    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;L'apartat 9.3. de la Convocatòria d'ajudes per al desenvolupament rural de l'illa de Menorca, relacionats directament o indirectament amb els àmbits agrari i/o ambiental, dins l'Estratègia de Desenvolupament Local Participatiu de Menorca, de data 22 de gener de 2018&amp;nbsp;especifica que la resolució es publicarà amb caràcter informatiu a les persones interessades mitjançant la seva publicació al &lt;em&gt;&lt;em&gt;Butlletí Oficial de les Illes Balears &lt;/em&gt;&lt;/em&gt;d'acord amb els termes que preveu&amp;nbsp;l'article 45.2 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;Els expedients han estat tramitats pel Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) en compliment del que disposa l'article 43 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;El vicepresident en matèria agrària del FOGAIBA en&amp;nbsp;data 7&amp;nbsp;d'abril&amp;nbsp;de 2021, va signar la següent resolució, &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;1. E&lt;/em&gt;&lt;/span&gt;&lt;em&gt;n data 8 de febrer de 2018 es va publicar al BOIB núm 18 la convocatòria d'ajudes per al desenvolupament rural de l'illa de Menorca, relacionats directament o indirectament amb els àmbits agrari i/o ambiental, dins l'Estratègia de Desenvolupament Local Participatiu de Menorca pels anys 2018 i 2019. Aquesta convocatòria va patir dues modificacions publicades als BOIB&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;nº&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;104 de 23 d'agost de 2018 i 119 de 27 de setembre de 2018&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;.&lt;/em&gt;&lt;/span&gt;&amp;nbsp;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;2. De conformitat amb l'apartat sisè de l'esmentada Resolució, els terminis de presentació de sol·licituds per als anys 2018 i 2019 van acabar els dies 15 de desembre de 2018 i 15 de desembre de 2019 respectivament i varen tenir entrada en el Registre del Fons de Garantia Agrària i Pesquera de les Illes Balears un total de &lt;/em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;7&lt;/em&gt;&lt;/span&gt;&lt;em&gt;&amp;nbsp;sol·licituds d'ajuda.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;3. En data 27 d'octubre de 2020 es va publicar al BOIB núm. 183 la Resolució de concessió als beneficiaris de les ajudes, R1 de data 15 d'octubre de 2020, a l'empara de la Convocatòria d'ajudes per al desenvolupament rural de l'illa de Menorca, relacionats directament o indirectament amb els àmbits agrari i/o ambiental, dins l'Estratègia de Desenvolupament Local Participatiu de Menorca, de data 22 de gener de 2018. EDLNP22018_1, pels anys 2018 i 2019 on s'atorgava una ajuda de 5.937,53 € a Es Molí de Baix, SRM per dur a terme un projecte de visites guiades a la finca Es Molí de Baix. Aquest import suposava un 44,50% del pressupost de l'actuació xifrat en 13.342,77€.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;4. En data &lt;/em&gt;&lt;/span&gt;&lt;em&gt;5 de febrer de 2021 amb NRGE 1930 &lt;/em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;Flora Elisabeth Ritman, en nom i representació d'es Molí de Baix va sol·licitar la modificació del projecte «Visites guiades a la finca del Molí de Baix». Aquesta modificació esdevé necessària donat que degut a la pandèmia de la COVID 19 i a la limitació temporal de les visites que ha fet el Consell de Menorca algunes de les inversions previstes inicialment ja no son necessàries i d'altras s'han hagut d'ajustar a un escenari en el que l'activitat objecte del projecte només es podrà dur a terme durant els mesos de tardor i hivern, per tal de garantir la seva viabilitat. En aquest sentit, es proposa la modificació següent de les partides del pressupost:&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;5. Les modificacions proposades per la persona beneficiària suposen una reducció del pressupost inicial del projecte que passa de 13.342,77€ a 4.265,60€. Amb la reducció del pressupost del projecte, correspon reduïr l'ajuda concedida fins als 1.898,19€, el que suposa la necessitat de revocar un import de 4.039,34€ respecte de la subvenció concedida per la Resolució del vicepresident del FOGAIBA de data 15 d'octubre de 2020 que va concedir una ajuda de fins a 5.937,53 euros.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;6. &lt;/em&gt;&lt;/span&gt;&lt;em&gt;D'acord amb l'article 24.2 del Text refós de la Llei de Subvencions, aprovat per Decret legislatiu 2/2005, de 28 de desembre, i donat que les modificacions proposades no alteren substancialment la naturalesa i/o la finalitat de la subvenció i que no perjudica a tercers, es poden modificar les condicions d'execució de l'activitat subvencionada mitjançant una resolució expressa de modificació emesa per l'òrgan concedent.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Aquesta convocatòria va patir dues modificacions publicades als BOIB 104 de 23 d'agost de 2018 i 119 de 27 de setembre de 2018.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;- Conveni de col&lt;/em&gt;&lt;/span&gt;&lt;em&gt;·laboració entre el Fons de Garantía Agrària i Pesquera de les Illes Balears com a Organisme Pagador, l'adjunt a la Gerència del FOGAIBA com Autoritat de Gestió i el Grup d'Acció Local Associació Leader Illa de Menorca pel que s'estableixen les condicions per a l'aplicació de la mesura 19 del Programa de Desenvolupament Rural de les Illes Balears 2014-2020 de 26 de juny de 2017.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;- Reglament (UE) núm. 1305/2013 del Parlament Europeu i del Consell, de 17 de desembre de 2013, relatiu a l'ajuda al desenvolupament rural a través del Fons Europeu Agrícola de Desenvolupament Rural (FEADER) i pel qual es deroga el Reglament (CE) núm. 1698/2005 del Consell.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;- Reial decret 887/2006, de 21 de juliol, pel qual s'aprova el Reglament de la Llei 38/2003, de 17 de novembre, general de subvencions. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;- Decret legislatiu 2/2005, de 28 de desembre, pel qual s'aprova el Text refós de la Llei de subvencions. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;- Programa de Desenvolupament Rural de les Illes Balears 2014-2020.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;- Ordre del conseller d'Agricultura, Medi Ambient i Territori de 19 de febrer de 2015, per la qual s'estableixen les bases reguladores per a la concessió de subvencions en el marc del Programa de Desenvolupament Rural de les Illes Balears 2014-2020. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;- Llei 39/2015, de 1 d'octubre del procediment administratiu comú de les administracions públiques.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;Proposta de resolució de concessió&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;Per tot això, s'informa favorablement i propòs al vicepresident del FOGAIBA que dicti una resolució en els termes següents:&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;1. Modificar la Resolució del vicepresident del FOGAIBA de 15 d'octubre de 2020 per la qual es concedeix una ajuda a Molí de Baix, SRM. Amb la modificació sol·licitada del projecte, correspon atorgar una ajuda de 1.898,19 € d'acord amb els pressuposts i percentatges de cofinançament detallats a l' Annex I&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;2. Revocar un import de 4.039,34€ de l'ajuda concedida en la Resolució del vicepresident del FOGAIBA de 15 d'octubre de 2020 a Molí de Baix, SRM&lt;/em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&amp;nbsp;d'acord amb el cofinançament detallat a l'Annex II&lt;/em&gt;&lt;/span&gt;&lt;em&gt;&amp;nbsp;relatiu a la línia d'ajuda “Suport a l'implementació a les operacions incloses els EDL No Programats MENORCA”. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;3. Notificar la resolució a cada un dels beneficiaris de l' Annex I.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;Interposició de recursos&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;Contra aquesta resolució –que no exhaureix la via administrativa- es pot interposar recurs d'alçada davant el conseller de Medi Ambient, Agricultura i Pesca, en el termini d'un mes, comptador des de l'endemà de la notificació de la resolució, d'acord amb l'article 58.4 de la Llei 3/2003, de 26 de març, de règim jurídic de l'Administració de la comunitat autònoma de les Illes Balears, i els articles 121 i 122, de la Llei 39/2015 del Procediment Administratiu Comú de les Administracions Públiques.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
