2021-02-20 CAIB 5792 text/html 5793 CAIB 2021-02-20 ca ca 3203 ![CDATA[<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">L'article 3 del Reial decret llei 8/2020, de 17 de març, de mesures urgents extraordinàries per fer front a l'impacte econòmic i social de la COVID-19 autoritza la incorporació del superàvit pressupostari corresponent a la liquidació de 2019 al pressupost de 2020 per finançar despeses en serveis socials i promoció social de la política de despesa 23 per efecte de la crisi sanitària de COVID-19, mitjançant modificació de crèdits en la modalitat de suplement de crèdits.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">L'article 20.2 del Reial decret llei 11/2020, de 31 de març, pel qual s'adopten mesures urgents complementàries en l'àmbit social i econòmic per fer front a la COVID-19, que estableix que la modificació pressupostària a dur a terme (suplements de crèdits en aquest cas) es tramitarà per decret del President de la corporació, sense que siguin d'aplicació les normes sobre reclamació i publicitat dels pressupostos a que es refereix l'article 169 del TRLRHL, aprovat pel Reial decret legislatiu 2/2004, de 5 de març. Aquest decret serà objecte de convalidació en el primer Ple posterior que es celebri, exigint-se per això el vot favorable de la majoria simple i la posterior publicació al Butlletí Oficial corresponent, tot i que la falta de convalidació plenària no tindrà efectes anul·latoris ni suspensius del decret aprovat, sense perjudici de la possibilitat d'acudir a la via de la reclamació economicoadministrativa, pel que el còmput de terminis es produirà a partir de la data de publicació de l'acord plenari.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">En data 22-12-2020 es formalitzà Decret de Presidència núm. 2020/PRES/000296 per aprovar el suplement de crèdit 4/2020 per a la incorporació del superàvit del 2019 per import de 961.062,62 € per a despeses de serveis socials.&nbsp;</span></span></span><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="line-height:100%">Per tot l'anterior el Ple del Consell Insular de Menorca en data 1 de febrer de 2021, adoptà l'acord següent:</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="line-height:100%"><strong>Primer.</strong> Convalidar el Decret de Presidència núm. 2020/PRES/0000296 de data 22/12/2020, pel qual s'aprova la modificació del pressupost del Consell Insular de Menorca per a l'any 2020 mitjançant suplement de crèdits núm. 4/2020, per a l'aplicació del superàvit pressupostari de 2019 per import de 961.062,62 € per a despeses de serveis socials.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="line-height:100%"><strong>Segon.</strong> Publicar el corresponent anunci en el <em>Butlletí Oficial de les Illes Balears</em>. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif;
