&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Joan Monjo Estelrich, Batle d'aquest Ajuntament, faig saber:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Vist que la jutgessa de pau suplent, la Sra. Catalina Rosselló Garaña, fou nomenada jutgessa de pau titular en data 28/10/2020, d'acord amb el que disposa la Llei 6/1985, d'1 de juliol, del poder judicial, i el Reglament núm. 3/1995, de 7 de juny, dels jutges de pau, és necessari procedir a l'elecció d'un nou jutge/ssa de pau suplent per a un període de 4 anys.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Que correspon al Ple de l'Ajuntament triar les persones per ser nomenades Jutge de Paz, titular i substitut d'aquest Municipi, de conformitat al que disposen els articles 101 i 102 de la Llei Orgànica 6/1985, d'1 de juliol, del Poder Judicial i article 4 i 5.1 del Reglament 3/1995, de 7 de juny, dels Jutges de Paz.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Que s'obre un termini de 20 dies hàbils perquè les persones que estiguin interessades, i reuneixin les condicions legals ho sol·licitin per escrit dirigit a aquesta Batlia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Les sol·licituds es presentaran en el Registre d'entrada d'aquest Ajuntament o bé mitjançant el registre electrònic d'acord amb l'article 16.4 de la Llei 39/2015, d'1 d'octubre, del Procediment Administratiu Comú de les Administracions Públiques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;El model d'instància es troba a la disposició dels interessats en les dependències municipals de la Corporació on podran ser presentades dins del termini establert.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Així mateix, estarà a la disposició dels interessats a la seu electrònica d'aquest Ajuntament. https://www.ajsantamargalida.net&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Que en cas de no presentar-se sol·licituds, el Ple de la Corporació triarà lliurement, d'acord amb el que es preveu en l'article 101.1 de la Llei Orgànica 6/1985, d'1 de juliol, del Poder Judicial i l'article 4 i 6 del Reglament 3/1995, de 7 de juny, dels Jutges de Paz, comunicant l'Acord al Jutjat de Primera Instància del partit.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;El que es publica per a general coneixement.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;2.- Que reuneixo els requisits de capacitat establerts al Reglament número 3/1995 de 7 de juny, dels Jutges de Pau, article 1.2 del Títol I i article 13 del Títol II.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;3.- Que compleixo tots els requisits que preveu la LO 6/1985, d'1 de juliol, del Poder Judicial, i en concret els següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;a) Ser espanyol&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;b) Ser major d'edat&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;c) No estar incurs en cap de les causes d'incapacitat que estableix l'article 303 de l'esmentada LO, i que literalment diu: "Estan incapacitats per ingressar en la Carrera Judicial els disminuïts física o psíquicament per a la funció judicial; els condemnats per delictes dolosos mentre no hagin obtingut la rehabilitació; els processats o inculpats per delicte dolós en tant no siguin absolts o es dicti auto de sobreseïment i aquells que no estiguin en el ple exercici dels seus drets civils.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;4.- Que no incorre en cap de les incompatibilitats i prohibicions regulades als articles 389 a 397 de la Llei Orgànica del Poder Judicial en allò que sigui aplicable:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;a) Amb qualsevol càrrec d'elecció popular o designació política de l'Estat, Comunitats Autònomes, Províncies i resta d'entitats locals i organismes dependents de qualsevol d'ells.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;c) Amb l'exercici de l'advocacia i de la procuradoria i amb tot tipus d'assessorament jurídic, sigui o no retribuït.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;No podran els/les jutges/sses pertànyer a partits polítics o sindicats o tenir ocupació al servei dels mateixos. Tampoc podran prendre en les eleccions legislatives o locals més part que la d'emetre el seu vot personal. No obstant això exerciran les funcions i complimentaran els deures inherents als seus càrrecs.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
