposa l'article 43 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;El vicepresident&amp;nbsp;en matèria agrària del FOGAIBA, en data&amp;nbsp;13&amp;nbsp;d'abril&amp;nbsp;de 2021, va signar la següent resolució, &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;strong&gt;&lt;em&gt;&lt;strong&gt;&lt;em&gt;“INFORME PROPOSTA DE RESOLUCIÓ / RESOLUCIÓ DE CANVI DE TITULARITAT&lt;/em&gt;&lt;/strong&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;1.&lt;/em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Resolució del President del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 13 de novembre de 2015 per la qual es convoquen, per als anys 2015 a 2019, subvencions per a inversions no productives vinculades a la realització de compromisos d'agroambient i clima.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;2.El 29 d'agost de 2016, el vicepresident del FOGAIBA va dictar Resolució de concessió d'ajuda al beneficiari &lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;CORPORACIÓN ROSSELLO CASTELL SA, de l'expedient IMIT2015_1/392, per un import de 11.999,91 euros, relativa a la línia d'ajuda “Inversions a les explotacions agràries”. Comunicat el 10 de setembre del 2016 al BOIB nº115. Pagat el 25 d'agost del 2017.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;3.&lt;/em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;En data 15 de febrer de 2021, Cristóbal Roselló Perelló, amb DNI &lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;***&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;9152&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;**, en representació de Corporació Rosselló Castell SA, amb NIF A07406325, així com de Son Mesquidassa SA, amb NIF A07319932, va presentar en registre electrònic número L95E2290/2021 una sol·licitud de subrogació, per part de Son Mesquidassa SA, de les ajudes, entre les quals, estan els expedient d'IMIT abans esmentats i manifestant que compleix tots els requisits i assumeix tots els compromisos contrets per corporació Rosselló Castell SA en relació a les ajudes concedides. &lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;4.El gestor del Servei d'Ajudes al Desenvolupament Rural, d'acord amb la normativa reguladora i la documentació aportada pel sol·licitant ha comprovat que aquest compleix tots els requisits exigits en l'apartat tercer de la Resolució de la convocatòria per poder ser beneficiari de les ajudes i que es pot acceptar la subrogació en tots els drets i obligacions pel que fa als expedients d'IMIT esmentats.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;5.&lt;/em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Conforme amb el que es disposa en l'article 47.2 del Reglament (UE) núm. 1305/2013 relatiu a l'ajuda al desenvolupament rural a través del Fons Europeu Agrícola de Desenvolupament Rural (FEADER)&lt;/em&gt;&lt;/span&gt;&lt;em&gt;&amp;nbsp;i pel qual es deroga el Reglament (CE) núm. 1698/2005 del Consell, quan durant el període d'execució d'un compromís contret com a condició per a la concessió d'una ajuda, es transfereixi totalment o parcialment l'explotació afectada a una altra persona, el compromís, o la part del mateix que correspongui a la terra transferida podrà ser assumit per aquesta persona durant la part restant d'aquest període o caducar, sense que s'exigeixi cap reemborsament pel període durant el qual el compromís fos efectiu.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;6.&lt;/em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;A&lt;/em&gt;&lt;/span&gt;&lt;em&gt;tès tot això, es proposa l'acceptació del canvi de titularitat, amb el compromís de mantenir les obligacions i compromisos restants respecte l'expedient d'ajuda Inversions no productives, IMIT2015_1/392.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;Fonaments de dret &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;1. L&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;'ajuda s'ha sol·licitat a l'empara de la Resolució del President del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 13 de novembre de 2015 per la qual es convoquen, per als anys 2015 a 2019, subvencions per a inversions no productives vinculades a la realització de compromisos d'agroambient i clima. Aquesta Resolució, en el seu apartat tercer punt 1, disposa que podran ser beneficiaris de les ajudes totes aquelles persones físiques o jurídiques o agrupacions sense personalitat jurídica, que duguin a terme les actuacions esmentades a l'apartat quart d'aquesta Resolució i, que en el moment de la proposta de resolució, compleixin un dels requisits següents:&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;a) Que siguin propietaris de la parcel·la on es volen dur a terme les inversions.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;b) Que siguin titulars d'una explotació agrària en la qual s'hi ubiquin les parcel·les on es volen dur a terme les inversions.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;Les parcel·les hauran de formar part d'una explotació agrària inscrita en el Registre Interinsular Agrari (RIA), abans de dictar-se la proposta de resolució.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;2. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;em&gt;L'apartat onzè de la Resolució de convocatòria , de “cessió i traspàs de l'explotació”, permet la cessió d'una explotació en els termes i condicions detallats en l'esmentat apartat.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;3. La possibilitat de subrogació o substitució de l'interessat en el procediment administratiu està prevista a l'article 31.3 de la Llei 30/1992, de 26 de novembre, de règim jurídic de les administracions públiques i del procediment administratiu comú, modificada per la Llei 4/1999, de 13 de gener, el qual disposa que: “cuando la condición de interesado derivase de alguna relación jurídica transmisible, el derecho-habiente sucederá en tal condición cualquiera que sea el estado del procedimiento”. Per aquest motiu, a excepció dels casos de relacions jurídiques de caràcter personal, en dret administratiu s'admet la successió tan per transmissió “inter vius” com “mortis causa” sempre que es tracti d'una situació jurídica transmissible.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;4. El Decret 64/2005, de 10 de juny, de creació del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA). Vista l'Ordre de la consellera d'Agricultura i Pesca de 23 de desembre de 2005, per la qual es disposa que el FOGAIBA assumeix l'execució de la política de la Conselleria d'Agricultura i Pesca referent a l'aplicació de les mesures de foment i millora dels sectors agrari i pesquer a partir de l'1 de gener de 2006.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;5. Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;Proposta de resolució&amp;nbsp;de modificació&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;D'acord amb la normativa reguladora &lt;/em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;i &lt;/em&gt;&lt;/span&gt;&lt;em&gt;la documentació aportada pels sol·licitants, s'ha comprovat que compleixen amb els requisits exigits per poder ser beneficiaris d'aquesta ajuda i que es poden acceptar les subrogacions en tots els drets i obligacions. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Per tot això, &lt;/em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;s' informa FAVORABLEMENT &lt;/em&gt;&lt;/span&gt;&lt;em&gt;del canvi de titular, i es proposa al vicepresident del FOGAIBA que dicti una resolució en els termes següents:&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;1.Aprovar el canvi de titular de&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;em&gt;&lt;em&gt;l&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;'&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;expedient&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;de la línia d'ajudes d'Inversions no productives següents a favor de:&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&amp;nbsp;&lt;em&gt;IMIT 2015_1/3&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;92 SON MESQUIDASSA S.A. amb CIF A07319932., que assumeixen formalment els compromisos adquirits pels anteriors beneficiaris de l&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;'ajuda.&lt;/em&gt;&amp;nbsp;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;2.Notificar la resolució als interessats.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;3.Contra aquesta Resolució es podrà interposar recurs d'alçada davant del conseller d&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;'Agricultura, &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;Pesca&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;i Alimentació&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;, en el termini d'un mes, comptador des de l'endemà de la notificació de la resolució, d'acord amb el que s'estableix en l'article 58.4 de la Llei 3/2003, de 26 de març, de règim jurídic de l'Administració de la Comunitat Autònoma de les Illes Balears, i en els articles 1&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;2&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;1 i 1&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;22&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;de la Llei 3&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;9&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;/2&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;015&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;, d&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;'1&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;d&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;'octubre&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;, de règim jurídic de les administracions públiques.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
