    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El punt 3 de l'apartat Vuitè de la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 3&amp;nbsp;de febrer&amp;nbsp;de 2020, per la qual es convoquen ajudes destinades al pagament compensatori en zones de muntanya per a l'any 2020, especifica que la resolució expressa es notificarà a les persones interessades mitjançant la seva publicació al Butlletí Oficial de les Illes Balears, i es farà d'acord amb els termes que preveu l'article 45.2 de la llei 39/2015, de l'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Els expedients han estat tramitats pel Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) en compliment del que disposa l'article 43 de la llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#212121"&gt;El vicepresident&amp;nbsp;&amp;nbsp;en Matèria Agrària&amp;nbsp;del FOGAIBA&amp;nbsp;en data 11&amp;nbsp;de març&amp;nbsp;de 2021, va signar la següent resolució:&lt;/span&gt;&lt;strong&gt;&amp;nbsp;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Antecedents&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;1.En data 26 de febrer de 2015, es va publicar en el BOIB núm. 29 l'Ordre del conseller d'Agricultura, Medi ambient i Territori de 19 de febrer de 2015, per la qual s'estableixen les bases reguladores per a la concessió de subvencions en el marc del Programa de Desenvolupament Rural de les Illes Balears 2014-2020.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;2.&lt;/em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;En data de 6 de febrer de 2020 es va publicar, en el BOIB núm. 16, la Resolució del President del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 3 de febrer de 2020, per la qual s'aprova la convocatòria per a l'any 2020 de les ajudes destinades al pagament compensatori en zones de muntanya a les Illes Balears.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;3.&lt;/em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;De conformitat amb l'apartat sisè de l'esmentada Resolució, i l'Ordre APA377/2020, de 28 d'abril, per la que es modifiquen , per a l'any 2020, diversos terminis establerts en els Reials Decrets 1075/2014, 1076/2014, 1077/2014 i 1078/2014, tots ells de 19 de desembre dictats per l'aplicació a Espanya de la Política Agrícola Comú, el termini de presentació de sol·licituds de la convocatòria va acabar el dia 15/06/2020. Els òrgans gestors del Servei d'Ajudes al Desenvolupament Rural han dut a terme el control administratiu de la sol·licitud i de la documentació aportada d'acord amb les normes reguladores d'aquesta ajuda.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;4.&lt;/em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;El representant de la societat SON AMUNT SL amb NIF B57779670 i núm. d'expedient 04002404, el Sr. Fritz Knuchel amb NIF&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;***&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;2474&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;**&amp;nbsp;en data 05/06/2020 presenta sol·licitud única amb núm. de registre d'entrada L95E12790/2020. De l'examen de la documentació aportada documentalment el titular compleix amb els requisits per a ser beneficiari de l'ajuda.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;5.En data 15/09/2020 els tècnics inspectors del Servei d'Ajudes Directes realitzen un control de camp atès el pla regional de controls sobre el terreny d'Ajudes Directes, el compareixent d'aquest control es el Sr. Pedro Vives Mas amb NIF &lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;***&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;9542&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;**. &lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;6.&lt;/em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;La secció de controls d'Ajudes Directes tramet còpia de l'acta de control de camp al titular, SON AMUNT SL, el titular reb la notificació en data 03/02/2021 a les 13:39:27 , número de registre 2021011732358.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;7.&lt;/em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;De l'anàlisi dels controls de camp, es desprèn que: &lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;- El titular sol·licita 75.58 has.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;- La superfície penalitzable resultant del control de camp es de 47.48 has, la superfície determinada resultant del control de camp es de 28.10 has. Aquestes dades suposen una sobredeclaració del 168.96%&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;8.Atès l'article 19.2. del Reglament Delegat (UE) 640/2014 de la Comissió de 11 de març de 2014, si la superfície declarada als efectes dels règims d'ajuda o mesures d'ajuda per superfície sobrepassa la superfície determinada en un 50% no es concedirà cap ajuda per superfície per al grup de cultiu en qüestió. A més a més, el beneficiari estarà subjecte a una sanció addicional igual a l'import de l'ajuda corresponent a la diferència entre la superfície declarada i la superfície determinada atès l'article 18. &lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;2.&lt;/em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Comunicar-li al beneficiari que l'import de la sanció addicional ascendeix a -8.684,93€ ( Anexe I) que s'haurà d'abonar amb conformitat d'allò establert a l'article 19. 2 i 19.3 del Reglament Delegat (UE) Nº 640/2014 de la Comissió i de l'article 19 bis del Reglament Delegat (UE)/1393 de la Comissió.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
