    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p style="margin-bottom:0,0000pt; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;L'apartat 8.5. de la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 5&amp;nbsp;de setiembre&amp;nbsp;de 2018&amp;nbsp;per la qual s'aprova la convocatòria de les ajudes destinades al foment de la coservació, l'us sostenible i el desenvolupament dels recursos genètics en agricultura, per l'any 2018, &amp;nbsp;especifica que la resolució es publicarà amb caràcter informatiu a les persones interessades mitjançant la seva publicació al &lt;em&gt;&lt;em&gt;Butlletí Oficial de les Illes Balears &lt;/em&gt;&lt;/em&gt;d'acord amb els termes que preveu l'article 45.2 de la Llei 39/2015, de 26 de novembre, d' 1 d'octubre, del procediment administratiu comú&amp;nbsp;de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0,0000pt; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&amp;nbsp;Els expedients han estat tramitats pel Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) en compliment del que disposa l'article 43&amp;nbsp;de la Llei 39/2015, d' 1 d'octubre, del procediment administratiu comú&amp;nbsp;de les administracions públiques. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0,0000pt; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;El vicepresident en matèria agrària del FOGAIBA, en data 17 de març&amp;nbsp;de 2021, va signar la següent resolució, &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0,0000pt; margin-right:0,0000pt; margin-top:5,0000pt; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;1.En data 17/09/2019, es va publicar al BOIB núm. 127 la resolució del vicepresident del FOGAIBA de 27 d'agost de 2019 de concessió de les ajudes pel foment de la &lt;/em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;conservació, l'ús sostenible i el desenvolupament dels recursos genètics en agricultura, entre els quals hi està com a beneficiari la ASSOCIACIÓ DE PRODUCTORS D'AGRICULTURA ECOLÒGICA DE MENORCA, amb núm expedient RRGG2018_1/003, amb una import total de 68.370 € pel projecte presentat, amb la següent distribució per capítols:&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

En data 23/11/2020, es va presentar una comunicació sobre l'afecció de la situació d'alerta sanitària provocada per la COVID-19 sobre l'execució del projecte, més concretament demanant una ampliació del termini d'execució de 6 mesos i com a justificació de l'incompliment de l'obligació d'execució de més del 80% de les actuacions anuals previstes al projecte inicial.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0,0000pt; margin-left:0,0000pt; margin-right:0,0000pt; margin-top:5,0000pt; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;4. Tal com figura a l'article 54 del reial decret llei 11/2020, de 31 de març, pel qual s'adopten mesures urgents complementàries en àmbit social i econòmic per fer fornt al COVID-19, sobre les mesures en matèria de subvencions i ajudes públiques, es poden ampliar els terminis d'execució de l'activitat subvencionada i, si s'escau, de justificció i comprovació d'aquesta. Segons informe tècnic de data 15/03/2021, per la natura del projecte està suficientment justificat la pròrroga de 6 mesos sol·licitada. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0,0000pt; margin-left:0,0000pt; margin-right:0,0000pt; margin-top:5,0000pt; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;5. Tal com figura al punt 1 de l'apartat novè de la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) per la qual es convoquen, per a l'exercici 2018, subvencions per al foment de la conservació, l'ús sostenible i el desenvolupament dels recursos genètics en agricultura,&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;els beneficiaris tenen l'obligació d'execució de les actuacions anuals previstes al calendari d'execució inicialment previst, llevat que la no&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;em&gt;execució sigui deguda a causes ambientals, fitosanitàries o de força major. Per tot l'exposat queda suficientment justificada la no execució de les actuacions.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
