    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p style="text-align:justify"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;L'apartat 9.3 de la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 10 de juliol de 2015 per la qual es convoquen subvencions per a&lt;strong&gt;&amp;nbsp;&lt;/strong&gt;les explotacions a les explotacions agràries, per als anys 2015-2019, especifica que la resolució expressa es notificarà a les persones interessades mitjançant la seva publicació en el Butlletí Oficial de les Illes Balears d'acord amb els termes que preveu l'article 45.2 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:justify"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Els expedients han estat tramitats pel Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA), en compliment del que disposa l'article 43 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:justify"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El vicepresident en matèria agrària del FOGAIBA, en data de 26 de febrer&amp;nbsp;de 2021, signa la següent resolució:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:center"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;strong&gt;&lt;em&gt;“&lt;/em&gt;&lt;/strong&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;em&gt;Resolució de revocació parcial&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:center"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;em&gt;CONVOCATÒRIA: INEA 2017_1&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Antecedents&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p style="text-align:justify"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;1. Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 10 de juliol de 2015 per la qual es convoquen, per als anys 2015 a 2019, subvencions per a inversions en les explotacions agràries. La Resolució esmentada es va modificar en data 17 de desembre de 2015 (BOIB núm. 185), en data 22 de juny de 2016, (BOIB núm. 81) i 26 de juny de 2018 (BOIB núm. 80).&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0,0000pt; margin-left:0,0000pt; margin-right:0,0000pt; margin-top:5,0000pt; text-align:justify"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;2.&amp;nbsp;Una vegada analitzada tota la documentació presentada, el vicepresident del FOGAIBA va resoldre favorablement la concessió de l'ajuda a favor dels interessats que figuren en l'annex de la Resolució amb les dades i els imports corresponents.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0,0000pt; text-align:justify"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;3. Atesa la Resolució de concessió de l'ajuda esmentada, i d'acord amb el que estableix l'apartat desè de la convocatòria abans esmentada, el beneficiari s'obliga, entre altres, a realitzar les actuacions auxiliades dins el termini establert i a justificar les despeses relacionades amb la inversió per a la recepció dels fons comunitaris en la manera i els terminis determinats en la convocatòria.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0,0000pt; margin-left:0,0000pt; margin-right:0,0000pt; margin-top:5,0000pt; text-align:justify"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;4. Dins el termini legalment establert per a la justificació de les inversions aprovades, l'interessada presenta la sol·licitud de pagament, com també la documentació exigida, però, una vegada revisada aquesta, es comprova que el tractor adquirit és NEW HOLLAND model T6.155 per un import de 112.000,00 euros; un model diferent al model del tractor concedit NEW HOLLAND model T6.175 amb un cost elegible de 112.000,00 euros, atès aquest canvi es va emetre l'informe de moderació de costs amb data 3 d'agost de 2020, que determina que l'import del tractor NEW HOLLAND model T6.155 és de 68.562,27 euros, el valor de mercat del producte és inferior a l'import que s'ha justificat. Així també, es comprova que l'adobadora adquirida és SOLA D903/2000 per un import de 22.310,00 euros; un model diferent al model de adobadora concedida ACCORD KVERNELAND TL1500l amb un cost elegible de 13.202,20 euros, atès aquest canvi es va emetre l'informe de moderació de costs amb data 3 d'agost de 2020, que determina que l'import de l'adobadora SOLA D903/2000 és de 9.892,30 euros, el valor de mercat del producte és inferior a l'import que s'ha justificat.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0,0000pt; margin-left:0,0000pt; margin-right:0,0000pt; margin-top:5,0000pt; text-align:justify"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;5. L'article 43 del Text refós de la Llei de subvencions, aprovat pel Decret legislatiu 2/2005, de 28 de desembre, disposa que “Pertoca la revocació de la subvenció quan, posteriorment a la resolució de concessió vàlida i ajustada a dret, el beneficiari incompleix totalment o parcialment les obligacions o els compromisos contrets als quals està condicionada l'eficàcia de l'acte de concessió de la subvenció. Com a conseqüència de la revocació de la subvenció, queda sense efecte, totalment o parcialment, l'acte de concessió i pertoca el reintegrament de les quantitats percebudes indegudament”.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0,0000pt; margin-left:0,0000pt; margin-right:0,0000pt; margin-top:5,0000pt; text-align:justify"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;6. En data 10 de d'agost de 2020 es notifica a la persona interessada, mitjançant la publicació al web, l'Informe/Proposta provisional de resolució de revocació parcial de 5 d'agost de 2020 per l'incompliment de l'obligació d'haver realitzat, pagat i justificat les inversions concedides dins el termini establert, a l'efecte de complir amb el tràmit d'audiència per dur a terme les al·legacions.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0,0000pt; text-align:justify"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;7. El 14 d'agost de 2020, dins del termini i en la forma escaient, la persona interessada va presentar escrit d'al·legacions, on exposa que les circumstàncies de l'oferta del mercat i la disponibilitat del distribuïdor no han fet possible adquirir els models de maquinària pels quals es va demanar l'ajuda. Que finalment s'ha apostat per comprar un model de tractor i una abonadora diferents, ja que s'adequaven mes a la situació de mercat actual. Aporta documentació per demostrar el valor de mercat real del tractor New Holland T6155 i de l'adobadora SOLA D903/200.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0,0000pt; text-align:justify"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;8. En data 3 d'agost de 2020 es realitza un nou informe de moderació de costos, atenent les al·legacions presentades. Segons l'informe tècnic de data 15 de febrer de 2021, s'admeten parcialment les al·legacions presentades per la cancel·lació de la revocació parcial, l'import elegible del tractor New Holland T6.155 és de 92.982, 27 euros (68.562,27 euros cost elegible més 24.420,00 euros extres elegibles) i l'import elegible de l'adobadora Sola D903/200 és de 11.520,30 euros (9.892,30 euros cost elegible més 1.628,00 euros extres elegibles).&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0,0000pt; margin-left:0,0000pt; margin-right:0,0000pt; margin-top:5,0000pt; text-align:justify"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;9. &lt;/em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Atès tot això, es proposa fer la revocació parcial ja que l'actuació subvencionable no s'ajusta al que estableix el punt 2.b de l'apartat quart de la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) per la qual es convoquen, per als anys 2015 a 2019, subvencions per a inversions a les explotacions agràries.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0,0000pt; margin-left:0,0000pt; margin-right:0,0000pt; margin-top:5,0000pt; text-align:justify"&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Fonaments de dret&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p style="text-align:justify"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;1. &lt;/em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 10 de juliol de 2015 per la qual es convoquen, per als anys 2015 a 2019, subvencions per a inversions en les explotacions agràries. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Ordre del conseller d'Agricultura, Medi Ambient i Territori de 19 de febrer de 2015, per la qual s'estableixen les bases reguladores per a la concessió de subvencions en el marc del Programa de Desenvolupament Rural de les Illes Balears 2014-2020.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:5,0000pt; margin-left:0,9500pt; margin-top:5,0000pt; text-align:justify"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;3. &lt;/em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:justify"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Per tot això, dict la següent&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Resolució&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p style="text-align:justify"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;1. Revocar parcialment la resolució d'ajuda concedida al beneficiari per l'import i amb les dades detallades en l'annex d'aquesta resolució, que és un total d'1 expedient i que comença amb Monserrat Mascaro C&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;erda&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&amp;nbsp;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&amp;nbsp;i acaba amb Monserrat Mascaro Cerda , que suma un import total de 10.350,06 euros, relativa a la línia d'ajuda “Inversions en les explotacions agràries”, ja que l'import elegible de la despesa és inferior a l'aprovada.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:justify"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;2. Notificar aquesta resolució a la persona beneficiària mitjançant la publicació al Butlletí Oficial de les Illes Balears.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:justify"&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Interposició de recursos&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p style="text-align:justify"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Contra aquesta resolució - que no exhaureix la via administrativa - es pot interposar recurs d'alçada davant la consellera d'Agricultura, Pesca i Alimentació, en el termini d'un mes, comptador des de l'endemà de la notificació de la resolució, d'acord amb l'article 58.4 de la Llei 3/2003, de 26 de març, de règim jurídic de l'Administració de la Comunitat Autònoma de les Illes Balears, i els articles 121 i 122, de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
