&lt;p&gt;&lt;span style="line-height:normal"&gt;1. El 19 de desembre de 2019 (RE 40021), Redexis Gas, SA, va sol·licitar una autorització d'execució d'instal·lacions i, en concret, de declaració d'utilitat pública per al projecte d'extensió de xarxa per a la distribució de gas canalitzat per al centre Amadip Esment a Son Ferriol, al terme municipal de Palma (Mallorca).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:normal"&gt;Les característiques principals de la instal·lació, indicades en el projecte d'execució signat digitalment el dia 18/12/2019 per l'enginyer industrial José Roig Gómez, col. 12392 pel Col·legi d'Enginyers Industrials de Madrid (COIMM), sense visar, són les següents:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:normal"&gt;Gas que s'ha de subministrar:&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:normal"&gt;Gas natural amb un PCS (Hs) entre un mínim de 10,26 kWh/m&lt;sup&gt;3&lt;/sup&gt; i un màxim de 13,26 kWh/m&lt;sup&gt;3&lt;/sup&gt;, en funció de la seva procedència.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:normal"&gt;Descripció de la instal·lació:&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:normal"&gt;Connexió consistent en la xarxa de distribució MOP 5 bar de 1.107 metres lineals de canonada de polietilè d'alta densitat PE100 DN 90 SDR 17/17,6.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;El traçat discorre a l'inici en direcció sud-est, pel marge dret del carrer del General Weyler i la carretera Ma-3013, per discórrer posteriorment per finques privades, i gira en sentit sud-oest fins al final del traçat, a l'altura del paral·lelisme amb la carretera Ma-30. A excepció de l'inici del traçat, el qual discorre sota sòl urbà municipal, i el tram final d'aquest, que discorre en terreny de categoria rústica, la resta del traçat discorre sota vials asfaltats categoritzats com a sòl rústic agrari.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Pressupost:&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:normal"&gt;84.428,49&amp;nbsp;€&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:normal"&gt;2. El 13 febrer de 2020, el Servei de Transport i Distribució d'Energia i Generació Tèrmica va requerir l'esmena de deficiències en la sol·licitud feta per Redexis Gas, SA, en què, entre altres qüestions, se li requereixen les separates tècniques del projecte relatives a les afeccions d'organismes i empreses de serveis públics.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:normal"&gt;3. Redexis Gas, SA, va esmenar les deficiències detectades pel Servei en el requeriment de 13 de febrer de 2020.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:normal"&gt;4. Atès que el projecte objecte d'autorització no figura entre els inclosos en els annexos de la Llei 12/2016, de 17 d'agost, d'avaluació ambiental de les Illes Balears, ni en els annexos de la Llei 21/2013, de 9 de desembre, d'avaluació ambiental, es pot considerar exclòs d'avaluació ambiental.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:normal"&gt;5. Aquesta sol·licitud inclou annexa la relació concreta i individualitzada de béns i drets afectats, ja que la instal·lació discorre per vials públics, i afecta:&lt;/span&gt;&lt;/p&gt;

El 15 de juny de 2020, es va publicar l'anunci d'informació pública en el BOE. El 9 de juny es van publicar els anuncis d'informació pública en el diari &lt;em&gt;Última Hora&lt;/em&gt; i en el &lt;em&gt;Diario de Mallorca&lt;/em&gt;. Es va publicar a la pàgina web de la Direcció General d'Energia i Canvi Climàtic. De dia 10/07/2020 a 07/08/2020 l'Ajuntament de Palma va publicar en el tauler d'anuncis la informació pública del projecte, segons el certificat de publicació en el tauler d'anuncis registrat a la Direcció General d'Energia i Canvi Climàtic el 08/09/2020. De dia 24/06/2020 a 23/07/2020 l'Ajuntament de Marratxí va publicar en el tauler d'anuncis la informació pública del projecte, segons el certificat de publicació en el tauler d'anuncis registrat a la Direcció General d'Energia i Canvi Climàtic el 04/08/2020. Aquest Servei no té constància de la presentació de cap al·legació pel que fa al cas.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:normal"&gt;9. El 30 de juny de 2020, servituds aeronàutiques de l'Agència Estatal de Seguretat Aèria sol·licita aportar la informació addicional següent:&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="line-height:normal"&gt;Aportar la documentació amb la taula de sol·licitud de coordenades.&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="line-height:normal"&gt;Es remet a Redexis Gas, SA, per tal de poder esmenar.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:normal"&gt;10. El 7 de juliol de 2020, FACSA informa i dona la conformitat per a l'extensió de xarxa de distribució de gas canalitzat al Centre Amadip Esment a Son Ferriol, sempre que es compleixin les condicions esmentades en el seu informe i la seva documentació adjunta. A més, ha fet arribar a Redexis Gas, SA, un informe dels serveis existents d'aigua potable, sanejament i pluvials que afecten el trajecte de la xarxa. &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:normal"&gt;11. El director general d'Energia i Canvi Climàtic va sol·licitar per segona vegada informes a:&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="line-height:normal"&gt;Ajuntament de Palma.&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:normal"&gt;Endesa Distribución Eléctrica SLU.&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:normal"&gt;Dept. de Mobilitat i Infraestructures del Consell Insular de Mallorca.&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:normal"&gt;Dept. d'Urbanisme i Territori del Consell Insular de Mallorca.&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:normal"&gt;EMAYA.&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:normal"&gt;2020 Vodafone España SAU.&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="line-height:normal"&gt;12. El 4 d'agost de 2020, la Comissió Insular d'Ordenació del Territori i Urbanisme del Departament del Territori del Consell Insular de Mallorca va informar-ne favorablement, sempre que el projecte rebi l'informe del Departament d'Infraestructures del Consell Insular de Mallorca.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:normal"&gt;13. El 12 d'agost de 2020, 2020 Vodafone España SAU exhaureix per caducitat la notificació del segon informe; per tant, es pot evacuar el tràmit de l'autorització de la instal·lació.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:normal"&gt;14. El 14 d'agost de 2020, Endesa Distribución Eléctrica SLU n'informa favorablement, sempre que:&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="line-height:normal"&gt;Si és necessari desplaçar o modificar alguna de les instal·lacions de mitjana i baixa tensió, el promotor haurà de sol·licitar-ho formalment a E-Distribución Redes Digitales, SLU, que farà l'estudi de viabilitat i el pressupost d'aquesta modificació.&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:normal"&gt;Abans de l'inici de les obres, s'haurà de sol·licitar a E-Distribución Redes Digitales, SLU, un replanteig &lt;em&gt;in situ&lt;/em&gt;, per evitar possibles danys, tant a les persones com a les instal·lacions.&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="line-height:normal"&gt;15. El 16 d'agost de 2020, venç el termini de reiteració marcat per l'article 80 del Reial decret 1434/2002, de 27 de desembre, pel qual es regulen les activitats de transport, distribució, comercialització, subministrament i procediments d'autorització d'instal·lacions de gas natural. Segons el que indica aquest article, EMAYA, un cop vençut aquest termini, dona la conformitat per a l'autorització de la instal·lació.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:normal"&gt;16. L'1 de setembre de 2020, l'Ajuntament de Palma n'informa favorablement, condicionat a presentar els certificats de materials utilitzats i complir les condicions generals que figuren en el document de l'informe del 26 d'agost de 2020.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:normal"&gt;17. El 9 d'octubre de 2020, la Direcció Insular d'Infraestructures del Departament de Mobilitat i Infraestructures del Consell Insular de Mallorca autoritza les obres del ramal de distribució de gas canalitzat per al centre Amadip Esment de Son Ferriol, a la Ma-30 ramal PK 4+200 a PK 4+500 i rotonda, al terme municipal de Palma, sempre que s'ajustin a les condicions esmentades en l'informe 479/2020 del 06/08/2020.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:normal"&gt;18. El 21 de desembre de 2020, servituds aeronàutiques de l'Agència Estatal de Seguretat Aèria informa favorablement sobre la instal·lació del ramal de distribució presentat amb el compliment de les condicions següents:&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="line-height:normal"&gt;No superar els valors d'altura i elevació indicats en la taula presentada pel ramal i per la maquinària, inclosos tots els seus elements o qualsevol afegit sobre aquests.&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:normal"&gt;Si és necessària la utilització d'altres mitjans auxiliars que superin l'altura i l'elevació autoritzades, s'haurà de sol·licitar la corresponent autorització de manera prèvia i preceptiva a la seva instal·lació, fent referència a aquest expedient.&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="line-height:normal"&gt;19. El Servei de Transport i Distribució d'Energia i Generació Tèrmica de la Direcció General d'Energia i Canvi Climàtic va examinar la sol·licitud i va emetre un informe favorable sobre l'autorització administrativa de construcció i de declaració d'utilitat pública sobre el projecte d'extensió de xarxa per a la distribució de gas canalitzat per al centre Amadip Esment a Son Ferriol, al terme municipal de Palma (Mallorca).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Fonaments de dret&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:normal"&gt;1. La Llei 34/1998, de 7 d'octubre, del sector d'hidrocarburs.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:normal"&gt;2. El Reial decret 1434/2002, de 27 de desembre, que regula les activitats de transport, distribució, comercialització, subministrament i autorització d'instal·lacions de gas natural.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:normal"&gt;3. El Reial decret 919/2006, de 28 de juliol, pel qual s'aprova el Reglament tècnic de distribució i utilització de combustibles gasosos i les seves instruccions tècniques complementàries ICG 01 a 11.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:normal"&gt;4. El Decret 96/2005, de 23 de setembre, d'aprovació definitiva de la revisió del Pla Director Sectorial Energètic de les Illes Balears.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:normal"&gt;5. El Decret llei 3/2014, de 5 de desembre, de mesures urgents destinades a potenciar la qualitat, la competitivitat i la desestacionalització turística a les Illes Balears.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:normal"&gt;Per tot això, dict la següent&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Resolució&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:normal"&gt;1. Atorgar l'autorització administrativa de construcció al projecte d'execució d'extensió de xarxa per a la distribució de gas canalitzat per al centre Amadip Esment a Son Ferriol, al terme municipal de Palma, redactat el desembre de 2019 pel senyor José Roig Gómez, enginyer industrial, amb els condicionants següents:&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="line-height:normal"&gt;Les condicions indicades en l'informe 2020/00003171V del 28 de maig de 2020 de l'Ajuntament de Marratxí.&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:normal"&gt;Complir les condicions esmentades en l'informe de FACSA de 28 maig de 2020 i la seva documentació adjunta.&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:normal"&gt;Si és necessari desplaçar o modificar alguna de les instal·lacions de mitjana i baixa tensió, el promotor haurà de sol·licitar-ho formalment a E-Distribución Redes Digitales, SLU, que farà l'estudi de viabilitat i el pressupost d'aquesta modificació.&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:normal"&gt;Abans de l'inici de les obres, s'haurà de sol·licitar a E-Distribución Redes Digitales, SLU, un replanteig &lt;em&gt;in situ&lt;/em&gt;, per evitar possibles danys, tant a les persones com a les instal·lacions.&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:normal"&gt;S'hauran de presentar els certificats de materials utilitzats i complir les condicions generals que figuren en el document de l'informe del 26 d'agost de 2020 de l'Ajuntament de Palma.&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:normal"&gt;S'haurà d'ajustar a les condicions esmentades en l'informe 479/2020 del 06/08/2020 de la Direcció Insular d'Infraestructures del Departament de Mobilitat i Infraestructures del Consell Insular de Mallorca.&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:normal"&gt;No superar els valors d'altura i elevació indicats en la taula presentada per servituds aeronàutiques de l'Agència Estatal de Seguretat Aèria pel ramal i per la maquinària, inclosos tots els seus elements o qualsevol afegit sobre aquests.&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:normal"&gt;Si és necessària la utilització d'altres mitjans auxiliars que superin l'altura i l'elevació autoritzades, s'haurà de sol·licitar la corresponent autorització de manera prèvia i preceptiva a la seva instal·lació, fent referència a aquest expedient a servituds aeronàutiques de l'Agència Estatal de Seguretat Aèria.&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="line-height:normal"&gt;Aquesta autorització habilita el titular per a la construcció de la instal·lació, sens perjudici d'altres autoritzacions, llicències o permisos si són necessaris per a la seva execució.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:normal"&gt;2. Reconèixer, en concret, la utilitat pública d'aquesta instal·lació, d'acord amb l'article 103 de la Llei 34/1998, de 7 d'octubre, del sector d'hidrocarburs.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:normal"&gt;3. Determinar que, d'acord amb la disposició addicional segona del Decret&amp;nbsp;96/2005, de 23 de setembre, d'aprovació definitiva de la revisió del Pla Director Sectorial Energètic de les Illes Balears, modificada per l'article 19 del Decret llei 3/2014, de 5 de desembre, de mesures urgents destinades a potenciar la qualitat, la competitivitat i la desestacionalització turística a les Illes Balears, els ramals de canonada que connecten gasoductes de transport primari i secundari, així com les xarxes de distribució de gas natural, poden ser declarats d'utilitat pública i tenir els mateixos efectes prevists en els articles 25, 26.5 i 26.6 del Pla Director Sectorial Energètic. Per tant, en aquest cas, com que es tracta d'una instal·lació de distribució de gas natural i s'ha seguit el procediment de declaració d'utilitat pública regulat en l'article 3 de la Llei 13/2012, de 20 de novembre, de mesures urgents per a l'activació econòmica en matèria d'indústria i energia, noves tecnologies, residus, aigües, altres activitats i mesures tributàries, la declaració d'utilitat pública ha de tenir els mateixos efectes que els prevists en els articles 25, 26.5 i 26.6 del Pla Director Sectorial Energètic de les Illes Balears.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:normal"&gt;En conseqüència, d'acord amb la disposició addicional i els apartats 5 i 6 de l'article 26 del Decret 96/2005, per tal com l'obra autoritzada es farà en execució de les determinacions del Pla Director Sectorial, i atès que està recollit amb el grau de detall suficient per avaluar-ne les característiques fonamentals, són d'aplicació plena, directa i immediata i, a més a més, l'obra autoritzada no se sotmetrà als actes de control preventiu municipal a què es refereix l'article 84.1.&lt;em&gt;b)&lt;/em&gt; de la Llei 7/1985, de 2 d'abril, reguladora de les bases de règim local, perquè es tracta d'activitats d'interès supramunicipal, i queda exempta de la subjecció al règim de llicències, autoritzacions i informes que estableix la Llei 8/1995, de 30 de març, d'atribució de competències als consells insulars en matèria d'activitats classificades i parcs aquàtics, reguladora del procediment i de les infraccions i sancions. D'altra banda, les obres autoritzades quedaran subjectes al règim impositiu establert en l'article&amp;nbsp;29 del Decret 96/2005.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:normal"&gt;4. Atorgar el termini de dos anys, comptador des de la notificació d'aquesta Resolució, per a l'execució de la instal·lació. La Direcció General d'Energia i Canvi Climàtic, per causes justificades i motivades, pot ampliar aquest termini.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:normal"&gt;5. Indicar que, una vegada executades totalment o parcialment les instal·lacions objecte d'aquesta autorització, el titular ha de presentar la sol·licitud de posada en servei, a la qual ha d'adjuntar un certificat de final d'obra subscrit per un tècnic facultatiu, així com les proves reglamentàries i la resta de documentació que exigeix la reglamentació vigent.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:normal"&gt;6. Notificar aquesta Resolució al titular de la instal·lació, a totes les persones interessades, Adrover Coll, Maria Rosa; Adrover Coll, Lluïsa; Rosselló Vicens, Catalina; Comunitat Autònoma de les Illes Balears, i a l'Ajuntament de Palma i al de Marratxí, i publicar-la en el &lt;em&gt;Butlletí Oficial de les Illes Balears&lt;/em&gt; i en el &lt;em&gt;Butlletí Oficial de l'Estat&lt;/em&gt;.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Interposició de recursos&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:normal"&gt;Contra aquesta Resolució, que exhaureix la via administrativa, es pot interposar un recurs potestatiu de reposició davant el conseller de Transició Energètica, Sectors Productius i Memòria Democràtica en el termini d'un mes comptador des de l'endemà de la publicació, d'acord amb l'article 124 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques, i l'article 57 de la Llei 3/2003, de 26 de març, de règim jurídic de l'Administració de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:normal"&gt;També es pot interposar directament un recurs contenciós administratiu davant la Sala Contenciosa Administrativa del Tribunal Superior de Justícia de les Illes Balears en el termini de dos mesos comptadors des de l'endemà d'haver rebut la notificació de la Resolució, d'acord amb l'article 46 de la Llei 29/1998, de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa.&lt;/span&gt;&lt;/p&gt;
