font-size:12px"><span style="line-height:normal"><strong>&lt;&lt; 1.-</strong> <strong>Subvenció </strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">En el marc de la convocatòria de subvencions 2021 adreçada als ajuntaments de Mallorca per pal·liar les conseqüències de les restriccions motivades per la crisi sanitària de la Covid-19 en els sectors econòmics, aprovar i concedir als següents ajuntaments amb càrrec a la partida pressupostària 65.23199.46205 les quantitats que tot seguit s'esmenten per a la finalitat d'aprovar convocatòries per ajudar a pal·liar les pèrdues produïdes en els sectors econòmics del seu àmbit territorial, especialment la restauració, el comerç, les activitats culturals, oci infantil, transport i d'altres, com a conseqüència de les restriccions aprovades pel Govern Balear en 2021 per aturar l'expansió de la crisi sanitària ocasionada per la COVID-19 o que siguin especialment afectats per la pandèmia: </span></span></p> <table border="1" cellspacing="0" class="Table"> <thead> <tr> <th scope="col" style="height: 15.75pt; La justificació de l'execució de les actuacions objecte d'aquesta convocatòria per part de les entitats locals beneficiàries de les subvencions s'ha de fer mitjançant l'expedició d'un certificat de l'interventor o la interventora de la corporació, d'acord amb el model que s'adjunta com a Annex V, que acrediti:</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">a) Que la quantitat lliurada pel Consell de Mallorca per aquest concepte s'ha destinat íntegrament al finançament de l'objecte de la subvenció. </span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">b) Que ha convocat ajudes o subvencions finançades amb recursos propis de la Corporació per un import igual o superior a la quantitat rebuda del Consell de Mallorca.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">c) La convocatòria o convocatòries realitzades, l'import de cada una d'elles i el seu objecte, la relació dels beneficiaris amb indicació de l'import percebut per cada un d'ells de les ajudes finançades, amb el desglossament de la part de la quantitat subvencionada pel Consell i la part corresponent als fons propis de l'Ajuntament.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">2. Aquest certificat s'ha de presentar davant el Departament de Promoció Econòmica i Desenvolupament Local del Consell de Mallorca abans de dia 1 de juliol de 2022.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><strong><span style="line-height:107%">3. Obligacions de les entitats beneficiàries</span></strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">Els ajuntaments als quals se'ls han concedit les subvencions estaran obligats a:</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">a) Convocar i publicar en el Butlletí Oficial de les Illes Balears, abans del dia 31 de juliol de 2021, una o vàries convocatòries de subvencions adreçades als sectors econòmics afectats per les restriccions aprovades pel Govern Balear en 2021 o que siguin especialment afectats per la pandèmia de la COVID-19 destinades a pal·liar la seva situació econòmica i garantir el seu sosteniment.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">No obstant això, si l'Ajuntament ho sol·licita abans que finalitzi el termini per convocar i publicar, el conseller de Promoció Econòmica i Desenvolupament Local podrà prorrogar dit termini mitjançant una resolució.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">b) Que el total de les ajudes convocades per l'Ajuntament, abans del dia 31 de juliol de 2021, per a aquesta finalitat ha de suposar una quantitat total igual o superior a la quantitat concedida pel Consell de Mallorca.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">c) Facilitar al Consell de Mallorca la informació relativa als expedients que requereixi.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">d) Justificar davant el Consell de Mallorca el compliment de l'objecte de la subvenció en la forma que s'especifica en la clàusula anterior.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">e) Fer constar en la convocatòria o convocatòries que aquestes són finançades pel Consell de Mallorca.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">f) Acabar les actuacions i presentar la justificació de les despeses abans de dia 1 de juliol de 2022. </span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">g) Comunicar al Departament de Promoció Econòmica i Desenvolupament Local del Consell de Mallorca, en qualsevol moment, l'obtenció de subvencions o ajudes per a la mateixa finalitat i no consignades en la sol·licitud.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">h) Complir la resta d'obligacions que es preveuen en l'article 9 de la vigent Ordenança general de subvencions del Consell de Mallorca aprovada per acord de Ple de dia 23 de desembre de 2016 (BOIB núm. 21, de dia 18 de febrer de 2017 i núm. 96, de 4 d'agost de 2018).</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><strong>4. Reintegrament</strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">1.- Les quantitats no disposades per l'Ajuntament s'han de reintegrar al Consell de Mallorca.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">2.- En el cas que les entitats locals beneficiàries de les subvencions no puguin certificar l'aprovació i la publicació al BOIB de la convocatòria o convocatòries d'ajuts per als sectors esmentats finançats amb fons propis municipals per un import igual o superior a la quantitat concedida pel Consell de Mallorca, s'haurà de tramitar el reintegrament al Consell de l'import que excedeixi del realment convocat amb recursos propis de les entitats locals.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">3.- En qualsevol moment el Consell podrà inspeccionar la documentació d'aquestes subvencions que obrin en poder dels ajuntaments beneficiaris o requerir-los perquè presentin els documents relacionats amb les actuacions subvencionades pel Consell de Mallorca que consideri convenients.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><strong>5. Ampliacions de terminis</strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">Les ampliacions dels terminis establerts en aquesta convocatòria es regirà pel que disposa l'article 32 de la Llei 39/2015, d'1 d'octubre, de procediment administratiu comú de les administracions públiques. En tot cas, les sol·licituds d'ampliació de terminis han de tenir entrada oficial al Consell de Mallorca amb una antelació mínima de quinze (15) dies naturals a la data de la seva finalització. S'autoritza el conseller executiu de Promoció Econòmica i Desenvolupament Local per a la resolució de les peticions d'ampliacions de terminis. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">Les entitats locals beneficiàries de la subvenció poden sol·licitar a l'òrgan que la concedeix, abans que conclogui el termini per dur a terme l'activitat subvencionada, modificacions de l'acord de concessió, reducció de l'import concedit, modificació de l'actuació objecte de l'ajuda, que s'autoritzen quan tenen la causa en circumstàncies imprevistes o són necessàries pel bon final de l'actuació, sempre que no s'alteri l'objecte o la finalitat de la subvenció i no es danyi el dret de tercers. </span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><em>De conformitat amb l'article 44 en relació amb el 46.6 de la Llei 29/1998, de 13 de juliol, reguladora de la Jurisdicció Contenciosa Administrativa, contra aquest acord no es podrà interposar recurs en via administrativa, si bé es podrà formular potestativament REQUERIMENT per a la seva anul·lació o revocació en el termini de dos mesos comptadors des del dia que es publiqui en el Butlletí Oficial de les Illes Balears amb caràcter previ a la interposició de recurs contenciós administratiu.</em></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><em>El requeriment s'entendrà desestimat si en el termini d'un mes des de la seva presentació no es notifica resolució expressa.
