font-size:12px"><span style="line-height:115%"><strong>3.</strong> La convocatòria es va publicar en el <span style="color:#000000">BOIB núm. </span><span style="color:#000000">1</span><span style="color:#000000">99</span><span style="color:#000000">,</span><span style="color:#000000"> de </span><span style="color:#000000">2</span><span style="color:#000000">4</span><span style="color:#000000"> d</span><span style="color:#000000">e </span><span style="color:#000000">novembre</span><span style="color:#000000"> </span><span style="color:#000000">de 20</span><span style="color:#000000">20</span><span style="color:#000000">,</span> i una vegada finalitzat el termini de presentació de sol·licituds únicament ha presentat sol·licitud, per a <span style="color:#000000">l</span><span style="color:#000000">a</span><span style="color:#000000"> concert</span><span style="color:#000000">ació</span><span style="color:#000000"> del </span><span style="color:#000000">servei</span><span style="color:#000000"> </span><span style="color:#000000"><span style="background-color:#ffffff">d'intervenció familiar de treball del vincle parental</span></span><span style="color:#000000">,</span><span style="color:#000000"> </span>l'entitat XARXA D'INICIATIVES D'ATENCIÓ A LA INFÀNCIA I FAMÍLIES (en endavant XIAIF). </span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong>4. </strong>La Comissió Avaluadora es va reunir els dies 12 i 18 de gener de 2021, acordant, després del pertinent tràmit d'esmenes, admetre a l'entitat XIAIF i presentar l'informe proposta per a la concessió de la concertació del <span style="color:#000000">servei</span><span style="color:#000000"> </span><span style="color:#000000"><span style="background-color:#ffffff">d'intervenció familiar de treball del vincle parental</span></span><span style="color:#000000">.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong>5. </strong>Per part del Servei d'Autoritzacions, Registre i Inspecció de Centres i Serveis Socials, en data 29 de gener de 2021, s'informa favorablement sobre els serveis autoritzats i vigents de l'entitat sol·licitant, així com de la inexistència d'expedient sancionador en matèria de serveis socials per infraccions de les que consten en els articles 128 i 129 de la Llei 4/2009, de Serveis Socials de les Illes Balears durant els darrers 24 mesos.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong>6. </strong> El 3 de febrer de 2021, va ser signat l'informe proposta de resolució, de data 29 de gener de 2021, emès pel cap del Servei d'Infància i Família amb el vist i plau de la directora insular de Menors i Família, segons el qual es proposa que el president de l'IMAS resolgui l'adjudicació de 75 places <span style="color:#000000">de l</span><span style="color:#000000">a</span><span style="color:#000000"> </span><span style="color:#000000">c</span><span style="color:#000000">oncert</span><span style="color:#000000">ació </span><span style="color:#000000">del </span><span style="color:#000000">servei</span><span style="color:#000000"> </span><span style="color:#000000"><span style="background-color:#ffffff">d'intervenció familiar de treball del vincle parental</span></span><span style="color:#000000">,</span> per un període d'un any, <span style="color:#000000">pod</span><span style="color:#000000">ent-se</span><span style="color:#000000"> </span><span style="color:#000000">ampliar i renovar</span><span style="color:#000000"> sempre i quan les entitats, </span><span style="color:#000000">en aquest període,</span><span style="color:#000000"> hagin </span><span style="color:#000000">obtingut l'acreditació del servei corresponent o subsisteix</span><span style="color:#000000">i</span><span style="color:#000000">n les necessitats que n'hagin motivat la </span><span style="color:#000000">seva </span><span style="color:#000000">formalització, d'acord amb </span><span style="color:#000000">l'establert a l</span><span style="color:#000000">a Llei 12/2018,</span> a favor de l'única entitat sol·licitant i admesa, XIAIF.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong>7.</strong> El Servei Juridicoadministratiu ha elaborat el pertinent model d'acord d'acció concertada mitjançant el que es formalitzaran les col·laboracions per a la prestació <span style="color:#000000">del </span><span style="color:#000000">servei</span><span style="color:#000000"> </span><span style="color:#000000"><span style="background-color:#ffffff">d'intervenció familiar de treball del vincle parental</span></span><span style="color:#000000">,</span><span style="color:#000000"> </span><span style="color:#000000">objecte d'aquesta concertació, </span><span style="color:#000000">d'acord amb l'article 5.4 de la Llei 12/2018, de 22 de novembre de 2018.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="color:#000000">8</span><span style="color:#000000">. </span></strong><span style="color:#000000">Per la</span><span style="color:#000000"> </span><span style="color:#000000">D</span><span style="color:#000000">irec</span><span style="color:#000000">ció</span><span style="color:#000000"> </span><span style="color:#000000">I</span><span style="color:#000000">nsular </span><span style="color:#000000">d'</span><span style="color:#000000">Infància</span><span style="color:#000000"> i Família </span><span style="color:#000000">s'ha aportat el model d'Avaluació i </span><span style="color:#000000">S</span><span style="color:#000000">eguiment del</span><span style="color:#000000"> </span><span style="color:#000000">servei</span><span style="color:#000000"> </span><span style="color:#000000"><span style="background-color:#ffffff">de treball del vincle</span></span><span style="color:#000000">,</span><span style="color:#000000"> </span><span style="color:#000000">per a la seva aprovació</span><span style="color:#000000">, </span><span style="color:#000000">de conformitat amb l'article 10.</span><span style="color:#000000">1 de la Llei 12/2018, de 22 de novembre de 2018.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong>Consideracions<strong> </strong>jurídiques</strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>1.</strong> La Llei orgànica 1/2007, de 28 de febrer, de reforma de l'Estatut d'Autonomia de les Illes Balears, en especial el seu article 70.8 que estableix que el Consell de Mallorca exerceix les competències pròpies en matèria de tutela, guarda, acolliment familiar i adopció.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>2.</strong> La Llei 9/2019, de 19 de febrer, de l'atenció i dels drets de la infància i adolescència de les Illes Balears (BOIB núm. 26 de 28 de febrer de 2019), regula a l'article 73 les competències dels Consells Insulars.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>3. </strong>La Llei 8/1997, de 18 de desembre, d'atribució de competències als consells insulars en matèria de tutela, acolliment i adopció de menors.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><strong>4</strong>. L'Institut Mallorquí d'Afers Socials, com a organisme autònom creat pel Consell de Mallorca, adscrit al Departament de Drets Socials del Consell de Mallorca, és l'organisme que exerceix les competències atribuïdes per qualsevol títol al Consell de Mallorca en matèria de serveis socials i menors, de conformitat a l'article 2 dels Estatuts de l'Institut Mallorquí d'Afers Socials (BOIB núm. 67, de 18 de maig de 2019) aprovat per acord del Ple del Consell de Mallorca de data 11 d'abril de 2019.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><strong>5</strong>. D'acord amb el títol IV de la Llei 9/2019, de 19 de febrer, de l'atenció i dels drets de la infància i adolescència de les Illes Balears es regula el <span style="color:#000000">conjunt de mesures i actuacions de prevenció, detecció, intervenció i reparació de situacions de risc, de desemparament i de conductes inadaptades o problemes de conducta en què l'infant o l'adolescent o, si n'és el cas, el concebut es pot trobar, tendents a garantir-ne el ple desenvolupament i autonomia personal, així com la integració familiar i social, i promoure'n la inserció en un context social i familiar normalitzat, amb la prevalença, en tot cas, de l'interès superior de la persona menor d'edat.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><strong>6</strong>. La Llei orgànica 1/1996, de 15 de gener, de protecció jurídica del menor (reformada per la Llei orgànica 8/2015, de 22 de juliol i Llei 26/2015, de 28 de juliol, de reforma del sistema de protecció de la infància i la adolescència).</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><strong>7.</strong> L<span style="color:#000000">a Llei 9/2017, 8 de novembre, de Contractes del Sector Públic, per la qual es transposen l</span><span style="color:#000000">es Directives del Parlament Europeu i del Consell 2014/23/UE i 2014/24/UE, de 26 de febrer de 2014, en el seu article 11.6 </span><span style="color:#000000">estableix que: </span><span style="color:#000000"><em>«</em></span><em>Queda exclosa de la present Llei la prestació de serveis socials per entitats privades, sempre que aquesta es realitzi sense necessitat de celebrar contractes públics, a través, entre altres mitjans, del simple finançament d'aquests serveis o la concessió de llicències o autoritzacions a totes les entitats que compleixin les condicions prèviament fixades pel poder adjudicador, sense límits ni quotes, i que aquest sistema garanteixi una publicitat suficient i s'ajusti als principis de transparència i no discriminació».</em></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><strong>8.</strong><span style="color:#000000"><em><strong> </strong></em></span>El Decret 46/1997, de 21 de març, </span>pel qual s'ordena, en l'àmbit territorial de la Comunitat Autònoma de les Illes Balears, l'establiment i la regulació dels requisits per a l'acreditació i habilitació de les entitats col·laboradores de l'Administració en matèria de guarda de menors i integració familiar que preveu un procediment específic de concertació amb aquestes entitats. Aquest Decret es va veure parcialment afectat per l'entrada en vigor de la Llei 4/2009,<strong> </strong>d'11 de juny, de serveis socials de les Illes Balears que estableix un règim incompatible amb l'anterior ampliant el concepte d'entitats col·laboradores o d'iniciativa privada a les entitats mercantils.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><strong>9.</strong> La Llei 4/2009, d'11 de juny, de serveis socials de les Illes Balears, preveu al seu article 3, entre d'altres, objectius que han de guiar l'actuació de les administracions públiques, els següents:</span></span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><em>Millorar la qualitat de vida i promoure la normalització, la participació i la integració social, política, econòmica, laboral, cultural i educativa i de salut de totes les persones.</em></span></span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><em>Prevenir i atendre les situacions de vulnerabilitat de les persones i dels grups en situació d'exclusió social.</em></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">Per altra banda, l'article 6.e) recull que les persones amb prioritat d'atenció des del serveis socials, entre d'altres, són les que es troben en situació de vulnerabilitat, risc o desemparament per a la gent gran, infants i adolescents.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><strong>10.</strong> L'article 37.k) de la mateixa Llei 4/2009 estableix que correspon als Consells Insulars <span style="color:#000000"><em>“concertar la gestió de serveis socials, en el seu àmbit territorial, amb entitats públiques o privades,...</em></span><span style="color:#000000">”.</span> A l<span style="color:#000000">'article 89.1 es disposa que <em>“les administracions públiques de les Illes Balears, en l'àmbit de les seves competències, poden organitzar la prestació dels serveis del Catàleg de Prestacions i Serveis Socials de les Illes Balears a través de les fórmules següents: gestió directa, règim de concert previst en aquesta Llei, gestió indirecta en el marc de la normativa de contractació de les administracions públiques i convenis amb entitats sense ànim de lucre</em>”.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><strong>11.</strong> La Llei 12/2018, de 15 de novembre, de serveis a les persones en l'àmbit social a la comunitat autònoma de les Illes Balears (BOIB núm. 146 de 22 de novembre de 2018), regula al Capítol I el «Règim de col·laboració privada en la gestió de serveis socials per a les persones mitjançant l'acció concertada» (en endavant Llei 12/2018).</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><strong>12.</strong> Segons l'article 2.1 de la Llei 12/2018, les administracions competents de les Illes Balears, per complementar el sistema públic i garantir una adequada equitat i qualitat de les prestacions incloses en la cartera de serveis o del servei d'orientació professional, poden encarregar la prestació d'aquests serveis de la seva competència, mitjançant el sistema d'acció concertada, a entitats sense ànim de lucre del tercer sector social, tal com es defineixen en els articles 3 i 4 de la Llei 3/2018, de 29 de maig, del Tercer Sector d'Acció Social, o, si escau, a entitats privades, preferentment del tercer sector social, quan existeixin anàlogues condicions d'eficàcia, qualitat i costs, d'acord amb els requisits que estableix aquesta llei i amb respecte als principis de publicitat, transparència i no-discriminació.<span style="color:#000000"><strong> </strong></span>A més, d'acord amb l'establert a l'article 2.2 de la Llei 12/2018, s'entén per règim d'acció concertada la prestació per tercers de serveis socials inclosos en la cartera de serveis socials i del servei d'orientació professional recollit en la cartera comuna del Sistema Nacional d'Ocupació, el finançament, l'accés i el control administratiu dels quals són públics.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><strong>13. </strong>El Decret 48/2017, de 27 d'octubre, (BOIB núm. 132, de 28 d'octubre de 2017) pel qual s'estableixen els principis generals als quals s'han de sotmetre els concerts socials (en endavant Decret 48/2017), la vigència del qual s'ha vist parcialment afectada per la Llei 12/2018 i, en conseqüència, resta en vigor en tot allò que no contradigui ni s'oposi al que disposa aquesta llei.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><strong>14. </strong>La disposició addicional segona del Decret 48/2017 de 27 d'octubre, disposa que el <em>«El règim de concert regulat en aquest Decret s'estableix com a diferenciat de la modalitat contractual de concert que regula el Text refós de la Llei de contractes del sector públic, aprovat pel Reial decret legislatiu 3/2011, de 14 de novembre, i, per tant, està exclòs de l'àmbit d'aplicació d'aquest Text refós».</em></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><strong>15. </strong>La disposició final primera de la Llei 12/2018 d'excepcions al requisit de l'acreditació determina que «per motius d'urgència o quan es tracti de serveis d'implantació recent, sempre que no es puguin satisfer les necessitats de la població amb altres serveis idonis, l'administració, amb l'acreditació prèvia d'aquestes circumstàncies, pot subscriure acords d'acció concertada amb les entitats d'iniciativa privada que tenguin autoritzats els serveis. Aquests concerts s'han de subscriure per un any i es poden ampliar i renovar si, en aquest període, els serveis obtenen l'acreditació o si subsisteixen les necessitats que n'hagin motivat la formalització».</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><strong>16. </strong>La disposició transitòria primera del Decret 48/2017 fixa el «<em>Procediment d'urgència</em>» per a la concertació.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><strong>17. </strong>La Llei 3/2018, de 29 de maig, del tercer sector d'acció social (BOIB núm. 67, de 31 de maig de 2018) regula al seu article 3 i 4 les entitats que tenen la consideració d'entitats del tercer sector d'acció social.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><strong>18. </strong>L'article 14 de la Llei 14/2001, de 29 d'octubre, d'atribució de competències als consells insulars en matèria de serveis socials i seguretat social, estableix la potestat reglamentària normativa atribuïda als consells insulars en matèria de serveis socials, dins el marc de la regulació bàsica establerta pel Govern de les Illes Balears.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><strong>19</strong>. Com s'estableix a l'article 27 i a la disposició final quarta de la Llei 4/2009, cada Consell Insular, en el marc de les seves competències, ha de definir les prestacions pròpies de serveis socials, complementant la cartera bàsica de serveis socials que aprova el Govern de les Illes Balears, la qual va ser aprovada mitjançant el Decret 66/2016, de 18 de novembre, pel qual s'estableixen principis generals per a les carteres insulars i locals.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><strong>20.</strong><span style="color:#000000"> </span>El Decret 10/2013, de 28 de febrer, pel qual es fixen els principis generals del registre Unificat de Serveis Socials de les Illes Balears i dels procediments per a l'autorització i l'acreditació de serveis socials, i es regulen la secció insular del registre i els procediments per autoritzar i acreditar serveis socials d'àmbit insular.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><strong>21. </strong>El</span><span style="color:#000000"> Ple del Consell de Mallorca, el 13 de juliol de 2017, aprova definitivament<span style="color:#000000"> </span>el reglament pel qual s'aprova la Cartera Insular de Serveis Socials i dels Serveis a Menors i Família de Mallorca (BOIB núm. 97, de 18 de juliol de 2017 i correcció d'errades materials publicada BOIB núm. 161, de 30 de desembre de 2017).</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><strong>22</strong>. Objecte del concert</strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">L'objecte del concert és la prestació del <span style="color:#000000">servei</span><span style="color:#000000"> </span><span style="color:#000000"><span style="background-color:#ffffff">d'intervenció familiar de treball del vincle parental</span></span><span style="color:#000000">,</span> <span style="color:#000000">per l</span><span style="color:#000000">'entitat </span><span style="color:#000000">xxxx</span><span style="color:#000000">, d'acord amb </span><span style="color:#000000">els</span><span style="color:#000000"> plecs de prescripcions tècniques </span><span style="color:#000000">que regeixen aquest</span><span style="color:#000000"> concert social</span><span style="color:#000000"><span style="background-color:#ffffff"> i pel número de places adjudicades </span></span><span style="color:#000000"><span style="background-color:#ffffff">a aquesta entitat, </span></span><span style="color:#000000"><span style="background-color:#ffffff">sent</span></span><span style="color:#000000"> </span><span style="color:#000000"><span style="background-color:#ffffff">de </span></span><span style="color:#000000"><span style="background-color:#ffffff">XX</span></span><span style="color:#000000"> </span><span style="color:#000000">places de</span><span style="color:#000000">l</span><span style="color:#000000"> </span><span style="color:#000000">servei<span style="color:#000000"> </span><span style="background-color:#ffffff">d'intervenció familiar de treball del vincle parental</span>.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">D'acord amb l'establert a l'Annex II del Reglament de la Cartera Insular, el defineix com el servei que «té per objecte avaluar i treballar el vincle afectiu entre els menors amb mesura de protecció i els seus pares».</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><strong>2. Caràcter de la concertació i règim jurídic aplicable</strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">La present concertació es regirà en quan als efectes i extinció per allò que estableix la Llei 12/2018, de 22 de novembre de 2018 (BOIB 146, de 22 de novembre de 2018), el <span style="color:#000000">Decret 48/2017 de 27 d'octubre, pel qual s'estableixen els principis generals als quals s'han de sotmetre els concerts socials (BOIB Núm. 132, de 28 d'octubre de 201</span><span style="color:#000000">7</span><span style="color:#000000">). </span><span style="color:#000000">A més, </span><span style="color:#000000">d</span><span style="color:#000000">el </span><span style="color:#000000">Reglament </span><span style="color:#000000"> </span><span style="color:#000000">publicat al BOIB núm. 87, de 18 de de juliol de 2017, pel qual s'aprova la Cartera Insular de serveis socials i del serveis a menors i família de Mallorca 2017-2020, aprovat pel Ple del Consell de Mallorca en sessió de dia 13 de juliol de 2017 que estableix el conjunt de prestacions del sistema públic de serveis socials d'aplicació a l'illa de Mallorca i que és complementària de la cartera bàsica de serveis socials que aprova el Govern de les Illes Balears. </span><span style="color:#000000">Així com</span><span style="color:#000000"> p</span><span style="color:#000000">er la convocatòria i els</span><span style="color:#000000"> plecs de prescripcions tècniques </span><span style="color:#000000">de l</span><span style="color:#000000">a</span><span style="color:#000000"> </span><span style="color:#000000">present concert</span><span style="color:#000000">ació</span><span style="color:#000000">, els quals s'adjunten com a annex al present document i ambdues parts expressament subscriuen. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><strong>3. Durada de la</strong><strong> concertació</strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">La vigència d'aquest concert serà d'un any, </span><span style="color:#000000">amb data d'inici dia 15 de febrer de 2021</span><span style="color:#000000">, </span><span style="color:#000000">i es podrà </span><span style="color:#000000">ampliar i renovar</span><span style="color:#000000"> sempre i quan les entitats, </span><span style="color:#000000">en aquest període,</span><span style="color:#000000"> hagin </span><span style="color:#000000">obtingut l'acreditació del servei corresponent o subsisteix</span><span style="color:#000000">i</span><span style="color:#000000">n les necessitats que n'hagin motivat la </span><span style="color:#000000">seva </span><span style="color:#000000">formalització, d'acord amb </span><span style="color:#000000">l'establert a l</span><span style="color:#000000">a</span><span style="color:#000000"> disposició final primera de la Llei 12/2018. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><strong>4. Quantia i partida pressupostària</strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">El preu per plaça de la prestació del</span><span style="color:#000000"> </span><span style="color:#000000">servei</span><span style="color:#000000"> </span><span style="color:#000000"><span style="background-color:#ffffff">d'intervenció familiar de treball del vincle parental</span></span><span style="color:#000000"> </span><span style="color:#000000">és de </span><span style="color:#000000">1</span><span style="color:#000000">90</span><span style="color:#000000">,</span><span style="color:#000000">80</span><span style="color:#000000"> euros </span><span style="color:#000000">plaça/mes (IVA exempt).</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><strong>5. Obligacions de les entitats concertades</strong></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">L'entitat titular del servei concertat contrau les següents obligacions des del moment de subscriure el present concert:</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">1. Complir amb l'establert als Plecs generals i específics, així com l'establert a la Llei 4/2009, d'11 de juny, de serveis socials (article 89 bis.2), al Decret 46/1997 de 21 de març pel qual s'ordena l'establiment i la regulació dels requisits per a l'acreditació i l'habilitació de les entitats col·laboradores de l'Administració en matèria de guarda de menors, a la Llei 12/2018, de 15 de novembre, de serveis a les persones en l'àmbit social a la comunitat autònoma de les Illes Balears, així com al Decret 48/2017 de 27 d'octubre, pel qual s'estableixen els principis generals als quals s'han de sotmetre els concerts socials.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">2. Atendre a totes les persones menors d'edat derivats per part del Servei d'Infància i Família de l'IMAS.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">3. Aportar tota la documentació requerida sobre el servei concertat o sobre les persones menors d'edat al Servei d' Infància i Família de l'IMAS.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">4. Participar activament amb la Direcció Insular d'Infància i Família en el seguiment i control dels requisits de manteniment del servei.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">5. Prestar el servei en les millors condicions possibles segons els principis de bona fe i diligència, ajustant-se estrictament a les condicions i les disposicions legals aplicables, així com als termes del concert.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">6. Elaborar el projecte educatiu individualitzat (PEI) a partir del Pla de Cas que emet el Servei d'Infància i Família.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">7. Presentar, a sol·licitud per part del Servei d'Infància i Família, els informes de la situació de la persona menor d'edat que reculli la intervenció efectuada i l'evolució respecte de la situació inicial o anterior informe, el PEI vigent, així com les propostes que es puguin dur a terme.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">8. Quan una persona menor d'edat no s'adapti al programa concertat, el servei ha d'emetre un informe de les adaptacions que s'han realitzat per atendre-la i presentar possibles propostes per garantir una correcta atenció de la persona menor d'edat al Servei d'Infància i Família. </span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">9. Les entitats objectes del concert també han d'enviar els informes i documents personals, previ requeriment o ofici, a l'autoritat judicial, al Ministeri Fiscal o al Defensor del Poble o Defensor del Menor. Els informes no es poden trametre a cap altra persona o entitat.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">10. Presentar, mensualment, còpia del registre de persones menors d'edat amb dates d'alta i baixa, data de naixement i número d'expedient.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">11. L'entitat objecte del concert es compromet a permetre en qualsevol moment la inspecció per part de l'IMAS, del centre i de les seves dependències, inclosos els annexes o altres equipaments de què disposin, sempre que formin part del programa presentat.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">12. Les entitats s'obliguen a complir el model d'avaluació dels continguts i les estipulacions recollits en l'acord d'acció concertada, que s'aprovarà mitjançant resolució, d'acord amb el que estableix l'article 10.1 de la Llei 12/2018, de 15 de novembre, de serveis a les persones en l'àmbit social a la comunitat autònoma de les Illes Balears.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">13. Presentar la memòria anual, com a mínim en idioma català.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">14. Presentar una auditoria externa de comptes anuals.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">15. Elaborar un llistat que reculli mensualment la relació de les persones adscrites al programa indicant la seva categoria laboral i jornada laboral, i un llistat ITA (informe de treballadors en alta en un codi de comptes de cotització) mensual del personal contractat. Aquesta documentació romandrà disponible per consultar per part de l' IMAS quan sigui requerida.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">16. Fer constar, en tota la documentació de l'entitat relacionada amb les persones menors d'edat i les famílies, la menció d'aquesta concertació i la llegenda “Entitat Col·laboradora de l'IMAS per a la intervenció i mediació familiar ”, com a mínim en idioma català i ha de reproduir aquesta expressió, i fer constar aquesta condició, en tota documentació relativa al servei destinada a altres entitats, autoritats, institucions i actes públics o oberts . Els rètols de les distintes dependències on es prestin els serveis objecte de la concertació també han d'anar, com a mínim en idioma català.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">17. Comunicar els canvis d'accionariat o de titularitat per preservar la identitat institucional que hagi justificat l'acord d'acció concertada.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><strong>6. Penalitats</strong></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><span style="color:#000000">Els incompliments per part de l'entitat concertada segons la seva qualificació assignada per l'IMAS de conformitat a l'establert al punt 1</span><span style="color:#000000">7</span><span style="color:#000000"> dels Plecs de prescripcions </span><span style="color:#000000">tècniques generals</span><span style="color:#000000"> seran objecte de les penalitzacions previstes al punt 1</span><span style="color:#000000">7.3, sense perjudici de les penalitzacions previstes a la normativa d'aplicació i, en especial, a l'establert als articles 127,128 i 129 de la Llei 4/2009. </span></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><strong>7. Facturació del servei</strong></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">a) L'entitat concertada ha de presentar una factura en la qual ha de constar l'import de la liquidació del serveis concertats corresponent al mes anterior. La factura es presentarà en format electrònic a l'aplicació FACe (https://face.gob.es) que és el Punt General d'Entrada de Factures Electròniques de l'administració. A aquesta factura, degudament signada pel representant legal de l'entitat concertada, ha d'adjuntar una relació detallada de les persones usuàries ateses, en format electrònic paper degudament registrada al registre d'entrada de l'IMAS, així com també electrònicament al Servei de Gestió Econòmica, segons model facilitat per l'IMAS.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#00000a"><span style="color:#000000">b) La justificació ha de tenir el conceptes següents: Nom de l'entitat, CIF, nom del centre, període de facturació, data de facturació, nombre de factura, </span><span style="color:#000000">nombre d'usuaris</span><span style="color:#000000">, </span><span style="color:#000000">data d'alta o baixa dels menors, </span><span style="color:#000000"> data de naixement, número d'expedient personal, </span><span style="color:#000000">nombre de dies, referència del concert i quantia facturada. </span></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><strong>8. Pagament</strong></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#00000a"><span style="color:#000000">a) </span><span style="color:#000000">El preu del concert es pagarà mensualment </span><span style="color:#000000">a l'entitat gestora del servei per </span><span style="color:#000000">mensualitats vençudes, amb la presentació prèvia de l</span><span style="color:#000000">es factures i la </span><span style="color:#000000">llista de les </span><span style="color:#000000">persones </span><span style="color:#000000">u</span><span style="color:#000000">suàries ateses mensualment</span><span style="color:#000000">. </span><span style="color:#000000">L'Institut Mallorquí d'Afers Socials, mitjançant la Direcció </span><span style="color:#000000">I</span><span style="color:#000000">nsular de Menors </span><span style="color:#000000">i Família, ha de tramitar mensualment la proposta de pagament en concepte de cost del servei concertat. El pagament de la quantitat que correspongui es durà a terme mitjançant l'ingrés en el compte corrent </span><span style="color:#000000">que indiqui l'entitat concertada.</span></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">b) L'entitat concertada no pot cobrar cap quantitat suplementària en concepte del servei o per qualsevol altra prestació que s'hagi de cobrir en virtut del concert subscrit.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">c) La percepció indeguda de quantitats per part de l'entitat concertada suposa l'obligació de reintegrar-les, amb la tramitació prèvia del procediment que correspongui, amb l'audiència de la persona interessada.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><span style="color:#000000">d) El pagament de les factures estarà sotmès a la comprovació de qu</span><span style="color:#000000">è</span><span style="color:#000000"> l'entitat concertada està al corrent de pagaments amb l'Agència Tributària i amb la Seguretat Social. </span></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><strong><span style="background-color:#ffffff">9. </span>Condicions tècniques d'execució</strong></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">L'entitat titular del servei ha de complir, com a mínim, l'establert <span style="background-color:#ffffff">al Decret 10/2013, de 28 de febrer, pel qual es fixen els principis generals del Registre Unificat de Serveis Socials de les Illes Balears i dels procediments per a l'autorització i l'acreditació de serveis socials, i es regulen la secció suprainsular del Registre i els procediments per autoritzar i acreditar serveis socials d'àmbit suprainsular, i els reglaments de desplegament vigents en el seu àmbit territorial d'actuació, així com també s'han d'ajustar a la Llei 12/2018 i al Decret 48/2017 i a</span> les condicions tècniques i de funcionament que estableixen els Plecs de prescripcions tècniques generals i específic, aprovat pel president de l'Institut Mallorquí d'Afers Socials en el marc de la convocatòria de la concertació del servei <span style="background-color:#ffffff">d'intervenció familiar de treball del vincle parental</span> (BOIB núm. 199, de 24 de novembre de 2020).</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><strong>10</strong></span><span style="color:#000000"><strong>. </strong></span><span style="color:#000000"><strong>Coordina</strong></span><span style="color:#000000"><strong><span style="background-color:#ffffff">ció i seguiment</span></strong></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">La Direcció Insular d'Infància i Família realitzarà un seguiment de l'execució, millores, compliment i efectivitat dels programes. Per això, es reunirà cada semestre amb els coordinadors dels programes.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">Així mateix, l'entitat concertada ha de facilitar tota la informació que li requereixin l'òrgan instructor, la Intervenció de l'IMAS, la Sindicatura de Comptes o altres òrgans de control extern.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Aquest seguiment no constitueix una inspecció dels requisits d'autorització ni d'acreditació sinó únicament una avaluació de seguiment de la fidelitat i els resultats del model d'atenció implantat. No obstant això, si s'observés un incompliment dels requisits d'autorització i/o acreditació es donarà trasllat d'aquesta informació al servei d'autorització i inspecció de l'IMAS perquè emprengui les actuacions que, en el seu cas, consideri oportunes.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Els acords d'acció concertada s'extingeixen, d'acord amb el previst a l'article 9 de la Llei 12/2018, pel compliment i venciment del termini, sempre que no s'hagin renovat, o per resolució.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">d) Incompliment dels objectius qualitatius i quantitatius establerts, sempre que l'incompliment sigui imputable a l'entitat concertada, així com de les estipulacions essencials de l'acord i dels plecs </span><span style="color:#231f20">de prescripcions tècniques aplicables.</span></span></span></p> <p style="margin-bottom:0px;
