    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;L'apartat 9.3 de la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 10 de juliol de 2015 per la qual es convoquen subvencions per a&lt;strong&gt;&amp;nbsp;&lt;/strong&gt;les explotacions a les explotacions agràries, per als anys 2015-2019, especifica que la resolució expressa es notificarà a les persones interessades mitjançant la seva publicació en el Butlletí Oficial de les Illes Balears d'acord amb els termes que preveu l'article 45.2 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;Els expedients han estat tramitats pel Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA), en compliment del que disposa l'article 43 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;El vicepresident en matèria agrària del FOGAIBA, en data de 12&amp;nbsp;de març&amp;nbsp;de 2021, signa la següent resolució:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;strong&gt;&lt;em&gt;&lt;strong&gt;&lt;em&gt;“&lt;/em&gt;&lt;/strong&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;em&gt;Resolució de revocació parcial&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Antecedents&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;1. Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 10 de juliol de 2015 per la qual es convoquen, per als anys 2015 a 2019, subvencions per a inversions en les explotacions agràries. La Resolució esmentada es va modificar en data 17 de desembre de 2015 (BOIB núm. 185), en data 22 de juny de 2016, (BOIB núm. 81) i 26 de juny de 2018 (BOIB núm. 80).&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;2.Una vegada analitzada tota la documentació presentada, el vicepresident del FOGAIBA va resoldre favorablement la concessió de l'ajuda a favor de&amp;nbsp;Antoni Sans Cañellas, entre d'altres, &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;que figuren en l'annex de la Resolució&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;, R1 de data 10 de setembre de 2020, (BOIB núm. 161, de 17 de setembre de 2020)&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&amp;nbsp;amb les dades i els imports corresponents&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&amp;nbsp;(amb un import concedit de 9.522,06€).&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;3. Atesa la Resolució de concessió de l'ajuda esmentada, i d'acord amb el que estableix l'apartat desè de la convocatòria abans esmentada, el beneficiari s'obliga, entre altres, a realitzar les actuacions auxiliades dins el termini establert i a justificar les despeses relacionades amb la inversió per a la recepció dels fons comunitaris en la manera i els terminis determinats en la convocatòria.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;4. Dins el termini legalment establert per a la justificació de les inversions aprovades, l'interessat presenta la sol·licitud de pagament com també la documentació exigida, però, una vegada examinada aquesta, es comprova que la factura del proveïdor J. Munné Maquinaria Agrícola SL, número factura V/1903679, de data 25 de juny de 2019, d'un import auxiliable de 677,35 €, amb un complement de la desbrossadora concepte fil nylon import 30,75 euros, no auxiliable, segons el punt 7.b) de l'apartat quart, on especifica que no podran ser subvencionades les despeses de reposició o simple substitució d'equipaments i maquinària a la Resolució de la convocatòria. També, a la sol·licitud de concessió havia una inversió dins instal·lacions d'una estació meteorològica per un import elegible de 11.860,07 euros, canvia d'actuació i realitza una instal·lació de filtratge, a la factura del proveïdor Suministres Manacor número 3984 figura una mà d'obra per un import de 3.782,00 euros i dins el pressupost número 368 havia un total de mà d'obra de 1.130,00 euros, import que consideram elegible&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;5. Atès que el concepte fil nylon de la desbrossadora és una despesa de reposició o simple substitució d'equipaments i maquinària, i no poden ser subvencionades i a més va haver un canvi d'actuació dins instal·lacions, amb un cost de mà d'obra superior al concedit. L'import de 30,75 euros no és auxiliable i la mà d'obra es pagarà l'import de 1.130,00 euros que figura al pressupost. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;6. L'article 43 del Text refós de la Llei de subvencions, aprovat per Decret legislatiu 2/2005,&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&amp;nbsp;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;de 28 de desembre, disposa que “Pertoca la revocació de la subvenció quan, posteriorment a la resolució de concessió vàlida i ajustada a dret, el beneficiari incompleix totalment o parcialment les obligacions o els compromisos contrets als quals està condicionada l'eficàcia de l'acte de concessió de la subvenció. Com a conseqüència de la revocació de la subvenció, queda sense efecte, totalment o parcialment, l'acte de concessió i pertoca el reintegrament de les quantitats percebudes indegudament”.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;7. En data 15 de febrer de 2021 es notifica a la persona interessada, mitjançant la publicació al web, l'Informe/Proposta provisional de resolució de revocació total de 11 de febrer de 2021 per l'incompliment de l'obligació d'haver realitzat, pagat i justificat les inversions concedides dins el termini establert, a l'efecte de complir amb el tràmit d'audiència per dur a terme les al·legacions. Una vegada transcorreguts els 10 dies hàbils, la persona interessada no ha presentant cap al·legació.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;8. S'ha considerat l'Informe/Proposta provisional de resolució de 11 de febrer de 2021, de revocació parcial de l'ajuda concedida a Antoni Sans Cañellas, amb NIF ***9690**.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Fonaments de dret&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;3. &lt;/em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Per tot això, dict la següent&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;1. Revocar parcialment la resolució d'ajuda concedida al beneficiari per l'import i amb les dades detallades en l'annex d'aquesta resolució, que és un total d'1 expedient i que comença amb &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Antoni Sans Cañellas&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&amp;nbsp;i acaba amb &amp;nbsp;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Antoni Sans Cañellas&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;, que suma un import total de &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;2&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;292&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;,&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;31&amp;nbsp;euros, relativa a la línia d'ajuda “Inversions en les explotacions agràries”, ja que l'import elegible de la despesa és inferior a l'aprovada.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;2. Notificar aquesta resolució a la persona beneficiària mitjançant la publicació al Butlletí Oficial de les Illes Balears.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Interposició de recursos&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Contra aquesta resolució - que no exhaureix la via administrativa - es pot interposar recurs d'alçada davant la consellera d'Agricultura, Pesca i Alimentació, en el termini d'un mes, comptador des de l'endemà de la notificació de la resolució, d'acord amb l'article 58.4 de la Llei 3/2003, de 26 de març, de règim jurídic de l'Administració de la Comunitat Autònoma de les Illes Balears, i els articles 121 i 122, de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
